A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUTTER CREEK

AUTHORIZING REMOTE TELECONFERENCE MEETINGS OF THE LEGISLATIVE

BODIES OF THE CITY OF SUTTER CREEK
WHEREAS, the City of Sutter Creek is committed to preserving and nurturing public access and participation in public meetings; and
WHEREAS, all meetings of the City’s legislative bodies are open and public, as required by the Ralph M. Brown Act (Cal. Gov. Code sections 54950 – 54963), so that any member of the public may attend, participate, and watch the City’s legislative bodies conduct their business; and WHEREAS, the Brown Act, Government Code section 54953(e), makes provisions for remote teleconferencing participation in meetings by members of a legislative body, without compliance with the requirements of Government Code section 54953(b)(3), subject to the existence of certain conditions; and
WHEREAS, a required condition is that a state of emergency is declared by the Governor pursuant to Government Code section 8625, proclaiming the existence of conditions of disaster or of extreme peril to the safety of persons and property within the state caused by conditions as described in Government Code section 8558; and
WHEREAS, a proclamation is made when there is an actual incident, threat of disaster, or extreme peril to the safety of persons and property within the jurisdictions that are within the City’s boundaries, caused by natural, technological, or human-caused disasters; and WHEREAS, such conditions now exist in the City of Sutter Creek; and WHEREAS, the City Council does hereby find that the Covid-19 emergency has caused, and will continue to cause, conditions of peril to the safety of persons within the City that are likely to be beyond the control of services, personnel, equipment, and facilities of the City, and desires to ratify the proclamation of state of emergency by the Governor of the State of California; and WHEREAS, as a consequence of the emergency, the City Council finds that the legislative bodies of the City of Sutter Creek shall conduct their meetings without compliance with paragraph (3) of subdivision (b) of Government Code section 54953, as authorized by subdivision (e) of section 54953, and that such legislative bodies shall comply with the requirements to provide the public with access to the meetings as prescribed in paragraph (2) of subdivision (e) of section 54953; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Sutter Creek proclaims that an emergency continues to exist throughout the City of Sutter Creek and requiring persons to meet in public. STAFF REPORT
TO: THE HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL MEETING DATE: August 15. 2022
FROM: James O’Connell, Police Chief
SUBJECT: PLACEMENT OF RADAR SIGNS
RECOMMENDATION:

Authorize the placement of four solar powered radar signs at the locations noted below.

BACKGROUND:

In 2021 the City of Sutter Creek received a generous grant from the Amador County Transportation Commission (ACTC) to purchase (4) Stalker PMG radar signs. The signs were purchased and are in the possession of the City.

DISCUSSION:

Vehicle and pedestrian safety are of paramount importance to the health and wellbeing of our community.

Research supports the position that radar speed displays, like those purchased by the ACTC grant and in the possession of the City of Sutter Creek, can contribute to reduced vehicle speeds. In one study the placement of radar display signs resulted in an average reduction in the 85th percentile speed of 7 mph. (Journal of Transportation Technologies, Vol.6, No.3, April).

Another study cited an overall speed reduction of 9 mph within school zones. (Journal of the Transportation Research Board, Transportation Research Board of the National Academies, Volume 1918/2005, 2006).

Yet another study cited the benefits of placing traffic radar signs in the area of sharp roadway curves, where average speeds were reduced more than 9 mph (Texas Transportation Institute, Texas A&M University System, Project Summary Report 0-4475-S).

There are many locations that would benefit from the placement of speed display signs. After review and discussion with PD staff, review of complaints and collisions, and with consideration to available research, some of which is noted above, it is the recommendation of the Sutter Creek Police Department that the signs be placed at the locations listed below:

Gopher Flat Road (Westbound)
Old Highway 49 (near Dennis Street)
Sutter Hill Road (area of Campbell Construction)
Spanish Street (area of Amelia)

The budgetary impact of this project is minimal. The signs are solar powered and will be installed by City of Sutter Creek staff during regular hours. The City will purchase the posts upon which the devices will be mounted.

