8. ORDINANCES & PUBLIC HEARING
A. Appeal of Grant of Conditioned Special Events Permit – Amador Farmers Market Association
Interim City Manager Spelliscy presented the staff recommendation, noting that losing the handicapped-accessible parking space could cause possible costly legal exposure to the city.

City Attorney Cole agreed that taking away a spot that the city currently provides opens the city up to an ADA lawsuit. H explained that this would be intentionally depriving patrons on an ongoing basis.

Mayor Gunselman suggested since the space is not considered a parking lot while operating under the permit does the city may not need to provide the ADA spot. 7 Ron Antone, applicant, noted that the ADA spot could remain available and offered to open the market earlier to help ease the parking concerns.

Mayor Gunselman invited public comment.

Andrew Gardner on behalf of Mike O’Neill, Tamara Richards, Susan Bragstad and Molly Allen and Ron Antone, members of the public, spoke in support of the Farmer’s Market location change.

Mike Kirkley of Sutter Creek commented that Sutter Creek is exempt from ADA regulations.

Sandy Anderson, of Sutter Creek noted that Sutter creek is not exempt from ADA regulations, they are required to do as much as possible to reach compliance.

Mayor Gunselman closed public comment at 8:14 p.m.

Council member Swift suggested that the city should consider charging a use fee for the parking lot like any other city facility that the public rents.

Interim City Manager Spelliscy agreed with Council member Swift that the Special Event Permit process does not fit for this event.

M/S Council member Sierk/Feist to approve the appeal and allow the Farmer’s Market to be held in the Violich parking lot with the following conditions:

1. The ADA parking spot remains available to the public.

8 C. Update on ARSA/Ione litigation, ARSA staffing, budget and other administrative matters, and role of Council in settlement agreement.

Interim City Manager Spelliscy suggested that this item be tabled considering Robin Peters resignation until a new ARSA representative is appointed.

Council member Sierk suggested staff prepare a letter from the City Council to the ARSA Board asking for an explanation about the litigation and noted that the staff report needed to be corrected to reflect that her request for ARSA information was made at the April 17th meeting not on the 20th.

Council member Swift noted that during litigation most of the discussion has been in closed session and that the ARSA Attorney and the City Attorney should have a discussion on what is appropriate to share.

City Attorney Cole noted that ARSA is a separate legal entity.

Mike Kirkley commented that the two City Council members acting as ARSA representatives should be looking out for the best interests of the city and if so, why is the Council in the dark about ARSA. He noted that the County Supervisors on the ARSA Board look to the Sutter Creek representatives for direction.

M/S Council member Sierk/Feist to direct staff to send a letter requesting that the ARSA Board provide the following:

STAFF REPORT
TO: CITY COUNCIL
MEETING DATE: MAY 15, 2023
FROM: DEREK COLE, CITY ATTORNEY
SUBJECT: PROCESS FOR FILLING VACANT CITY COUNCIL SEAT

IN LIGHT OF RECENT RESIGNATION OF COUNCIL

MEMBER PETERS
This memorandum provides guidance on the filling of the vacant City Council position in light of the recent resignation of Councilmember Peters.

Under California law, the City Council has the authority to fill a vacancy in its membership by appointment. The appointment must be made within 60 days from the date of the vacancy. (California Government Code Section 36512.) Council member Peters tendered his resignation on May 1, 2023. The City Council must accordingly take action to fill the vacant council seat by no later than June 30, 2023.

The City Council may either appoint a qualified person to fill the vacancy or call for a special election to fill the vacancy. However, given the costs associated with a special election and the relatively short time frame to fill the vacancy by appointment, the appointment option is often preferred.

To ensure a fair and transparent process for filling the vacancy, the City Council may choose to solicit applications from interested individuals and conduct interviews to determine the most qualified candidate. The City Council may also consider input from the public and other stakeholders during the appointment process.

Once the appointment is made, the new Council member will serve for the remainder of the unexpired term of the vacated office. The newly appointed Council member will be required to take the oath of office and complete any necessary training or orientation before taking his or her seat on the Council.

