TEHACHAPI AREA TRANSPORTATION IMPACT FEE PROGRAM: ADOPTION OF REVISED AND
UPDATED IMPACT FEES
SUBJECT:
BACKGROUND
As the Councilwill recall, the City of Tehachapi entered a contract with TJKM, lnc. in November 2O2Ito prepare an update to the City of Tehachapi/ County of Kern shared Transportation lmpact Fee Program for the greater Tehachapi area. This effort was funded through a combination of available funds including Local Early Action Planning (LEAP) funds, Regional Early Action Planning (REAP), and Kern County traffic funds. LEAP and REAP funds are state monies.
RESULTS
As required under the agreed upon scope of services, TJKM, lnc. completed the following steps:
1. With assistance from the Kern Council of Governments, TJKM produced an updated traffic model for the Tehachapi area including both the City General Plan area combined with the County's Greater Tehachapi Area Specific Plan area.
2. TJKM produced updated traffictrip estimates based upon anticipated and actualgrowth both within the City and in the outlying communities.
3. From the updated model and from staff input, a new group of improvement projects are selected targeting areas of the communitywhere future traffic expansion is expected to produce needed changes.
4. These projects are scoped and costs to construct each project are prepared.
5. From this master list, new traffic impacts fees are calculated based upon land use.
The purpose of this Council Report is to first inform the City Council that the work commissioned by the Council in Novemb er 2021is complete to the satisfaction of City Staff. Further, this report serves to present the results of the final analysis.
These impact fees are applied to new development only within the City of Tehachapi. The County is expected to seek adoption of the new program for consistent use within the surrounding Tehachapi communities. These fees are based on the principal that new development should bear the expense that growth has upon the City's facilities. ln short, these fees are designed such that development will "pay its own way". The following table 1 CITY OF
Revised & Updated Transportation lmpact Fee Program

presents the existing and proposed connection fees. This table also provides fees for a few neighboring communities for context.

Under the Section titled "New Fee Schedule" on page 12 of the report, TJKM recommends that the City include a Consumer Price lndex (CPl) escalation clause to account for the effects of inflation on the construction cost estimates that help establish the fee. City Staff accordingly recommends the CPI escalation factor for the Los Angeles / Long Beach / Anaheim area be adopted to maintain consistency with other City expense categories that adjust annually with the CPl.
FISCAT IMPACT
Since this Transportation lmpact Fee Program replaces an existing fee first created in 2006, a capital account exists.
Future revenue resulting from new development as well as expenses resulting from capital outlay will be tracked in this fund. The intent is that the cost of these development induced improvements will be fully borne by the various development applicants such that limited assistance from other City revenues will be necessary. As such, the Council should expect that this fund will vary annually.

Tehachapi Area lmpact Fee
Chapter 1. lntroduction and Summary
lntroduction
This analysis provides the technical basis for updating the Transportation lmpact Fee OIF) for the Tehachapi area of Kern County, including both the area within the city and the surrounding unincorporated area.
Transportation impact fees are one-time fees typically paid prior to the issuance of a building permit and imposed on development projects by local agencies responsible for regulating land use. To guide the widespread imposition of public facilities fees, the State Legislature adopted the Mitigation Fee Act (the Act) with Assembly Bill 1600 in 1987 and subsequent amendments.
The Act, contained in California Government Code $$66000-66025, establishes requirements on local agencies for the imposition and administration of fee programs.
The existing fee dates backto 2005 as a part of the Kern CountyTransportation lmpact Fee (TlF).
The fee had two components, the Tehachapi Region Transportation lmpact Fee and the Tehachapi Region Core Area Transportation lmpact Fee. The fee has not been escalated over the years to account for rising construction costs, so the current rates are very low compared to fees in other areas, including elsewhere in Kern County.
For this project, an updated comprehensive plan was developed for improvements that will be required on the area road network. The objective is to ensure that adequate transportation facilities will be available to meet the projected needs of the Tehachapi area as it continues to grow, and that the facilities planned are consistent with the relevant future land use and circulation plans. lt is projected that during the life of the TlF, it would collect $34.8 million to assist in funding the 35 proposed improvement projects.
Summary
Chopter 2 - Plonned Growth and Trip Generotion
The first step required for the update was to review previous work and studies, particularly the existing TIF adopted in 2005. This report utilizes similar procedures and assumptions contained in the 2005 report, but with updated procedures.
The next step in the process is to obtain the land use growth planned for the Tehachapi region, both within the City limits and in the surrounding area. The TIF utilizes the land use totals and forecasts contained in the Kern County Traffic Forecasting Model. These are taken from the applicable traffic analysis zones OAZs).These are based on a determination of available developable acreage in the City and its planned land uses.
New residential development is expected to add 5,234 new households in the Tehachapi area during the period 2022to 2042. Non-residential growth is expected to add 3,881 new jobs. The analysis examines the impact of p.m. peak hour trips created by new development. lt was calculated that there will be 7,018 new p.m. peak hour vehicle trips during the life of the TlF.

