DEPARTMENT

CITY MANAGE

TO HONORABLE MAYOR SMITH AND COUNCIL MEMBERS
FROM: ASHLEY WHITMORE, GENERAL SERVICES DIRECTOR
DATE: MARCH t7,2022
SUBJECT: CITY OF TEHACHAPI REDISTRICT!NG PUBLIC HEARING 4

BACKGROUND
As the Council is aware, the City hired USGeoCoder in November to begin the process of redistricting for the City of Tehachapi. The Elections Code requires that every ten years, or sooner if the initial transition was made prior to new census data, local governments use new census data to redraw their district lines to reflect how local populations have changed. On January 18, FebruaryT,and February I0,2022, the City Council held the first three public hearings to receive comments regarding the composition of newly drawn City Council district maps.

DRAFT MAPS
After hearingfrom the City Council and public, USGeoCoder prepared "Map 1" based on the comments received at the hearings. An additional map was prepared by myself, "Map 2", geared more towards an understanding of the distinct neighborhoods throughout the community. Both "Map 1" and "Map 2" keep the currently seated councilmembers in their district seats. A report has been provided by Usgeocoder that outlines the workshop that took place on February 10th. Additionally, you will find an analysis of "Map 2" from Usgeocoder and justification for the Map, as provided by myself. Justification for "Map 1" was provided during the February 7, 2022, City Council meeting.

The maps were made available to the public as of Febru ary 28,2022 at the following locations:
. City Hall, 115 S Robinson Street
. City Hall Annex, LL7 S Robinson Street
o Tehachapi Police Department,22O W C Street
o Tehachapi Visitors Center, 200 W Tehachapi Blvd
. City Website: https://www.liveuptehachapi.com/467lRedistrictins This is the fourth public hearing scheduled for the City Council to receive public comments on the proposed district maps before Council takes final action on the map establishing new voting districts. A Notice of Public Hearing was posted and published in the Tehachapi News on February 23,2022.

RE: Report on Workshop and Workshop Follow-up
Dear Honorable Council Members, Clerk and Manager:

I presented a workshop as scheduled on February 07,2022. Only a city staff member and a local newspaper reporter showed up. I demonstrated the DRA 2O2O website based re-districting program to the attendees in the form of giving a tutorial.

Attendees demonstrated competent grasp of the material and process. I answered the reporter's questions.

I did not receive any feed back that anyone would submit a map to propose to the city council till February 23 when I engaged in oral communications with Ms. Whitmore via phone. At that time, she stated she wanted to present a map she had drawn.

The next day, I followed up with an email to Ms. Whitmore, in which I explained my duty as the city's consultant to help her with her map and assist her with preparing a presentation by her to the city council. Ms. Whitmore's written response is attached as Exhibit 1. Her map is Exhibit 2, population statistics for her map are Exhibit 3 and the assignment of census blocks for her map is Exhibit 4.

Ms. Whitmore's comment that streets make better demarcations of districts than backyard fences is accurate and consistent with the statements in the Fair Maps Act that district borders should be easily recognizable. My map does have an area that does not have streets marking the borders between districts District 5 where it meets with District 3 west of Pinion St. This is the same border as is on the city's existing districts. Although this border demarcates Census blocks, and thus is assumed to be a recognizable border; roads are more recognizable borders. All Mrs. Whitmore's map's district borders are bounded by city borders and roads.

Most of Ms. Whitmore's arguments for reshaping the districts boil down to the idea that people she sees as having a unifying interest unique to their geography or the

size of their communities within the city are better served if they are all within the same district. This is often promoted in theory but in practice it does not work.

Typically, representatives in legislative roles unless they are motivated by prejudice or party loyalties, strive to create coalitions to get things done. [t is also easier to create coalitions if multiple representatives share communities of interest since it creates a motive for both representatives to advocate for the community they share.

Mrs. Whitmore's comment that advocacy for the two schools would be better served by having them in the same city council district falls prey to the same reality as just mentioned and ignores the fact that school advocacy and grants are managed at the school district level which is many times larger than the City of Tehachapi. The community of interest that the Tehachapi school district encompasses is the communiff within its borders. All members of the city and its council, as residents of the school district, are within the same community of interest with respect to the school district. Traffic patterns to and from the school are the concern of the people in districts surrounding the schools, which includes at least four districts under either plan.

