THE SUCCESSOR AGENCY TO THE

TEHACHAPI REDEVELOPMENT AGENCY
TO: BOARD DIRECTORS OF THE SUCCESSOR
AGENCY

TO THE TEHACHAPI REDEVELOPMENT
FROM: HAMED JONES, FINANCE DIRECTOR
DATE: JANUARY 16,2024
SUBJECT: APPROVE A RECOGNIZED OBLIGATION PAYMENT SCHEDULE FOR THE FISCAL PERIOD FROM JULY 1, 2024 THROUGH JUNE ?O,2025 PURSUANT TO HEALTH AND SAFETY CODE sEcTloN 34L17
Background
Pursuant to Section 34177 of the Health and safety code ("HSC"), in order to make payments on enforceable obligations, the Successor Agency to the Tehachapi Redevelopment Agency ("Successor Agency") is required to prepare a Recognized Obligation Payment Schedule ("ROPS") for specified fiscal periods. Each ROPS must be approved by the Oversight Board, submitted to the County AuditorController, the State Controller, as well as the State Department of Finance ("DOF"). Previously, the Successor Agency was required to prepare a ROPS for each six-month fiscal period (from July 1 through December 31, and from January 1 through June 30, respectively). Due to a change in law (SB 107) enacted in Septembe r 2OL5, amended HSC Section 34L77, the Successor Agency is now required to prepare only one ROPS per fiscal year beginning with fiscal year 2OL6-L7 instead of twice a year.

All ROPS must be approved by the Oversight Board. Furthermore, each Oversight Board-approved ROPS must be submitted to the DOF for review. HSC Section 34L77 also requires the Successor Agency to submit an Oversight Board-approved ROPS to the State Controller as well as to the County Auditor-Controller no later than February 7, 2024. A copy of the Oversight Board-approved ROPS must be posted on the Successor Agency's website.

The DOF may eliminate or modify any item on the ROPS before approving the ROPS. The DOF must make its determination regarding the enforceable obligations and the amount and funding source for each enforceable obligation listed on ROPS 24-25 no later than April 75,2024. Within five business days of the DOF's determination, the Successor Agency may request to "meet and confer" with the DOF on disputed items. The meet and confer period may vary, but an untimely submission of ROPS 24-25 may result in a meet and confer period of less than 30 days.

The County Auditor-Controller may object to the inclusion of any item on the ROPS that is not demonstrated to be an enforceable obligation and may object to the funding source proposed for any item. The County Auditor-Controller must provide notice of its objections to the DOF, the Successor Agency and the Oversight Board at least 50 days before disbursements from the Redevelopment Property Tax Trust Fund ("RPTTF") are required to be made.

I 267 I -0006\ I 9 I 702 lv l.doc
Staff Report - Oversight Board Approvalof ROPS 24-25
Page2 of 2
January 16,2024
The County Auditor-Controller is required to make RPTTF disbursements to the Successor Agency pursuant to the DoF-approved ROPS 24-25 on June 1, 2024 (to cover enforceable obligation payments from July t, 2024 through December 31, 20241 and January 2, 2025 (to cover enforceable obligation payments from January t,2025 through June 30, 2025l,.

Penalties for Foilure to Make Timely Submission
lf the Successor Agency does not submit an Oversight Board-approved ROPS 24-25 by February L,2024, the City of Tehachapi will be subject to a civil penalty of S10,000 per day for every day that ROPS 24-25 is not submitted to the DOF. The penalty will be paid to the County Auditor-Controller for distribution to the taxing entities. lf the Successor Agency does not timely submit ROPS 24-25, creditors of the Successor Agency, the DOF, and affected taxing entities may request a writ of mandate to require the Successor Agency to immediately perform this duty. Additionally, if the Successor Agency does not submit ROPS 24- 25 within 10 days of the February L,2024 deadline, the Successor Agency's maximum administrative cost for that period will be reduced by 25 percent.
tf the Successor Agency fails to submit an Oversight Board-approved ROPS to the DOF within five business days of "the date upon which the ROPS is to be used to determine the amount of property tax allocations," the DOF may order the County Auditor-Controller to withhold a scheduled RPTTF disbursement to the Successor Agency pending the DOF's review of the related ROPS. (lt is not clear what is meant by "the date upon which the ROPS is to be used to determine the amount of property tax allocations." Possibly, it is referring to October 1 and April 1, the dates by which the County Auditor-Controller must prepare estimates for the upcoming RPTTF disbursements on January 2 and June 1, respectively, and provide the estimates to the DOF, the Successor Agency and the taxing entities.) ln conjunction with such a withholding, the DOF may order the County Auditor-Controller to disburse to the taxing entities money from the RPTTF that the DOF determines to be in excess of the amount needed for enforceable obligations.

