COUNCIL REPORTS
MEETING DATE: February 20,2024, AGENDA SECTION: COMMUNITY ENGAGEMENT

APPROVED
CITY MANAGER:

DEPARTMENT

TO HONORABLE MAYOR DAVIES AND COUNCIL MEMBERS
FROM: KEY BUDGE, COMMUNITY ENGAGEMENT MANAGER
DATE: February 8,2024
SUBJECT: Honor Flight Kern County Sponsorship
The Community Engagement Department was made aware of the fundraising efforts for Honor Flight Kern County recently for 2024. Honor Flight Kern County is a 501 (C) 3 and provides a valuable and powerful service for our veteran community. They organize and coordinate a special trip for our veterans by paying for their expenses to Washington D.C. The veterans receive all air and ground transportation, meals and overnight accommodations, and a guided tour or the monuments. They also receive a hero's sendoff in Bakersfield and a hero's welcome in D.C.

With councils' approval of this item, we would like to engage American Legion Post 221 and ask them to help select the local Tehachapi veteran to be honored and receive this sponsorship.

Fiscal impact would be 51,500.00 applied to the general fund.

Steven Miles represents Tehachapi for Honor Flight Kern County and would like to share a little more on the impact the program makes for our veteran community.

To whom it may concern;
Honor Flight Kern County, as a recognized 501-3C by the Federal Governmenf does fund raising which allows us to send Veterans to Washington D. C. to view their Memorials and take part in events to honor their accomplishments during their time in the service of our Country.

All travel and accommodations are provided to the veteran at no cost. The approximate cost to send one Veteran to Washington D. C- is 51,5OO.OO
Fund raising is our only means of accomplishing this goal. With that in mind, we do direct and indirect fund raising. Direct fund raising is accomplished via an appointed person or group from Honor Flight Kem County. lndirect fund raising is done through a recognized person or group by Honor Flight Kern County.

Stephen Miles is a recognized fund raiser for the Greater Tehachapi CA Area by Honor Flight Kern County.

Thank you to all who so generously give their time and money to Honor Flight Kern County.

Through your efforts alone we continue to send our localVeterans on a trip of a lifetime.

HONORABLE MAYOR DAVIES AND COUNCIL MEMBERS

HAMED JONES, FINANCE DIRECTOR
FEBRUARY t3,2024
COMMITTED FUND BAIANCE FOR FY 2023-24

BACKGROUND
ln February 2009, the Governmental Accounting Standards Board issued its Statement No. 54 (GASB 54), Fund Balance Repofting and Govemmental Fund Type Definitions.

The objective of this statement is to improve financial reporting and to help with understanding the fund balance by presenting the fund balance in five new components.

The five new components are: Non-spendable Fund Balance, Restricted Fund Balance, Committed Fund Balance, Assigned Fund Balance and Unassigned Fund Balance. ln order to comply with GASB 54 requirements, the City adopted a Fund Balance Policy ("Policy") on June 20, 2011, which requires Council to approve the Committed Fund Balance on an annual basis by adopting a resolution. Since then, two amendments were made to the original resolution 28-11. The Committed Fund Balance is dedicated for the purpose of emergency contingency and is calculated as follows:
"The General Fund Emergency Contingency Fund is calculated using the prior fiscal year General Fund total expenditures. From the total expenditures, subtract the following expenses:

1. total capita! project costs,

2. total operating transfers out, and

3. expenses reimbursed by grants
Then the difference is divided by 12 months and then multiplied by 2 months." The resolution is the City Council's formal commitment of an amount of fund balance to be set aside specifically for emergency contingencies defined as a state or federal state of emergency or declaration of a local emergency. The amount is set at $1,588,629 for fiscal year 2023-24. lt should be noted that this amount and/or commitment may be changed with the adoption of a new resolution by the council.

FISCAL IMPACT
None.

