Resolution No.

STOCKTON CITY COUNCIL

RESOLUTION AUTHORIZING AN AGREEMENT WITH THE PORT OF STOCKTON, AND AUTHORIZING NECESSARY EXPENDITURE FOR THE BUCKLEY COVE INLET MAINTENANCE DREDGING PROJECT Dredging operations at the Buckley Cove inlet located at 4911 Buckley Cove Way have become necessary because sediment has accumulated in the shared channel, significantly reducing water depth and impeding vessel navigation; and In June 2025, the Economic Development Department released an Invitation for Bids to procure a contractor for the maintenance dredging of the Buckley Cove inlet. Based on a review of the responses, staff identified Dutra Group LLC (Dutra) as the lowest responsive and responsible bidder, and City Council approved a construction contract with Dutra; and As the project advanced into pre-construction and final coordination, staff identified that the project solicitation established that the City would be responsible for payment of the Port of Stockton’s (Port) dredged sediment tipping fee. The City is required to enter into a Dredged Sediment Agreement (Agreement) with the Port and Dutra to address the tipping fee responsibility; and On April 14, 2026, Council approved by Motion 2026-04-14-1602-02, a $2.2 million allocation to the project, which includes $1,700,00 from Community Facilities District funds and $500,000 from the General Fund. Thus, there is funding available to pay for the Port’s tipping fee; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:

The City Council approves findings pursuant to Stockton Municipal Code (SMC) 3.68.070 in support of an exception to the competitive bidding process. These findings include:

The Port of Stockton’s Roberts Island Dredging Material Placement Site is identified and approved by the Central Valley Regional Water Quality Control Board for replacement of dredging material generated by the Buckley Cove Inlet Maintenance Dredging Project; The Port of Stockton owns and controls the Robert Island Dredged Material Placement Site and is the only entity authorized to provide access to and accept dredged material at the approved site; No comparable alternative provider or placement site has been identified that can meet the project's existing regulatory, operational, and schedule requirements; Use of Robert’s Island is necessary to maintain the project schedule and complete dredging within the approved July 1 through November 30 dredging period; and Completion of the dredging project is necessary to restore and maintain navigational access within the Buckley Cove inlet and support marina operations, recreational boating, commerce, and fisheries.

The City Council approves findings and authorizes the City Manager to execute the Dredging Sediment Agreement with the Port and Dutra for use of the Roberts Island Dredging Material Placement Site for CIP EV22601, including payment of the applicable dredging sediment tipping fee, a copy of which is attached as Exhibit 1 and incorporated by this reference.

The City Manager, or designee, is authorized to approve necessary budget amendments and establish or modify expenditure accounts, as may be required to implement the Dredging Sediment Agreement and associated project costs.

The City Manager, or designee, is hereby authorized to take whatever actions are necessary and appropriate to carry out the purpose and intent of this Resolution.

PASSED, APPROVED, AND ADOPTED October 13, 2026 .