Staff recommends that the Successor Agency adopt Resolution No. SA Ot-24 approving ROPS 24-25 and taking certain related actions.

Fiscal lmpact
The preparation and submittal of ROPS 24-25 is for the purpose of allowing the Successor Agency to pay its enforceable obligations for the period from July L, 2024 to June 30, 2025. The total enforceable obligations amount included on the ROPS 24-25 is S1,708,379.

Recommendation
ADOPT RESOLUTION NO. SA 01.24 APPROVING THE RECOGNTZED OBLIGATION PAYMENT SCHEDULE FOR THE ANNUAL PERIOD FROM JULY 1, 2024 THROUGH JUNE tO,2025 ("ROPS 24-25"1. 1267 I -0006\l9l702lvl doc

Section 66013(d) has similar requirements for water and wastewater capacity charges in that, within 180 days after the close of each fiscal year, the local agency must make available to the public the following information:

1. A description of the charges deposited in the fund; (see report sections 1.2 and 1.3)

2. The beginning and ending balance of the fund and the interest earned from investment of moneys in the fund; (see report section 1.4)

3. The amount of charges collected in that fiscal year; (see report section 1.4) City of Tehachapi 2
Annual & Five-Year Development Impact Fee Report

4. An identification of:
a. Each public improvement on which charges were expended and the amount of expenditure for each improvement, including the percentage of the total cost of the public improvement that was funded with those charges if more than one source of funding was used; (see report section 1.5)
b. Each public improvement on which charges were expended that was completed during that fiscal year; (see report section 1.5) c. Each public improvement that is anticipated to be undertaken in the following fiscal year; (see report section 1.5)

(see report section 1.6)

1.2 Types of Impact Fees and Impact Fee Funds The fees documented in the body of this Annual Development Impact Fee Report (Report) include those listed below. The revenue and expenditures for each fee type are tracked by the City in separate funds.

Table 1. Impact Fees and Funds FY 2022-23
Fund No. Fund/Fee Name Purpose and Use of the Fee
128 Park and Recreation Development Impact Fee
1 Per City Resolution 9-21, further corrected by 36-21, the purpose of this impact fee is for developing, improving, and enhancing public parks and recreation facilities servicing residential development. The basis for the fees as adopted by City Council is detailed in the “Parks and Recreation and Civic Facilities Development Impact Fee Study” report. The report calculated a city share fee for parks and recreation infrastructure needed to serve new development, as well as a Tehachapi Valley Recreation and Park District share fee. The City of Tehachapi collects and spends the city share portion of the fee only, which is documented herein for purposes of compliance with the Mitigation Fee Act’s Annual and Five-Year reporting requirements.

Uses for impact fee revenue are identified in the district’s capital improvement plan, the Open Space/Recreation Element of the City’s General Plan, and other planned projects approved by the City Council described in the impact fee report. 1 In addition to development impact fees, Tehachapi Municipal Code Section 17.42 – Park and Recreation Land Dedication sets forth the requirement for which dedication of land and/or payment of a fee in lieu of dedication is required. Per City Finance Department, the City has not collected any fees in lieu of land dedication. Therefore, no reporting on a separate fund for these fees is shown.

City of Tehachapi 3
Annual & Five-Year Development Impact Fee Report
Fund No. Fund/Fee Name Purpose and Use of the Fee
129 Public (Civic) Facilities Development Impact Fee
Per City Resolution 10-21, further corrected by 8-23, the purpose of this impact fee is to construct Civic Facilities as described in the “Parks and Recreation and Civic Facilities Development Impact Fee Study” report, and to reimburse any capital outlay for completed facilities designed to support growth including the police station and City Hall Annex. Impact fee revenues will be used accordingly. 228 Transportation Impact Fee – Core and Regional
Per City Resolution 37.06, the purpose of this impact fee is to reduce the impacts of increased demand on the city’s roadway network caused by new development. Impact fee revenues shall be used to finance the public facilities described in the Facilities List which is attached to the Resolution and Kern County Transportation Impact Fee Report, showing the list of projects eligible for impact fee funding. One Transportation Impact Fee is set for facilities needs specific to the core area of the city, and the other is set to pay for needs specific to the regional/unincorporated County area. 440 Water Entitlement Fee
Per City Resolution 48-21, Section 13.08.020.B of the Tehachapi Municipal Code requires development outside of Zone A to provide sufficient water rights to accommodate the proposed development. If the developer has insufficient water rights, the Municipal Code requires the developer to purchase an allocation of water rights from the unallocated water rights owned by the City or if these are insufficient, to pay a “water entitlement fee” for each acre foot of water for which water rights are needed. Though development impact fees are governed by the Mitigation Fee Act, the fees are charged in-lieu of meeting the city’s water rights requirements for new development. The City has decided to report on these fees in a similar manner to other development impact fees. 443 Water Connection Fee
Per City Resolution 04-20 and supporting documentation, the purpose of the Water Connection Fee is to fund expansion of the water supply and storage facilities needed to serve new development. The fees collected will be used to finance the public facilities described in the “Water and Sewer Connection Fee Study Final Report”, January 30, 2020.

City of Tehachapi 4
Annual & Five-Year Development Impact Fee Report
Fund No. Fund/Fee Name Purpose and Use of the Fee
445 Sewer Connection Fee
Per City Resolution 05-20, the purpose of the Sewer Connection Fee is to finance wastewater treatment and disposal facilities to reduce the impacts of increased demand caused by new development within the City. The fees collected will be used to finance the public facilities described in the “Water and Sewer Connection Fee Study Final Report”, January 30, 2020. The sewer city-wide fee recovers the cost of the wastewater treatment plant and other sewer assets that benefit the entire service area. Areaspecific fees recover the cost of sewer trunk lines that only benefit their respective development areas.

Annual & Five-Year Development Impact Fee Report 1.5 Public Improvements This section of the Annual Report identifies each public improvement on which fees were expended for the Fiscal Year End June 30, 2023, the amount of the expenditures on each improvement, including the percentage of the cost of the public improvement that was funded with fees.

Table 5. Public Improvement Expenditures FY 2022-23
The Mitigation Fee Act also requires annual identification of the approximate date by which the construction of a public improvement will commence, if the City determines sufficient funds have been collected to complete financing of an incomplete public improvement. The projects listed above represent active uses of impact fee funds to complete current capital improvement projects. Other than the projects listed in the table above, the City has not identified any public improvements that have sufficient funds as of June 30, 2023, to complete the financing on incomplete public improvements.

Government Section 66013(d) has similar requirements for water and wastewater capacity charges to identify each public improvement that is anticipated to be undertaken in the following fiscal year. The current adopted Fiscal year 2023/2024 – 2027/28 Five-Year Budget identifies the following projects as planned for progress and/or completion in Fiscal Year 2023-24:
 Water Entitlement Fee Fund 440 will continue to pay note installments for purchased water rights.  Water Capacity Increase Fund 443 will continue to repay Water Operating Fund 440 for a loan balance before scheduling completion of additonal projects identified in the City’s connection fee study.  Sewer Capacity Increase Fund 445 has planned expenditures for increasing the capacity of the sewer plant.

Annual & Five-Year Development Impact Fee Report 1.6 Interfund Loans The Mitigation Fee Act requires a description of each inter-fund transfer or loan made from the account or fund, including interest rates, repayment dates, and a description of the improvement on which the transfer or loan will be expended. There were no new interfund transfers or loans made between impact fee funds in Fiscal Year 2022-23. The following table summarizes the status of all existing interfund loans from the City’s impact fee funds.

Table 6. Interfund Transfers & Loans as of FY 2022-23

1.7 Refunds The refunding requirements for the Mitigation Fee Act are summarized as follows: If the City determines that sufficient funds have been collected to complete financing on incomplete improvements for which impact fee revenue is to be used, it must, within 180 days of that determination, identify an approximate date by which construction of the public improvement will be commenced (Government Code Section 66001 (e)). If the agency fails to comply with that requirement, it must refund impact fee revenue in the account according to procedures specified in Section 66001 (d). As discussed in this Section 1.5 of this report, determinations regarding sufficient funds collected to complete incomplete improvements are provided by the City’s annual Capital Improvement Plan. The current adopted Fiscal year 2023/2024 – 2027/28 Five-Year Budget identifies projects and funding commitments accordingly. The City has not made a determination that sufficient funds have been collected to complete financing of any other incomplete public improvements. No refunds of impact fee monies were made or required.