MEETING DATE: AUGUST 15, 2022
FROM: AMY GEDNEY, CITY MANAGER
SUBJECT: CONTRACT FOR PROFESSIONAL SERVICES FOR A

WASTEWATER RATE STUDY
RECOMMENDATION:
1) Adopt Resolution 22-23-* Authorizing the City Manager to execute a professional services contract with Hildebrand Consulting. for the Phase 2 wastewater rate study. 2) Adopt Resolution 22-23-* Authorizing Amendment #1 to the Fiscal Year 22-23 Budget.

BACKGROUND:

In 2019 a comprehensive rate study was completed and implementation of a Phase 1 five-year plan began in January 2020 that addressed the operational costs of providing the service. In July 2020, the City received a grant to develop a Plan of Study. The grant was to look at the costs of construction for a design-build project upgrading the current system to the tertiary level. The cost estimates and feasibility for doing this were so large that it has been determined it will simply be infeasible for the Sutter Creek ratepayers.

DISCUSSION:

The attached proposal is for the Phase 2 Study that will examine capital costs as well as connection fee costs. While the exact determination of improvements to be made is still unknown, it is imperative that the City begin financial planning to ensure that any new development is paying its fair share in connection charges and that capital replacement costs are being considered for current users. Without that, we will lose potential revenue to the system resulting in larger increases further out in time.

BUDGET IMPACT:

The proposal is for $47,150.

RESOLUTION 22-23-*

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUTTER CREEK

AUTHORIZING THE CITY MANAGER TO EXECUTE A PROFESSIONAL

WHEREAS, the City deems it necessary to proceed with a Phase 2 rate analysis; and NOW THEREFORE BE IT RESOLVED, that the City Council does authorize the City Manager to enter into a professional services agreement with Hildebrand Consulting. for a Wastewater Rate Study, as per proposal dated August 5, 2022 included as Attachment A.

Subject: Proposal for 2022 Sewer Financial Plan, Rate Update and Connection Fee Study Dear Ms. Gedney,
In response to your request, Hildebrand Consulting is pleased to submit this proposal to conduct a Sewer Enterprise Financial Plan and Rate Update study for the City of Sutter Creek (City).

Background
In 2019 Hildebrand Consulting (along with The Reed Group) completed a comprehensive sewer rate study for the City. At the time the City was facing significant capital costs in both its collection system as well as anticipated costs to upgrade or replace its existing wastewater treatment plant with a tertiary plant (WWTP Project). At the time, however, the timing and the magnitude of the wastewater treatment costs were still under development. Ultimately the City decided to implement a 5-year rate schedule that would address the financial needs of operations and repairs to the collection system while deferring rate increases for the WWTP Project until the needs were better defined. The 2019 Sewer Rate Study Report referred to these initial rate increases as “Phase 1” and concluded that the City should conduct a “Phase 2” rate study to address the treatment costs. This proposal describes the scope of work and cost to conduct the so called Phase 2, which will supersede the adopted rates for the latter portion of the Phase 1 5-year rate schedule.

In speaking to the City, we understand that the WWTP Project will not involve a new WWTP. The costs will more likely include modifications to the existing WWTP as well as solutions for disposal of treated wastewater.

In addition, the City is interested in updating its connection fees. Connection fees (referred to as “Capacity Charges” by California law) are one-time charges paid by new development for capacity in the sewer system. The calculation of capacity charges is governed by California Government Code Section 66013, as well as constitutional requirements and court decisions. The City wishes to update its connection fee schedule to ensure that the cost of providing new services to development are being fully recovered.

There are two standard approaches for calculating connection fees. The system “buy-in” methodology is based on the current value of existing assets (historical costs escalated to current dollars and adjusted for depreciation) divided by the capacity of the existing system. The basic equation for

calculating the connection fee charge using the system buy-in method is:

Present Value of Existing System
Total Capacity of System
Alternatively, the “incremental” approach examines the estimated cost of building new infrastructure to serve new development. The basic equation for calculating the connection fee charge using the incremental method is:

Cost of Expanding the Capacity of the System
New Capacity created by Expansion Projects
We will consider both approaches with the City, as well as the possibility of a hybrid approach.

Scope of Services
The scope of services includes preparing a financial plan model a 10-year planning period and calculating updated rates and fee plans for a 5-year period. To the extent possible, we will use information from the 2019 rate study in order to streamline the effort, expedite the process and minimize the budget. Specific tasks to be performed include the following:
• Study Initiation and Data Collection – This task involves obtaining and reviewing the documents and information needed to update the City’s financial plan and calculate the connection fees.