. 18 roadwaywidening projects . 4 roundabouts
. 9 new traffic signals or intersection . 4 interchanges or ramp improvements improvements
Chopter 4 - Progrom Costs ond Fee Calculation
The basic fee per trip or dwelling unit is calculated by dividing the total cost of the TIF program, $34,791,335 by the total projected 7,108 new p.m. trips. The TIF requirement calculates to a cost of $4,895 per p.m. trip. The proposed TIF fee schedule is shown in Table 1.

Chopter 5 - Nexus Findings
California legislation requires that charges on new developments bear a reasonable relationship to the needs created by, and the benefits accruing to, that development. California courts have long used that reasonableness standard or nexus to evaluate the constitutionality of exactions, including development fees. Based on the analysis included in the body of this report, it can be concluded that the future development and the need for its associated improvements meet or exceed the basic requirements set forth in Government Code sections beginning with 66000 to govern development fees.
The methodology of this report ensures that only the portions of the projects included in the updated TIF project list are necessitated bythe planned growth in traffic and are in support of the adopted General Plans and Policies which guide development. Thus, there is a reasonable relationship between the proposed use of the TIF and the proposed land use development projects on which the fee will be imposed. ln the same manner, there is a reasonable relationship between the need for facilities included in the TIF and the proposed land use development projects.

Chapter 2. Planned Growth and Trip Generation
The roadway network is the fundamental component of transportation in the Tehachapi area. lt provides a basic network for the movement of people and goods in the area. Roadways are used by nearly all travel modes including automobiles, ridesharing (carpools and vanpools), transit buses, bicycles, and local and interregional trucks.
The fee is applied to a number of projects within the Tehachapi area. Many of the projects proposed in this update are included in the existing traffic impact fees adopted in 2005.
New Growth
A key step in the fee development process is to determine the number of trips that will be generated over a Z}-year period by the growth in local development within the fee area. To determine the land use groMh, TJKM utilized information obtained from the Kern COG traffic forecasting model. Land use in the model is arranged by geographic subdivisions within the model that are known as Traffic Analysis Zones, or TAZs. TAZs contain land use, either in employment or housing over a period of years, usually at least 20 years in the future. Table 2 below summarizes the land use growth, expressed in dwelling units and employees, within the study area by the various land use categories.

Residential
The expected residentialgrowth is forecast to increase from 11,122 dwelling units in 2015 to 18,188 dwelling units in 2042,twenty years in the future. The anticipated growth in dwelling units over the 20 year period beginning in 2022 is 5,234 dwelling units. Of these, 70 percent are assumed to be single family dwelling units and the remainder multi-family. The pro-rated p.m. peak hourtrip rate is 0.81 trips perdwelling unit, resulting in an estimated 4,240p.m. peak hour trips over the life of the fee.
Non- Residential
Table 2 also depicts the amount of non-residential land development expected over the life of the TIF based on available developable acreage and employment growth. lt can be seen that there are nine different land use categories represented on the table, again based on land use projections made by planners. These categories are education, food, government, industrial, medical, office, retail, agricultural and other. The growth in employment over the 2O-year periods is estimated at 3,881jobs.