Annual & Five-Year Development Impact Fee Report

DEVELOPMENT IMPACT FIVE-YEAR REPORT
This Section meets the requirements for the Five-Year Report. 2.1 Five-Year Report Requirements Prior to 1996, The Mitigation Fee Act required that a local agency collecting impact fees was required to expend or commit impact fee revenue within five years or make findings to justify a continued need for the money. Otherwise, those funds had to be refunded. SB 1693, adopted in 1996 as an amendment to the Mitigation Fee Act, changed that requirement in material ways. Now, Section 66001 (d) requires that, for the fifth fiscal year following the first deposit of any impact fee revenue into an account or fund as required by Section 66006 (b), and every five years thereafter, the local agency shall make all the following findings for any fee revenue that remains unexpended, whether committed or uncommitted:

1. Identify the purpose to which the fee will be put;

2. Demonstrate the reasonable relationship between the fee and the purpose for which it is charged;

3. Identify all sources and amounts of funding anticipated to complete financing of incomplete improvements for which impact fees are to be used;

4. Designate the approximate dates on which the funding necessary to complete financing of those improvements will be deposited into the appropriate account or fund.

Those findings are to be made in conjunction with the annual reports discussed above. If such findings are not made as required by Section 66001, the local agency could be required to refund the moneys in the account or fund, per Section 66001 (d). Once the agency determines that sufficient funds have been collected to complete financing on incomplete improvements for which impact fee revenue is to be used, it must, within 180 days of that determination, identify an approximate date by which construction of the public improvement will be commenced (Section 66001 (e)). If the agency fails to comply with that requirement, it must refund impact fee revenue in the account according to procedures specified in Section 66001 (d). The following provides Five-Year Report financial analysis and findings for each of the City’s PFE Funds.

4. Designate the approximate dates on which the funding necessary to complete financing of those improvements will be deposited into the appropriate account or fund. The date of impact fee collection and deposit of funding is impossible to predict, as impact fee revenue is dependent on economic cycles associated with development activity. The City annually identifies public improvement projects that have sufficient impact fee funds available to complete, including approximate dates (fiscal year) of construction in the Capital Improvement Plan as adopted by City Council. The current adopted Fiscal year 2023/2024 – 2027/28 Five-Year Budget has not identified sufficient funding to complete financing of incomplete improvements. It should be noted that projects are constructed in tandem with TVRPD, requiring both entities to have enough funding from impact fees and other sources accumulated to initiate improvement projects. To date, the City and TVRPD have not identified sufficient funds available to finance incomplete improvements.

2.3 Fund 129 Public Facilities Impact Fee As of June 30, 2023, the Public Facilities Fund has a negative balance of $2,847,915. Please consult Annual Report, Section 1.4 for details. COUNCIL REPORTS
MEETING DATE: JANUARY 8,2024 AGENDA SECTION: PUBLIC WORKS

DEPARTMENT

APPROVED
CITY

TO HONORABLE MAYOR DAVIES AND COUNCIL MEMBERS
FROM: TYLER NAP!ER, DEPUW PUBTIC WORKS D!RECTOR
DATE: JANUARY 8,2024
SUBJECT: DENNISON WELL REHAB WORK
BACKGROUND:

The City of Tehachapi had plans in place for some necessary maintenance work on the Dennison Well. To get things started, we worked alongside Provost and Pritchard (P&P) and Bakersfield Well and Pump. They used a camera to inspect the well, and it turned out that we needed to make some important changes.

The first proposal, as outlined in the attached report submitted to the staff, focuses on a comprehensive set of actions. This includes the replacement of the 8" column pipe spanning 400 feet, along with the 2 Lf 2" tube and shaft, incorporating a new 1/4" airline. Additionally, the proposal includes servicing the 100 hp motor, aiming to ensure its optimal functionality. Moreover, the proposal advocates for the installation of a new 6- stage Goulds pump.

The second proposal involves targeted repair work on a specific section of the well casing identified as requiring immediate attention. Bakersfield Well and Pump proposed a strategic solution by suggesting the installation of a S-foot stainless steelswedge patch atthe 365-foot levelof the well. The swedge patch is a highly durable and reliable repair method, ensuring structural reinforcement by seamlessly fitting over the damaged section of the casing.

