STAFF REPORT
TO: CITY COUNCIL
MEETING DATE: AUGUST 21, 2023
FROM: GRANT REYNOLDS, CITY SANITARY SEWER

ENGINEER
SUBJECT: 2023 SEWER MAIN PIPE BURSTING PROJECT FOR THE

SUTTER OAKS RESIDENTIAL AREA
RECOMMENDATION:

None. Plans and Specifications are being presented to the City Council for informational purposes only to keep all members aware of the bidding process.

BACKGROUND:

In an effort to continue to reduce I &I in the City’s sewer collection system and relieving recurring maintenance issues by replacing old sewer mains within the system, this proposed project has been placed as a priority to complete by the Public Works Department. It is planned to replace up to 5055 lineal feet of sewer main dependent on the results of the bidding process. A lesser footage may be realized due to budget constraints. Plans and Specifications for the project were included in the agenda packet.

DISCUSSION:

The Notice to Contractors will be sent for advertising to our local newspaper and regional contractor plan rooms to hopefully obtain competitive bids for the work. The project is currently set to bid on September 26, 2023. Successful bidder information will be presented after that date.

BUDGET IMPACT:

The cost of this contract (Base Bid $740,000.00 with a possible Additive Alternate) has been allowed for in the approved City Budget as part of Sewer Line Replacement.

THIS AGREEMENT, made and entered into on ___________________________, 2023, by and between the City of Sutter Creek, California (hereinafter referred to as CITY), and ___________________________, Contractor, (hereinafter referred to as CONTRACTOR), or under the authority of the Public Contract Code of the State of California.

The parties hereto mutually agree as follows:

For and in consideration of the mutual promises and other valuable consideration set forth herein, receipt of which is hereby acknowledged, City agrees to employ Contractor and Contractor agrees to furnish all materials and labor for the prescribed work; perform and complete in good and workmanlike manner all the work pertaining thereto shown on the plans and specifications therefore; to furnish at his sole cost and expense all materials, tools, equipment and facilities, and all labor and services necessary therefore (except such materials, if any, which under the specifications are to be furnished by the City), and to do everything required by this Agreement and said plans and specifications, including but not limited to the payment of prevailing wages as required by state law.

Contractor is responsible for furnishing all said materials and labor, tools and equipment, and doing all the work contemplated and embraced in this Agreement, also for all loss and damage arising out of the nature of the work aforesaid, or from the action of the elements, or from any unforeseen difficulties which may arise or be encountered in the prosecution of the work until its acceptance by the City, and for all risks of every description connected with the work; also for all expenses incurred by or in consequence of the suspension or discontinuance of work, except such as in the said specifications are expressly stipulated to be borne by the City. For well and faithfully completing the work and the whole thereof, in the manner shown and described in said plans and specifications, the City will pay and the Contractor shall receive in full compensation therefore the lump sum price, or if the bid is on the unit price basis, the total price for the several items furnished pursuant to the specifications, named in the schedule of the Proposal in the amount of _______________________.

The Notice To Contractors, Proposal, and Specifications, copies of which are attached hereto, are hereby incorporated into and made a part of this Agreement by reference as if fully set forth.

Civil Code Section 3247 requires every contractor that receives a public works contract to file a payment bond and performance bond with the awarding agency for the agency’s review and approval. It is the public agency’s mandatory duty to ensure that the general contractor’s payment bond surety meets the requirement of Code of Civil Procedure 995.310.

The City requires that the contractor submit verification from the California Insurance Commissioner of the surety’s certificate of authority to issue such bonds. If the surety is not admitted or the certificate is unavailable, the agency must reject the bonds and the proposed contract unless and until the contractor furnishes bonds provided by an admitted surety insurer or 17 by otherwise sufficient sureties. Verification from the California Insurance Commission must be received, along with the bonds, before work begins, or no payment shall be made to Contractor.

Contractor shall submit a detailed schedule of work at the pre-construction conference for approval by the City Engineer. This contract shall not take effect and no payment shall be made to Contractor until that schedule is submitted and approved.