Chapter 3. Selection and Cost of Projects
ln this chapter, the proposed projects to be included in the update of the TIF were selected.
Many of the projects were carried fonarard from the existing TIF adopted in 2005. Projects that have been completed were dropped and new projects were added based on several traffic studies in the area as well as staff knowledge of the area. New cost estimates were made for each project and are included in the Appendix of this report.
A total of 35 projects are included in the updated TIF:
. 18 roadway widening projects
. 9 new traffic signals or intersection improvements
. 4 roundabouts
o 4 interchanges or ramp improvements
These projects are further detailed in Tables 3 and 4 and illustrated in Figure 2.
Assembly Bill 602 (AB 602)
AB 602 was signed into law on September 28,2021. The bill requires that the fee for housing must be levied on a project proportional to the square footage of the proposed unit, or make specific findings explaining why square footage is not an appropriate metric to calculate the fees. ln other words, small homes should pay smaller fees than larger homes. TJKM has adopted two fee categories of fees for both single family homes and multi-family dwelling units. For example, for single family homes, units over 1,500 square feet would pay a standard fee, while home less than 1,500 square feet would pay a reduced fee. The same is true for multi-family units where the break point is 800 square feet. The reduced fee is 30 percent of the standard fee.

Chapter 4. Program Costs and Fee Calculation
Cost per Trip Estimate
Table 5 presents a summary of the TIF improvement project costs; the projected future trips to be added by new development, and the resulting estimated TIF improvement cost per trip. The total cost of the TIF projects to be included is $50,040,525.
The fee calculation is based on trip generation estimates in Table 2 and the cost estimates of the TIF improvement projects. The cost per p.m. peak hour trip is calculated to be $4,895, using a totalTlF project cost of $34,791,335 including the cost for administering the program and 7,018 new p.m. peak hour trips. The TIF improvement project costs as well as the calculated new TIF cost per trip are shown in Table 5.
Table 5:2O22 Cost lrr Estimate
Normalize Land Use
Each land use type has its own trip characteristics. To factor in the percent of new trips and the average trip length, each land use is equated to its equivalency with a single family dwelling unit. A single family dwelling unit is considered to generate 100 percent new trips to the network with an average trip length of 8 miles based on SANDAG's Brief Guide of Vehicular Traffic Generation Rote (April 2002). However, other land uses generate trips that are already on the roadway network and are considered pass-by trips. Additionally, some land uses generate trips with shorter average trip lengths and thus have a reduced impact on the roadway network.
Thus, each land use type was normalized to a single family residential unit by factoring in the percentage of new trips and average trip length. The trip rates used are from the ITE Inp Generotion 1lth Edition and estimates of pass-bytrips and average trip lengths from SANDAG.
All dwelling unit equivalents (DUEs) are then normalized to the single family residential rate.
This information is summarized in Table 6.

New Fee Schedule
Table 7 presents the new schedule of fees for 27 land use types. The land use categories in this fee schedule have been determined based on a range of expected development land use types.
The transportation impact fee for Kern County is calculated by multiplying the DUE by $4,895 (Cost per PM Peak Hour Trip). The transportation impact fee for the City of Tehachapi is determined to be 25o/" less than the Kern County to encourage development within the city core.
Based on guidance from AB 603, single-family residences smaller than 1,500 square feet and multi-family residences smaller than 800 square feet include a 30 percent rate reduction.
Therefore, the Kern County fee for these smaller land uses are calculated with a 30 percent reduction. And the City of Tehachapi fee for these smaller residences is 25 percent less than the Kern County fee within the city core.
lf a project has a land use not listed in Table 7, a similar land use can be utilized. For projects with a use with characteristics that are substantially different from those provided in Table 7, the ITE Trip Generation Manual can be referenced to determine the PM peak hour trip generation rate to calculate the total number of PM peak hour trips for the project. lf a land use type has a documented percentage of pass-by trips, these can be deducted from the PM peak hour trips.
The number of PM peak hour trips is then multiplied by $4,895 for the total impact fee.
It is noted that the cost to build the projects will change over time due to inflation and other factors. To ensure that the projects become fully funded over the course of the program, it is recommended that the fee is adjusted over the course of the life of the fee in relation to the Consumer Price lndex to account for increases in construction costs.

