Resolution No.
STOCKTON CITY COUNCIL
RESOLUTION AUTHORIZING THE GRANT OF EASEMENTS TO UNION PACIFIC RAILROAD COMPANY FOR THE STOCKTON DIAMOND GRADE SEPARATION PROJECT The Union Pacific Railroad Company (UPRR) and the San Joaquin Regional Rail Commission (SJRRC) have requested the City of Stockton grant easements required for the construction of the Stockton Diamond Grade Separation Project, a critical infrastructure project that will improve freight and passenger rail operations throughout the region; and The project will eliminate the at-grade rail crossing at the Stockton Diamond by constructing a grade-separated crossing that will allow uninterrupted rail traffic; and The areas required for the easements include existing at-grade crossings at Main Street, Market Street, and Lafayette Street, and aerial crossings at Hazelton Avenue, and Dr. Martin Luther King Jr. Boulevard, as depicted in Exhibits 1, 2, 3, 4, and 5 of this resolution; and The granting of the requested easements is necessary for UPRR and SJRRC to obtain right-of-way certification and proceed with construction, operation, and maintenance of the elevated structure over and across the City’s roadway network; and A notice of intention to grant or sell real property interest was published on September 12, 2025, in accordance with Section 510 of the City Charter, and at least ten (10) days prior to City Council consideration of this resolution; and The Community Development Department has determined that this action/project is exempt from the requirements of the California Environmental Quality Act (CEQA) and is granted a “Categorical Exemption” per CEQA Guidelines by section 15061(B)(3); and City staff concur with, and recommend to City Council, the granting of a series of easements to UPRR; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:
