Resolution No.

STOCKTON CITY COUNCIL
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF STOCKTON AUTHORIZING AN AMENDMENT TO THE HOMEKEY PROGRAM STANDARD AGREEMENT NUMBER 20-HK-00067 The Department of Housing and Community Development ("Department") issued a Notice of Funding Availability (“NOFA"), dated July 16, 2020, as may be amended from time to time, for the Homekey Program ("Homekey" or "Homekey Program"). The Department issued the NOFA for Homekey grant funds pursuant to Health and Safety Code section 50675.1.1 (Assem. Bill No. 83 (2019-2020 Reg. Sess.), § 21.); and The CITY OF STOCKTON (the "City" or "Applicant") along with Central Valley Low Income Housing (“CVLIHC”) and Stocktonians Taking Action to Neutralize Drugs (“STAND”) (collectively, "Co-Applicants") submitted an application for Homekey grant funds ("Application") to the Department for review and consideration; and The Department is authorized to administer Homekey pursuant to the Multifamily Housing Program (Chapter 6.7 (commencing with Section 50675) of Part 2 of Division 31 of the Health and Safety Code). Homekey funding allocations are subject to the terms and conditions of the NOFA, the Application, the Department-approved STD 213, Standard Agreement ("Standard Agreement"), and all other legal requirements of the Homekey Program; and The Department awarded grant funds in the amount of $3,609,091.00 to the City and Co-Applicants and executed the Department approved STD 213 - Standard Agreement dated 11/10/2020, under Contract Number 20-HK-00067; and CVLIHC and STAND acquired title to the certain real property located at 1604 N. Wilson Way in Stockton (the "Property") for use as a Homekey Program Site with Homekey grant funds provided to it by the Department and subject to the terms of the Standard Agreement; and CVLIHC and STAND subsequently transferred ownership of the Property by grant deed to Town Center Studios LP; and The Standard Agreement between the Department and the City and Co-Applicants requires a change in ownership of the Property to be approved by the Department in writing. The Department further requires that Town Center Studios, LP be added to the Standard Agreement by amendment; and Town Center Studios LP desires to join the Standard Agreement between the Department and the City and Co-Applicants. Towards that end, Town Center Studios, LP is joining the City and Co-Applicants in the submittal of an amendment to the Standard Agreement for Homekey funds (“Amendment”) to the Department for review and consideration; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:

The City is hereby authorized to enter into, execute, and deliver to the Department, an amendment to the Standard Agreement, whereby the City and Co-Applicants agree to add Town Center Studios, LP as a party to the Standard Agreement, and thereafter become contract-obligated under the terms of the Standard Agreement, jointly and severally along with the City and Co-Applicants to the Department.

The City Manager is hereby authorized to submit and approve the Amendment and associated necessary documents.

The City Manager is hereby authorized to take whatever actions are necessary and appropriate to carry out the purpose and intent of this Resolution.
