This is a Notice of Completion for the work under contract agreement with Bowman Asphalt, Inc. for the road rehabilitation of 10th St. from Xwalk at Bike/Ped Path to Kern St. – STPL – 5193 (044).
The work consisted of grinding 3-inches of existing asphalt pavement and overlay with a 3-inch layer of hot mix asphalt, installation of traffic stripes and pavement markings and signage.
The City Council awarded the Contract to Bowman Asphalt, Inc. in the amount of $286,800.00. The final project construction cost with quantity adjustments is $281,284.19. TO: HONORABLE MAYOR AND COUNCIL MEMBERS
AGENDA MATTER:
LANDSCAPE AND LIGHTING MAINTENANCE DISTRICT NO. 1 ENGINEERS REPORT FOR CONSIDERATION OF PROPOSITION 218 RATE INCREASE
SUMMARY STATEMENT:
The funds from Landscape and Lighting Maintenance District No. 1 are collected by the Kern County Assessor’s Office and disbursed to the City as a special assessment. These assessments, when collected, go to their respective funds to pay for the maintenance and operation of the landscaping, walls, lighting and drainage of the Maintenance District. For many years the District has ran at a deficit and the current deficit balance of the District as of 6/30/2024 is $116,640.28. The City attempted the Proposition 218 process in 2013 and 2020 to raise the assessment to cover the costs of maintaining the District, but unfortunately those ballots did not pass, and therefore has placed the District in a position where the deficit to the account to maintain the District grows each year.
The City Engineer has prepared the attached Engineer’s report for the purpose of cost analysis of the District and per the report the recommended amount needed to maintain the District is $231.00 annually per parcel. The City currently collects $86.00 annually per parcel.
RECOMMENDED ACTION
Motion to receive September 2024 Engineer’s Report for Landscape Maintenance District No. 1 and direct staff to move forward with the Proposition 218 process to increase the annual rate to the needed $231.00 to cover the cost of the District and Find that the activity is not a project per the California Environmental Quality Act (CEQA) as set forth in Section 15060(c)(3) and Section 15378 of the CEQA Guidelines.

EXHIBIT "D"
The 1972 Act permits the establishment of assessment districts by agencies for the purpose of providing certain public improvements, including the acquisition, construction, installation and servicing of landscape improvements and related facilities. The 1972 Act requires that the cost of these improvements be levied according to benefit rather than assessed value:
Section 22573 defines the net amount to be assessed as follows:
"The net amount to be assessed upon lands within an assessment district may be apportioned by any formula or method which fairly distributes the net amount among all assessable lots or parcels in proportion to the estimated benefits to be received by each such lot or parcel from the improvements." Per Article 4 Section 53087.4(a)(1) of the Government Code. The formula used to calculate the amount spread to all parcels within the district for landscaping employs the basis “assessment unit” (AU). The AU is given a value of one (1) for a single family detached residential parcel with public streets and public streetlights.
From this base the remaining parcels are related according to their equivalent benefit within the district.
The assessment formula is shown on Exhibit “B”.
PROPOSITION 218 BENEFIT ANALYSIS
Special Benefit
The continuing maintenance of landscaped areas in the district provides direct benefits to the properties within each respective Tract and provides a more pleasant environment to live, drive, walk, and work. The main function of these landscape improvements and related elements is to serve as a visually pleasing enhancement for the benefit of the adjoining developments for which the upgrades were constructed. These landscape improvements are an essential part of the physical environment of parcels in the district, and if not properly maintained these parcels would be aesthetically affected. As a result, the maintenance of these landscape improvements is a particular and distinct benefit to the properties located in a district.
The lighting and landscape improvements are local improvements that were installed in connection with the development of properties in each respective Tract or are improvements that would otherwise be shared by and required for the future development of properties in these Tracts. The maintenance of these improvements and the level of conservation provided, only has a direct and particular impact on those properties (special benefit) and such maintenance beyond that which is required to ensure the safety and protection of the general public and property in general, has no identifiable benefit to the public at large or properties outside each respective Tract.
General Benefit
There is no general benefit provided by the maintenance of the improvements provided in the LLMD #1. All expenses used to calculate the LLMD #1 assessment support the provision of a specific benefit to the parcels paying the assessment and no expenses included provide a general benefit to properties outside the assessment district.
