SUBJECT: BOY SCOUT TROOP 3 RECOGNITION
Clare Scotti the Executive Director for the Greater Tehachapi Chamber of Commerce made us aware of the selfless actions and community service by Tehachapi Boy Scout Troop 3 on Saturday, August 19. "Tropical storm Hilary was making itself known forcing the cancelation of the Mountain Festival, the Tehachapi Boy Scout Troop 3 jumped into action with their sense of community. \A/hen the rain started pouring, the Scouts quickly turned their attention to helping the Chamber and festival vendors pack up safely.
Each scout looked for where help was needed, and they efficiently and safely got others on their way. One vendor had hundreds of items fall during the rush and in less than a minute several scouts were at the booth helping to pick up and move the items safely to the vehicle. Troop 3 stayed until everything had been cleared and guests and vendors had safely left. We want to commend the integrity and dedication of Troop 3. Thank you!"
As described by Clare Scotti and Councilmember Jeanette Pauer we believe Tehachapi Boy Scout Troop 3 should be recognized for their acts of community service on August 19,2023.

CITY
TO HONORABLE MAYOR DAVIES AND COUNCIL MEMBERS
FROM: JOHN (JAYI SCHLOSSER, P.E., DEVELOPMENT SERVICES DIRECTOR DATE: sEPTEMBER25,2023
SUBJECT: BRENTWOOD DRIVE PEDESTRIAN FACILITIES PROJECT - REJECT ALL BIDS BACKGROUND:
The City of Tehachapi was awarded funding, in the Spring of 2022, through the Transportation Development Act Article 3 Program, administered by the Kern Council of Governments. This award was for the completion of pedestrian facilities on both sides of Brentwood Drive between Curry Street and Oakwood Street with a new ADA compliant sidewalk, curb, and gutter. Staff has diligently pursued the design of this project preparing for construction to begin October 2023.
Advertising began for the project in August 2023. Staff opened bids for this project on September L2,2023 The results of the bid opening are listed in the table below:
Contractor Name Bid Amount
DOD Construction lnc. s404,361.00
RC Becker and Son, lnc. S++6,t5+.tt
JL Plank, lnc. DBA Cen-Cal Construction 5452,27s.7s
Unified Field Services Corp 5499,372.OO
The lowest bid is approximately 5200,000 over the estimated construction budget OPT!ONS:
Given the above bid results, the following options are available
7. Direct Staff to try and identify City funds to supplement the project grant funds.
2. Direct Staff to reject the bids received and down-scope the design to deliver a grant-compliant but reduced project.
CITY OF
3. Direct Staff to reject all bids and forfeit the remaining project grant funds. The City would be obligated to repay expenses to the Kern Council of Governments of approximately 545,000.
RECOMMENDATION:
City Staff believes there is room to reduce the project scope and we, therefore, recommend Option 2.
REJECT ALL BIDS FOR THE BRENTWOOD DRIVE PEDESTRIAN FACILITIES PROJECT AND INSTRUCT STAFF TO DOWN.SIZE THE PROJECT AS FEASIBLE AND PRESENT A REVISED SCOPE AND BUDGET IN THE MID.YEAR BUDGET.