Staff can also develop an application form, which will require candidates to identify their relevant qualifications for the vacant position. Staff can also develop a list of questions for the Council's use in interviewing prospective candidates.

STAFF REPORT
TO: MAYOR AND MEMBERS OF THE CITY COUNCIL
MEETING DATE: MAY 15, 2023
FROM: SANDRA SPELLISCY, INTERIM CITY MANAGER
SUBJECT: VACANCIES ON OUTSIDE AGENCY REPRESENTATION
RECOMMENDATION:

1. Remove Robin Peters from appointments to Amador Regional Sanitation Authority, Amador County Transportation Commission, and Regional Traffic Mitigation Fee Oversight Committee.

2. Approve new Mayoral appointments.

BACKGROUND: Robin Peters no longer serves on the Sutter Creek City Council, so his previous appointments are vacant and need to be filled. They are:
• ARSA Governing Board
• Amador County Regional Transportation Commission Board • RTMF Oversight Committee (part of ACTC)
DISCUSSION: The Mayor will recommend new appointments for Council approval. (Note:

This process is not codified in the Municipal Code nor in the Council Procedures Manual, but seems to be based on past practice. Staff recommends that when either of those documents are updated, this issue be addressed and a process codified.) BUDGET IMPACT: None

STAFF REPORT
TO: MAYOR AND MEMBERS OF THE CITY COUNCIL
MEETING DATE: MAY 15, 2023
FROM: SANDRA SPELLISCY, INTERIM CITY MANAGER
SUBJECT: RECONSIDERATION OF COUNCIL STIPENDS ACTION
RECOMMENDATION: Approve request for reconsideration and discuss possible new action.

BACKGROUND: At the May 1 Council meeting the Council passed a motion “to approve the use of the reserved council stipends for immediate road conditions, i.e., filling potholes.” Councilmember Swift has now asked to reconsider that action.

DISCUSSION: In order to reconsider a previous Council action, one of the members who voted in the majority must move to reconsider the action. The Council then votes on the motion for reconsideration, but not on merits of a new proposal. If the motion for reconsideration is approved, a new motion can be made, and the Council can then discuss and act on the new motion.

BUDGET IMPACT: Possible change to directing approximately $20,000 to road repair.

STAFF REPORT
TO: CITY COUNCIL
MEETING DATE: MAY 15, 2023
FROM: GRANT REYNOLDS, CITY SANITARY SEWER

ENGINEER
SUBJECT: COLLECTION SYSTEM INFILTRATION & INFLOW

SUMMARY REPORT OF PAST AND CURRENT

ATTEMPTS TO LOCATE AND CORRECT I & I IN THE
CITY’S COLLECTION SYSTEM
RECOMMENDATIONS:
• Continue with work being completed from the Smoke Testing Work List. • Review Sutter Oaks Subdivision Sewer Main Replacement Project during budget process.
• Continue with Manhole Metering Project data collection and analyzing of results to aid in locating I & I.
• Determine system for requiring customer-responsibility deficiencies to be corrected. • Find funds to finance replacement of deficient residential and commercial service lines. • Look at options for EDA line replacement project.

BACKGROUND:

During the preliminary design phase for the recent (2020-2021) process of determining a feasible WWTP Replacement Project, the City’s ongoing sewer collection system infiltration and inflow (I&I) problem was a concern regarding sizing and costs for a new WWTP. As a result of this process, it was decided that the City needed to collect data that would be useful in addressing the problem. Reducing I&I correlates directly with reducing costs of constructing, operating, and maintaining sewer treatment facilities. After discussion, two avenues of data collection were to be pursued: smoke testing and storm flow metering. Firstly, smoke testing of the system has been completed both in the past and more currently in the last two years. The testing done in the 16 18 Main St., Sutter Creek, CA 95685 • Telephone: (209)267-5647 • Fax: (209)267-0639 • TTY: 711 The City of Sutter Creek is an equal opportunity service provider and employer past is discussed below. During the most current smoke testing some areas of concern were located but no large instances of infiltration or inflow were discovered. The areas of concern from the current smoke testing are in the process of being addressed at this time. Secondly, since no large instances of infiltration were found with smoke testing, storm flow metering of the manholes needed to be completed to help segregate any sections of the collection system that may contribute more I&I than other sections.

