Resolution No.
STOCKTON CITY COUNCIL
RESOLUTION AUTHORIZING CONTRACT CHANGE ORDER NO. 2 FOR $2,336,169 WITH GATEWAY PACIFIC CONTRACTORS, INC. FOR IMPROVED SOURCE CAPACITY AND EFFICIENCY OF THE GROUNDWATER RECHARGE PROJECT In 2012, the Municipal Utilities Department (MUD) dedicated the Delta Water Supply Project (DWSP) to provide a supplemental surface water supply to the City of Stockton and protect the groundwater basin through conjunctive management; and A groundwater recharge project will make use of available water under the City’s Water Right Permit 21176, contract supply from Woodbridge Irrigation District, and potentially other water sources; and On September 10, 2024, the City awarded a design-build contract to Gateway Pacific Contractors, Inc. to design and construct the recharge basins; and On August 12, 2025, the City Council approved Contract Change Order No. 1 to Gateway Pacific Contractors, Inc. for design enhancements to the groundwater recharge basins to improve operational flexibility, reliability, and overall recharge capacity; and Design modifications to the original design-build contract with Gateway Pacific are necessary to increase the amount of water available from the Woodbridge Irrigation District, add a park water system to support sanitation needs, and install an additional variable frequency drive on the DWTP’s treated water pumps; and The modifications also add building all-season service roads along the basin levees to ensure reliable access for operations and maintenance; and Staff recommend the approval of Contract Change Order No. 2 with Gateway Pacific Contractors, Inc, in the amount of $2,336,169, for a total not to exceed $19,533,982; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:
The City Council approves the following findings pursuant to Stockton Municipal Code section 3.68.070 to support and justify an exception to the competitive bidding process:
The existing contract between Getaway Pacific and the City was negotiated following an evaluation of competitive proposals.
Considering the size and complexity of the Groundwater Recharge Project, the City does not have the technical expertise to monitor it and ensure compliance in a cost-effective and timely manner.
Gateway Pacific possesses unique familiarity with the Delta Water Treatment Plant site, project design, and operational requirements, and is therefore best positioned to efficiently implement the necessary design modifications and improvements without duplicating work, increasing project costs, or delaying construction.
The success of the project will depend on the credibility the professional develops with the staff and the ability of the professional to develop a working relationship with the City.
Contract Change Order No. 2 with Gateway Pacific Contractors, Inc, for $2,336,169, is hereby approved, and the City Manager is authorized and directed to execute same, a copy of which is attached as Exhibit 1 and incorporated by this reference.
The City Manager or designee is hereby authorized to take appropriate and necessary actions to carry out the purpose and intent of this Resolution.
PASSED, APPROVED, and ADOPTED October 13, 2026 .