Tehacha Area Fee
Chapter 5. Nexus Findings
TIF's are one-time fees typically paid prior to the issuance of a building permit and imposed on development projects by local agencies responsible for regulating land use (cities and counties).
To guide the widespread imposition of public facilities fees, the State Legislature adopted the Act with Assembly Bill 1600 in 1987 and subsequent amendments. The Act, contained in California Government Code 5566000-66025, establishes requirements on local agencies for the imposition and administration of fee programs. The Act requires local agencies to document five findings when adopting a fee.
The five statutory findings required for adoption of the maximum justified fee documented in this report are presented in this chapter and supported in detail by this report. All statutory references are to the Act.
Purpose of the Fee
For the first finding, the City and County must:
. ldenttfythe purpose of thefee (566001(o) (1)).
This fee is charged under the authority of ordinance 14-00 adopted by the County of Kern on November 13, 2000. The ordinance authorizes the collection of developer impact fees for the purpose of funding projects that help to mitigate congestion in the City and the County. The ordinance notes that legislative-established nexus requirements are satisfied. This fee will charge new development the fair share cost of transportation improvements needed to mitigate the transportation impacts created by that development.
Use of Fee Revenues
For the second finding the City and County must:
. ldentify the use to which the fee is to be put.
lf the use is financing public facilities, the facilities shall be identified. That identification may, but need not, be made by reference to a capital improvement plan as specified in Section 65403 or 66002, may be made in applicable general or specific plan requirements, or may be made in other public documents that identify the public facilities for which the fee is charged (566001(aX2)).
Thirty-five projects have been identified within Kern County and the City of Tehachapi that will benefit from the fee revenues. These projects are listed in Table 3 and Table 4 in Chapter 3 of this report. Appendix 1 includes detailed project descriptions.

Te Area Transportation !m Fee
Benefit Relationship
For the third finding, the City and County must:
o Determine how there is a reasonable relationship between the fee's use and the type of development project on which the fee is imposed (566001(a) (i)).
The City and County have determined that the improvements listed in the report are necessary to support projected development within the City and County. Public facilities funded by the fee will provide a network of transportation infrastructure accessible to the additional residents and workers associated with new development. The benefit from planned improvements and facilities will result from the maintenance of acceptable levels of congestion, as well as improve safety as the use of transportation facilities grow due to addition trips from new development. Thus, there is a reasonable relationship between the use of fee revenues and the residential and nonresidential types of new development that will pay the fee.
Burden Relationship
For the fourth finding, the City and County must:
o Determine how there is a reasonoble relotionship between the need for the public facility ond the type of development projed on which the fee is imposed (566001(d @).
Residential dwelling units and building square footage/employment are indicators of the demand for transportation facilities needed to accommodate growth. As new building square footage is created, the occupants of the new structures will place additional burdens on the transportation facilities. The need for the fee is based on traffic engineering studies assessing the impact of additional vehicle trips from new development as well as City and County policies governing the design of a transportation system needed to serve new growth areas. Traffic engineering and related data were also used to inform the scope of improvements included in the fee program. Appendix 3 includes the source of the traffic engineering data or study for each project along with a summary of level of service results, if applicable.
The City of Tehachapi General Plan Mobility Element, dated January 2012, outlines several policies in support of public facilities that benefit future development as follows:
Policy M3 - lncrease regional roadway connections to improve mobility.
Policy M7 - Require new development to pay its fair share of transportation improvements per the Mobility Element.
Policy M11 - lmplement traffic signals only when other traffic control measures are determined by the City of be inappropriate or unadvisable.
Policy M18 - Maintain a bicycle network that connects bikeways, including multi-use trails, with activity centers.
Policy M20 - Require pedestrian infrastructure consistent with the street hierarchy and intended physical context.
Page | 15
TJKM
Tehachapi Area Transportation lmpact Fee
The Kern County Greater Tehachapi Area Specific Plan, dated December 2010, also outlines several goals and policies in support of public facilities that benefit future development as follows:
Goal Cir. 3 - Reduce congestion in all established community areas and main points of access into such areas.
Goal Cir.4 - Upgrade road circulation in and around Tehachapi.
Policy Cir.12 - Encourage street network connectivity and "complete streets" designed to accommodate multiple transportation modes.
For transportation improvements needed to accommodate the development anticipated in the near term, the cost burden is fully allocated based on development anticipated in the near term.
For transportation improvements that are not immediately needed to accommodate near term development, but will be needed to accommodate development in the longer term, the cost burden is allocated based on projections of new development. Thus, there is a reasonable relationship between the need for the planned improvements, the scope of the improvements, and the developments that will pay the fee.
Proportionality
For the fifth finding, the City and County must:
o Determine how there is o reosonoble relotionship between the amount of the fee and the cost of the public focility, or portion of the public focility, ottributoble to the development on which the fee is imposed (566001(b)).
There is a reasonable relationship between the TIF for a specific development project and the cost of the facilities attributable to that development based on the estimated vehicle trip demand the development will generate in the Tehachapi area. The total fee for a specific development is based on its planned employment and/or square footage for nonresidential uses and the number of dwelling units for residential use. Larger projects of a certain land use type will have a higher trip generation and pay a higher fee than smaller projects of the same land use type. Thus, the fee schedule ensures a reasonable relationship between the transportation impact fee for a specific development project and the cost of the facilities attributable to that project.