RECOMMENDATION
Adopt a resolution establishing the Committed Fund Balance at $1,588,629 for fiscal year 2023-24 and repealing Resolution No. 06-23.

COUNCIL REPORTS
MEETING DATE: February 20,2024 AGENDA SECTION: ASSISTANT CITY MANAGER

APPROVED

DEPARTMENT H
CITY
TO HONORABLE MAYOR DAVIES AND COUNC!L MEMBERS
FROM: COREY COSTELLOE, ASSISTANT CITY MANAGER
DATE: FEBRUARY 20,2024
SUBJECT: LETTER TO OPPOSE AT&T REQUEST FOR RELIEF OF CARRIER OF LAST RESORT OBLIGATION

BACKGROUND
Telecommunications provider AT&T is labeled as a "Carrier of Last Resort" by the California Public Utilities Commission(CPUC) and is therefore required to provide "Plain Old Telephone Service" or (POTS) landline service upon request to all residential and business customers within its service area. POTS service consists of a uniform set of minimum standards and are important on several levels. They provide reliable voice communication during power outages, have a simple infrastructure that is less susceptible to cyberattacks, and are often used for critical services like emergency calls and alarm systems. POTS service also provides a basic form of communication when more advanced options are unavailable, unreliable or disrupted.

Under the Universal Service rules, carriers, such as AT&T may opt out of their Carrier of Last Resort (COLR) responsibilities when another COLR is providing service and assumes the COLR responsibilities. AT&T is applying and requesting relief for over 99% over their service territory, including the City of Tehachapi and greater Tehachapi areas.

AT&T has identified another voice carrier, but is not requesting, nor identifying another COLR to take their place. AT&T's recent application also requests expedited approve for future COLR relief under the CPUC Tier 1 Advice Letter process, which does not require a traditional CPUC approval.
lf their first request is approved by the CPUC, AT&T could cancel service to its POTS customers as soon as six months from the approval date.

OPPOSITION LETTER
Staff has drafted an opposition letter, addressed to Alice Reynolds, President of the CPUC in opposition of AT&T's request as it would negatively impact both rural customers with few service options and limit reliable access to 9-1-1 dispatch services and both fire and security alarms in the City of Tehachapi. Furthermore, AT&T cannot rely on their wireless and lacking coverage in Tehachapi as a reliable option for either cellular or voice over lP phone connection.

On four occasions, AT&T has attempted to build or co-locate cellular technology unsuccessfully within the Ci$ of Tehachapi. There has not been a new tower built to this date, although they continue to work through the process for a tower at Tehachapi Municipal Airport and are expected to co-locate new antennas on existing facilities within the city this year. However, cellular technology is less reliable for critical services and is impacted by power outages, emergency events and potential cyber-attacks.

We would like to ensure that both equitable and reliable quality services for our communi$ is available and a true POTS service line provider is identified prior to the CPUC granting AT&T's request to essentially abandon their telephone lines.

RECOMMENDATION

WE RECOMMEND THAT THE COUNCIL JOIN SURROUNDING COMMUNITIES IN OPPOSING THIS REQUEST BY AT&T TO THE CPUC AND AUTHORIZE THE MAYOR TO SIGN AND THE LETTER BE SUBiIITTED ON BEHALF OF THE TEHACHAPI CITY COUNCIL.

Re: AT& T Application for Relief of Carrier of Last Resort Obligations-OPPOSE Dear
Alice Reynolds:

On behalf of the Tehachapi City Council, I am requesting that the CPPUC reject AT&T's application for relief of Carrier of Last Resort (COLR) obligations.

As a COLR, AT&T is required to provide "Plain Old Telephone Service" or (POTS) landline service upon request to all residential and business customers within its service area.

