SUBJECT: WAHISTROM WELL EMERGENCY REPAIRS

BACKGROUND
On August l-sth,2022 the City's Wahlstrom Well experienced a catastrophic failure of the pump bearings and pump shaft.

City staff immediately contacted several well service companies and Bakersfield Well and Pump Co. (BWP) was the only service company able to respond within a reasonable amount of time. BWP followed-up with an estimate of 572,300 for the expected work. The work proposal is attached to this staff report.

Due to the criticality of this well, City staff authorized BWP to move forward with the work on an emergency basis.

All repairs were completed, and the wellwas returned to service on October lth,2022.

A claim for these repairs has been submitted to our insurance carrier. ln the past, similar failures has been covered under our policy and the cost to the City has only been our deductible (currently S5,OOO).

FISCAL IMPACT
The Water Fund has sufficient reserves to cover the full costs for repair of this well. From past experience, the expected cost wil! only be 55,000 for our insurance deductible.

RECOMMENDAT!ON
AUTHORIZE BAKERSFIELD WELL AND PUMP CO. TO PERFORM EMERGENCY REPAIRS ON THE WAHLSTROM WEIL IN THE AMOUNT OF $72,300 AND AUTHORTZE THE CITY MANAGER TO APPROVE ANY NECESSARY CHANGE ORDERS UP TO A MAXTMUM OF tO%OF THE CONSTRUCTTON COST (57,230). ,^.f

NOVEMBER 2,2022
SUBJECT: REqUEST FOR A FINDING OF PUBLIC CONVENIENCE AND/OR NECESSTW PER THE REqUEST oF THE DEPARTMENT OF ALCOHOLTC BEVERAGE CONTROL (ABCI AT 109 NORTH GREEN STREET.

DATE:

The Department of Alcoholic Beverage Control is requesting a finding of public convenience and/or necessity on behalf of the future La Bodega de Castillo at 109 North Green Street who is attempting purchase of a Type 42 (On-Sale Beer and Wine-Public Premises) license. The Type 42 license authorizes the sale of beer and wine for consumption on or off the premises where sold. The Type 42 license does not authorize distilled spirits to be on the premises. Minors are not allowed to enter and remain. Food service is not required.

As the City Council may be aware Assembly Bill (A.8.) 2897 was signed into law in L994, amending Section 23958.4 of the Business and Professional Code, which precludes the Department of Alcoholic Beverage Control (ABC) from issuing a license in an existing over-concentrated census tract without the consent of the local government. ln this regard, the prohibition against issuing new licenses, up-grading a license or modifying an existing license in an over concentrated area can be lifted if the local government determines that public convenience and/or necessity would be served by said issuance.

The subject site is located in a Kern County Census Tract area which meets the over-concentration criteria per A.8.2897 and therefore the ABC cannot commence with the licensing exchange process without a finding of public convenience and/or necessity being issued by the City of Tehachapi. lt should be noted that the ABC does not have specific criteria on which to base the finding and as such cities have a great deal of latitude in this process. "Over Concentration" also does not imply that the State, or anyone else, has previously looked at this census tract and determined that it has suffered any deleterious effects from the actual number of licenses existing; or that it will suffer if a new license is issued. lt merely provides a guideline for making such a determination, in the form of determining whether in a particular situation, the ABC license would serve the "public convenience or necessity".

The applicant plans to open 109 North Green Street as La Bodega de Castillo; an on-sale beer and wine establishment. The applicant believes that their business will benefit the community in several ways including being a part of the ongoing urban renewal project of the north side of downtown and providing food and refreshment to the surrounding neighborhood. A statement from the applicant has been included as an attachment.

CITY MANAGER

DEPARTMENT
TO: HONORABLE MAYOR SMITH AND COUNCIL MEMBERS
FROM: JAY SCHLOSSER, DEVELOPMENT SERVICES DIRECTOR
DATE: NOVEMBER2,2022
SUBJECT: ANNEXATION NO.2 INTO COMMUNIW FACILITIES DISTRICT NO.2017-1(PUBLIC SERVICES) BACKGROUND:

By Resolution No. 22-\7, the City Council established Community Facilities District No. 2017-1 (Public Services) ("CFD 2OL7-L"1, a Mello-Roos Community Facilities District with the intention that future development within the City of Tehachapi (the "City") would annex into this district. The special taxes collected from the property owners within the district are to be used for the funding of police protection services, street maintenance, and landscaping in the Tehachapi area.

The annexation territory, Tract Map No. 7366 Sage Ranch (the "Project") proposed for annexation is owned by Greenbriar Capital (US) LLC and is generally located north of Pinon Street, south of Valley Boulevard, west of Dennison Road, and east of South Curry Street. The Project includes the development of seven hundred and ninety-five (795)single-family and multi-family residential lots, two (2) basins, and twenty-nine (29)open space lots. The boundary of the annexation includes the area within assessor's parcel numbers 4L7-OL2-07, 417-OL2- 24,477-OL2-25,4L7-OL2-27 and 477-072-28 as depicted on Exhibit A.

Development of this property changes the characteristics of undeveloped land. Once developed, this Project will have intensified the use of the property, creating a need for more services underthis CFD.

As part of the annexation process, the City contracts with Willdan Financial Services for the preparation of the necessary resolutions and balloting procedures for the annexation. Willdan Financial Services completed a comprehensive specialtax analysis that took into account the types of properties proposed for inclusion in the CFD currently, and in the future through annexations, and the City's maintenance budgets to arrive at the proposed levels of special tax amounts on the various land uses and created CFD 2077-L in 2OL7 .

The Resolution of lntention is the first step in the process of annexing new developments into CFD 201-7-7. This will be the second annexation into the CFD. The resolution also establishes December L9, 2022, or shortly thereafter, as the public hearing date for the final consideration of the annexation of the property into CFD 2Ot7-L. Once the annexation is complete and the property is developed, the property owner of the Project will be required to pay annual special taxes for CFD 2OL7-1, beginning in Fiscal Year 2023/2024 as itemized on their property tax bill in accordance with the rate set forth in the Rate and Method of Apportionment of Special Tax.

The CFD 2Ot7-L Rate and Method of Apportionment was established as part of the formation of the district and fixed Fiscal Year 2077|}OLB as the base year for the annual special tax rate as shown in Exhibit B. Since the formation, assessments have increased based on a cost inflator allowed in the original formation documents.

The current special tax rate for the district is as shown in Exhibit C.

PROPOSAL:

To initiate proceedings to annex the Project into Community Facilities District No. 2017-1 (Public Services) to pay for the impact of the development on City services pertaining to landscaping, street maintenance, and police services.

RECOMMENDATION
The recommended actions will declare the City Council's intent to annex into the CFD pursuant to the terms and provisions of the "Mello-Roos Community Facilities Act of L982", being Chapter 2.5,Part 1, Division 2, Title 5 of the Government Code of the State of California (the "Act"), as amended, for the purpose of financing the landscaping, street maintenance, and police services.
