reduce retirement system

Why Prefund Pension Obligations?
Complete Local Control over Assets
City has complete control over assets, including contributions, disbursements and the timing, amount, and risk tolerance level of investments
1. Pension Rate Stabilization
Assets can be transferred to the retirement system at the City’s direction, potentially reducing/eliminating large fluctuations in employer contribution amounts
2. Rainy Day Fund
Emergency source of funds when employer revenues are strained in difficult budgetary or economic times
3. Diversification
Allows for investment flexibility and offers the potential for assets to earn greater returns than the general fund; spread the risk vs. sending additional money to CalPERS
4. City of Sutter creek 10
1. Input Phase
– Target discount rate
– Risk tolerance
– Investment philosophy
– Asset allocation
– Timing on use of funds
2. Model Portfolios 3. Dedicated Portfolio Manager

MEMORANDUM
DATE: JUNE 13, 2022
TO: AMY GEDNEY, CITY MANAGER
FROM: CHRISTY CONSOLINI, CONTRACT PLANNER
RE: STATUS UPDATE REGARDING PLANNING ACTIVITIES
Broadmeadows Estates - appeal denial letter summarizing the direction of the Planning Commission sent on 6/29/22
Panner Creek Estates - hydrology study reviewed and engineering prepared a memo regarding outstanding topics. Waiting on EIR and other documentation required for Panner and Broadmeadows.
MACT medical building at 321 Old Hwy 49 - Resubmittal on 6/22 - in process of review of the site plan and traffic study. DRC to review.
DANCO - completeness review letter sent on June 25 to meet the 30 day time line (June 27), they have not paid however, and the application was again deemed incomplete as the stormwater management area was not defined and no utility demand estimates were provided, and no landscape irrigation or retaining wall materials provided. In addition, the AB 2162 requirement to provide information on staffing and funding were incomplete in that not enough information was provided and the resolutions regarding permanent supportive housing we County documents and not City resolutions. There were also some design issues noted, such as exterior stairways; however, those types of issues would be identified during a consistency evaluation. The City is currently only within the application completeness review period, not consistency review period.
Housing Element Update - We have an administrative draft element that can be reviewed.
Ridge Business Park - lot merger complete with approval and materials to be provided to County recorder, they will be submitting plans for a personal/mini storage facility in the future. 70 Greenstone Terrace - Design Review - proposing to move an existing approximately 4’ retaining wall closer to the house to allow for four parking spaces. The application lacks any additional information and is under review.
Zoning Update - draft update prepared for consideration on July 11. Map revisions under preparation for consideration.
Sutter Creek Ranch (Gold Rush Ranch) - no complete application or Specific Plan revision submitted to date; however, the applicant is actively seeking to update the plan.
Signage 581 Hwy 49 (Flea Market) - staff report for Planning Commission prepared for consideration at their next meeting
440 Hwy 49 Gardella (Deli) - 7/1/22 Staff relayed to the applicant that a site plan is needed due to new use and reconstruction of the building which has different parking and use requirements.

Code sections 54950 – 54963), so that any member of the public may attend, participate, and watch the City’s legislative bodies conduct their business; and WHEREAS, the Brown Act, Government Code section 54953(e), makes provisions for remote teleconferencing participation in meetings by members of a legislative body, without compliance with the requirements of Government Code section 54953(b)(3), subject to the existence of certain conditions; and
WHEREAS, a required condition is that a state of emergency is declared by the Governor pursuant to Government Code section 8625, proclaiming the existence of conditions of disaster or of extreme peril to the safety of persons and property within the state caused by conditions as described in Government Code section 8558; and