Mrs. Whitmore's comments that the small businesses can have a stronger voice and can compete better against the larger businesses in Capital Hills if the smaller businesses are fit into a single district without Capital Hilts fatls prey to a sad reality of US politics. Peoples' votes are restricted by their locations to the districts they are in. Businesses don't vote by marking a ballot. They vote by spending money on candidates and incumbents. Money can travel anywhere. Money is the mother's milk of political campaigns which are the engines of bids for office. Attempting to limit the influence of big business by creating districts that separate them from small businesses is an exercise in futility.

Mrs. Whitmore and I agree that both our maps place the communities facing the brunt of impact from the airport into district 1 and 2.

As a consultant, I should give deference to the maps that, in a prior vote, expressed the will of the people. Absent information provided by staff and citizens that would indicate I should do otherwise; I strive to preserve the will expressed by the maps they voted to have by minimizing changes necessitated by redistricting. This helps to reduce voter confusion by keeping voters within districts they already know.

Mrs. Whitmore, as a resident and city servant is privy to local history and first hand experience regarding how things work or could work better in Tehachapi. Also, she has no obligation to defer to previous maps. I commend her for presenting a map that has a smaller deviation from the mean than mine.

There are many ways of measuring compactness in addition to the two she presents in her letter, such as deviation of mean of distance of borders from the center which I favor, and the "I know it when I see it" researched method discussed on the DRA2020 website. The more tests applied to the question of compactness, the more the maps appear equally compact.

Mrs. Whitmore's map's districts 3 4 and 5 look similar to the districts in the 2Ol7 Green map which was rejected in favor of the districts in use today.

The U.S. Supreme Court has stated that maps on the local and state level can deviate some in order to accommodate rational goals of state and local government.

Deviations up to lO%in state representative districts are not presumed prima facie invalid. California has expressed a "rational" interest in promoting the fair representation and efficient delivery of services as expressed in the California Fair Maps Act, so deviations from a zero deviation from the mean to further this policy goal are acceptable under California law. The decision concerning what a community of interest is and what results in more fair or efficient representation and delivery of services is the purview of the City Council.

As demographic and historical guidance regarding the definition and use of "community of interest" I offer a few observations:

Community of Interest in the Federal law is not defined by statute but is recognized by the courts as separate government entities that share delivery of service(s) to their combined populations. The examples of Community of lnterest as defined by the California Map Act, such as rural community v urban community, zoning differences, commercial or industrial communities, areas of similar employment, and the like have been disapproved by Federal courts when they result in one man one vote rule being diminished in effect. No court has found cause to disqualify a local government districting map for local government containing deviation of district population count of less than2% from the mean. Mrs. Whitmore's map does approach closer to the ideal of zero deviation from the mean.

Nationally, on the local levels, creating city districts mirroring communities of interest traditionally has been used to help immigrant communities achieve representation from one of their own. Historically, this has resulted in more rapid acceptance of their culturally distinct behaviors and preservation of their community traditions. For instance, East Asians used to be prosecuted for child and elder abuse for practicing effective home remedies for reducing fevers and tissue congestion and improving circulation that left welts on their children's or elder's skin. Not until their Tehachapi City Council

representatives educated local police forces and education providers did this criminalization stop. Representation creates voice.

Neither Mrs. Whitmore's nor my map attempt to identify communities of interest by cultural identity. There is not a large enough neighborhood concentration of any particular cultural identity to make this feasible.

The Fair Maps Act presents a goal of creating fair districts based upon fairness and efficiency of delivery of city services. Should the city council feel the consultant's map presents more efficiency or fairness, then the question becomes, "Does that weigh more than the Iesser deviation found in Mrs. Whitmore's map?" If the community of interest question is mooted, the question becomes a choice between two policies that have been expressed by the courts:

Policy 1: Better maps are those with districts having the least deviation from the mean. The courts in many decisions have stated this is a laudable goal, but should not result in a race to the least deviation at the expense of other re-districting considerations, and is (at least minimally) met when the deviations created are less than the upper limit tolerated by the Federal courts, State courts and legislatures.