If Contractor fails to complete the work in accordance with the schedule set forth in the specifications and/or accordance with Section 4 of Section II, Supplemental General Conditions, of the project specifications, Contractor shall be liable for liquidated damages pursuant to Section II-4.03, for each day of delay. Liquidated damages accrued shall be deducted from compensation due the Contractor and retained by City.

All certificates of insurance, policy endorsements, and all other certificates required by the specifications shall be on file with the City before work begins or no payment will be made to Contractor.

This is a public works contract within the meaning of Part 7 of Division 2 of the California Labor Code (Sections 1720 and following), and the contractor and any subcontractor under him shall pay not less than the specified prevailing rates of wages to all workmen employed and be registered with the Department of Industrial Relations pursuant to Labor Code Section 1725.5.

IN WITNESS WHEREOF, the Parties hereto have caused this contract to be executed the day and year first above written.

Bests rating of no less than A:VII or its equivalent against injury/death to persons or damage to property which may arise from or in connection with the activities hereunder of Contractor, its agents, employees or subcontractors:

(3) The inclusion of more than one insured shall not operate to impair the rights of one insured against another insured, and the coverage afforded shall apply as though separate policies had been issued to each insured, but the inclusion of more than one insured shall not operate to increase the limits of the insurer’s liability. (4) For claims related to this project, the Contractor’s insurance is primary coverage to the City, and any insurance or self-insurance programs maintained by the City are excess to Contractor’s insurance and will not be called upon to contribute with it. THE PROGRESS OF WORK SHOULD BE REVIEWED AND ANY MODIFICATIONS NEEDED TO THE EROSION/SEDIMENT CONTROL FACILITIES DISCUSSED. NO MODIFICATION TO THE EROSION/SEDIMENT CONTROL FACILITIES SHALL BE MADE WITHOUT APPROVAL OF THE AMADOR COUNTY PUBLIC WORKS AGENCY. THIS PLAN MAY NOT COVER ALL THE SITUATIONS THAT ARISE DURING CONSTRUCTION DUE TO ANTICIPATED FIELD CONDITIONS. VARIATIONS MAY BE MADE TO THE PLAN IN THE FIELD SUBJECT TO APPROVAL OF THE AMADOR COUNTY PUBLIC WORKS AGENCY. LIMIT THE REMOVAL OF NATURAL VEGETATION OR GROUND COVER FROM THE SITE DURING THE CONSTRUCTION OF THE PROPOSED SITE IMPROVEMENTS IN ORDER TO MINIMIZE THE POTENTIAL FOR EROSION PROBLEMS. ALL CUT AND FILL SLOPES SHALL BE STABILIZED AS SOON AS POSSIBLE AFTER COMPLETION OF GRADING, IN NO CASE LATER THAN OCTOBER 15. NO SITE GRADING SHALL OCCUR BETWEEN OCTOBER 15 AND APRIL 15 UNLESS APPROVED EROSION CONTROL MEASURES ARE IN PLACE. AVOID VEHICLE EQUIPMENT REPAIR, MAINTENANCE, AND WASHING ON THE