TEHACHAPI REDEVELOPMENT AGENCY

TO BOARD DIRECTORS OF THE SUCCESSOR
AGENCY

TO THE TEHACHAPI REDEVELOPMENT
FROM: HAMED JONES, FINANCE DIRECTOR
DATE: JANUARY L7,2023
SUBJECT: APPROVE A RECOGNIZED OBLIGATION PAYMENT SCHEDULE FOR THE FISCAI PERIOD FROM JULY 1, 2023 THROUGH JUNE 30,2024 PURSUANT TO HEALTH AND SAFETY CODE sEcTloN 34t77
Backsround
Pursuant to Section 34L77 of the Health and Safety Code ("HSC"), in order to make payments on enforceable obligations, the Successor Agency to the Tehachapi Redevelopment Agency ("Successor Agency") is required to prepare a Recognized Obligation Payment Schedule ("ROPS") for specified fiscal periods. Each ROPS must be approved by the Oversight Board, submitted to the County AuditorController, the State Controller, as well as the State Department of Finance ("DOF"). Previously, the Successor Agency was required to prepare a ROPS for each six-month fiscal period (from July 1 through December 31, and from January 1 through June 30, respectively). Due to a change in law (SB L07) enacted in Septembe r 20L5, amended HSC Section 34177, the Successor Agency is now required to prepare only one ROPS per fiscal year beginning with fiscal year 2076-L7 instead of twice a year.

All ROPS must be approved by the Oversight Board. Furthermore, each Oversight Board-approved ROPS must be submitted to the DOF for review. HSC Section 34177 also requires the Successor Agency to submit an Oversight Board-approved ROPS to the State Controller as well as to the County Auditor-Controller no later than February 'J,, 2023. A copy of the Oversight Board-approved ROPS must be posted on the Successor Agency's website.

The DOF may eliminate or modify any item on the ROPS before approving the ROPS. The DOF must make its determination regarding the enforceable obligations and the amount and funding source for each enforceable obligation listed on ROPS 23-24 no later than April 15,2023. Within five business days of the DOF's determination, the Successor Agency may request to "meet and confer" with the DOF on disputed items. The meet and confer period may vary, but an untimely submission of ROPS 23-24 may result in a meet and confer period of less than 30 days.

The County Auditor-Controller may object to the inclusion of any item on the ROPS that is not demonstrated to be an enforceable obligation and may object to the funding source proposed for any item. The County Auditor-Controller must provide notice of its objections to the DOF, the Successor Agency and the Oversight Board at least 60 days before disbursements from the Redevelopment Property Tax Trust Fund ("RPTTF") are required to be made.

Staff Report - Oversight Board Approval of ROPS 23-24
Page2 of 2
January 17,2023
The County Auditor-Controller is required to make RPTTF disbursements to the Successor Agency pursuant to the DOF-approved ROPS 23-24 on June 1,2023 (to cover enforceable obligation payments from July L, 2023 through December 31, 2023) and January 2, 2024 (to cover enforceable obligation payments from January t,Zo24through June 30, 2024l,.

Penolties for Foilure to Make Timely Submission
lf the Successor Agency does not submit an Oversight Board-approved ROPS 23-24 by February L,2023, the City of Tehachapi will be subject to a civil penalty of 510,000 per day for every day that ROPS 23-24 is not submitted to the DOF. The penalty will be paid to the County Auditor-Controller for distribution to the taxing entities. lf the Successor Agency does not timely submit ROPS 23-24, creditors of the Successor Agency, the DOF, and affected taxing entities may request a writ of mandate to require the Successor Agency to immediately perform this duty. Additionally, if the Successor Agency does not submit ROPS 23- 24 within 10 days of the February 1,2023 deadline, the Successor Agency's maximum administrative cost for that period will be reduced by 25 percent.
lf the Successor Agency fails to submit an Oversight Board-approved ROPS to the DOF within five business days of "the date upon which the ROPS is to be used to determine the amount of property tax allocations," the DOF may order the County Auditor-Controller to withhold a scheduled RPTTF disbursement to the Successor Agency pending the DOF's review of the related ROPS. (lt is not clear what is meant by "the date upon which the ROPS is to be used to determine the amount of property tax allocations." Possibly, it is referring to October 1 and April 1, the dates by which the County Auditor-Controller must prepare estimates for the upcoming RPTTF disbursements on January 2 and June 1, respectively, and provide the estimates to the DOF, the Successor Agency and the taxing entities.) ln conjunction with such a withholding, the DOF may order the County Auditor-Controller to disburse to the taxing entities money from the RPTTF that the DOF determines to be in excess of the amount needed for enforceable obligations.

