COUNCIL REPORTS
MEETING DATE: JUNE 6,2022 AGENDA SECTION: FINANCE DIRECTOR
APPROVED
DEPARTMENT
CITY
TO HONORABLE MAYOR SMITH AND COUNCIL MEMBERS
FROM: HAMED JONES, FINANCE DIRECTOR
DATE: JUNE 1,2022
SUBJECT: TREASURER'S REPORT - APRIL 30,2022
BACKGROUND
Over the last several years, the City has invested the majority of its surplus pooled cash in the State's LocalAgency lnvestment Fund (LAIF). While LAIF has been and continues to be a safe, liquid investment, its interest rate tends to follow the federal funds rate and has dropped significantly over the last few years. This had led to a significant decline in the City's investment income.
ln the last few months, interest rates on other investment types authorized by the City's investment policy have risen as the Federal Reserve has increased its federalfunds rate to help combat rising inflation. Safe investments like Treasuries, Government Agency Bonds, and CD's are offering higher yields and presented an option for the City to more actively invest its surplus pooled cash and earn more interest revenue. ln April 2022, the Finance Director, with the authority delegated from the City's investment policy, began an investment program to examine the City's cash flow and started out with an investment of $4 million of surplus cash in Treasury bonds, Government Agency bonds, and CD's. The average yield of this investment is 2.45o/o, which is significantly higher than the current LAIF rate of 0.52o/o, and will result in additional interest income to the City of $77,000 annually. The Finance Director will continue to analyze the City's cash flow and monitor the bond market with a goal of investing more of the City's surplus pooled cash to further increase interest income.
ln accordance with California Government Code Section 53646(bX1) and the City's lnvestment Policy, the Finance Director is to submit a quarterly investment report to Council. The policy states "the report shall include the type of investment, issuer, maturity date, par value and the current market value of each component of the portfolio, including funds managed for the City of Tehachapi by third party contracted managers. The report will also include the source of the portfolio valuation. The report must also include a statement that (1) all investments are in full compliance with the lnvestment Policy, with any exception disclosed and, (2) the City of Tehachapi will meet its expenditure obligations for the next six months, as required by CGC S53646(b)(2) and (3) respectively."
Due to the City's new investments outside of LAIF, the format of the Treasurer's report has been modified to show the City's investments in Treasuries, Agency bonds, and CD's and satisfy the California government code and Ci$ investment policy requirements. ln addition to the policy's requirement of submitting a quarterly investment report, staff will continue to present a monthly Treasurer's report to provide the investment balances for its operating, investment, and fiscal agent accounts.

SUBJECT: APPROPRTATION LIMIT FOR FISCAL YEAR 2022123
BACKGROUND
ln November L979, the voters of the State of California approved Proposition 4, commonly known as the "appropriations limit" or "Gann limit". The proposition created Article Xlll B of the State Constitution, a law that requires state and local governments to adopt an annual appropriation limit. The appropriation limit establishes a limit on the proceeds of taxes that may be appropriated for spending in a given fiscal year. ln June 1990, Proposition 111was passed to modify Proposition 4. Two of the provisions included in Proposition 111 were to provide for an option for local governments to select from adjustment factors that would allow them to be more responsive to local groMh and to require an annual review of the appropriation limit calculations. The adjustment factors can be based on either the growth in California per capital income (Per Capita lncome) or the growth in non-residential assessed valuation due to new construction within the City (New Construction Rate). The adjustment factor for population can be based on either a population growth rate in Tehachapi or Kern County.
The limit is based on actual appropriations from fiscalyear t978179 and it is increased each year by population and economic growth factors. The calculation includes only revenues that are classified as proceeds from taxes and allows for certain exclusions including transfers, capital outlays, payment for debt services, appropriations supported by increased gas taxes, and appropriations required to comply with mandates of the courts or federal government, such as FLSA overtime or payments of FICA/Medicare Tax.
When the limit is exceeded, Proposition 4 requires the surplus to be returned to taxpayers within two years.
Appropriations in the two-year period can be averaged before becoming subject to excess revenue provisions of the Gann limit.
The appropriation limit calculation for fiscal year 2022123 is derived from the percentage change in California Per Capita Personal lncome and the population rate change in Kern County. The percentage change in Per Capita lncome was7.55o/o and the population rate change for Kern County was 0.05%.
The calculated appropriations limit for the City of Tehachapi for Fiscal Year 2022123 is S15,321,205.
FISCAL IMPACT
No fiscal impact unless appropriations from tax proceeds exceed the limit.
RECOMMENDATION
Staff recommends council adopt the resolution establishing an appropriation limit for fiscal year 2022/23 and repealing Resolution No. 27-27.

APPROVED
DEPARTMENT
CITY MANAGER
TO HONORABLE MAYOR SMITH AND COUNCIL MEMBERS
FROM: ASHLEY WHITMORE, GENERAL SERVICES D!RECTOR
DATE: JUNE 1,2022
SUBJECT: AERONAUTICAL HANGAR GROUND LEASE AGREEMENT - HANGAR NUMBERS TBD
BACKGROUND
Staff was recently approached by Bruce Glenn, a hangar owner at Tehachapi Municipal Airport, to develop a portion of the airport mid-field. Mr. Glenn is exploring the development of hangars in an area consisting of approximately 8,100 square feet. The attached lease would allow Mr. Glenn to hold the property at a cost of 5121.50 per month. The lease allows for 9 months to obtain a building permit and !2 months thereafter to receive a Certificate of Occupation. lf these milestones are not met, the lease will become null and void. lf all milestones are met the lease will revert to a traditionalground lease for 20 years, with two 5 years options, at the ground lease rate in place at that time.
RECOMMENDATION
Approve the agreement between the City of Tehachapi and Bruce Glenn and authorize the Mayor to sign, subject to City Manager and City Attorney approval.

League of California Cities Annual Conference
The League of California Cities Annual Conference will be held on September 7-9, 2022 in Long Beach. The registration fee is $600.00 and a two-night stay in the hotel is $478.00. During the conference, the city attorney's department of the League has two days of presentations devoted solely to legal issues facing cities and updates on cases recently decided. This is a critical learning session for city attorneys.
My other city is being asked to contribute equally to the cost for the registration fee and one night's lodging. The City's share of the expenses would be $539.00. I would request permission to represent the City of Tehachapi at the annual league conference and for the City to pay up to $539.00 for my expenses.
