employees: Labor Relations: Disputes.

The City of Sunnyvale opposes AB 504 (Reyes) which allows any public employee with a limited exception to join a strike of another bargaining unit that they are not a member of which could lead to severe workforce shortage/stoppage. AB 504 (Reyes) would declare it a human right for a public employee to participate in a sympathy strike and to honor a picket line. The bill would override any policy or collective bargaining agreement that would limit or waive the rights.

Jurisdiction Legislative Year Bill No. or Issue Topic City's Position Existing City Policy State 2023 AB 1484 (Zbur): Temporary public employees
The City of Sunnyvale opposes AB 1484 (Zbur) which imposes an automatic requirement that temporary employees performing the same or similar work as a permanent employee be represented by a recognized employee organization that currently represents permanent employees performing that work. This requirement would provide temporary at-will employees with representation on all matters including employment conditions and employer-employee relations. Although AB 1484 intends to benefit temporary employees of local public agencies, it would negatively impact both the temporary and permanent employees, the City of Sunnyvale, and the community.

State 2023 AB 84 (Ward) Property tax: welfare
exemption: affordable housing
The City of Sunnyvale opposes unless amended, AB 84 (Ward) which would negatively impact local government property tax revenues by providing significant expansions of the “property tax welfare exemption.” Specifically, AB 84 allows land (including vacant land) to qualify for the exemption from the date restrictions are placed on the property, not when construction commences, expands the 140% Area Median Income (AMI) rule to cover all deed restricted affordable housing, and eliminates the statutory sunset date.

State 2023 ACA 5 (Low) Marriage Equality The City of Sunnyvale supports Assembly Constitutional Amendment (ACA) 5, which would amend the California Constitution relating to marriage equality. Support Statement on our City Values and Public Service
State 2023 AB 309 (Lee) The Social Housing Act
The City of Sunnyvale opposes unless amended AB 309 (Lee). AB 309 would create the Social Housing Program within the Department of General Services (DGS) to facilitate the construction of government-owned housing on leased state property or excess state-owned property. Cities would have no ability to regulate zoning or development standards, including floor area ratios, height limitations, or density requirements. We call on the Governor and lawmakers to invest $3 billion annually to help cities prevent and reduce homelessness and spur affordable housing development.

Oppose General Plan, Chapter 5: Housing
State 2023 ACA 13 (Ward) Voting thresholds
The City of Sunnyvale supports ACA 13 (Ward) Voting thresholds. ACA 13 would require any constitutional amendment proposed by initiative that increases a voter approval threshold for future measures, be approved by the same proportion of votes cast as the measure would require. The measure would also preserve the right of cities, counties, and special districts to place advisory questions of the ballot to ask voters their opinion on issues.

Positions – Planning and Management
State 2023 AB 1484 (Zbur): Temporary public employees
The City of Sunnyvale requests Governor Newsom's veto on AB 1484 (Zbur) regarding representation for temporary employees. As written, AB 1484 includes requirements that will be difficult for public employers to fulfill. AB 1484 would negatively impact public services.

The City of Sunnyvale requests Governor Newsom's signature on AB 557 (Hart), related to emergency remote meeting procedures under the Ralph M. Brown Act.