Staff recommends that the Successor Agency adopt Resolution No. SA 01-23 approving ROPS 23-24 and taking certain related actions.

Fiscal lmpact
The preparation and submittal of ROPS 23-24is for the purpose of allowing the Successor Agency to pay its enforceable obligations for the period from July l, 2023 to June 30, 2024. The total enforceable obligations amount included the ROPS 23-24is52,L75,662.

Recommendation

PUBLIC HEARING: TEHACHAPI RED APPLE TRACT ADDENDUM TO THE GENERAL PIAN ENVIRONMENTAL IMPACT REPORT, GENERAL PIAN AMENDMENT 2O22-OT, PRE-ZONE OF SUBJECT PROPERTY TO C.3, AND ANNEXATION NO. 86
BACKGROUND:

On January 3,2022, the City of Tehachapi received an application to annex the property known as the Tehachapi Red Apple Tract, located at 21501 Tucker Road (Project), from Kern County into the City. The site is approximately 10.7 acres in size, with approximately 2 acres consisting of a single-family ranch residence and the remaining 8.7 acres consisting of undeveloped land. No development is currently proposed for this site.

The City determined that this annexation (No. 86) will involve a General Plan land use designation change involving the project site to be amended from Rural General to Commercial. The site will be pre-zoned to the City's zone of General Commercial (C-3). These amendments will maintain consistency with the General Plan and pre-zoning, as required by the Local Agency Formation Commission (LAFCo) for processing.

This Planning Commission Staff Report (Attachment A) describes all the actions being considered to allow the project proponent to annex this property into the City within a commercial zoning district. The actions include the following:

1. EIR Addendum - Recommend the City Council review and consider the analysis in the Addendum to the previously Certified EIR for the 2012 City of Tehachapi General Plan prior to making a determination on Annexation No. 85.

3. Pre-zone to commercia! (C-3) - lntroduce and adopt an ordinance of the City Council to pre-zone the subject property to General Commercial (C-3) zone

4. Annexation No. 85 - Recommend the City Council adopt a Resolution of Application to Kern LAFCo for the annexation of Tehachapi Red Apple Tract from Kern County into the City of Tehachapi.

F;l

2. General Plan Amendment 2O22-Ot - Recommend the City Council change the land use designation of the portion of the Red Apple Tract from "Rural General" to "Commercial." Annexation No.85
January 17,2023
The supporting details for each of the above actions are contained in the attached Planning Commission Report from November 14, 2022. The Planning Commission adopted Resolution No. 22-09 in support of the actions as presented by Staff.

RECOMMENDATION:

Subject to the testimony received during the public hearing, staff recommends the above actions be undertaken:

BACKGROUND
The State of California has adopted a new set of building construction codes as contained within Title 24 of the California Code of Regulations, also known as the lnternational Codes. This update process occurs approximately every three years and was most recently performed in January 2022. The State correspondingly requires that local agencies enact and enforce these new codes beginning January 1 of the following year (ln this case January I,2023).

Furthermore, local agencies are granted the authority to add to the State codes. Kern County undertakes this effort in each cycle and the City has traditionally followed the County in order to provide consistency for the benefit of property owners and contractors operating within the County. ln order to achieve this goal, we must amend municipal code section 15.04.160 to reflect the new county ordinance as it relates to the adoption of the County-level building codes.