Utilizing a swedge patch offers numerous advantages in such repairs. lts stainless-steel composition provides exceptional strength and corrosion resistance, safeguarding against future deterioration and maintaining the well's integrity. Swedge patches are renowned for their ability to create a secure, long-lasting seal, effectively preventing any potential leaks or structural weaknesses.

These proposed replacements and maintenance components, alongside targeted repairs like the installation of a swedge patch, constitute a significant initiative to revamp the essential elements of the Dennison Well. APPROVED

DEPARTMENT
crw
TO: HONORABLE MAYOR MICHAEL DAVIES AND COUNC!L MEMBERS
FROM: WLER NAPIER, DEPUTY PUBLIC WORKS DIRECTOR
DATE: JANUARY 8,2024
SUBJECT: LANDSCAPE MAINTENANCE SERVICES AGREEMENT (AMENDMENT AND EXTENSION)

BACKGROUND
On August 1,2022, the City of Tehachapi initiated a contract with BrightView Landscape Services, lnc., engaging them to provide landscape maintenance services at a monthly cost of 529,704. The original agreement, set to last from August 1,2022, to July 3L,2024, included the provision for both parties to modify the monthly fee by mutua! consent. Over the course of the agreement, the City expanded the scope of services with BrightView, prompting a reassessment of the contract.
ln response, City staff collaborated with BrightView's estimators to accurately price the newly incorporated areas, resulting in a revised monthly rate of 533,041. For perspective, that is a total increase of 53,337, however, 51,852 is a result of the City adding new areas to the scope.

To align with the City's fiscal year starting on July 1st annually, the agreement is slated for an extension and amendment on July \,2024. The renewed term is set to span from July 1, 2o24,to June 30,2027, with an agreedupon annual increase of 5% in the monthly rates over the three-year period.

FISCAL !MPACT
The expenses for this WORK are included in the tY2O23l2O24 budget. The adjustments based on the revised scope and pricing will be updated within the 5-year budget.

HONORABLE MAYOR DAVIES AND COUNCIL MEMBERS

DON MARSH, PUBLIC WORKS DIRECTOR
JANUARY L6,2024
SUBJECT: 2024-2025 PAVI NG PROJ ECTS
BACKGROUND:

The City of Tehachapi owns and maintains 163 lane miles of paved roads within the City limits. This equates to more than 10.3 million square feet of asphalt. Over the past three years, the City has made a significant investment in preserving, repairing and rehabilitating streets. The table below shows the amount of money spent per year on pavement preservation and rehabilitation projects and the source of those funds:
202t 2022 2023
General Fund s390,179 S233,815 5492,572
RSTP Grant S314,500 so S314,750
SBl/Gas Tax $5L6,972 s673,065 s959,935
TOTAL = 5l,,2zl,6st s906,880 $1,177,2s7
SBl=Senate Bill 1(state funds generated through fuel taxes) RSTP=Regional Surface Transportation Program(federal transportation funding program) The work executed in the past three years has significantly improved the overall condition of more than 39 miles and nearly 2.5 million square feet of paved roads within the City. Even with this aggressive effort, this only equates to less than 25% of City roads.
ln November,2022 City residents overwhelmingly passed sales tax Measure S and through several surveys indicated that one of the top priorities for residents was maintaining city infrastructure (roads). Based on this direction from City residents and the success of paving projects over the past three years, City staff has prepared a two-year plan to leverage available grant funding, SBl/Gas Tax funds and Measure S sales tax revenues to accelerate the existing pavement management plan.
2024 2025

RSTP Grant s314,500 s314,500
SB1/Gas Tax s35o,ooo s350,000
TOTAL = 52,728,960 s3,2go,gg4
2024. 2025 PLAN NED EXPENDITURES
By executing larger paving projects, the City will not only improve the pavement quality faster but also maximize available funds by improving contracting efficiencies. The two years of planned work will improve an additional 31 miles of roadway equivalent to 2 million square feet of asphalt.

The attached presentation outlines the planned paving work for 2024 and 2025 FISCAL IMPACT:

The impact to the Fy2O23l2O24 budget is estimated to be 5350,000 for engineering and design work only. Construction costs for the two projects will be incorporated into the FY2O24|2O25 and FY202512026 budgets.