STAFF REPORT
TO: THE HONORABLE MAYOR AND MEMBERS OF THE CITY
COUNCIL
MEETING DATE: JULY 18, 2022
FROM: JODI STENECK, ACCOUNTING SUPERVISOR
SUBJECT: BUDGET AMENDMENT #3 FOR FISCAL YEAR 2021-22
RECOMMENDATION:
Adopt Resolution 21-22-* approving Budget Amendment #3 for Fiscal Year 2021-22 as outlined below.
BACKGROUND:
The Badger Street Bridge Notice of Completion was issued February 2018, the final payment from CalTrans was received April 2020. The City of Sutter Creek was reimbursed 100% for eligible expenditures incurred on this project, therefore the remaining balance is due to ineligible expenditures that occurred due to a civil matter with the Contractor. The legal expenses totaled $89,046, arbitration totaled $8,000 and the environmental fine totaled $86,112 for a combined total of $183,158.00
The Main Street Bridge Notice of Completion was issued March 19, 2020 and the final payment from CalTrans was received November 2021. The City of Sutter Creek was reimbursed 88.53% of eligible expenditures incurred on this project. The City’s portion for the Main Street Bridge project is $286,971.
DISCUSSION:
During Finance Committee discussions, and most recently the Council meeting on June 6, 2022, the Council had discussed paying the deficit of the above Bridge Funds over time. Since that time, however, our auditors have been here for our interim audit. Per our auditors, the funds should be zeroed out in fiscal year 2021-22. Since both funds have received all of the revenue and expenses related to the projects and the projects are final, the funds are no longer legitimate funds. If we do not zero out the funds then they will need to be rolled into the General Fund for auditing purposes.
2 Staff did discuss making payments to the bridge funds over time to pay down the negative balance; however, the auditors recommended that both bridge funds be zeroed and closed. Then the monies that were used to zero out the bridge funds could be repaid with general fund monies over time.
Fund 46 – Badger Street Bridge Replacement is negative $183,158 due to legal expenses, arbitration, and environmental fine imposed by a civil dispute with the Contractor. To close the Badger Street Bridge fund, staff is recommending transferring funds from Fund 01 – General Fund in the amount of $183,158 into the Badger St Bridge fund.
Fund 55 – Sutter Creek Main Street Bridge Replacement is negative $286,971 due to the CalTrans funding of the project being 88.53% reimbursed by CalTrans and the City of Sutter Creek responsible for 11.47% of expenditures. To close the Main Street Bridge fund staff is recommending transferring funds from Fund 39 – General Reserve in the amount of $286,691 into the Main Street Bridge fund.
The General Reserve fund was initially established with CalTrans monies that was given to the City due to Caltrans relinquishing Old Highway 49 when the bypass was built. As of June 1, 2022, Fund 39 – General Reserve has a balance of $693,094. Staff recommends using this fund to zero out the bridge fund. Should the Council direct staff to do this, the balance in Fund 39 will be $406,123.
To replenish Fund 39 – General Reserve, future budgets would include a percentage of revenue be transferred from 01 – General Fund.
BUDGET IMPACT:
Fund Beginning Balance
(June 1, 2022)
Transfer Amount Ending Balance
01 – General Fund $679,674 -$183,158 $496,516
39 – General Reserve $693,094 -$286,971 $406,123
46 – Badger St Bridge -$183,158 $183,158 $0
55 – Main St. Bridge -$286,971 $286,971 $0

SUBJECT: UPDATED USE FEE AND DEPOSITS
RECOMMENDATION:
Adopt Resolution 22-23-* updating Planning, Police and Administration deposits and fees for the City of Sutter Creek effective August 1, 2022.
BACKGROUND:
The City has established use fees for providing services and facility rentals to the public.
Annually the fees are reviewed and if necessary, a recommendation to update the fees to adequately cover the cost of providing services is requested. After reviewing the current fee schedules, city staff is recommending some changes.
The major changes are in the initial deposit received from Planning Department applicants.
Currently, the initial deposit is received at the time an applicant submits an application. As expenses on the project are incurred, a statement is sent to the applicant to show the amount of the deposit, the direct costs incurred by the City and the staff time. If the expenses are more than the deposit, then additional funds are requested by the applicant for the balance due. For projects such as tentative maps, final maps, boundary line adjustments, general plan amendment, zone changes and site plan permits, an applicant usually receives multiple statements from the City requesting additional funds for expenditures incurred by the City.
DISCUSSION:
Staff is recommending that the initial deposit be increased to be in-line with the actual cost of maps, zone changes, permits, etc. being issued in the Planning Department. Staff has reviewed over one hundred twenty (120) E&P accounts issued in the last six years to find an average cost for each type of permit, map, boundary line adjustment, etc. and that is what is recommended for the deposit. The deposit would be refundable and an itemized statement would be prepared to show the deposit received, with direct costs and staff costs incurred. Also, the increased deposit would give the applicant a better understanding of the cost of the project. See attachment “A” for current and proposed deposits.
Fees for the Facility Rental are minor, with an additional fee for kitchen use in the auditorium and reducing the hourly non-profit rental of the Historical Grammar School. We would 18 Main St., Sutter Creek, CA 95685 • Telephone: (209)267-5647 • Fax: (209)266-7789 • TTY: 711 The City of Sutter Creek is an equal opportunity service provider and employer recommend reducing the non-profit rental as an option to encourages non-profits organizations to use the building and reduce the number of requests to have the fee waived. See attachment “B” for current and proposed fees.
The Police Department is requesting one fee increase for Concealed Weapon. See attachment “C”.
BUDGET IMPACT:
The fee changes would have a minimal effect on the budget.