COUNCIL REPORTS
MEETING DATE: JANUARY L7,2023 AGENDA SECTION: DEVELOPMENT SERVICES

DEPARTMENT H

CITY MANAGER

APPROVED
TO: HONORABLE MAYOR DAVIES AND COUNCIL MEMBERS
FROM: JAY SCHLOSSER, DEVELOPMENT SERVICES DIRECTOR
DATE: JANUARY 9,2023
SUBJECT: TENTATIVE TRACT MAP 5714 ENTITLEMENT EXTENSION BACKGROUND:

Tentative Tract Map 67t4is a 74-lot single-family home neighborhood located west and adjacent to the Cherry Lane Estates bounded on the north by Cherry Lane and the south by Pinon Street. The tentative subdivision map was originally approved by the Tehachapi City Council on May 5, 2008. The City of Tehachapi granted three one-year extensions in May of 2070,2011, and 2012. Subsequently, various actions from the California legislature (SB 1185, AB 333, AB2O8, AB 116, AB 1303, and 481561)further extended the project entitlement to November 5,2022.

This project was first entitled by a company named Cardiff Equities, lnc. located in Gardena California. To our knowledge, it was purchased by Saticoy Developmenlin 2027 with an intent to advance the project to construction.

Since that purchase, Saticoy has actively advanced the project by working on the engineering elements including, but not limited to, Final Map, Grading, Drainage, Water, Sewer, and Street lmprovement Plans.

Saticoy applied for the Final Map in October 2022 asking for a short extension of time to the entitlement. ln consideration of the valid and timely application, City Staff agreed to advance the project setting a deadline of January 77 ,2023 for the date in which the Final Map and Subdivision Agreement must be before the City Council.

The original entitlement requires the applicant to seek the vacation of a flowage easement from the TehachapiCummings County Water District who owns the adjacent Antelope Dam. This issue has been known since inception and the developer produced a sizable hydrology report for review and approval from TCCWD in the summer of 2022 to affect a solution to this issue. This process is proving to take longer than expected.

PROPOSAL:

At this point, the delay preventing the completion of the Final Map and the advancement of the project lies with the review and approval of TCCWD relating to the vacation of an adjacent flowage easement. This review and approval is outside the control of the City and the developer. The developer has prepared the analysis required by TCCWD and continues to be responsive to the District's questions and comments.

As a result of this issue, the developer has requested a 6-month extension to the Tentative Tract 6714 Entitlement.

Attached is the letter requesting this consideration.

RECOMMENDATION:

APPROVE THE REQUEST FROM SATICOY DEVELOPMENT COMPANY, LLC TO EXTEND THE TENTATIVE TRACT MAP 6714 PROJECT ENTITLEMENT FOR SIX MONTHS UNTIL IULY 17,2023

RE: Tentative Tract Map 6714
Subject: 6-month time Extension Request.

Mr. Schlosser,
Saticoy Development Company (SDC) is optimistic and remains committed to the development of this project and the City of Tehachapi.

Currently we are in a plan review with COT for the improvement plans and tract map with the house plans to follow soon. To date we have paid over $ 174,000 for consultants and fees to entitle the tract.

We would be on track to record our map by this January 2023 except that Condition #6, page l6 of tentative map 6714 of the approved condition requires us to have TCCWD approval of a hydrology study for our improvements in the flowage easement, that traverses the northwest corner of the tract.

This study is evolving into a more extensive and time-consuming task than originally anticipated.

Unfortunately, for design sequence the hydrology study required the grading plan to be sufficiently completed to incorporate into the analysis which occurred this past spring.

Based on our current timeline below with TCCWD we anticipate it will take an additional 6 months to clear this condition.

CITY OF

COUNC!L REPORTS
MEETING DATE: JANUARY L7,2023 AGENDASECTION: DEVELOPMENTSERVICES

APPROVED

CITY MANAGER

DEPARTMENT

TO HONORABLE MAYOR DAVIES AND COUNCIL MEMBERS
FROM: JOHN (JAY) SCHLOSSER, DEVELOPMENT SERVTCES DTRECTOR DATE: JANUARY LO,2023
SUBJECT: DEVELOPMENT DEPARTMENT USER FEES UPDATE 2023

BACKGROUND
ln November 2019 Council adopted a resolution which implemented the Updated Fee Schedule for planning, engineering, and building services in relation to recovery of the City's costs for providing those services. The original User Fee Study examined fees for select City services using the full cost allocation hourly rates in combination with processing time estimates. lt largely focused on development services (Planning, Building, and Engineering) but included a minor Police component.