RICHARD STANDRIDGE, CHIEF OF POTICE

TEHACHAPT POLICE DEPARTMENT AND THE CIW OF TEHACHAP! CONTRACT WITH THE tAW
FIRM OF HANSON BRIDGETT
BACKGROUND
Police Departments are an extremely high liability function of any municipality, and the City of Tehachapi is no exception. There are occasions in which the department and or city must engage in the disciplinary process with police department employees, which could be as simple as administrative documentation, or termination and litigation. lt is important for the Chief of Police to have a law firm available to provide up to date legal advice on all issues pertaining to the Peace Officer Bill of Rights as well as other legislative mandates that are currently or coming into effect in the upcoming year. The Law Firm of Hanson Bridgett, particularly Alfonso Estrada, are well versed in these issues as they have a proven track record of successful representation of many cities and counties in California. This firm will be used in a very limited capacity for those instances in which the Chief of Police or City Manager deem it necessary.
RECOMMENDAT!ON
The Chief of Police Staff is asking the Council to approve the request for the Mayor to execute an agreement between the City of Tehachapi and the Law Office of Hanson Bridgett, with Alfonso Estrada being the primary attorney assigned to our city. The engagement letter and fee agreement are attached for review and signature.
The City Attorney has been involved in this process and it meets all legal requirements. This contract is subject to City Manager and City Attorney approval.