ADMINISTRATION DEPARTMENTS FOR THE CITY OF SUTTER CREEK EFFECTIVE JULY 1, 2022
WHEREAS, the City of Sutter Creek charges fees and or requires a deposit for engineering and planning projects; and

WHEREAS, from time to time it is necessary to adjust said fees and deposits to ensure that said fees are adequately covering the costs to provide such services; and WHEREAS, the City has determined that it is necessary to update these fees and deposits; and WHEREAS, the City Council has reviewed the proposed fees and deposits, shown in Attachment A, B, and C and has determined that they are reasonable and logical and represent an estimate of the cost of providing the service for which the fees and deposits are collected.

RE: 2022-2023 FINAL OPERATING BUDGET
INTRODUCTION:
The 2022-2023 Budget document represents the City Council’s continued commitment to prudent fiscal management and effective service delivery while creating a foundation for future fiscal sustainability. Once adopted by the Council, the Budget establishes the direction for all City services for the coming year. It represents the consensus of Council direction and staff recommendations on how to best accomplish Council goals and respond to the highest priorities of community needs. This budget attempts to hold onto many years of effort and discussion by the City Council in allocating resources to a variety of priorities to ensure fiscal sustainability, while maintaining the community’s quality of life. Attachment A depicts the City’s organizational chart.
The 2022-2023 Draft Budget presented herein makes several assumptions regarding the upcoming fiscal year’s anticipated revenues. As in past years, our assumptions are fairly conservative, although we are assuming a little more growth than in years past. As in years past, the 2022-2023 Operating Budget seeks to: 1) Balance current revenues and current expenses while maintaining acceptable reserve levels; 2) Make decisions that continue to reset the City’s financial plan and create a foundation to maintain a balanced budget in future years; and 3) Maintain the highest quality of service. Still to be completed during the fiscal year is a Capital Improvement Program and use of American Recovery funds. Staff will return with a recommendation for both.
The City’s operating budget is akin to planning expenditures for the upcoming year, while balancing anticipated revenue. This 2022-2023 Draft Operating Budget as presented does not include any new programming or increased levels of service. Below are the following assumptions that are incorporated into the revenues as presented.
KEY BUDGET ASSUMPTIONS:
As we develop the Draft Budget, staff takes into considerations regarding our anticipated revenues, 2 expected staffing costs, capital replacement costs, current contracts, economic trends, as well as carryover expenses.
I. Revenue
Attachment A identifies all revenue sources their 2022-2023 projections as well as projected year end for this fiscal year and actuals for the 2020-2021 fiscal year. For the General Fund, overall, we are projecting a 2% increase. Figure 1 shows the revenue source distribution. Property Tax continues to be the City’s largest source for General Fund revenue with Retail Sales Tax second, and Transient Occupancy Tax, TOT, third. Figure 2 depicts their historic trends.

B. Local Streets and Road Funds:
1. Increase in Local Transportation Funds of $51,000. The Amador County Transportation Commission is distributing the increase. This will help significantly offset the costs of streetlights.
C. Sewer Fund:
1. Increase of 2% due to rate increase effective July 1, 2022.
D. ARPA Funding: This is not programmed into the Budget. Staff will return with recommendations once the CIP is complete.

