FROM: ASHTEY WHITMORE, GENERAL SERVICES DIRECTOR
FEBRUARY 2, 2022
SUBJECT: CITY OF TEHACHAPI REDISTRICTING PUBTIC HEARING 2 As the Council is aware, the City of hired USGeoCoder in November to begin the process of redistricting for the City of Tehachapi. The Election Code requires that every ten years, or sooner if the initial transition was made prior to new census data, local governments use new census data to redraw their district lines to reflect how local populations have changed. On January 18th the City Council heard the first of 4 public hearings and was presented with USGeoCoders initial assessment on the City's current district boundaries. At that time the Council asked USGeoCoder to provide them with a newly drawn map focusing on compactness. Attached is the newly drawn map, as well as district statistics.

Elections Code 21602(aX3) requires that the City's redistricting be completed no later than 205 days before the next election. Since the next election is November 2,2022, redistricting must be completed by April 10, 2022.

This is the second hearing in a series of 4 public hearings.

RE: Proposed Map for 2020 cycle city council districts
Bill for services thus far rendered
Dear Honorable Council Members, Clerk and Manager:

Attached as Exhibit 1 is my proposed map of city districts for the 2020 to 2030 election cycle. Exhibit 2 is the excel spreadsheet of the deviation of population by district statistics. Considerations made and strategies used to develop the districts follow.

First, I followed the principles laid out in USgeocoder’s Guide to California Redistricting of Cities and Counties. One of the legal requirements is to not favor incumbents. There is no principle or legal requirement to disfavor recumbents. My approach regarding the starting point for re-districting and retaining or building districts which would pit incumbents against each other are very closely aligned. I assume that the will of the people was expressed in the district creations of only a few years ago and I assume the incumbents are incumbents because they won fair and square. I also noted, and expressed at the January 18, 2022 meeting, that the 2010 cycle demographer did a splendid job of making balanced districts. Thus, I tried to preserve the strategy of the previous demographer/cartographer and also not act with any strategy that would tend to disfavor incumbents remaining in their current districts. I mentioned this strategy in my remarks to the council on January 18, 2022.

There were no questions or objections from the citizens in attendance.

Second, I explored the population data for the current districts as adjusted by the state and also explored the aggregate voting age population data and distribution of race and ethnicity by district for the city of Tehachapi provided in the DRA 2020 toolkit. Basically, District 5 represented currently by the Honorable Susan Wiggins, is a

To: Tehachapi City Council Page 2 of 7
Re: Proposed 2020 Cycle City District Maps January 28, 2022 majority minority district when blacks and Hispanics are lumped together into the “minority count”. Last election, the council was elected at large, so whether Ms.

Wiggins would have won had the minorities voted as a unified block is a question that cannot be definitively answered without knowing how they marked their ballots. That is private information. An alternative is to survey the voters in the district as to how they voted. I do not have access to any such survey and have not been informed that one has been done. Moreover, as a demographer, I should avoid partisanship and be neutral, thus I should not create such surveys, advertise a desire to have them or work at creating them. That said, should a party produce such data and want it considered, I would send their request to the City Council so as to inform the public of the existence of such data and ask the city council in open session how they would want me regard such data in drawing their maps, and in the workshop, work with that data to assist citizens who want help drawing maps using such data. No such request for use of such data, should any actually even exist, was made at the meeting on January 18, 2022.

Using Democrat and Republican registration tallies provided by DRA 2020, all five districts have a range of Republican registration percentage from 59% in district 1 to 67% in districts 2, 3, and 5. Assuming that minorities have a bias favoring the Democrat party, one could assume that either the minority registration was low, or they don’t follow the stereotype of favoring the Democrat party. This is a shaky stereotype given that Mr. Trump did fairly well among both black and Hispanic voters in 2016. That 65% of the voting age population in district 5 is minority (42% Hispanic and 18% Black) but 67% are Republican, the stereotype is not supported in district 5.

As a demographer, my take on this data is that there is insufficient evidence for me to assume ethnic or racial groups, and in particular the blacks and Hispanics in Tehachapi, vote in a unified matter (vote as a block) so as to only favor a candidate of their ethnicity or race if given a chance to vote for such a candidate. An alternative hypothesis is that there is a high percentage of voting age Hispanics that are not eligible to vote by virtue of not having citizenship. But, since the Census Bureau was prevented by court order from collecting such data, I do not have data, from the Census, to test that hypothesis. Nor do I have data at hand that indicates the whites in any district of the city vote as a unified racial block. I have not sought such evidence in a desire to remain a neutral non-partisan and unbiased demographer. Should such evidence be presented to me by a party, I shall present it to the City Council and react in the same manner as above mentioned if presented with minority voting data. In short, District 5 is a minority “opportunity district” where, if the minority were to coalesce into a block, they would have a good chance of seating a minority candidate on the council. As such, I, as a demographer, do not have to build an opportunity

To: Tehachapi City Council Page 3 of 7
Re: Proposed 2020 Cycle City District Maps January 28, 2022 district. Nor do I have to dismantle one. My duty is to carry out the will of the people and not make unnecessary changes to districts the people chose to create a few short years ago. I should only make balanced, compact, contiguous districts to the extent such are practicable given the geography and demography of the city, its census blocks and block groups, and population distribution. This is what I have endeavored to do in creating my proposed map for the city council districts in the 2020-2030 elections cycles.