While modern technologies such as wireless carriers and voice over lP (VOIP) lines are available, AT&T's unreliable service both in our city and surrounding ruralcommunities does not consist of the same reliability as their current POTS service. While they have made several attempts to improve their wireless coverage, they have yet to do so on four separate occasions. Until a time when AT&T or others provide better more reliable alternative services, we respectfully request a denial of this application.
ln addition, many senior residents still rely on POTS service as their main form of communication in our community due to the simplicity and the costs of that service compared to pricier and lessdependable wireless or VOIP coverage. Security and fire alarms, along with our local emergency response would be negatively impacted by the removal of POTS service.

Additionally, should the CPUC approve AT&T's request, we would like a requirement placed on AT&Tto remove all unused infrastructure includingtelephone lines, poles and support structures within two years. We cannot allow a telecommunications company to not only abandon customers, but also abandon their infrastructure and blight the neighborhoods of the customers they chose not to serve. We hope a rejection of their request is in order and our second request does not come to fruition, but we would like both to be considered on the record.

We support quality services for our residents and businesses and believe COLR relief should not be granted without securing alternatives with similar minimum service quality standards of POTS.

Thank you for considering our request to reject AT&T's application.

Sincerely,
Michael Davis, Mayor
City of Tehachapi

COUNCIL REPORTS
MEETING DATE: February 20,2024 AGENDA SECTION: ASSISTANT CITY MANAGER

DEPARTMENT H

APPROVED
CITY
TO: HONORABLE MAYOR DAVIES AND COUNCIL MEMBERS
FROM: COREY COSTEIIOE, ASSISTANT CIW MANAGER
FEBRUARY 20,2024
SUBJECT: Recycting and Organic Material Service and Authorization of New Rates Subiect to Public Notice and Hearing
DATE:

BAGKGROUND
As the Council is aware, the City of Tehachapi continues to work through the state-mandated regulations surrounding SB 1383 and State-mandated organics recycling programs. \A/lrile the ordinances establishing such services have already been approved by Council, the City of Tehachapi has been working through regulatory and compliance issues with CalRecycle and navigating a complex commercial implementation, food rescue and waivers program with our contract hau ler \A/M(formerly Waste Management).

As it relates to our curbside program for residential customers, we have worked through a tapestry of issues in our "Corrective Action Plan" issued by CalRecycle in 2023, with the goal of adding the final compliance item, curbside organics collection services by the Summer of 2024. Recently, due to the progress made in all other areas of the CAP, the City of Tehachapi was granted an extension to implement curbside service until July 1, 2024. previously, the City Council has approved this new service as part of our CAP, adding organics recycling components into the City's Municipal Code in 2023. The enforcement of that code was put on hold until all the remaining elements of starting the service were addressed. We have reached that position in this long journey.

NEW RATE STRUGTURE
The City of Tehachapi worked in collaboration with \M/l and MSW consultants in reviewing proposed rates for the services. The entire rate structure is included rn the agenda packet along with a rates report, projected increases over the next five years and engineer's report. \A/ith an additional service being added to the \MI route, including another vehicle, and staff to service the additional route, the costs were evaluated by our consultant and found in the attached engineer's report to be reasonable within the costs of providing such services.

The new structure for residential services includes the three-cart collection model for trash, recycling and organics. Under this proposal, the monthly rates for basic residential service will increase from $22.68 per month to $33.91 per month, for a total increase of $1 1 .23 per month. Any additional carts will be billed separately by \A/[Vl, as is the current process.

Additionally, due to State requirements surrounding the operation of the materials recovery facility (MRF), business rates will also increase as businesses will now be required to have a source-separated recycling cart as part of their service.

Currenfly, some commercial customers are serviced with a mixed waste and recycling bin and a 64-gallon organics cart, 6a
=J
the waste and recycling bin is then sent to the MRF where recyclable material is hand separated. Cal Recycle is requiring a move away from this "dirty MRF" practice as it adds to the contamination of the potentially recyclable material. lnstead, it is required to move towards source-separated materials, meaning the additional cart service for recyclable materials will now be required for many commercial customers. The proposed commercial rates reflect that change.

