RESOLUTION NO. ______
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SUNNYVALE EXTENDING THE CITY
MANAGER/DIRECTOR OF EMERGENCY SERVICES’
PROCLAMATION OF EXISTENCE OF A LOCAL
EMERGENCY (COVID-19)
WHEREAS, on March 12, 2020, the City Manager acting as the Director of Emergency Services proclaimed the existence of a local emergency within the City due to the novel coronavirus (COVID-19), a respiratory disease that may result in serious illness or death and is easily transmissible from person to person; and
WHEREAS, the City Council unanimously ratified and confirmed that proclamation of local emergency on March 17, 2020 by adopting Resolution 979-20; and WHEREAS, the City Council reviewed and unanimously extended the proclamation of local emergency on April 7, 2020 (Resolution 981-20); May 26, 2020 (Resolution 994-20); July 14, 2020 (Resolution 1010-20); August 25, 2020 (Resolution 1016-20); October 13, 2020 (Resolution 1025-20); December 8, 2020 (Resolution 1036-20); February 2, 2021 (Resolution 1042-21); March 30, 2021 (Resolution 1045-21); May 25, 2021 (Resolution 1057-21); July 13, 2021 (Resolution 1069-21); August 31, 2021 (Resolution 1078-21); October 26, 2021 (Resolution 1088-21); and December 14, 2021 (Resolution 1099-21); and WHEREAS, the City Council has reviewed the need to continue the existence of a local emergency and finds that the conditions supporting the declaration of emergency related to COVID-19 continue to exist, for reasons including, but not limited to:
(1) Emergency conditions related to COVID-19 continue. Nationwide and worldwide, countries are experiencing an unprecedented surge in cases from the COVID-19 “Omicron” variant; and
(2) Vaccination rates in Santa Clara County are high, yet studies have indicated that immunity for those vaccinated 6 or more months ago may be waning, requiring a booster dose of vaccine, and the Omicron variant is both more contagious than previous variants and able to infect individuals who have been vaccinated.
Though research to date indicates that people who have been vaccinated and boosted experience milder symptoms and are significantly less likely to require hospitalization or serious medical intervention, requirements for isolation and quarantine of infected and exposed unvaccinated individuals continue; and (3) The California state of emergency and Santa Clara County’s local emergency declarations related to COVID-19 remain in effect. The State and county continue to closely monitor cases and the spread of COVID-19. On November 10, 2021, the Governor extended the state of emergency due to concerns about a potential winter case surge in order to ensure that the State's health care facilities DRAFT 1/19/22________

continue to have the staffing and resources needed to prevent potential strain on the State's health care delivery system, and on December 15, 2021, the state issued a statewide indoor mask mandate, which was recently extended to continue through at least February 15, 2022; and
(4) All residents of Santa Clara County remain subject to a mask mandate, requiring face coverings indoors for all, regardless of vaccination status; and (5) The surge in cases associated with the Omicron variant has made clear that the pandemic is not yet over. Although California “reopened” on June 15, 2021, certain health measures intended to limit the spread of COVID-19, particularly among unvaccinated individuals and for very young children who are not yet eligible for vaccination, remain in effect, and public health authorities continue to make aggressive efforts to reach individuals not yet vaccinated; and (6) Although the stay-home/shelter orders and other orders regulating operations, capacity, and similar measures have been lifted with the reopening, many residents and businesses continue to suffer economic hardship that began while those orders were in effect. In addition, the surge in Omicron cases has had widespread staffing impacts to businesses and impacts on infected individuals who are required to isolate or quarantine due to illness or exposure; and (7) Due to COVID-19 closures and stay-at-home orders, many Sunnyvale residents experienced job loss or reduced hours, and many Sunnyvale businesses experienced reduced revenues, and/or faced temporary or permanent closures.
The recovery period for these individuals and businesses is only beginning. For example, although resources have been identified to help repay landlords for rent lost during the pandemic and to provide tenants with financial assistance to continue making rent payments, many of these resources have been slow or not yet able to distribute funds. Some businesses, such as restaurants and other public-serving industries, were experiencing a worker shortage that limits the ability of the businesses to return to full capacity, which was compounded for many businesses by high case numbers and employee absences due to the Omicron surge; and
(8) The City has and continues to experience a loss of revenue from several areas due to closures related to COVID-19; and
(9) The economic recovery from COVID-19 and its impacts are now estimated to be in terms of years not months; and
WHEREAS, the City Council finds that the COVID-19 situation continues to create conditions of peril to the health, safety, and welfare of persons and property in the City of Sunnyvale and is still deemed to be beyond the control of normal protective services, personnel, equipment and facilities of and within the City.
