DEPARTMENT
CITY
TO: HONORABLE MAYOR SMITH AND COUNC!L MEMBERS
FROM: JAY SCHTOSSER, DEVELOPMENT SERVICES DTRECTOR
DATE: APRTL L3,2022
SUBJECT: ANNEXATION NO. 1 !NTO COMMUNIw FACILITIES DISTRICT NO.2017-1(PUBLIC SERVICESI BACKGROUND:
The annexation territory, Tract Map No. 7353 (the "Project") proposed for annexation is owned by Comprehend & Copy Nature, LLC and is located north of Highland Road, east of Tucker Road, and west of South Curry Street.
The Project includes the development of two-hundred and thirty-eight (238) single family residential lots and four (4) common area lots. The boundary of the annexation includes the area within assessor's parcel numbers 477-OLL-L4 and 417-011-15 as depicted on Exhibit A.
As part of the annexation process, the City contracted with Willdan Financial Services for the preparation of the necessary resolutions and balloting procedures for the annexation. Willdan Financial Services completed a comprehensive special tax analysis that took into account the types of properties proposed for inclusion in the CFD currently, and in the future through annexations, and the City's maintenance budgets to arrive at the proposed levels of special tax amounts on the various land uses and created CFD 2OL7-1- in 2OL7 .
Resolution No. 15-22 was adopted on March 7, 2022, and set the public hearing for April 18, 2022. The adoption of the attached resolutions annex the territory into CFD 2077-7, submits the levy of the special tax to the qualified electors, and declares the results of the special election. This is the final step in the annexation process; and since the conditions of approval for the development require it to annex into CFD 2077-7 and Comprehend & Copy Nature, LLC owns the parcel, a majority protest of the annexation is not anticipated.
Once the annexation is complete, the property owner of the Project will be required to pay annual special taxes for CFD 2OL7-1, beginning in Fiscal Year 2022/2023 as itemized on their property tax bill in accordance with the rate set forth in the Rate and Method of Apportionment of Special Tax.
By Resolution No. 22-L7, the City Council established Community Facilities District No. 2017-1 (Public Services) ("CFD 2OL7-L"1, a Mello-Roos Community Facilities District with the intention that future development within the Cityof Tehachapi (the "City'')would annex intothis district. The specialtaxes collected from the property owners within the district are to be used for the funding of police protection services, street maintenance, and landscaping in the Tehachapi area.
The estimated annual revenue received by the City for the CFD 2OL7-t Fund once fully developed will be approximately 5262,140.30 for the Project which is based on the maximum specia! tax rates for Fiscal Year 2O2L|2O22 for Single Family Residential Properties (Detached Residential). CFD 2OL7-L includes an annual CPI adjustment. The process for the annexation is funded by the developer and no General Fund monies are used for this effort.
PROPOSAL:
To hold the public hearing, declare the results of the election, and adopt the resolutions to annex the Project into Community Facilities District No. 2017-1 (Public Services) to pay for the impact of the development on City services pertaining to landscaping, street maintenance, and police services.
RECOMMENDATION:
Staff recommends that the City Council open the public hearing for the purpose of receiving public testimony and property owner protests regarding the annexation to the CFD for public services. Once the public hearing has been closed, staff recommends that the City Council adopt the two resolutions.
It is recommended that the City Council:
L. Open the public hearing and receive public testimony and property owner protests for the proposed formation of Community Facilities District No. 2017-1 (Public Services) and the authorization to levy a specia! tax within the territory proposed to be included in CFD 2OL7-7.
2. Adopt a "RESOLUTION OF THE CIW COUNCIL OF THE CITY OF TEHACHAPI ANNEXING OF TERRITORY (TRACT MAp NO. 73631TO A COMMUNTTY FACtLtTtES DISTRTCT, AUTHORTZING THE LEVY OF A SPECTAL

The recommended actions will declare the City Council's intent to annex into the CFD pursuant to the terms and provisions of the "Mello-Roos Community Facilities Act of 1982", being Chapter 2.5, Part 1, Division 2, Title 5 of the Government Code of the State of California (the "Act"), as amended, for the purpose of financing the landscaping, street maintenance, and police services.
