5 9.D Consider accepting Honey Lake Valley Recreation Authority amendment letter from the HLVRA Board and discussion regarding changes that Council may wish to make to the joint powers agreement and give direction to staff.

Bob Godman, Public Works Director, provided an explanation of the item and requested council discussion.

Mayor Schuster stated that she agreed with the city taking over the finances/accounting for the Honey Lake Valley Recreation Authority. She stated that she cannot decide on the additional funding until she sees the financials.

Mayor pro tem Brown, who sits on the HLVRA Board. stated that he agrees that more money is needed as there are definite rises in costs.

Dan Newton, City Manager, stated that he has little doubt that the money is needed as it was always working with a shoestring budget. He added that new programs have not been added or elements because of that limited budget and limited resources to allocate to those items.

Kelsey Walsh, City Attorney, stated that the item has gone a little off topic and requested the item be discussed in a future item.

Mayor Schuster has stated that more information would be needed and requested that the item be brought back for more in-depth discussion related to the costs.

Mr. Newton inquired as to whether they would like a special meeting to hear the information, or would the council prefer it be brought back as another agenda item. He also provided additional information regarding the joint power agency. He asked what the Council would like to see.

Mayor Schuster stated that she would like to see the last five years’ financials.

Council Member Miller requested to see numbers, not percentages, as well as future projects that are needing to be completed.

Council Member Parrish inquired as to whether the council and board of supervisors could all meet and talk all of this out at the same time.

Mr. Godman stated that anything brought to the council would also be provided to the board of supervisors.

Mr. Newton inquired as to whether he should bring it back or set up a meeting with the board of supervisors.

It was the consensus of the council to bring the item back.

Action Item
Submitted By: Chandra Jabbs, Administrative Services
Action Date: December 18, 2024
SUBJECT: Consider Resolution No. 24-6389, Accepting FY 2023-24 Annual Report of Development/Mitigation Fees
PRESENTED BY: Chandra Jabbs, Finance Director
SUMMARY:

Government Code Section 66000, also known as the Mitigation Fee Act, provides the legal authority for local agencies to charge and collect development impact fees for new development within their jurisdiction. The fees require new developments to pay their fair share of their impact on existing facilities and to pay for new facilities to maintain existing service levels. Government Code 66001 requires local agencies that impose a fee as a condition of approval of a development project to identify the purpose of the fee and the use to which the fee is to be put. After the adoption of the 1990 General Plan, the City contracted with The Abby Group to prepare a Capital Facilities Mitigation Analysis which projected population growth and future development and the cost of the additional public facilities that would be needed to serve the increased population. The cost of the new facilities was then divided by the number of projected homes and square feet of commercial development to determine a fair share cost for each new development. Periodically, the City has increased these fees to more closely keep up with inflation.

In some cases, the City has also adopted additional provisions outlining the use of specific funds. Municipal Code Title 3, Chapter 32, outlines the use of Public Facilities impact fees for Police, Fire, Street and Traffic Facility and Maintenance. Municipal Code Title 16, Chapter 32, outlines the use of Parkland Dedication Fees. Most Impact fees apply equally to all new development within the City limits. However, in some instances, fees have been assessed to a specific development for public facilities that will benefit a specific geographic area. On June 1, 1992, the City Council approved Phase One of the Skyline Terrace Tentative Subdivision Map and later established five mitigation fees for that project area.

SUSANVILLE CITY COUNCIL AGENDA ITEM
28 #93-2471 Establishing the Skyline Drive/Numa Signal Traffic Signal Fund
#95-2649 Establishing a Class 1 Bicycle Lane Construction Fund for Skyline Road
#14-5108 Establishing Traffic Signal Fund by combining
Skyline/Numa and Skyline/139
All of the mitigation funds are deposited into separate accounts and interest income is allocated accordingly. These funds are considered “restricted” funds and expenditures are made only for the purpose for which the fee was originally collected. Government Code 6600 (b) outlines the annual reporting requirements.

FISCAL IMPACT: None.

55 AGENDA ITEM NO. 9.E
Action Item
Submitted By: Cheyenne Ratkey, Fire
Action Date: December 18, 2024
SUBJECT: Consider Resolution No. 24-6392, authorizing the Finance Director to increase the budget for the Fire Mitigation fund in the amount of $100,000 for the purchase of self-contained breathing apparatus.