Policy 2: Better maps reduce confusion for voters by not drawing them out of the district they are already in. This policy also has found favor in many states as summarized at paragraph 73 of the Supreme Court of Wisconsin's opinion in Johnson v. Wisconsin Elections Commission2O2l WI 87, 399 Wis. 2d623,967 N.W.2d 469.

Another way to address the interplay of these policies to the choice between Map 1 and Map 2 is: Citizens have developed relationships with their current representatives as their districts are currently drawn. Does the disruption of those relationships by a radically different arrangement of districts similar to a previously rejected D&p, iustify the slightly higher deviation from the mean in representation presented in USgeocoder's map?
I respectfully present USgeocoder's map (Exhibit 5, "Map 1") and Mrs. Whitmore's map (Exhibit 2, "Map 2") for public debate and the City Council's consideration.

Respectfully submitted,

EXHIBIT 1
Whitmore Written Response
Map 2 Justification:

Districts
District 1: The reorganization of this district highlights the ability to keep the Downtown Tehachapi residential community with one voice. Previously, portions of the homes surrounding Central Park were on the fringes of District 2, by placing them together in District 1, all the residential units share the commonality of being located Downtown. Any representatives elected in that District will share the same concerns on the residential aspect as well, assisting in the ability to secure funding for Downtown city streets, assist in preparingforthe impact of special events, which are almost exclusively hosted in this District.

From a commercial standpoint, the representation ensures a voice for the small business owner, of which Downtown is exclusively comprised of. Keeping the independent small business aligned with their councilmember with issues, challenges and opportunities for small business will prove to be more beneficial. Previously this District represented both the small downtown businesses and much larger corporate entities in Capital Hills, where there was little commonality between business interests.

District 2: The reorganization of this District centers around the residential communities which represent mostly five-distinct dense communities of Orchard Glen near Tehachapi High School, Mountain Aire Estates, Dennison Mobile Estates, Ashe Village and Arabian Estates. Allthese neighborhoods share Dennison Road as their major route, but none of them are contiguous to one another, creating five separate neighborhoods which have unique needs and concerns. A setup like this allows a representative to study an issue specific to the neighborhood in which it is presented and allows for infrastructure needs along Dennison Road to be prioritized for residential benefit.

From a commercial standpoint, this map aligns all the highway commerce under one representative.

East Tehachapi Boulevard is comprised of three travel stops and hotel catering to the traveling public.

This aligns with the next exit from Highway 58 where another series of businesses catering to the traveling public are located including a pair of hotels, service stations, and restaurants. This assists in the implementation of freeway-specific transportation projects and advocacy for the City of Tehachapi. ln addition, this area includes the Adventist Health Tehachapi Valley Hospital.

High Speed Rail lmpact: The City of Tehachapi has a documented history in dealing with the California High Speed Rail Authority. Most recently, the authority had proposed to not mitigate the impact of the proposed rail line, despite it negatively impacting a neighborhood in this district. After an extensive public affairs campaign led by the City, the rail authority made good on their previous promises to include mitigation measures in their proposed route through the city. As currently drawn, this district will encompass the entire proposed rail line in one district as the route runs from the northern edge of the city limits and arches around the edge of this district. Should the rail line ever be built, containing it to one Council district will make communication, mitigation, and advocacy simpler and more beneficial to residents.

District 3: Previously this district surrounded an unincorporated County island, the Tucker Road commercial corridor and a series of single-family neighborhoods north of Cherry Lane but cut off some of the neighborhoods that bordered District 4, including a portion of Oakwood Street and Silver Oak Drive which isolated that neighborhood away from any other neighborhood represented by District 3.

By adding those streets to District 4, these neighborhoods now share a representative with their neighbors.

