Resolution No.

STOCKTON CITY COUNCIL
RESOLUTION TO APPROVE AMENDMENT TO THE FISCAL YEAR 2024-25 FEE SCHEDULE RELATED TO VIOLATIONS CODIFIED AS INFRACTIONS Stockton Municipal Code (“SMC”), Title 1, Chapter 1.08, Section 1.08.010A codifies violations of the Municipal Code as misdemeanors unless a particular Code, or State Law, states the violation to be an infraction. As such, within various Chapters and Sections of the Municipal Code, there are several violations identified as infractions rather than misdemeanors; and In an attempt to bring the Stockton Municipal Code into compliance with State Law, Stockton Police Department Neighborhood Services Section (“NSS”) reviewed current SMC provisions related to infractions and found several areas for potential improvement; and NSS has proposed several amendments to the current SMC to bring City enforcement of infraction into compliance with State law; and The City seeks to implement fines consistent with State Law when levied for violations; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:

1. The City Council approves the amendment of the Fiscal Year 2024-25 Fee Schedule to create new fees concerning violations codified as infractions attached as Exhibit 1 and incorporated by this reference.