Contiguous districts connect with each other with shared linear borders, not just a point, and are not islands without connection to the rest of the city. Tehachapi is not a contiguous city. The two census blocks to the west on which the prison and one sparsely populated census block sits, are an island to the west of the city. The closest point of the rest of the city to them is the westward most extension of District 5. Thus, under the rules of district construction, the prison and its adjacent census block must stay with District 5. Because District 5 is a non-contiguous district (two parts separated by space) it is impossible to create a map of Tehachapi that will pass the “contiguous test”. Hence, that test can be ignored as a criteria for passage of the plan so long as no other non-contiguous district is created within the plan.

The most compact shape is a circle. All borders of a circle are equidistant from its center. Circles don’t mix together with linear joins but join at points, leaving gaps between them. Circles, though compact, can never be contiguous. Hexagons, with the same length for each side are the only compact shapes that can fit 100% contiguously to each other. If humans could occupy space like bees, all districts would be hexagons and the same size. Humans distribute themselves according to social patterns formalized in zoning regulations and configured in accord with the ease of transportation and the efficient use of resources. Thus, the geographic shapes of their connections that form communities tend to be highly irregular in shape. The goal for compactness in human districts of political representation is to get the districts as compact as practicable given the irregular shapes of the city and the irregularities of population distribution created by history of settlement, transportation routes, access to resources, and the vagaries of zoning.

Tehachapi’s District 5, with an island to the west, cannot pass any mathematical test for compactness. Tehachapi’s District 2 has a long tail running eastwardly from Bailey Ave to Tehachapi Willow Springs Road. Any district containing such a tail won’t pass the mathematical tests for compactness such as those shown in Figure 1. This is because the ends of the head and tail are so much further away from the center than the sides. The other three districts, do pass these popular mathematical tests of compactness. Figure 1, on the top of the next page shows the two popular statistical

Re: Proposed 2020 Cycle City District Maps January 28, 2022 tests for compactness as run by the DRA2020 computer algorithms. For all these tests, the bigger the score the better. The Reock measures how dispersed the shapes are.

The Polsby-Popper measures how indented the districts are. The KIWYSI is the “know it when you see it” approach that has been popularized recently in the political science literature where the algorithm tries to mimic relying on non-mathematical human visual cues and processing. The rule of thumb the California Legislature prescribes is that compact districts don’t connect two or more areas by bypassing areas between them. By that measure, all the districts except District 5 are compact.

FIGURE 1: Compactness Statistics Created by the DRA2020 computer algorithms.

At the January 18, 2022 meeting, Mayor Smith stated, that given a choice between compactness and as close to zero deviation from the mean for the distribution of the population between the districts, he would prefer the closest to one man one vote you can get in the closest most to compact way you can manage (paraphrased). The rest of the council voiced similar sentiments and Mr. Davies and Ms.

Scrivner stressed that fairness is best met by the one man one vote goal. I believe I have gotten as close to that goal as the shape of the census blocks will allow in my plan. In the process, some blocks have been traded from one district to another but the overall shape of the districts is not much varied from the existing districts. The overall population deviation from the mean is 1.82%.

Exhibit 3 is a view of the map as rated by population classification used commonly in political “bookmaking” (in the gambling, not publishing sense of bookmaking) for election results. A population is “solid one race” if more than 3/4 of the population is that race. It is mostly one race if that race is over 50% of the population. DRA2020 hover help on when looking at Exhibit 3 over the web states that Hispanic/White is when both are over 30% and together, they make up 75% of the population. District 2 is 67% white. District 1 is 55% white. District 5 is 34.6% white.

Re: Proposed 2020 Cycle City District Maps January 28, 2022 Demographers, political pundits, judges, and party activists vary on when the definition of “potential opportunity district” for election of a minority member applies, but there is a consensus that somewhere between 35% to 45% minority is enough to consider the district a “potential opportunity district” or an “opportunity district” for the purposes to making a challenge to the makeup of districts under the Federal Voting Rights Act. Using these definition ranges, District 5 is definitely a “coalition opportunity district of Black and Hispanic”. District 1 is a “coalition United Minority Opportunity District”. District 2 is not a potential opportunity district. The others may or may not be depending on where one stands on the continuum of the definition. At any rate, the existence of these “minority opportunity districts” both as they were drawn for the last election and for the upcoming elections means that there is no point trying to move blocks one way or the other in order to boost minority vote in any one district since, it would very difficult not reduce minority vote for the opportunity district it would be likely to come from. This alone makes the idea of re-drawing to increase minority representation in a district above what they already are by searching for high minority population census blocks to gather into a single district a hard row to hoe, if not actually an exercise in futility, in Tehachapi.

