City of Taft Agenda Report
DATE: JANUARY 16, 2024
TO: HONORABLE MAYOR AND COUNCIL MEMBERS
AGENDA MATTER:

UPDATE OF DESIGNATION OF CONFLICT-OF-INTEREST STATEMENT FILERS AND

ASSIGNMENT OF DISCLOSURE CATEGORIES PURSUANT TO THE POLITICAL REFORM ACT OF 1974
SUMMARY STATEMENT:

The Political Reform Act requires every local government agency to review its conflict-of-interest code biennially, as the code tells public officials, governmental employees and consultants what financial interests they must disclose on their Statement of Economic Interests Form 700. The Act also requires the City to enumerate specific City positions, other than those specified in Government Code §87200, which involve making or participating in making decisions which have a reasonable material effect on an economic interest, and to designate for each position the specific types of investments, business positions, interests in real property and sources of income which are reportable based on the scope of the decision-making authority of the position.

Usually, this biennial update takes place later in the year, but due to the reopening of the Community Correctional Facility adding positions there was a need to review and update the policy earlier this year. Staff have now reviewed current positions held within the city, designated the categories of reporting based on the duties of each position and updated the policy. The attached resolution is now being brought forth to the Council for review and adoption.

RECOMMENDED ACTION
Motion to adopt a resolution entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

AGENDA MATTER:

EXTENSION OF TAFT MOTORCYCLE CLUB, INC. LEASE MEMORANDUM OF

UNDERSTANDING
SUMMARY STATEMENT:

The Taft Motorcycle Club has had a lease agreement on the property located at 400 Petroleum Club Road, that houses their clubhouse since at least 1961. The lease on the property was assumed by the City in 2008 after the purchase of the property from Union Pacific Railroad Company. In the 2010 renewal of the lease agreement, the City agreed to reduce the very minimal lease payment to zero, as the Motorcycle Club is a registered 501(c)3 nonprofit organization that puts all of its money raised back into the community in form of scholarships and other community investment.

The 2010 agreement has expired, and the Motorcycle Club has requested to extend the lease for another 10 years. The attached agreement will take the lease into 2034 and continues the requirement of retention of their nonprofit status and continuance of insurance for the property listing the City of Taft as Certificate Holder.

RECOMMENDED ACTION
Motion to approve the 10-year extension of the lease on the property located at 400 Petroleum Club Road to the Taft Motorcycle Club, authorizing the Mayor to sign the agreement, and find that the activity is not a project per the California Environmental Quality Act (CEQA) as set forth in Section 15060(c)(3) and Section 15378 of the CEQA Guidelines.

Conduct the required Affirmatively Furthering Fair Housing (AFFH) analysis for the Taft area and incorporate into the draft housing element.

Conduct the necessary and required public outreach, workshops, surveys, and other input from the general public.

Draft and process the required CEQA documents appropriate for the General Plan Amendment that is the Housing Element Update 2023-2031
Complete the adoption of the General Plan Amendment that approves the completed Housing Element Update 2023-2031 at the Planning Commission and City Council meetings.

Submit the draft Housing Element Update 2023-2031 to HCD for review.

PCE will meet these goals through a comprehensive scope of work that covers five primary tasks, with corresponding sub-tasks as described further in this proposal. Our proposed scope is summarized as follows.

Project Management, Coordination, and Administration will occur throughout the duration of the project, beginning with a kick-off meeting and preparation of a final project task schedule. We recommend holding weekly (or bi-weekly) coordination meetings to keep the project on task and within budget. We will also carry out regular correspondence and communications with the Director, including submittal of monthly invoicing, through the completion of the project.

1. Public Outreach and Engagement is an important component of housing element update processes, as required by State housing law. We recommend supplementing community workshops with stakeholder engagement and an online community survey. This comprehensive outreach and engagement strategy will facilitate a diligent effort toward receiving direction, feedback, and concerns for incorporation in the draft housing element.

2. Housing Element Preparation will comprise a majority of our work. We understand that the Director has completed a strikethrough underlined copy of the draft housing element, with the exception of public outreach and engagement and affirmatively furthering fair housing (AFFH). We expect that most of our work under this task will be to 1) review and verify that the draft is in compliance with current state law and Housing Element guidance, including the California Department of Housing and Community Development’s (HCD) Housing Element Completeness Checklist and 2) conduct the AFFH analysis pursuant to state law.

3. CEQA Review will entail preparing an initial study and negative declaration. We understand that the Director is completing the SB 18 and AB 52 tribal consultation process and that the proposed housing program would not result in land use designation or zoning ordinance changes to meet housing requirements. The initial study/negative declaration will address environmental concerns of the General Plan Amendment to adopt the housing element update.

4. Public Meetings and Housing Element Transmittal will occur as the last “step” of the project and will primarily consist of preparing staff reports and resolutions for the Planning Commission and City Council Hearings. We are also able to assist with the preparation of PowerPoint presentations, if needed, and will be in attendance remotely to present/answer questions at each hearing. After the City Council adoption, the draft element will be submitted to HCD to begin their 90-day review.

consists of a detailed, how-to guide with
step-by-step instructions for building an
ADU in the city of Kerman. The 20-page
How-to Guide introduces residents and
property owners to ADU basics and walks
them through ADU requirements,
designing an ADU, and preparing and
submitting an ADU application. ADU
concepts and requirements are illustrated
with graphics, icons, and checklists for
ease of use and understanding. The Howto Guide also provides an overview of the available Pre-Approved ADU Plans,
answers frequently asked questions, and
offers references and further reading for
additional assistance and information.

The ADU building permit application specifies submittal requirements that are unique to ADUs, provides general information about ADUs, introduces the pre-approved ADU program, and describes the permit processing procedure.

The submittal requirements checklist contained in the application describes each requirement in detail. This takes the guesswork out of the application process for residents and property owners and ensures that current and future City staff are consistent in implementing the City’s process and procedure for permitting ADUs.

The City of Kerman ADU Program is designed for Kerman residents and property owners to utilize as they navigate the process to build an ADU, with the intent to streamline the ADU permit process and reduce design costs.
