I love Tehachapi so much, and while I worked for the City of Tehachapi, I felt so proud of our little town and of all its accomplishments. I left the City to achieve my goals and dreams of being a Real Estate Agent and having more time to spend with my two year old daughter. My goal and ambition is to help the individuals in the community to find a place to call home, and welcome those that want to be part of the community. lt was very difficult to do both jobs at the same time, alongside being a mom and a wife! So leaving the City was one of the hardest decisions of my life, but with the support of my family and friends, I was able to step away. My husband and I moved to Tehachapi in 2017 where we barely knew anyone. \y'y'hen I got hired with the City, I was so grateful and thankful to get to meet and be surrounded by a very intellectual, fun, ambitious, and outgoing group of people who too have similar stories as me. They welcomed me with open hands and warm hearts, and I knew the City will forever be my home no matter where life leads me. When I learned that Stacy resigned, I thought this was such an amazing and Godgiven opportunity to come back home and be part of the City family again! Accounts Payable

COUNC!L REPORTS

APPROVED

DEPARTMENT H

CITY MANAGER
TO: HONORABLE MAYOR PHILlP SMITH AND COUNCIL MEMBERS
FROM: DON MARSH, PUBLIC WORKS D!RECTOR
DATE: OCTOBER 3rd,2022
SUBJECT: 2022LOCAL STREET GRTND AND OVERLAY PROJECT - CHANGE ORDER #1 BAC ND
On August 15,2022 the City Council awarded the2022 Localstreet Grind and Overlay Project to Nagel Earthworks. The original scope of this project was to perform asphalt improvements to Anita Drive, portions of Elm Street, Maple Street and C Street. Field construction work began on Septemb er L2,2022 and is continuing through the next few weeks. ln addition to this grind and overlay project, the Public Works Department had planned on performing some interim patchwork and temporary surface treatments on Golden West Court using internal resources and rental equipment' The asphalt on this street is severely failing and is in terrible condition. The estimated cost for these temporary repairs was S13,000 and would come from a combination of general fund and Gas Tax.

A better option is to perform an asphalt grind and overlay similar to the work currently in progress. Staff obtained a cost from Nagel Earthworks to add this to their existing scope of work. Their proposal is 560,539.

Staff feels that the best use of taxpayer funds would be to perform an asphalt grind and overlay utilizing Nagel Earthworks.

FISCAL !MPACT
The expenses for this work will come from Gas Tax funds

TO HONORABLE MAYOR SMITH AND COUNCIL MEMBERS
FROM: JOHN (JAy) SCHLOSSER, p.E., DEVELOPMENT SERVTCES DTRECTOR DATE: SEPTEMBER30,2022
SUBJECT: FIRST AMENDMENT TO ENGINEERING SERVICES AGREEMENT WITH 4-CREEKS, lNC.

BACKGROUND
As the Council is aware, 4-Creeks, lnc. has been providing engineering consultant services to the City of Tehachapi for many years. The Council approved an agreement for on-call services with 4-Creeks, lnc., in January 2020. This agreement pertains to engineering services encumbered by specific grant-related obligations. The agreement contains a three-year term with a potential two-year extension and includes a maximum contract value of S999,999.

PROPOSED AMENDMENT
The current agreement will expire at the beginning of 2023. The proposed amendment extends this agreement until December 31, 2024 and updates the maximum contract amount to 52,999,999. The amendment also includes new required language from the Federal Highway Administration for consultant contracts as Exhibits "C" and "D." The City will not necessarily utilize the maximum contract value. This amendment helps staff by significantly reducing the cost of compliance with state and federal regulations and continues to allow us to work with a preferred consultant.

RECOMMENDATION

APPROVE AND AUTHORIZE THE MAYOR TO SIGN THE AMENDMENT TO THE ENGINEERING SERVICES AGREEMENT BETWEEN THE CITY OF TEHACHAPI AND 4.CREEKS, INCORPORATED TO EXTEND THE TERM OF THE AGREEMENT AND INCREASE THE MAXIMUM CONTRACT AMOUNT. a

5. In the event that the future use of said highway right of way shall at any time or times necessitate a rearrangement, relocation, reconstruction or removal of any of Company's facilities then existing in said new location, and City shall notify Company in writing of such necessity and agree to reimburse Company on demand for its costs incurred in complying with such notice, Company will provide City with plans of its proposed rearrangement and an estimate of the cost thereof, and upon approval of such plans by City, Company will promptly proceed to effect such rearrangement, relocation, reconstruction or removal. City agrees that Company's facilities shall not be damaged by reason of the construction, reconstruction or maintenance of said street or highway, by the City or its contractors, and that, if necessary, City will protect Company's facilities against any such damage, at City's expense.

COUNCIL REPORTS
MEETING DATE: OCTOBER 3,2022 AGENDA SECTION: POLICE DEPARTMENT

APPROVED

DEPARTMENT

CITY MANAGE

TO HONORABLE MAYOR SMITH AND COUNCIL MEMBERS
FROM: ANTHONY BONELLI, CODE ENFORCEMENT OFFICER
DATE: SEPTEMBER 27 ,2022
SUBJECT: EMERGENCY ABATEMENT AT 316 HAYES STREET
Pursuant to Municipal Code Section 1.16.065M, emergency abatements may be conducted by the city when appropriate. This code also requires a hearing before the city council following any such abatement to determine whether the Code Enforcement Officer's abatement actions were appropriate.

On May 23,2022, the property located at 315 Hayes Street was inspected based on a complaint of dead and overgrown vegetation constituting a fire hazard. During the inspection the property was found to be vacant. A Notice of Violation was mailed to the legal owner of record. A records check of the property showed that the owner was deceased.

Over the next few weeks several attempts were made to find a person responsible for the property which yielded negative results.

On August 18,2022, a warrant was served to abate the violations on the property. Through the use of a private contractor the dead and overgrown vegetation was removed from the property.

RECOMMENDAT!ON
Staff recommends that the City Council approves emergency abatement actions conducted by Code Enforcement at 316 Hayes Street.