5 B. Employee Costs:
1. We are in second year of a three-year contract with POA- they will receive a cost of living allowance of 2% as well as an increase to their Section 125 Plan of $100 per month per employee.
2. Assumes a 5% cost of living increase for all other employees as well as an increase to their Section 125 Plan of $100 per month per employee.
3. Adding a Foreman position to the Public Works Department and reorganizing the department roles.
4. Adding a full time Management Analyst position which was previously a .48 FTE Administrative Analyst position.
C. Operating Costs: increase in costs department wide for fuel, electricity, and water.
D. Capital Costs: Transfers to capital accounts for trucks and sewer line repairs.
III. Capital Improvement Program
Development of a city-wide CIP is underway. Staff will bring all projects forward so that they Council can prioritize with available funding across all projects. We have projects planned for both ongoing and repair and replacement, utilizing fund balance for portions of those projects. Total capital project costs for the sewer fund are $384,280.
IV. Costs of Services
Sewer service increases will go into effect July 1, 2022, as per the 2018 Sewer Rate Study. It is important to remember that regular increases are important to maintain the financial health of our utility operations and to meet our current and future debt service requirements, while also maintaining reserve levels. As we work to determine effluent disposal needs, we will also need to undertake an additional rate study to begin examining capital costs.
POLICY CONSIDERATIONS:
This section identifies policy considerations that staff believes the Council will need to undertake for the next fiscal year. Staff is seeking direction for these items.
I. ACRA has requested a $1.50 increase to its membership fees from $5.00 per person to $6.50. Based on the Draft Budget discussion, this has been included in the budget.
II. Attachment D outlines ending balances across all funds. Funds 86, 95, and 96 are the result of six years of accumulated savings through Council Policy direction. Staff is recommending that we continue with this practice.
Fund 86 General Fund Reserves: 1% of General Fund Revenues transferred into this fund annually.
6 Fund 89 Road CIP: $50,000 is projected to be transferred from the General Fund into this Fund to assist with funding of roadway projects that will be determined through the CIP process which is underway.
Fund 95 General Fund Operations Reserves: 1% of General Fund Revenues transferred into this fund annually.
Fund 96 Capital Reserves: 2% of General Fund Reserves transferred annually. Staff is recommending that this be increased to 4% in order to more aggressively save for capital improvement projects.
III. As the CIP is being developed and presented, the Council will also need to consider future maintenance needs for implementation of some of the capital items such as parks, walking trails etc. Staff will return will cost estimates; however, it is important to note here, that our inflation and other cost factors are outpacing our current revenue sources and to remain financially stable, we will need to seek other revenue sources to maintain the current standard.
IV. Our operations agreement with Amador City has expired and there are items that need to be addressed regarding capital costs and capacity allocations. To that end, a comprehensive review of our Municipal Code relating to sewer operations also needs to be addressed this fiscal year.
V. An operations overview of all facilities and maintenance costs is also in order. We need to be prepared to look into the future to determine future costs of operations for service including utility costs and begin planning for those- such as installing solar at City Hall.
SUMMARY:
Our fiscal prudence continues to serve us well. Increased efforts in marketing have kept us nimble through a very difficult last two years. That said, this can only be one part of the solution. We also need to turn our attention towards long-term fiscal sustainability, being thoughtful in ensuring the City is stronger and more resilient through identifying opportunities to diversify our revenue sources and expand our revenue base. As we flourish, we must use our resources strategically. We are going to need to target investments in strategic focus areas to ensure long term fiscal sustainability.
And one final note regarding City staff. We have an incredible staff who all work very hard for the City. I am proud of each of them and also proud that we have very little turnover.

COUNCIL
MEETING DATE: JULY 18, 2022
FROM: AMY GEDNEY, CITY MANAGER
SUBJECT: COUNCIL STIPENDS
RECOMMENDATION:
By motion, provide staff direction.
BACKGROUND:
During the 2021-2022 fiscal year, the City Council voted to set aside their monthly stipends to be able to offset any costs as a result of the pandemic. The Council ceased the monthly diversion in January 2022. $21,438 was the total amount set aside. The Council directed staff to return with a recommendation on how to use those funds.
DISCUSSION:
Below are a variety of options on how the Council could distribute those funds:
1. Redistribute back to each Council member their pro rata share.
2. Return funds to the General Fund.
3. Use the funds to offset a future project or event.
4. Retain in a set aside fund for a future special project or event request.
5. Partner with another group for a project or event.
