RE:
AB-1990 (
Carrillo) Criminal procedure: arrests: shoplifting – SUPPORT (As Amended on April 16, 2024)
Dear Assemblymember Low:
On behalf of the City of Sunnyvale, we strongly urge your Support of AB 1990 (Carrillo) which would allow for police officers to make warrantless arrests for misdemeanor shoplifting offenses not committed in the presence of law enforcement.
AB 1990 provides that a peace officer does not have to release a person when there is probable cause to believe the person arrested is guilty of shoplifting. This would offer peace officers a practical method for addressing challenges associated with enforcing misdemeanor shoplifting offenses not committed in the presence of the officer.
Like people in every other city in California, Sunnyvale residents are concerned about the rise in retail theft in recent years, with commercial burglary at the highest rate since 2008. To address rising theft, city officials need additional tools to reduce crime and improve the safety of their neighborhoods.
Current City of Sunnyvale policy places a high priority on reducing crime and ensuring a safe and secure environment for people and property in the community (General Plan Goal SN-3 Safe and Secure City). We believe that AB 1990 provides peace officers with a useful means for reducing retail theft by identifying and detaining the persons who commit these crimes. Importantly, expanded enforcement of retail theft will promote the success of retail businesses that provide jobs and other valuable services to the community.

T
he City supports this bill along with AB 1972 (Alanis) – Regional Property Crimes Task Force. We believe that a strengthened local and regional enforcement will ultimately act as a deterrent to property crimes and retail theft.
For thes
e reasons, we would appreciate your supp ort of AB 1990 (Carrillo). Thank you for your consideration of our position. Please do not hesitate to contact me or Chief Phan Ngo, Director of Public Safety ([email protected], 408-730-7155), if you have any questions.