Section 53755 of the California Government Code allows for annual increases based on the consumer price index, along with calculation methodology for a period not to exceed five years. This process is currently in place with our current franchise agreement and will be included in an amended and restated agreement that will come before the Council in April. Annually WI\/l submits the CPI increase request in May and ratepayers are notified a month prior to the coming changes on July 1st.

Staff has done another analysis of nearby jurisdictions to review their rate increases, specifically among residential customers, to compare the proposed increase. The following table indicates the jurisdiction, the hauler, and the increase by adding SB 1383 required organics service.

Jurisdiction Hauler Previous Rate Rate w/ Organics Cost lncrease City of Tehachapi \AAT $22.68 $33.91 $1 1.23
City of Ridgecrest* \/M $25.29 $26.81 $1.52
Westside Waste $5.72
Management
City of Taft^ $32 39 $38.1 1
Golden Hills CSD J Torres $23.48 $34.62
Ci$ of Wasco American Refuse $33.74 $43.33 $9.59
'City of Ridgecrest received permission to service organics and mixed recycling every week carts every other week. ^ Taft includes street sweeping services in rates. Also projects a 17% increase annually for each of the next three years with rates 711124 anlicipated lo be $44.85 a month.

CONSULTANT ANALYSIS
lncluded in the agenda packet is a rate study conducted by MSW Consultants which analyzed the rates provided by \tVTt4, reviewed our proposed franchise agreement, which will come before the Council at a later date, and verified the administrative costs, many of which are State-mandated, to oversee the refuse and recycling services in the City. \/t/trile many cities aim lor 25o/o reserves in their enterprise fund, accomplished by raising either franchise fees with their hauler, or administrative costs, we took a lesser approach to ensure the rates proposed were as low as possible. As you can see in the report there are some projections for future rate increases based on CPI as is allowable for a five-year period and the fund not only balances itself out, but does project about a 5% reserve in the coming years.

Most of this fund are pass-through revenues that come from the residents via city billing for waste and recycling services and then paid to \A/lt/l by the City monthly. The City does allocate portions of salaries of employees who spend time billing, handling customer service, setting up accounts and administering the requirements of the State for recycling compliance.

There are not any capital expenses or assets related to this fund as there are in other enterprise funds.

The conclusion of this report finds that the 10% franchise fee along with proposed rates are adequate to pay \A/ttI, fund City costs or managing our solid waste programs, and maintain adequate cash reserves over the next five years.

PROPOSITION 218 PROTEST PERIOD
The proposed rate structure, as previously mentioned and included in this staff report, is subjectto the Proposition 218 protest process. Council will be asked tonight to tentatively approve the attached rate structure and authorize the 45-day notification period as outlined under Government Code Section 53755. ln addition, MSW, our solid waste consultant, has also included a study on our proposed rates, projected growth within our ratepayers, an analysis of our refuse and recycling enterprise fund and provided the attached study and report.

MSWs contributions have ensured us that these rates are reasonable, do not exceed the costs of delivering the physical services and administrative costs associated, especially with State laws requiring more City staff time be allocated to waste, recycling and landfill diversion efforts.

Customers will receive a notification via mail with the new proposed rate structure, including County landfill fees, which are adopted separately by the County of Kern, along with information regarding the process for the rate approval. Those desiring to protest the proposed rate increase will be instructed in the notice about that process. A public hearing notice will be published in the Tehachapi News, no less than 10 days prior to the public hearing date.

Barring a 50-percent-plus-one majority protest of all property owners, the new rate structure can be approved by the City Council at the public hearing. Should the protest be successful, the City of Tehachapi will still be required to provide the organics collection and commercial recycling bin service. Estimated costs for this service would impact the General Fund by $800,000 in the coming fiscal year, with an anticipated 5% increase annually depending on the Consumer Price lndex used to generate annual rate increases.
ln addition, failure to provide this service will result in a $10,000 a day fine by CalRecycle, totaling $3,650,000 annually, those funds are levied against the allocations of revenue controlled by the State and would therefore be withheld to address the penalties.