A list of required information is attached to this letter proposal. Once under contract, we will conduct a video conference kick-off meeting with appropriate staff. We will review any data and information provided in advance prior to the kick-off meeting so the meeting is as productive as possible. During this meeting we will confirm the project scope, timeline, responsibilities, and key milestones. Our goal is to develop a clear and common understanding of the scenarios to be evaluated and what is to be accomplished during the study. • Multi-Year Financial Plan– A 10-year financial plan model will be developed based on FY 2021/22 actual revenue and expense information, as well as the FY 2022/23 budget. The financial plan will forecast future operating and maintenance costs, debt service obligations, and capital improvement needs, and will be used to determine annual sewer rate revenue requirements.

The financial plan model will also reflect non-rate revenues as well as comply with existing financial reserve policies. If warranted, the financial plan model can also be used to evaluate the potential for future debt issuance and the impact additional debt service costs might have on the sewer rates.

We will prepare a complete sewer rate and fee schedule for the 5-year planning period based on estimated revenue needs. To place proposed new rates into context, we will compare the typical residential sewer bills with bills under current sewer rate schedules, as well as with neighboring communities.
• Calculate Water Connection Fees –Hildebrand Consulting will calculate connection fees for the

sewer system using the incremental methodology. The charge will reflect the estimated reasonable cost of giving access to sewer system capacity for new development, based on the estimated cost of expanding the system. A complete schedule, based on meter size, will be developed based on the capacity associated with each meter size. Calculations will be consistent with the requirements contained in Government Code Section 66013. • Draft and Final Report and Proposition 218 Notice – Once the financial plan has been prepared and proposed rates have been calculated, an administrative draft study report will be prepared and submitted to staff for review. The report will document all information, assumption, analyses, findings, and recommendations from the study and provide the technical basis for proposed rates and connection fees. We will review the administrative draft with staff, make any required refinements, and then prepare a draft report that can be presented to City Council. Following receipt of comments on rate recommendations from staff, the study report will be revised, as necessary, and submitted in final form. This task will also include preparing a draft Notice of Public Hearing regarding proposed sewer rates, in accordance with the requirements of Proposition 218. Our proposal assumes that the City will be responsible for finalizing, printing, and mailing the Notice of Public Hearing. • City Council Presentations –This scope assumes that the study recommendations will be presented to the City Council three times: the first presentation will be a draft recommendation, the second will be the final recommendation and will ask the City Council to direct staff to mail the Proposition 218 notices, and the third will be the public hearing to adopt the new sewer rates. Mr. Hildebrand can conduct these meetings remotely or in person (for an additional fee as described in the proposed budget below).

Project Schedule
The following project schedule assumes that work will commence in July 2022. We will work closely with the City to maintain the schedule, or to modify it as conditions warrant. • Project approval and notice to proceed Late August
• Obtain requested information and conduct kick-off meeting Early September • Prepare financial plan and calculate rates (including CIP iterations) October • Present initial findings to the City Council / Finance Sub Committee Late October • Prepare draft report and draft public hearing notice Early November • Present recommendations to the City Council Late November • Mail notice of public hearing and prepare final report Early December • Conduct sewer rate public hearing Early February
• Adopt new sewer rates March 1, 2023

COUNCIL
MEETING DATE: AUGUST 15, 2022
FROM: AMY GEDNEY, CITY MANAGER
SUBJECT: COUNCIL STIPENDS
RECOMMENDATION:

By motion, provide staff direction.

BACKGROUND:

During the 2021-2022 fiscal year, the City Council voted to set aside their monthly stipends to be able to offset any costs as a result of the pandemic. The Council ceased the monthly diversion in January 2022. $21,438 was the total amount set aside. The Council directed staff to return with a recommendation on how to use those funds.

DISCUSSION:

Below are a variety of options on how the Council could distribute those funds:

1. Redistribute back to each Council member their pro rata share.

2. Return funds to the General Fund.

3. Use the funds to offset a future project or event.

4. Retain in a set aside fund for a future special project or event request.

5. Partner with another group for a project or event.