COUNC!L REPORTS
MEETING DATE: OCTOBER 2,2023 AGENDA SECTION: DEVELOPMENT SERVICES
DEPARTMENT
CITY MANAGER
APPROVED
TO HONORABLE MAYOR DAVIES AND COUNCIL MEMBERS
FROM: JAY SCHLOSSER, DEVELOPMENT SERVICES D!RECTOR
DATE: ocToBER 2,2023
SUBJECT: ANNEXATION NO. 3 INTO COMMUNITY FACILITIES DISTRICT NO. 2017-1(PUBLIC SERVICESI BACKGROUND:
By Resolution No. 22-L7, the City Council established Community Facilities District No. 2017-1 (Public Services) ("CFD 2OL7-L"1, a Mello-Roos Community Facilities District with the intention that future development within the City of Tehachapi (the "City'')would annex into this district. The specialtaxes collected from the property owners within the district are to be used for the funding of police protection services, street maintenance, and landscaping in the Tehachapi area.
The annexation territory, two separate, adjacent developments, collectively known as the Pinon-Curry Condominiums (the "Project") are proposed for annexation and owned by Curry LLC and Pinon LLC. These two projects are generally located at the northwest and southwest corners of Curry Street and Pinon Street. The Project includes the development of thirty-seven condominium units. The boundary of the annexation includes the area within assessor's parce! numbers 4L6-L2O-2O and 4L7-OL1-23 as depicted on Exhibit A.
As part of the annexation process, the City contracted with Willdan Financial Services for the preparation of the necessary resolutions and balloting procedures for the annexation. Willdan Financial Services completed a comprehensive special tax analysis that took into account the types of properties proposed for inclusion in the CFD and the City's maintenance budgets to arrive at the proposed levels of special tax on the various land uses creating CFD 2OL7-L in 2017 .
Resolution No. 44-23 was adopted on August 2L,2023 and set the public hearing for October 2,2023. The adoption of the attached resolutions would annex the territory into CFD 2OL7-L, submit the levy of the special tax to the qualified electors, and declare the results of the special election. This is the final step in the annexation process.
Once the annexation is complete and development occurs, the property owners of the Project will be required to pay annual special taxes for CFD 2OL7-L, beginning in Fiscal Year 202412025 as itemized on their property tax bill in accordance with the rate set forth in the Rate and Method of Apportionment of Special Tax.
The estimated annual revenue received by the City for the CFD 2OL7-I Fund once fully developed will be approximately 537,000.00 for the Project based on the maximum specia! tax rates for Fiscal Year 2023/2024for Attached Condominiums. CFD 2OL7-L includes an annual CPI adjustment. The process for the annexation is funded by the developer and no General Fund monies are used for this effort.
PROPOSAL:
To hold the public hearing, declare the results of the election, and adopt the resolutions to annex the Project into Community Facilities District No. 2017-1 (Public Services) to pay for the impact of the development on City services pertaining to landscaping, street maintenance, and police services.
RECOMMENDAT!ON:
Staff recommends that the City Council open the public hearing for the purpose of receiving public testimony and property owner protests to the annexation. Once the public hearing has been closed, staff recommends that the City Council adopt the two resolutions.
It is recommended that the City Council:
1. Open the public hearing and receive public testimony and property owner protests for the proposed annexation of territory in Community Facilities District No. 2017-1 (Public Services) and the authorization to levy a special tax within the territory proposed to be included in CFD 2OL7-L.
2. Adopt a "RESOLUTTON OF THE C|TY COUNCIL OF THE CITY OF TEHACHAPI ANNEXING OF TERRITORY (ptNoN cuRRy coNDoMtNtuMs) To A coMMUNtw FACTLTflES DISTRICT, AUTHORIZING THE LEVY OF A SPECIAL TA)q AND SUBMTTTTNG LEVY OF TAX TO QUAUFTED ELECTORS, CITY OF TEHACHAPI COMMUNTW FACILITIES DISTRICT NO. 2017-1 (PUBttC SERVICESIANNEXATION NO.3"; and
3. Adopt a "RESOLUTION OF THE CIW COUNCTL OF THE CITY OF TEHACHAPI DECLARING RESULTS OF A SPECIAL ANNEXATION ELECTION, DETERM!NtNG VALIDITY OF PRIOR PROCEEDINGS, AND DIRECT!NG RECORDING OF AMENDED NOTTCE OF SPECIALTAX L!EN, CIW OF TEHACHAPI COMMUNIW FACILITIES DrsrRtcT No. 2017-1 (PUBLIC SERVICESI ANNEXATION NO. 3', The recommended actions will declare the City Council's intent to annex into the CFD pursuant to the terms and provisions of the "Mello-Roos Community Facilities Act of 7982", being Chapter 2.5, Part 1, Division 2, Title 5 of the Government Code of the State of California (the "Act"), as amended, for the purpose of financing the landscaping, street maintenance, and police services.

SUBJECT: ATp DENNTSON ROAD BTCYCLE / PEDESTRTAN CORRTDOR PROJECT - ACQUTSTTION OF RIGHT OF WAY
BACKGROUND:
The City of Tehachapi successfully applied for an ATP Grant on Dennison Road to installcurb, gutter, and sidewalks to close gaps between Tehachapi Boulevard and Pinon Street. The project also includes improving pedestrian crosswalks, installing flashing crosswalk signage, and installing bike lanes along the Dennison Road corridor. The grant funds are to be used to improve the safety and accessibility of pedestrian and bicycle routes to and from Tehachapi High School, as well as other schools in the area whose students commute along Dennison Road.
ln order to accommodate the improvements necessary to construct the project, the City needs to obtain right of way from two (2) affected property owners. The use of ATP funds requires the City to follow federal guidelines and requirements for the acquisition of right-of-way. Staff retained a right-of-way consultant to meet with all affected property owners. One of the two owners has agreed to donate the right-of-way as a Road Easement. The remaining property owner has agreed to sell.
The City enlisted the services of a qualified appraiser and review appraiser to establish the fair market value of the required property in accordance with Federalguidelines. The purchase price for right of way was based on an initial appraisal completed by Thomas A. Leonard of Bender Rosenthal lncorporated. The appraisal was then reviewed by a third-party appraiser (Santolucito Dor6 Group, lnc.) before a final purchase price was determined and accepted by both parties in compliance with Caltrans Local Assistance Procedure Manual (LAPM).

