ORDINANCE NO. ______
AN ORDINANCE AMENDING TITLE 10, CHAPTER 10.04, SECTION 10.04.600 OF THE
STOCKTON MUNICIPAL CODE BY AMENDING THE PROVISIONS REGARDING THE USE
OF STREETS FOR THE STORAGE OF VEHICLES
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:
SECTION I. FINDINGS AND INTENT
The City Council of the City of Stockton finds that amending Title 10, Chapter 10.04, Section 10.04.600 of the Stockton Municipal Code ("SMC") is necessary to address the growing challenges associated with long-term vehicle storage on public streets. The prior ordinance lacked a clear standard for what constituted sufficient vehicle movement to restart the 72-hour parking limit. Establishing a precise distance requirement ensures that vehicle relocation represents an actual change in location rather than a nominal adjustment, providing more consistent enforcement, reducing compliance disputes, and better addressing neighborhood blight, parking availability, and public safety.
SECTION II. AMENDMENT OF CODE
Title 10, Chapter 10.04, Section 10.04.600 of the Stockton Municipal Code is hereby amended to read as follows:
§ 10.04.600. Use of streets for storage of vehicles prohibited.
A. No person who owns or has possession, custody or control of any vehicle shall park or leave such vehicle standing upon any street or alley for more than a period of 72 consecutive hours or more. For purposes of this section, a vehicle shall be considered to have been parked or left standing for 72 or more consecutive hours if it has remained inoperable or has not been moved at least 300 feet from its previous stopping point during any continuous 72-hour period. In the event a vehicle is parked or left standing upon a street in excess of a period of 72 consecutive hours such vehicle may be removed in the manner and subject to the requirements of Article I of Chapter 10.16.
B. Police officers, officers, or parking enforcement officers are hereby authorized to issue a citation provided for in the California Vehicle Code whenever he or she has reasonable cause to believe that a violation of this section has occurred in his or her presence. (Prior code § 10-017.5; Ord. 2015-07-21-1201 C.S. § 2)
SECTION III. SEVERABILITY
ATTACHMENT A
If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this article or any part thereof is for any reason held to be unconstitutional or invalid or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this article or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase thereof irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases be declared unconstitutional or invalid or ineffective.
SECTION IV. EFFECTIVE DATE
This ordinance shall be in full force and take effect 30 days after its passage.