CONSTRUCTING SITE UNLESS MEASURES ARE TAKEN TO PREVENT PETROLEUM PRODUCTS AND CLEANERS FROM CONTAMINATING THE GROUND OR DISCHARGING TO THE STORM DRAIN SYSTEM. DO NOT PAVE OR SEAL IN WET WEATHER, OR WHEN RAIN IS FORECAST. DON'T WASH DOWN "PAVED SURFACES" WHERE FLUIDS HAVE BEEN SPILLED. USE DRY CLEANUP METHODS ABSORBENT MATERIALS, CAT LITTER. AND/OR RAGS) WHENEVER POSSIBLE. SWEEP UP DRY SPILLED MATERIALS IMMEDIATELY. DON'T "WASH THEM AWAY" WITH WATER. DURING SAW CUTTING OPERATIONS, SLURRY MUST NOT BE DISCHARGED TO STORM DRAIN SYSTEM. VACUUM UP SLURRY AND PUMP TO A HOLDING TANK FOR DISPOSAL, OR PUMP TO A CONTAINMENT POND/DIRT AREA WHERE WATER CAN FILTER OR EVAPORATE, ALLOWING THE CONCRETE TO SET. SET UP AND OPERATE SMALL MIXERS ON TARPS OR HEAVY PLASTIC DROP CLOTHS. DESIGNATE AN AREA ON-SITE FOR DUMPING EXCESS CONCRETE. INSURE THAT CONCRETE SUPPLY TRUCKS OR CONCRETE FINISHING OPERATIONS DO NOT DISCHARGE WASH WATER INTO STREET GUTTERS OR DRAINS. INSTALL A WASHOUT ON A DIRT AREA THAT CANNOT DISCHARGE TO A STORM DRAIN FACILITY. NEVER CLEAN BRUSHES OR RINSE PAINT CONTAINERS INTO A STREET, GUTTER, OR STORM DRAIN. WATER-BASED PAINT RESIDUES CAN BE RINSED IN A SINK; OIL-BASED PAINTS, SOLVENT, AND CLEANERS SHOULD BE RECYCLED OR DISPOSED OF AS HAZARDOUS WASTE. PROVIDE A CONTAINED AND/OR COVERED AREA ON THE SITE FOR THE STORAGE OF CEMENT, PAINTS, FLAMMABLES, OILS, FERTILIZERS, PESTICIDES, OR OTHER MATERIALS USED ON THE PROJECT SITE THAT HAVE A POTENTIAL FOR BEING DISCHARGED TO THE STORM DRAIN SYSTEM BY RAIN, WIND, OR FROM A SPILL. INSTALL FILTER MATERIALS AT THE STORM DRAIN INLETS PRIOR TO: 1) START OF THE RAINY SEASON (OCTOBER 15); 2) SITE DEWATERING ACTIVITIES; OR 3) STREET WASHING ACTIVITIES, IN ORDER TO RETAIN ANY DEBRIS OR DIRT FROM FLOWING INTO THE STORM DRAIN SYSTEM. FILTER MATERIALS SHALL BE MAINTAINED AND/OR REPLACED AS NECESSARY. ROADWAY CLEANING SHALL BE CONDUCTED TO CONTROL DUST AND DIRT TRACED FROM THE PROJECT SITE. PAVING SHALL BE COMPLETED AS SOON AS IS PRACTICABLE TO REDUCE THE TIME THAT BARE SURFACES AND SOILS ARE EXPOSED. IN AREAS WHERE CONSTRUCTION IS DELAYED FOR AN EXTENDED PERIOD OF TIME, THE GROUND SHALL BE REVEGETATED TO MINIMIZE THE GENERATION OF DUST. STOCKPILE OF TOPSOIL, AND OTHER STOCKPILE MATERIAL CONTAINING FINE PARTICULATE SHALL BE KEPT COVERED OR KEPT MOIST TO LIMIT WIND EROSION. DURING CONSTRUCTION, ACTIVITIES INVOLVING EARTH MOVING OR TRAVEL ON UNPAVED SURFACES SHALL BE DISCONTINUED WHEN WIND SPEEDS EXCEED 25 MPH OR PREVENT EXCESSIVE GENERATION OF DUST. DUST GENERATED ON THE PROJECT SITE SHALL BE CONTROLLED BY SELECTIVE WATERING OF EXPOSED AREAS, ESPECIALLY DURING CLEARING AND GRADING OPERATIONS. GATHER ALL CONSTRUCTION DEBRIS ON A DAILY BASIS AND PLACE IN A COVERED DUMPSTER OR CONTAINER. REMOVE ALL DIRT, GRAVEL, RUBBISH, REFUSE, AND GREEN WASTE FROM THE SIDEWALK, STREET PAVEMENT, AND STORM DRAIN INLET GRATES ADJACENT TO OR ON THE PROJECT SITE.
