RESOLUTION AUTHORIZING THE SUMMARY VACATION OF TWO WATERLINE EASEMENTS AT WESTLAKE VILLAGES UNIT NO. 1 AND UNIT NO. 5; AND ONE PUBLIC UTILITY EASEMENT AT WESTLAKE VILLAGES UNIT NO. 18
The first proposed waterline easement vacation (abandonment) is located at 6010 Westlake Drive (APN 066-050-60), as described in Exhibit A (Exhibit 1) and shown in Exhibit B (Exhibit 1); and The second proposed waterline easement vacation (abandonment) is located at 10940 Portside Drive (APN 066-410-19), as described in Exhibit A (Exhibit 2) and shown in Exhibit B (Exhibit 2); and The public utility easement vacation (abandonment) is located at 10066 Talung drive (APN 066-520-22), as described in Exhibit A (Exhibit 3) as shown in Exhibit B (Exhibit 3); and Stockton Westlake Investment, LLC, the developer, is requesting the abandonment of two 10-foot waterline easements and one 10-foot public utility easement due to no longer being in use. The easement abandonments are located on real property of Westlake Villages, Unit No. 1, Unit No. 5, and Unit No. 18, assessor parcel numbers (066-050-60, 066-410-19, 066-520-22); and The City may perform a summary vacation of a public utility easement under Division 9, Part 3, Section 8333, et seq., of the California Streets and Highway Code, and a public hearing is not required when the easement has been superseded by relocation, and there are no public facilities located within the easement. This vacation has been superseded by the newly constructed waterline and public utility easements in the vicinity that currently serve utility purposes; and The Municipal Utilities Department concurs with the vacation of the two waterline easements and the public utility easement; and The Community Development Department has determined that this action/project is exempt from the requirements of the California Environmental Quality Act (CEQA) and is granted a “Categorical Exemption” pursuant to CEQA Guidelines by section 15061(b)(3); now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:
This action is taken pursuant to Division 9, Part 3, Chapter 4 of the California Streets and Highways Code sections 8333, et seq., the Summary Vacation Procedure of the Public Streets, Highways, and Service Easements Vacation Law.
All City Departments were notified of the proposed vacations at these sites, and no objections were received. The local utilities were not notified because there are no other utilities and only waterlines within the easements.
The subject property meets the criteria set forth in the Streets and Highways Code section 8333, provided below in relevant part:
“The legislative body of a local agency…may summarily vacate a public service easement…[if] [t]he easement has been superseded by relocation, or determined to be excess by the easement holder, and there are no other public facilities located within the easement.” The City Council hereby authorizes that the two waterline easements located at Westlake Villages Unit No. 1 and Unit No. 5, and the public utility easement located at Westlake Villages Unit No. 18, more particularly described in Exhibits 1, 2 & 3, attached hereto, and incorporated by this reference, is hereby declared to be vacated and abandoned as of the date this Resolution is recorded.
That the City Manager is authorized to approve the filing of Notice of Exemption No. 48-24 under CEQA, a copy of which is attached as Exhibit 4 and incorporated by this reference.
In accordance with section 65402 of the Government Code, this project/activity conforms to the City’s General Plan Policy Document, as amended.
Stockton Westlake Investment, LLC has paid the necessary fees to process this vacation.
The City Manager, or designee, is hereby authorized to take whatever actions are necessary and appropriate to carry out the purpose and intent of this Resolution.