By using the geographical lines of Cherry Lane, Tucker and Curry to help shape this district, the residential neighborhoods that share borders are also sharing a representative. Previously, Alta Estates was part of the 5th District, however since that map was created, the northern half of that housing tract was completely developed, and construction is underway in the southern portion. This new district line keeps not only that neighborhood whole, but also the homes that border it when before they were carved into District 4. The dividing line for a district should have more geographical importance than a backyard or a fence line.

Although there is no voting public, the non-contiguous exception to this District is the California Correction lnstitution which is part of the city but located in Cummings Valley. This map adds CCI to District 3 removing it from District 5.

District 4: This proposed map expands the size of the residentially dense District 4 but as previously mentioned keeps several neighborhoods together along with similar housing types. This District captures several neighborhoods at the edge of Downtown, no longer breaks up streets like Oakwood and Silver Oak, and the multifamily residences on Aspen Court along with the multifamily residences located at the southern end ofTucker Road.

From a commercial standpoint, this district will now include the Tucker Road commercial corridor which is comprised of most of the City's chain stores, restaurants and retail offerings.

District 5: Previously crossing several major roads, District 5 is now provided with better geographical lines using Curry, Valley Boulevard and Dennison Road to encompass dense residential neighborhoods.

Unlike the neighborhoods in District 2, these neighborhoods are unique but are connected with common residential roads.

This District now includes two major education centers, Tompkins Elementary and Tehachapi High School, this allows for a better understanding of challenges facing these neighborhoods when it comes to traffic and other impact of the school presence since they are both located within a mile of one another and share two roads-soon to be three with the completion of Pinion extension. These two major schools are the catalyst for grant opportunities and safe route to school infrastructure and will benefit from a single representative.

Considerations
Contiguous Districts: The proposed map meets the requirement for contiguous districts, excluding district 3, which would include the prison, as it is the closest geographical district to the prison.

Geographic tntegrity: The proposed map brings several neighborhoods of community interest together by district, whereas many were split in the previous map.

Boundaries: The proposed map has easily identifiable boundaries which follow many of the main corridors throughout the City. Although you will see what look like drastic changes to the boundaries of some districts, most of the newly included or removed district areas are eithersparsely populated orare now encompassed into a district of community interest, as stated above in the district justification.

Compactness: During a recent Council meeting the Council requested that the maps focus on the compactness of the districts. Below is a comparison of Map 1 and Map 2 compactness tests. As stated during previous council meetings, the biggerthe score the better. Although the numbers are close in both maps, Map 2 has an overall better compactness rating than Map 1.

70 Population Deviation: ln addition to compactness, the Council also requested that the districts be as close to "one man one vote" as possible. When it comes to population deviation, the smaller the deviation, the better. Previously, the population deviation between all districts was 4.52%. The population deviation of the proposed map takes that number down to O.75o/o,3.77o/o less than the previous maps. This is also 1.07% less than the deviation proposed in Map 1, which falls at 1.82o/o.

Current City Council Seats: The proposed map does not remove any city council member from their current district seat.

Map l lssues:

Districts
District 1: The unique neighborhoods of Downtown Tehachapi are separated by the intrusion of District

2. Unfortunately, this creates a disconnect between residential communities that share in challenges, the impact of special events for example are felt in the homes located Downtown but not an issue for the other side of District 2. Should a representative not live in a Downtown neighborhood as allowed by this map, they would be disconnected from the concerns of those living in that very dense and unique area.
ln addition, the businesses in District 1 are both the small downtown business and some of the large corporate interests in Capital Hills. lt would be best, for the sake of advocacy, to keep those two business entities separated so a representative can focus on small business advocacy and assistance when requests.

High Speed Rail: The City of Tehachapi has a documented history in dealing with the California High Speed Rail Authority. Most recently, the authority had proposed to not mitigate the impact of the proposed rail line, despite it negatively impacting a neighborhood in this district. After an extensive public affairs campaign led by the City, the rail authority made good on their previous promises to include mitigation measures in their proposed route through the city. As currently drawn, the proposed rail line cuts through two City council districts, this should be contained into one for the sake of advocacy and keeping the High-Speed Rail Authority accountable. Should the rail line ever be built, containing it to one Council district will make communication, mitigation, and advocacy simpler and more beneficial to residents.