PRESENTED BY: M. Bengoa-Bollinger, Public Safety Chief
SUMMARY: Self-contained breathing apparatus (SCBAs) are one of the main and mandatory items of personal safety for firefighters. SCBAs allow firefighters to enter Immediate Danger to Life and Health (IDLH) atmospheres to affect rescues of persons, mitigate hazards, and control fires. Firefighters are only able to perform effectively when they are comfortable and confident their equipment and protective gear will perform their primary function of protecting their health, safety, and lives. Having in-service and working SCBAs will allow us to perform rescues of individuals who are in any IDLH atmosphere i.e. fires, chemical spills, decreased oxygen levels, etc.

The Susanville Fire Department is requesting Fire Mitigation funding to replace 12 of our 35 critically needed SCBAs, masks, cylinders and spare cylinders. Our SCBA equipment has reached the end of its usability due to replacement and repair parts no longer being available. We are having to take SCBAs out of service and then use parts from an out-of-service pack to fix another pack. In turn, that pack that “donates” parts is no longer able to be used at all. Currently, we have 3 SCBAs that are out of service, which will increase in time as our current SCBAs are 10 years old. These packs run from $7,500 to $11,000 each.

FISCAL IMPACT: Use of funds not to exceed $100,000 in Fire Mitigation Budget and authorize the Finance Director to modify the budget as necessary.

ACTION REQUESTED: Motion to approve Resolution No. 24-6392, authorizing the Finance Director to increase the budget for the Fire Mitigation fund in the amount of $100,000 for the purchase of self-contained breathing apparatus.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUSANVILLE

AUTHORIZING THE FINANCE DIRECTOR TO INCREASE THE BUDGET FOR THE FIRE MITIGATION FUND IN THE AMOUNT OF $100,000 FOR THE PURCHASE OF

SELF-CONTAINED BREATHING APPARATUS
WHEREAS, the Susanville Fire Department’s daily operations depend self-contained breathing apparatus (SCBAs), as one of the main and mandatory items of personal safety for firefighters; and

58 AGENDA ITEM NO. 9.F
Action Item
Submitted By: Dan Newton, Administrative Services
Action Date: December 18, 2024
SUBJECT: Consider Resolution No. 24-6394, allocating General Fund and American Rescue Plan Act (ARPA) funds to various projects.

PRESENTED BY: Dan Newton, City Manager
SUMMARY:

The City Council previously allocated General Fund and ARPA funding to various projects. As the ARPA obligation deadline of December 31, 2024, approaches, staff has reevaluated the obligation status of projects. While it appears that the requirements are met, it would be prudent to make some modifications to the funds allocated to projects before the end of the year.

Most notably, the City has expended General Fund money in the amount of $570,995.54 for a fire engine, which is an eligible ARPA expense. To enhance the City's obligation position specifically for the external project (performing arts center), staff is proposing to modify previous allocations so that a larger portion of ARPA funding is allocated to the fire engine. As a result, $450,000 dollars of the General Fund allocation previously allocated for the fire engine is proposed to be allocated to the development of the performing arts center.

In addition, using General Fund money for the performing arts center will provide the City Council greater flexibility when negotiating the terms and conditions of the Agreement with the Susanville Symphony Society.

Other proposed modifications include the following:

Modification of remaining performing arts center business plan

SUSANVILLE CITY COUNCIL AGENDA ITEM
59 funding allocation of $25,000 from ARPA to General Fund. The full $25,000 will likely not be needed; however, the City Council may ask the Symphony Society to have their consultant do more work on the business plan. If this occurs, the existing Agreement authorizes up to up to $30,000 for the creation of a viable business plan. Current costs for the business plan are estimated at $5,000.

Allocation of $70,000 in funding of the Golf Course
maintenance and improvements from the General Fund. This funding was previously earmarked by City Council to come from ARPA; however, there is no need to do this because there is capacity to shift the ARPA funding to the fire engine purchase.

A list of potential projects at the Diamond Mountain Golf Course is also attached for Council's consideration.

FISCAL IMPACT: Modifications to previous General Fund and ARPA allocations as described in Resolution No. 24-6328, Resolution No. 24-6334, and Resolution No. 24-6370. No net increase in funds allocated.

ACTION REQUESTED: Motion to approve Resolution No. 24-6394, allocating General Fund and American Rescue Plan Act (ARPA) funds to various projects.