DISCUSSION:

PAST ATTEMPTS

SMOKE TESTING
2000 – Entire collection system was smoke tested by City crew. Items found were categorized as a city responsibility or a Customer Service Line responsibility. All of the items deemed a city responsibility were repaired by City crews and contractors. The Customer Service Line responsibilities were not repaired. A program to require the customers with infiltration problems to repair their lines was not undertaken.
2011 – Smoke testing of a portion of the collection system was completed. The lines in the Creek and lines adjacent to drainage areas were tested. Obvious items such as bad cleanout caps and large discharges of smoke were repaired by contractors. Two areas of drainage cross connection were found. The line extending in Rabb Street was replaced during this time. Smoke was found emanating from a pair of drainage inlets along the frontage of Main Street, south of Nickerson Street. The location of the cross connection could not be pinpointed at the time so no repairs were completed. This area of sewer main was replaced in 2018 as part of the Miscellaneous Street Improvement Project.

MANHOLE LINING PROJECTS
2017 – First Phase – In an effort to locate I & I within the Creek collection line areas, all of the lines in the Creek area were CCTV’d. No holes, cracks, or joint separations were located in the lines but, the condition of the manholes was noted as deficient with joint infiltration points and pipe connection points being areas for creek water infiltration. It was decided to proceed with mortar lining of the manholes located in the Creek area. Twenty-one manholes were lined by a contractor hired by the city. A reduction of I & I of approximately 10% was noted by the Plant Operator during the next winter’s storm period. It was discussed that some outflow could have been occurring at these manholes during storms prior to the lining work. A second phase of Manhole Lining was then scheduled.
2019-2021 – Second Phase – The City contracted with the same company that completed the work in 2017 to complete the second phase of work. 18 to 19 manholes were selected by staff to be lined each of the three years. Some infiltration was located during the lining work, but no large infiltration flows were discovered. Reduction of I & I flows were not significant after the completion of this work.
17 18 Main St., Sutter Creek, CA 95685 • Telephone: (209)267-5647 • Fax: (209)267-0639 • TTY: 711 The City of Sutter Creek is an equal opportunity service provider and employer

CURRENT ATTEMPTS

SMOKE TESTING
2021-2022 – Smoke testing of the entire collection system was again undertaken with the aid of a grant and a technical assistant from the California Rural Water Association (CRWA). The City’s crew found multiple small points of entry. Additionally, a few drainage cross connection points were also located. No large points of infiltration were discovered.

A work list was created from the report prepared by CRWA (see attached). The City’s crew is in the process of completing the easier items of work, mostly the repair or replacement of cleanout caps. The drainage cross connections are still being investigated. The cross connections found in the Sutter Oaks Subdivision would be removed when the sewer main is replaced. A cross connection found in the Frakes Street/Greenstone Terrace area is contributing a full 6” pipe of storm water into the collection system. It is recommended to dig up this area this summer (2023) and remove the cross connection. Other areas of cross connection still need to be investigated by either dyeing water flow through the areas or using CCTV to locate the points.

Repair of residential/commercial service lines where smoke appeared during the testing is still being discussed by staff.

SEWER MAIN REPLACEMENT PROJECTS
A 6” line that ran full during storms was found during the Miscellaneous Street Improvement Project. This line was capped to stop drainage inflow into a manhole. A 6” line that ran full during storms was found during the Elm Street Sewer Main replacement Project. This pipe was disconnected and rerouted to a storm drain inlet.

The City is currently preparing plans to replace the sewer mains in the Sutter Oaks Subdivision area using the pipe bursting method. Many of these pipes are currently clay pipes which allow I & I at nearly every joint. It is hoped to reduce I & I from this area with the completion of this project. Creating a plan to replace residential service lines in this area using either a grant or a City financed program has been discussed.