Over time, new scenarios have arisen which were not taken into consideration in the previous study and a regular review of the City's user fees is needed to ensure the fees were appropriate. Earlier this year City Staff contracted with Capital Accounting Partners, LLC to create fees for these new scenarios and review current fees.

REPORT RESULTS
Attached to this staff report is the final draft of the Development User Fee Update 2023. The report contains an update to the fees collected in the Building, Engineering, and Planning Departments. Further, the detailed list of fees contained in the report has been simplified and attached to this Staff Report to help display the existing and proposed fees.

The fees proposed are based upon a full cost recovery program. This means staff undertook extensive review and calculation to determine the actual cost to provide any given service. This task was undertaken to conform to the City Council's stated desire for "development to pay its way" in the City. The only circumstance in which staff believes full-cost recovery can be a concern is when it comes to minor permit services. ln these cases, if the cost for the service is high relative to the activity undertaken by a person or business, a full-cost fee could result in more people undertaking the activity without a permit. For instance, in the past, the City charged S20 for a Temporary Use Permit to install a temporary banner on a business. The actual cost to provide that service is 5L22. That said, S122 is in most cases more expensive than the banner itself. As such, City Staff recommends that the following permit activities be charged at the stated value in the following table (which is below the fullcost recovery sum):

FISCAL IMPACT
The analysis from Capital Accounting Partners aggregated the total number of permits issued in Fiscal Year 21-

22. The report then compares what sum of money we should have captured with our existing fees against what we would have captured with the proposed fees.

PROJECT SCOPE
The City re-engaged CapitalAccounting Partners (CAP)to update its Building, Planning, and Development Engineering fees. CAP provided the City's first fee study in 2015-2016. An update followed this in 2018. lt is generally considered best practice for cities to review their user fees regularly. ln keeping with this practice, the City determined that an update was in its best interest. The scope included:
. Updating labor, nonlabor, and overhead costs to fiscal2022-2023; . Reviewing permit and application processes workflows; . Updating and reconfiguring permits and applications where appropriate; and . Reviewing the role and impact of customer services on applicants.

Special thanks to the outstanding efforts of the Community Development staff for the quick response to data requests.

SU tVI tVI ARY OF COSTING
tVI ETHODOLOGIES USER FEE STUDY
The methodology used to calculate the cost of user fee studies is based on developing a driver-based costing model. This is a detailed and robust method of calculatlng the cost of a specific service. The approach is based on the principles of activity-based costing, Activity Based Costing seeks to calculate cost based on assessing operational workflows. Practically, this means it relies on understanding the time staff invests in core business processes to provide fee and non-fee services. This provides the ability to understand staff time and cost as each staff position participates in providing fee services.

Project Steps and Process
Step 1: Collect Data - This first step involves discussions with staff to identify those positions within the department that provide and support direct services. lt also consists in collecting departmental budget and expenditure data, identifying the salary and benefits for each position, and identifying non-personnel expenditures and any departmental and Citywide overhead. Specifically, the steps involve the following:
o ldentifring staff positions - This includes aligning staff names and positions.

Capital Accounting Partners Proposal for
City of Tehachapi, CA
page 2
o Calculating the number of productive hours - For each position, vacation time, sick leave, paid holidays, professional development (training), routine staff meetings, and daily work breaks are deducted from the standard 2,080 annual hours. The result is a range of hours available for each position on an annual basis. This range is typically 1,500 to i,600 hours. Factors influencing this range are length of service with the jurisdiction and local holidays and personal leave time policies.