CALIFORNIA,
COUNCIL REPORTS
MEETING DATE: OCTOBER 2,2023 AGENDA SECTION: ASSISTANT CITY MANAGER
APPROVED
DEPARTMENT
CITY MANAGE]
TO: HONORABLE MAYOR DAVIES AND COUNCIL MEMBERS
FROM: COREY COSTELLOE, ASSISTANT CITY MANAGER
DATE: ocToBER 2,2023
SUBJECT: RESOLUTION AUTHORIZING APPLICATION AND ADMINISTRATION OF CALRECYCLE GRANTS
BACKGROUND
As the Council is aware, the City of Tehachapi continues to work through the state-mandated regulations surrounding SB 1383 and AB 1826 as they relate to mandatory organics recycling programs. Recently, the Council approved consultant and compliance software agreements to assist in the implementation and monitoring of these organics recycling services.
CALRECYCLE LOCAL IMPLEMENTATION GRANT
The California Department of Resources Recycling and Recovery (CalRecycle) has been allocated $90 million in funding to assist localjurisdictions in the implementation process for the new regulations. The Local Assistance Grant Program consists of a pre-designated level of funding in a non-competitive format with the City of Tehachapi eligible for $75,000 during this round of funding.
As mentioned in previous meetings, the recent agreement with Minerva software is part of the City of Tehachapi's implementation and compliance program that will assist staff in monitoring the service levels of our organics recycling and mixed recycling programs. The details of that program are attached in this staff report. The funding for the Minerva software, our inspection program and appropriate staff time will be covered by the Local lmplementation Grant funding.
CalRecycle requires that the governing body of all localjurisdictions adopt a resolution authorizing staff to apply for and administer CalRecycle grants and funding. The attached resolution authorizes the City of Tehachapi to apply for all grants of which we are eligible for a period of five years. The application window for the current Local Assistance Grant is now open and due by November 15,2023.
RECOMMENDATION
ADOPT A RESOLUTION AUTHORIZING STAFF TO APPLY FOR, ACCEPT AND ADiiINISTER GRANT FUNDING FROM CALRECYCLE FOR A PERIOD OF FIVE YEARS.
City of Tehachapi SB 1383 Compliance and Enforcement Program The gool of the City of Tehachopi Complionce ond Enforcement progrom rs to ossist residents ond business owners with the transition into orgonics recycling services while providing education ond outreach ond accurate monitoring to ensure proper service levels.
Historv
The City of Tehachapi adopted an enforceable ordinance relating to both commercial and residential organics services in March of 2022. While commercial and multifamily organics service has been initiated in line with AB 1826, residentialorganics is scheduled to be active on July I,2024. The City of Tehachapi is currently working through a Corrective Action Plan with CalRecycle with the lone major task to complete being the curbside service.
ln January of 2022, the City of Tehachapi Adopted Ordinance No. 22-04-0769:
https://acrobat.ado be.com/l i n k/review?uri=u rn id%3Ascds%3AUS%3A073f47f5-15ad-3786-8d73- 94ab2280a115
This ordinance modified the City's municipal code to establishing the requirements for residential organic recycling services as well as supplement the business recycling requirements established by AB 1825 and adopted via ordinance by the Tehachapi City Council in January of 2019.
Compliance and Enforcement
During the introduction of commercial organics service and the preparation for residential service, the City of Tehachapi has found a need for more assistance to monitor compliance and assist with our inspection and enforcement mechanisms with a limited staff.
The City of Tehachapi has entered into an agreement with Minerva to provide record keeping for implementation, reporting via their compliance dashboard, matrix tracking for businesses, commercial food generators, material type tracking and edible food rescue tracking. ln addition, this program will assist with education and outreach along with digital mobile tools for inspections that will assist with commercial inspections and follow ups for residential inspections of violations trigger them via our enforcement ordinance. This program will be implemented for commercial and select residential tracking.
The tools of this program, ease of use and resources will make inspections easier via mobile upload capabilities, compliance tracking, service level audits and additional tools to ensure ongoing compliance.
This is a software subscription that after initial setup, will be utilized by City staff as part of our overall compliance and enforcement program.
The Statement of Work for Minerva is as follows:
. Work with each jurisdiction and hauler and staff to obtain commercial service data export file using an existing hauler billing system query and gaining an understanding of the available containers and materials by jurisdiction. Requires consistent data query from hauler for each on-going upload. . Create initial City/hauler specific data schemas to import service data consistently over time. . Setup jurisdictions & hauler users and establish user access via established jurisdiction/company email.
. Records organized by year, regulatory category, and sub-category for easy navigation, adding new records, status review and auditing.
. Easily include file attachments such as photos, documents, and spreadsheet records. . Quick reference regulatory text to see what is required for each sub-category. . View summary list by entire lmplementation Record, listing category and sub-category. Click to view uploaded documents.
Complia nce Motrix Trocking