RECOMillENDATION
TENTATIVELY APPROVE THE ATTACHED RATE STRUCTURE SUBJECT TO THE PROPOSITION 218 PROGESS AND ACCEPT THE RATE REPORT FROIT' iISW CONSULTANTS.

AUTHORIZE STAFF TO NOTIFY RATEPAYERS VIA WRITTEN NOTICE AND SET THE FINAL PUBLIC HEARING FOR THE ADOPTION OF THE NEW RATES ON MONDAY, APRIL 15,2024 AND ALLOW STAFF TO ADJUST THE PUBLIC HEARING DATE, SHOULD CIRCUMSTANCES REQUIRE, PRIOR TO THE ISSUING OF THE NOTICES.

1.1 Background
The City arranges for solid waste collection service through an exclusive franchise agreement (Agreement) with Waste Management (WM). Under the terms of the Agreement, WM provides solid waste collection service to all residential and commercial premises within the City. The City directly bills all customers for solid waste collection service in conjunction with other utility services. WM directly bills for certain special services requested by customers such as extra carts, extra cart pickups, and cart replacement. The City pays WM for waste collection service based on standard rates set in the Agreement. The amount paid to WM by the City includes an amount to reimburse WM for MRF processing fees that WM pays to Kern County.
ln addition to the amounts it pays to WM, the City incurs cost to manage its residential, commercial, and construction and demolition waste programs, and comply with State recycling laws. The State recently adopted SB 1383, which is the most significant change in solid waste regulations in 30 years' SB 1383 mandates that jurisdictions provide organics waste recycling services to all residents and businesses. SB 1383 also requires jurisdictions to conduct outreach, perform recordkeeping, minimize contamination, recover edible food, and procure organics recycled products.

The solid waste rates billed to its customers are intended to cover the amounts paid by the City to WM, and to cover the Citry's cost of overseeing its solid waste program. The revenue from the amounts it bills customers, the amounts it pays to WM, and the expenses it incurs to oversee its solid waste program, are all recorded in the City's solid waste enterprise fund.

Under the terms of the Agreement, the City retains a franchise fee equal to LOo/o of gross receipts collected from customers. The franchise fee retained by the City is intended to cover the City's cost of program management, and maintain an operating reserve in the solid waste enterprise fund. The Ciby's Agreement with WM entitles the company to an annual increase in rates that is proportionate to the annual percent change in the Consumer Price lndex (Water Sewer Trash). The Agreement also allows WM to request increases in its charges due to increase in the cost of disposal or processing of refuse and recyclables.

This report sets forth the objective of the rate study, describes the work we performed and our key assumptions, outlines the City's projected revenuet expenditures, and cash balance, and states our conclusion regarding the Ci!y's solid waste rates and franchise fee' t.2 Objective
The objective of this solid waste rate study is to:

Ensure that the revenues generated by the City's solid waste rates are adequate to pay WM for the services it provides, and to fund the Ci$s cost of managing its solid waste program. o

2.L Work Performed
To accomplish the project objective, we:

Gathered financial and operational information about the City's solid waste system including financial reports, and a download of service information from the City's billing system.

Developed a rate model that mirrored the financial behavior of the City's solid waste enterprise fund.

Recalculated the Ci!y's solid waste rate revenue based on its current rates and customer count.

Reconciled the calculated revenues, expenses, and cash reserve in the rate model to the amounts in the Cifiy's financial reports.

Analyzed the information provided by the City for reasonableness and internal consistency.

Projected the City's cost of managing its solid waste program over a five-year planning horizon.

Projected the operating results and ending cash balance in the Cihy's solid waste enterprise fund.

2.2 Key Assumptions
Our projected operating results are based on certain key assumptions. Our assumed cost inflation factors and other key assumptions are shown below in Table 1.