District 2: As mentioned there is no consistency between the residential neighborhoods as they do not share a major geographical feature or roadway and each face a different reality when it comes to traffic, roads or other issues. This District divides Downtown when the lifestyle and residential world should be shared by one representative.

Other proposals advocate for including all the residential neighborhoods fed off Dennison Road into this district which makes more sense geographically.

From a commercial standpoint, the two major commercial sectors for the traveling public at East Tehachapi Blvd. and Mill Street are divided. lt would be best if both areas had the same representative in order to advocate for transportation projects and funding and address any issues brought on by the businesses that market to the traveling public.

As previously mentioned, this District divides the impact of the proposed High Speed Rail line.

District 3: These district boundaries isolate portions of neighborhoods to the north of Valley Boulevard including cutting off the northern end of Oakwood Court and Silver Oak ensuring that these homes do not share the same representatives as their neighbors. ln addition, due to the makeup of the council when these maps were adopted, in order to ensure the elected council at the time remained in their seats, as was allowed by law, this District captured a portion bordering Alta Estates. With that neighborhood's northern half now developed, and future development underway in the southern half, it makes more sense to encompass this entire neighborhood into the same district, so backyards are no longer the dividing line, and the common interest of the neighborhood is now grouped together. Since the Alta Estates neighborhood will soon be physically connected through an extension of Pinon, combining it into District 3 and starting District 5 at Curry is more geographically pleasing and provides better representation by not cutting off portions of neighborhoods with different representatives as this map currently does.

District 4: As mentioned portions of Oakwood are cut off and in District 3, that same goes for the homes located in the Silver Oak housing development. This current map isolates them both geographically since they back up to open space, but also separates them from their nearest residential neighbors.

This District is also very small and dense and isn't capturing allthe nearby homes despite its density.

District 5: As mentioned this District was previously impacted by the former council makeup in 201-7 when the districts were first formed. lt reaches too far into Alta Estates which needs to be one district but cannot be a part of District 5 due to population size and new development over the last few years.

DATE:

HONORABLE MAYOR SMITH AND COUNCIL MEMBERS
JOHN (JAY) SCHLOSSER, p.E., DEVELOPMENT SERVTCES DIRECTOR MARCH L5,2O22
SUBJECT: ACTIVE TRANSPORTATION PROGRAM CYCLE 6
PROGRAM DESCRIPTION:

The Active Transportation Program, or ATP for short, created in 2013 by Senate Bill 99 and Assembly Bill 101, encourages increased use of active modes of transportation, such as biking and walking. The City of Tehachapi's success in winning these competitive grants for ATP funds is evident in the following projects:
1,. Cycle 1- City was awarded 2 grants totaling 52,L42,OOO a. Valley Boulevard Bike Path Phase ll
b. SRTS Gap Closure Project

2. Cycle 2 - City was awarded 1 grant valued at 52,042,000 a. Rail Corridor Pedestrian Safety lmprovement Project

3. Cycle 3 - City was awarded 1 grant valued at 5462,000 a. Cherry Lane Southside Sidewalk lmprovements

4. Cycle 4 - City was awarded 1 grant valued at S1,495,000 a. SRTS Snyder Avenue Gap Closure Project

5. Cycle 5 - City was awarded 1 grant valued at 52,436,640 a. Dennison Road Bicycle/Pedestrian Corridor lmprovement Project The ATP Cycle 5 application was released last week. The main goals of ATP are to increase the proportion of trips accomplished by biking and walking as wellas the safety and mobility on non-motorized users. One of the features most advantageous to the City is that communities qualifying as 'disadvantaged' can receive 100% grant funds with no matching funds required. The City of Tehachapi qualifies as 'disadvantaged'. With the release of the Cycle 5 ATP call for projects, City Staff is seeking public input on locations in need of improvements that benefit active transportation modes (i.e., walking, biking)within the City limits.

The City will be holding a public workshop to discuss potential project components and locations on March 30th at 5:00 pm at the Tehachapi Police Department Community Room. ldeas for project can also be emailed to City Staff at projects@tehacha picityha ll.com.