Under the Federal Voting Rights Act, there are additional thresholds to meet before the attempt to move high minority population census blocks into a district so as to increase minority opportunity to elect a minority representative. After establishing there is a “potential opportunity district”, the next step is to determine that enough of the minority actually votes (as opposed to are simply registered to vote) such that the actual votes would have a potential of electing a minority candidate. It is up to the advocate for that position, not the demographer, to provide that voting history evidence to the demographer. If that evidence were to be presented, the next step would be to show that voting occurs in racial and/or ethnic blocks, i.e. the minority mostly votes for their candidate and the whites mostly vote for the white candidate.

Again, it is the duty of the advocate, not the demographer, to gather this information, should it exist. The final test before one can insist on drawing an “opportunity district” is to show that areas that house the minority historically and in the present receive less city services, or inferior city services. This is the crucial, “the minority is underserved as a result of the current make up of districts” evidence that must be present to meet the “totality of the circumstances” showing that minority opportunity districts should be drawn. Again, it would be the province of the advocate(s) for the drawing of minority opportunity districts to gather such evidence, not the demographer. This information is presented to assist any advocate in understanding the sorts of evidence I would need to receive in order to assist the advocate in presenting a map that would assist in his or her ultimate goal. It also is presented to

Re: Proposed 2020 Cycle City District Maps January 28, 2022 help an advocate decide whether the effort would likely to be successful. If his or her decision is yes, then it would be my obligation during the upcoming mapping workshop to give the same best effort assistance as I’ve used to develop the maps I’m submitting today. Once the advocate’s map was to be drawn (if it turns out it can be drawn), it would be for the people to comment and debate and the city council to ultimately decide which map to adopt.

Of real note on Exhibit 3 is the table in the upper left hand corner which shows the deviation from the mean by actual numbers of people. The deviation, measured in actual people, is very small.

The California Elections codes for cities also states districts should, to the extent practicable, be bordered by natural barriers or streets and keep communities of interest together. Communities of interest are vaguely defined. Tehachapi’s population is pretty homogenous as seen in Exhibit 2. I have not been informed of any communities of interest by city staff. It appears to me that the City of Tehachapi is its own homogenous community of interest. Tehachapi Blvd is an artificial barrier in that one must carefully watch for cars if trying to cross it. It also is a landmark street, being a major thoroughfare through the business sections of town. It makes a logical border between districts 1 and 2 to the extent it can while maintaining consistency with the existing city districts and the new proposed districts.

I reviewed the active housing construction permit numbers by district. There are not enough to add weight to the idea of trying to deviate districts 1 and 5 to lower populations than the rest of the city districts. The section of district 5 already being “streeted” for new housing would add weight, but it is entirely unpredictable when any housing construction will actually start there so it is not advisable to attempt to move census blocks from District 5 into the other districts based on the potential for development. District mapping must be done according to the results of the Census, not grandiose fantasies of a demographer’s ability to predict the future.

Exhibit 4 is a list of Census Blocks within each district of my proposed map.

Exhibits 5 and 6 are maps focused on the census blocks that have changed districts. The number hand written in clocks that have changed districts represent the district the census block came from.

I respectfully submit my proposed map and exhibits for the Council’s consideration and further directions. Readers are asked to present all questions and comments in writing to Ashley Whitmore for distribution to the city council and if the city council deems appropriate, they will forward them to me. Because this is a public process, oral comments should be made at open sessions of City Council meetings, not

Office Memorandum : CITY OF TEHACHAPI

TO : City Council, City Manager DATE: January 21, 2022
FROM : Thomas F. Schroeter, City Attorney
SUBJECT: League of California Cities City Attorney’s Spring Conference The League of California Cities City Attorney’s Spring Conference will be held on May 4-6, 2022 in Carlsbad. The registration fee is $625.00 and a two-night stay in the hotel is $458.00. During the conference, the city attorney's department of the League has three days of presentations devoted solely to legal issues facing cities and updates on cases recently decided. This is a critical learning session for city attorneys.

My other city is being asked to contribute equally to the cost for the registration fee and one night's lodging. The City's share of the expenses would be $541.50. I would request permission to represent the City of Tehachapi at the City Attorney’s Spring League Conference and for the City to pay up to $541.50 for my expenses.