The City’s EDA Line (the line that runs through the Allen property and connects part of the Sutter Hill Area and the pump stations from the Martell Area) is currently being replaced by a contractor hired by the Jackson Rancheria Development Corporation as part of the Pinewoods West Apartment Project. The apartment project has been stopped, but currently this sewer line installation project is still to be completed. Completion of this line needs to be discussed during the budget process. Installation of this line should reduce I & I in this area by replacing a line and manholes that were installed in 1981.

MANHOLE METERING
2023 – During March and April of this year the city rented 10 Manhole Meters to help identify I&I flows that exist throughout the collection system. The meters were located in selected 18 18 Main St., Sutter Creek, CA 95685 • Telephone: (209)267-5647 • Fax: (209)267-0639 • TTY: 711 The City of Sutter Creek is an equal opportunity service provider and employer manholes to try and segregate areas of the collection system. A map of the locations and a sample of the data collected are attached. The data is currently being analyzed.

The charts show that the peak flow during rain events varies from 3-4 times the normal peak flow to 8-9 times the normal peak flow. It also appears that every location suffers from infiltration. A meeting between City staff and Carollo Engineers has been scheduled to review the data and determine what level of infiltration is acceptable so that the locations of the meters during the next round of data collection can be planned effectively.

As noted above, some infiltration will be eliminated with the work being done from the Smoke Testing Work List and the Sewer Main Replacement Projects.

1 TO: Sandy Spelliscy, City Manager
FROM: Matt Ospital, PE City Engineer
SUBJECT: Project Status Update
DATE: May 11, 2023
Sandy, the following is a status update of all projects WGA is currently working on:

1. Building Inspections/Plan Check – Continuing building inspections on Tuesdays and Thursdays or as needed. Building plan check is being performed on a continual basis as plans are submitted.

2. Encroachment Permit Review – Encroachment permits are reviewed as needed when requested by the City’s Account Technician, Jodi Arroyos.

3. Citywide CIP – Preliminary cost estimates and exhibits have been completed and presented to the City Council. The engineering team has updated project worksheets and is ready for City review.

4. Eureka Road Storm Drain Replacement Project – City public works staff identified a sinkhole at the site on May 4th. Contractor mobilized and started construction on May 8th. Work is anticipated to be completed by June 5th.

5. Gold Strike Court Storm Drain Replacement Project – City has received a signed contract from Campbell Construction.

6. Cramer Hills – Final Map is scheduled to go back to Council for City acceptance at the June 5th meeting.

7. Bryson Park Upgrade – Construction was substantially completed on November 18th. Due to the colder weather, court striping cannot be completed until Spring as recommended by the paint manufacturer.

8. Gopher Flat Realignment – Currently working on a new alignment to remove one of the road curves and possible widening. On hold due to Swift parcel findings.

9. Development Standards – Create new standards under the current planning grant the City received. Scope of grant included an EIR for the Zoning Ordinance update, circulation element, and the development standards. Grant has a deadline of 9/30/23. 113
Sutter Creek Projects as of 4/13/2023:

City Projects
Zoning:

A draft Zoning Ordinance will be brought to the PC on May 22 for a public hearing and review.

Housing Element Update
The comment period ended on 1/9/23. The 90 day HCD review period ended on 5/9/23. Staff has not heard from the consultant regarding HCD comments.

Circulation Element
Draft completed by GHD, and reviewed by PC and CC, but has not adopted because CEQA has not been done. CEQA will be done with the Citywide environmental analyses. If the CC would like to adopt the Circulation Element before completing the Citywide EIR that is possible but will cost additional money and will not be grant funded.

Citywide EIR
Grant project to be spent by end of 2023. This most likely will be reduced to a Mitigated Negative Declaration depending on the revised scope of the grant work products. Staff will begin the environmental review process once the PC has looked at the draft zoning ordinance amendments.

Applicant Projects
Planning staff and the City manager met with applicants who are currently in the application process. We held 6 meetings. We were able to understand what some of the hold ups have been and come up with a plan to help the applicants move forward.

Sutter Creek Ranch (Gold Rush Ranch Specific Plan)
Staff met with Allen family, who owns a portion of the land within the project/specific plan area. They would like to move forward with either the project or a separate project. We will meet again with them on 4/24.