Billing and Policy Summary
1. Billine Practice. We have learned from experience that the attorney-client relationship works best when clients receive a full explanation at the outset about fees and payment terms. Califomia law requires written fee agreements in many cases, and we have found that our clients prefer to have them even when not legally required. This "Billing and Policy Summary" sets forth the principles underlying our fees and other charges. Please review it and let me know if you have any questions about our billing policies.
In addition, you should direct any future questions about our billing practices or any particular invoices to me.
2. Fees. Except as otherwise agreed with a client, we bill for our services on an hourly basis. We account for our time in tenth-of-an-hour increments, and calculate fees by applying hourly rates assigned to attomeys and other staffto the time spent on a matter. On occasion, we may utilize contract employees to assist in providing legal or paralegal services, working under our direct supervision. In such cases the client is billed at an appropriate hourly rate commensurate with that of our professional staff with equal experience and expertise. All billing rates are reviewed annually and may be adjusted periodically.
3. Other Charges. Depending on the mafter, we may have to use various in-office support systems and outside services. Therefore, you may incur and be billed for costs in addition to professional fees, subject only to written policies regarding the billing of disbursements that a client may provide to us in advance of the engagement. Usually we bill such charges to a client's account at the time they are incurred.
Examples include photocopying, ovemight delivery, messenger services, computer research, travel expenses, court filings, court reporting, data storage and expert witnesses. In some cases, we may request that a client pay the invoice of an outside vendor directly. These expenses are billed at the actual cost with no additional mark up to you. We reserve the right to make periodic adjustments to these charges.
4. Fee Estimates. From time to time, we may be asked to provide estimates of anticipated fees.
Although we will make every effort to do so in a manner appropriate to the circumstances, these estimates may be subject to uncertainties beyond our control. Such estimates should not be viewed as a maximum or minimum fee quotation, unless we expressly confirm so in writing.
5. Billinq Procedurer. Ordinarily, we will bill clients on a monthly basis. Each invoice rvill separately state the amount of fees and costs. Unless otherwise specified, each represents fees and disbursements charged to the client through the end of the preceding month. The full amount of each invoice is due upon receipt by the client. Although we seek to include all fees and charges for a billing period, certain time and cost items from a billing period may not appear in the invoice for that period.
Instead, they may be included in a later invoice. Matters such as probate, bankruptcy, and tmst services and certain financial transactions may involve billing at specified times other than monthly, as mutually agreed upon by thc client and the firm, or as required by the court.
6. Pavment Terms. Payment is due upon presentation of the invoice. Invoices that remain unpaid after thirty (30) days from the invoice date are subject to a late payment charge of ten percent (10%) per year. Payments that are made "on account" and not identified with a specific invoice will be credited to outstanding invoices chronologically, first to costs and then to fees.
7. Credit Reoort- By executing this engagement letter, you agree that we have the right to obtain a consumer report from a recognized credit reporting agency. Should we choose to obtain such a repoq it would be for the purposes of extending credit to you or to review or collect a past due account.
8. Insurer's Role. If you are insured for all or part of the costs of our representation, we will work with you to provide the insurer with the necessary information regarding the claim. However, insurers frequently assert, rightly or wrongly, that they are not obligated to pay for all fees and costs or to pay them on a culrent basis. For this reason, our fees and costs will be billed to you and payment will be due from you on a current basis, irrespective of any eventual reimbursement of a portion of your fees and costs by your insurer,
9. Preservation of Electronic Information. If your engagement includes a litigation matter, it is possible that it will involve electronic discovery. Under Califomia and federal law, the obligation to provide discovery of electronic information carries with it the obligation to preserve such information- Failure to preserve all electronic and paper information that is later determined to be of potential importance to pending or threatened litigation can result in a range of sanctions, including, in extreme cases, the sanction of an adverse judgment. This evidence may also turn out to be critical to your ability to prove facts that support your position in the case, or disprove facts that the opposing party offers. Many electronic document storage systems contain prcgrams that automatically overwrite or delete data. lt is therefore important that you take appropriate steps to ensure that all information and electonic data that may be relevant is not lost, deleted, or destroyed. We will conduct an assessment of your electronic information systems. The assessment will include an initial evaluation and an in-depth identification of sources of relevant information. In the meantime, we recommend that normal document disposition policies, or automatic purging of electronic records, be suspended as to the matters at issue in any pending or threatened litigation until the matter is concluded. Please contact me for our additional fee schedule for assistance with collecting and processing electronically stored information as needed in your matter.
10. Conllicts Review. We have performed a computerized check of potential conflicts of interest that might have prevented us from providing representation in this matter. We understand that you have no objection to our representation of parties with interests adverse to you, and that you consent to such representations and waive any actual or potential conflict of interest as long as those other engagements are not substantially related to our services to you.
Accordingly, you agree that (i) we can in the future represent existing or new clients in any matter, including litigation or other disputes, so long as the matter is not substantially related to our work for you, even if those other clients' interests are adverse to you in the other matter; (ii) we may obtain confidential information of interest to you in these other matters that we cannot share with you; and (iii) you waive any conflict of interest that might arise from any of these representations and will not seek to disqualify us in or assert a conflict of interest with respect to any of those representations.
We agree, however, that your consent to, and waiver of such representations shall not apply in any instance where, as a result of our representation of you, we have obtained proprietary or other confidential information of a non-public nature, that, if known to such other clien! could be used in any such other matter by such client to your material disadvantage or potential material disadvantage. -2-

If, after receiving a notice of the client's right to arbitrate, you do not elect to proceed under the State Bar fee arbitration procedures, and file a request for fee arbitration within 30 days, any dispute over fees, charges, costs or expenses, any dispute, claim or controversy arising between us, will be resolved by binding arbitration as provided in Section l6 above.
