Commissioner Figone asked whether measures may be put in place prior to the approval of Senate Bill (SB) 9. Principal Planner Vashist answered that SB 9 is already in effect and that the City’s goal is to ensure our zoning code is compliant with it and other state laws. Assistant Director of Community Development VanHua provided details of an upcoming community outreach meeting regarding residential parking standards.

Commissioner Figone confirmed with Assistant Director of Community Development VanHua that Accessory Dwelling Units (ADUs) are not subject to parking requirements. Principal Planner Vashist explained how state laws affect the parking requirements that Dual Urban Opportunity (DUO) Housing are subject to.

Commissioner Sigura received clarification from Senior Planner Cindy Hom regarding the traffic impact fee reduction under Assembly Bill (AB) 2553 and instances when it would apply.

At Commissioner Sigura’s request, Senior Planner Hom explained how the City will track fee deferrals by means of a contract and the City’s permit system.

Commissioner Pyne inquired about the number of SB 9 projects the City has received thus far and whether that number is considered typical.

Chair Serrone questioned the legality of SB 9 for the City considering the 2024 Los Angeles Superior Court ruling that SB 9 is unconstitutional for several charter cities.

Chair Serrone asked about whether the traffic impact fee reduction would apply in an instance where there is a planned demolition for one of the three qualifying amenity types. Assistant Director of Community Development VanHua responded that this is likely the case since SB 330 would qualify the project under conditions that are met at that time.

At Chair Serrone’s request, Senior Planner Hom provided details on how the traffic impact fee is calculated.
