FIRST AMENDMENT TO AGREEMENT FOR SERVICES
BETWEEN THE CITY OF SUNNYVALE AND
REBECCA MOON (CITY ATTORNEY)
THIS FIRST AMENDMENT TO THE AGREEMENT FOR SERVICES is entered into this _____ day of June 2025, by THE CITY COUNCIL OF THE CITY OF SUNNYVALE (“City Council”) and REBECCA MOON (“Employee”).
WHEREAS, on or about May 9, 2024, the City Council and Employee entered into an Agreement for Services (the “Agreement”); and
WHEREAS, on June 17, 2025, at its regular meeting, the City Council approved an increase to the City Attorney’s salary.
NOW, THEREFORE, the parties agree to amend the Agreement as follows:
1. Section 3.1 of the Agreement is hereby amended to read as follows:
3.1. Base Salary. Employee received an initial base annual salary of two hundred ninety-three thousand dollars ($293,000.00), beginning with the pay period including May 12, 2024. Effective the pay period including June 22, 2025, Employee’s annual base salary shall be increased to three hundred five thousand dollars ($305,000.00). This amount is subject to authorized or required deductions and withholding, prorated and paid on City's regular paydays. The City Attorney position is exempt from overtime under applicable wage and hour law and the base salary shall be compensation for all hours worked. The City agrees that the amount of Employee's base annual salary will not decrease, except as otherwise agreed in writing or as part of a permanent decrease that is consistent with the Fair Labor Standards Act.
2. All of the terms and conditions of the Agreement not specifically modified by this Amendment remain in full force and effect.