Table 1- Key Assumptions
Our projected revenues for fiscal 2025 are based on the customer rates proposed to become effective on J uly L,2024. Our projected revenues for the fiscal years 2026 through fiscal 2029 are based on the assumption that the annual CPI (Water Sewer Trash) adjustment to the City's solid waste rates will be 6% each year.

2.3 Limitations
Our projected operating results are subject to certain limitations. Our projections have been prepared pursuant to the work described above and are based on the City's current number and mix of customers (i.e., residential vs. commercial, etc.). Moreover, the projections are based on assumptions regarding customer volume growth and changes in inflation. For example, our projections are based on the assumption that the annual change in the CPI for Water Sewer Trash will be 6% each year. The actualfuture annual changes in this index may be more or less.

As a result, the City's actual solid waste rates scheduled to become effective beginning )uly L,2025 may be lower or higher than those included in this report. For this reason, and because events and circumstances sometimes do not occur as planned, there may be differences between the projected and actual operating results, and those differences may be material. Finally, these projections were prepared for the sole use of the City for the purpose of analyzing the Ci!y's solid waste enterprise fund.

They are not intended to be used for any other purpose.

The City's projected expenditures and revenues are detailed below in Table 2 through Table 7 (on pages 4 through 8). The Citry's projected operating results and cash balance are summarized in Table 8 (on page 9) , shown graphically in Chart 1 (on page 10), and analyzed in Table 9 (on page 10).

3.1 Projected Expenditures
Table 2 below shows the City's projected expenditures. Table 2 shows that the two largest line items in the Citry's projected expenditures are amounts paid to WM for its collection service and to reimburse WM for County gate fees.

City of Tehachapi 8 Solid Waste Rate Study

3.3 Projected Operating Results and Cash Balance
Table 8 below shows the projected operating results and the resulting changes to the cash balance in the solid waste enterprise fund. The projected operating results are based on the projected expenses shown in Table 2, and the total rate revenue summarized in Table 7. Table 8 also shows that the enterprise fund is projected to realize a shortfall in fiscal 2024. However, upon implementing the proposed rates on July 1, 2024, lhe fund is projected to generate a surplus in fiscal 2025. The cash balance at the end of fiscal 2025 is projected to grow to be approximately $t11,000. The cash balance is projected to grow to be approximately 5292,000 by the end of fiscal 2029. Table 8 also shows that the projected cash balance is expected to exceed the target cash balance by the end of fiscal 2026, and remain above the target balance for the remainder of the planning horizon. This demonstrates that the proposed rates and franchise fee percentage are adequate to pay WM for the services it provides, and to fund the Ci$s cost of managing its solid waste program.

(in 000s)
Chart 1 on the following page graphically shows the relationship between the annual revenues and expenses, and compares the ending cash balance to the minimum reserve target. lt is the Ci$s objective to maintain a minimum cash reserve balance of 5% of the enterprise fund's annual operating expense. Chart 1 shows that at the proposed rates, the cash balance will meet the target by the end of fiscal 2O26, and remain above the target through fiscal 2029. 9 Current

Table 9 below shows the relationship between the portion of revenues used to fund City expenses and the portion of expenses incurred by the City to oversee the solid waste program. Table 9 also shows the projected cash balance as a percent of only the portion of expenditures used to fund the Ci!y's solid waste program. This shows that the projected cash balance as a percentage of this portion of expenses is expected to range between 50% and 108% over the planning horizon. This demonstrates that the City's projected cash reserves are adequate when compared to the City-related portion of total expenses.

City of Tehachapi 10 Solid Waste Rate Study

4. Corucu.lsrorrr
Based on the work we performed, and our review and analysis of the City's proposed rates, we found that the City's proposed rates (including the 10% franchise fee) are adequate to pay WM, fund the Cihy's cost of managing its solid waste program, and maintain adequate cash reserves, over the next five years.