However, based on previous work with the City where the calculated number of productive hours was almost exactly 1600 hours, and at the request of the Office of Management and Finance, we set all positions at'1600 productive hours.
o ldentifring and allocating non-personnel costs - Costs for materials and supplies are allocated to the salary and benefits for each position.
o Assigning any other expenses that are budgeted in other areas - There are often expenses that should be included with the total cost of services. Examples of such costs might include amortized capital expenses for vehicles and technology.
o ldentiffing core business processes or actMities - This step also involves discussions with staff to understand, at an operational level, the work of the operating unit. Core business processes used to provide services are identified and then defined by the tasks that are involved. Direct and indirect categories also organize processes.
o Direct processes and activities - Those processes that directly contribute to processing an application or permit are first identified. Examples of a direct activity are building inspection, application intake, and pre-application review.
o lndirect processes and activities - Are those processes that support, but do not directly apply to the processing of a specific application or permit. An example of an indirect activity is customer service or staff training to maintain certifications. Most jurisdictions highly value customer service, but assigning a specific cost or unit of time to an individual service is difficult.

Step 2: Building cost structures - This second step involves significant interaction with staff and the development of time estimates for both direct and indirect processes in each department. Specifically, this step is at the core of the analysis. Four processes comprise this step:
o Gathering time estimates for direct processes - By interviewing staff in individual and group meetings, an estimate of time was assigned to each service by the indicated process. For the most part, the processes included three primary steps:
r Permit intake;
. Plan review; and
o Constructioninspections.
ln this analysis, staff time is estimated and assigned to each step. The sum of all the process steps is the total time that is required to provide that specific service.

Assigning indirect and annual process time - An annual time estimate is gathered from staff for those indirect or supporl processes in which they are involved. These may include actrvities such as program administration, customer service, and department administration. These costs are allocated to all services proportionately to all services provided by the department. a
Capital Accounting Partners Proposal for
City of Tehachapi, CA
page 3
. Calculating fully loaded hourly rates and the cost of service - Once the total time for each direct and indirect service is estimated, the cost of service is calculated by using the fully loaded hourly rates for each staff member or position that is involved with the service. The fully loaded hourly rate for each employee is based on the employee s salary and benefit costs plus a share of non-personnel and City overhead costs divided by the employee's available work hours (i.e. 2,080 hours minus all leave hours).

Thus, the direct and indirect cost by activity also includes departmental and Citywide overhead as well as nonlabor costs. The City's indirect and non-personnel costs are from the annual budget or cost allocation that the City has established.
o Gathering activity or volume data - A critical element in the analysis is the number of times a given service is provided annually. This is critical data for three reasons:
. lt allows a calculated projection of current revenue based on current prices. This is compared with actual revenue to see if there is a close match as the data should match. . lt allows for a calculated projection of revenue at full cost. This is compared to actual expenditures to see if there is a close match as the data should match. . lt allows for a calculation of total hours consumed. Hours consumed must closely match actual hours available.
lf any of the three calculations do not approximate actual numbers, then time estimates and/or volume data need re-evaluation. Again, these are critical quality checks for costing accuracy.

Step 3: Calculating the full cost of services - This third step calculates the full cost of service for each direct service in the department. ln the previous step, the service cost was calculated for each direct and indirect service. ln this step, the cost layers are brought together to establish the full cost of service for a specific direct service, program, or activity. As previously mentioned, the cost of each direct service is calculated.

The cost of indirect services is allocated to each direct service to determine the full cost of service. The indirect services costs are allocated to each dlrect service based on each direct services proportion of labor spent processing each permit and application. By adding the direct and allocated indirect costs and multiplying that by the activity data, a total service cost is calculated for both an individual service and the operating unit.

Step 4: Set fees
The recommended fees can be established based on new, existing, or revised cost recovery policies. The recommended fees will be established based on City staff recommendations and Council discussion in the future. The fee analyses in this report are based on full cost recovery.

Assuring Quality Results
ln our analysis, we utilize both quantitative and qualitative tests for quality. These tests are an essential part of our costing models and processes. Without these, the results lack defensibility and integrity.