. Advanced, transparent, generator location-based reporting accounting for all active accounts and services a generator may have, even multiple haulers. . Reports can be exported as .xlsx or .csv files as raw data or analyzed graph tables or can be printed directly from the browser.
. Reports can be filtered by thirty-four (34) different variables like "haule/', or "Container System", or "Regulation Compliance Status" allowing quick and specific customizable reports.
Edible Food

Easy export of commercial edible food generator, and jurisdiction edible food recoverer lists for addition to the lmplementation Record.
. Realtime calculation of the total number of commercial edible food recoverers.
Educotion and Outreach
. Location linked assets such as notes, photos, documents, waivers and more that remain accessible even as haulers change account numbers, services or information. . Facilitates mobile site visit documentation, uploading of documents and photos right from a tablet.
. Outreach history per location independent of hauler billing system account level changes. a
Doto lmporting System
MSW works with the hauler (and staff as needed) to obtain compliance related billing system data.
. Intuitive data importing using existing consistent hauler billing system data query . lncludes ability to import residential account information.
Grant Funding
The Minervo softwore toolwill cost 557,000 for o three-yeor period to be funded by this grant. ln addition, os pdrt of the enforcement portion the City of Tehochapi sholl:
o Fund additional staff time needed to conduct inspections of commercial and residential organics customers via the Refuse/Recycle budget.
o Provide education and outreach as needed to those needing assistance with implementation. o Fund any additional mobile technology upgrades needed to facilitate inspection uploads real time in the field.
o Fund administrative costs associated with violations.
The 575,000 allocation from this AB 1383 Local Assistance Grant Program will assist the City of Tehachapi in covering the costs associated with the compliance software, inspections and enforcement.
All these tools will be invaluable with continued success of the commercial organics recycling program and the implementation of the residential organics curbside recycling program.

COUNCIL REPORTS
MEETING DATE: OCTOBER L6,2023, AGENDA SECTION: POLICE DEPARTMENT
DEPARTMENT H
CITY MANAGER
APPROVED
TO: HONORABLE MAYOR DAVIES AND COUNCIL MEMBERS
FROM: ANTHONY BONELLI, CODE ENFORCEMENT OFFICER
DATE: SEPTEMBER25,2023
SUBJECT: EMERGENCY ABATEMENT AT 320% EAST ! STREET
BACKGROUND
Pursuant to Municipal Code Section 1.16.065M, emergency abatements may be conducted by the city when appropriate. This code also requires a hearing before the city council following any such abatement to determine whether the Code Enforcement Officer's abatement actions were appropriate.
On August 22,2023, the property located at 320 lzEast lStreet was inspected based on a complaint of dead and overgrown vegetation debris constituting a fire hazard. This property has been the subject of multiple code enforcement cases over a few years. During the inspection the property was found to be vacant/ secure with overgrown dead vegetation causing a fire hazard. A Notice of Violation was posted and mailed to the legal owner of record. A records check of the property showed the owners as Leonard & Mary Abramson with a mailing address of 1100 Valencia Dr Bakersfield, Ca 93306.
Due to the property being abandoned, the lack of responsiveness from the owner and real-estate agent, and the likely of trespassing caused by the property's condition as a public nuisance an inspection warrant was obtained from the Kern County Superior court.
On September 22,2023, an inspection warrant was served to abate the violations on the property. Through the use of a private contractor the dead and overgrown vegetation debris causing a fire hazard was removed from the property incurring a cost of S1,400.00 to the city.
On September 26,2023, a Notice of Pendency of Administrative Action (lien) was filed against the property.
RECOMMENDATION
Staff recommends that the City Council approves emergency abatement actions conducted by Code Enforcement at 320 %East lStreet.