Qualitative
Our process incorporates substantial input from both individuals and groups. Our bias is that we get the best data from group interviews. For example, in determining how much time is required for any specific building rnspection, we want to hear the perspective of an inspectol the inspector supervisor, and the Capital Accounting Partners Proposal for
City of Tehachapi, CA
page 4
C rf Tehar, har Ret
counter tech or project manager. Each will have a perspective. Each will contribute value to the estimate.

When all perspectives agree, we have confidence in our results.

Quantitative
We also utilize four quantitative measures of quality data. When each of these measures match and there are no major disagreements with the quantitative assessment, we have significant confidence in our results These quantitative measures are:

Targeted Margin of Error
1) Budgeted expenses entering the cost models must equal total expenses accounted for in the costing model.
2l Projected revenue from fees must closely match actual revenue from fees. +or3) Available staff time must be fully accounted for in the costing models. 4l Total revenues from fees and contributions from the general fund or other sources must match total expenses.

USER FEE STUDY RESULTS
The results of this update results demonstrate an opportunity to increase cost recovery from developmentrelated user fees. There are two major reasons why user fees increase in cost over time:

1. The regulatory environment changes. Additional federal and state regulations require more time and effort to process fee-based services.

2. Changes in labor costs. We generally find that city labor costs are currently outpacing the general rate of inflation. This has been especially true in the last several months.

Summary of Revenues and Expenses
The reader will note that the largest cost increase is in Engineering and Planning fees. ln most of our user fee studies, this is where we see the opportunity for additional cost recovery. Typically, this is where we see costs outpacing general labor costs.

Support and Overhead Costs
We are frequently asked about overhead. More specifically, overhead rates. User fees, overhead and support costs come from a variety of sources:

1. City overhead.

2. Departmental management and administration.

3. Support services to applicants.

Generally, the largest component of these costs are those associated with support services to applicants. This comes in a variety of activities:

1. Counter time is where the public will come in to ask a question of counter staff, request time with a planner, or engineer. These general questions may or may not turn into applications or permits.

2. Pre-application review. Cities will frequently spend significant time working with applicants before a project is ever started. Ir/ost cities consider this a value-added service to the applicant and a benefit to the City. Applications that are delivered in good form and all required documentation is delivered speeds the process through the system faster. This means the developer spends less time with City staff on multiple iterations of plans. As a result, the developer starts their project faster and the City spends less time on the application.

OBSERVATI ONSAND
RE COIVI IVI E N DAT! ON S
Adjusting the Fee Schedule
One of the most common challenges we see in municipal government concerning fees is the failure to adjust fees regularly. Those cities that practice regular adjustments to fees tend to have better cost recovery and a higher level of service for their customers. Conversely, those that do not update their fees regularly tend to recover less and less costs and the level of customer service follows.

Therefore, we applaud the City of Tehachapi for continuing the practice of regular fee updates. Besides better cost recovery, we also find that cities that regularly update their fees provide the highest customer service level.

For flat fees we recommend using a simple CPI type increase that is attached to the City's labor cost. For example, if the labor cost for the City goes up by 27o then adjust each fee by 2o/". This is the simplest and most common method of adjusting fees. However, we observe that the regulatory requirements change enough within three to five years to warrant a comprehensive review of costs. Therefore, we also recommend similar adjustments to productive hourly rates when these are the basis of a fee as well as percentages of engineers cost estimates.

Building Reserves
Since the "great depression of 2007" many of our clients have recognized the value of reserves for building functions. Due to the volatile nature of building activity, reserves provide a cushion to the general fund. ln addition, when larger construction projects require 6-24 months to complete, reserves provide a funding mechanism for these projects over a longer time period.

Capital Accounting Partners Proposal for
City of Tehachapi, CA
page 7
City of Tehachapi Report
Therefore, as a long-term strategy, we recommend developing a reserve fund to be managed for exclusive use for Community Development. These resources can be used to maintain staffing during short-term economic downturns, maintain up-to-date technology, which is a value-added benefit to builders and developers, or add staffing during spikes in building activity.
