COUNC!L REPORTS
MEETING DATE: MARCH 18,2024 AGENDASECTION: PUBLICWORKS

HONORABLE MAYOR DAVIES AND COUNCIL MEMBERS

WLER NAPIER, DEPUTY PUBLIC WORKS DIREC-TOR
MARCH LL,2024
SUBJECT: S-YEAR AGREEMENT WITH xlO (SCADA SERVICESI
FROM:

DATE:

APPROVED

DEPARTMENT
CITY
BACKGROUND:

For the past five years, the City of Tehachapi has relied upon XIO for Supervisory Control and Data Acquisition (SCADA) services, a crucial component in maintaining the efficiency and functionality of our water and wastewater systems. XIO's SCADA monitoring encompasses a wide range of essential infrastructure including well sites, tank sites, booster pump stations, pump stations, and the Sewer Lift Station. Through their services, XIO facilitates remote access and scheduling capabilities, ensuring that all aspects of our municipal water and wastewater systems operate effectively and reliably.

Recent developments have prompted discussions between City staff and XIO regarding modifications to their platform and dashboard for operators. These modifications are aimed at enhancing efficiency in viewing and operating the SCADA system. As part of these conversations, City Staff have conveyed their interest in establishing a long-term agreement with XlO. This desire stems from the need to accurately budget for annual fees associated with the SCADA services and to solidify a dependable partnership with XIO over an extended period. Rather than maintaining a year-by-year agreement, the City seeks the assurance of a long-term commitment from XIO to ensure stability and continuity in the management of our water and wastewater systems.
ln light of the critical role that XIO plays in the effective operation of Tehachapi's infrastructure, establishing a long-term partnership is seen as essential for both parties. This arrangement not only provides financial predictability for the City but also fosters a collaborative relationship aimed at continually improving the efficiency and reliability of our water and wastewater systems.

Rt
FISCAL IMPACT:

The cost of services will be split 57,124 annually (67%l in the Water Fund ( 2) and 53,552 annually (33%) in the Sewer Fund (444). The total annual cost (year one) is 510,686.00.

The City wil! pay XIO 510,685.00 for their services in 2024 by April 15,2024. This payment covers the services for the whole year. ln the following years, the payment will increase based on the Consumer Price lndex (CPl) for all Urban Consumers, plus 1.5 percentage points. However, this increase won't exceed 5.5% per year.

XIO must inform the City about the new annual fee. The City manager or their representative will review and approve it. Then, it will be presented to the City Councilfor approval at the next scheduled meeting. Once approved by the City Council, the invoice will be paid within a reasonable timeframe.

RECOMMENDATION
STAFF RECOMMENDS THAT THE CITY COUNCIT APPROVE THE 5 YEAR AGREEMENT WITH X!O, INC FOR scADA SERVTCES AS OUTUNED lN THE PROPOSED SCOPE OF SERVTCES WITH A COST OF $10,586 (ANNUAL FEE - YEAR ONEI.

ASSIGNMENT & ASSUMPTION AGREEMENT AND FIRST AMENDMENT TO IMPROVEMENT AGREEMENT FOR FINAT MAP NO.6248
FROM:

DATE:

SUBJECT:

BACKGROUND:

Tentative Tract Map 6248 was initially approved by the City of Tehachapi in 2003 and represents the oldest residential subdivision project on the City's records. The proposed development is located at the southern end of Robinson Street adjacent to the Wells Education Center and includes 30 lots. Two previous owners/developers failed to move the project into construction leaving staff on the verge of expiring the tentative tract map when the property changed ownership again. Saticoy Development Company, LLC approached the city to continue the map and move the project forward. Saticoy successfully recorded the Final Tract Map on June 15, 2023 and launched construction. As the project progressed into construction, it underwent an ownership change. This has led to Family Lodging, LLC becoming the sole owner of Tract 6248.

Family Lodging, LLC has been working with the city for the past 3-4 months to continue construction. The original improvement agreement was approved on August L5,2022. Since then, 80% of the public improvements have been completed.

PROPOSAL:

This action proposes to move responsibility for the final 20% of the public improvements to Family Lodging, LLC. City staff feels this remains a manageable project for the developer and is in a favorable location that would be an asset to the downtown area. Attached first is an Assignment and Assumption Agreement that will transfer responsibility for the original lmprovement Agreement from Saticoy to Family Lodging. To address the changing project security (bonds), the attached First Amendment to lmprovement Agreement for Final Tract Map No. 6248 was prepared. This amendment serves to allow Family Lodging to make a cash deposit of 5486,289 as security for the remainder of the project work. This deposit assures the city that the unfinished remaining improvements are completed in a timely manner.

The proposed agreement also governs reimbursement terms for the City's expenses in monitoring the project construction. Once construction is complete to the satisfaction of the City Engineer, Staff will request that the Council approve those improvements completing the effort.

RECOMMENDAT!ON:

APPROVE AND AUTHORIZE THE MAYOR TO SIGN BOTH THE ASSIGNMENT AND ASSUMPTION AGREEMENT AND THE FIRST AMENDMENT TO IMPROVEMENT AGREEMENT FOR FINAL TRACT MAP NO. 5248 ATTACHMENT A: Aerial Site View

COUNCIL REPORTS
MEETING DATE: MARCH 18,2024 AGENDA SECTION: CHIEF OF POLICE

DEPARTMENT

APPROVED
CITY
TO: HONORABLE MAYOR DAVIES AND COUNCIL MEMBERS
RICHARD STANDRIDGE, CH!EF OF POLICE
MARCH L3,2O24
SUBJECT: PURCHASE OF POLICE UNITS
FROM:

DATE:

The Tehachapi Police Department continues to need patrol units. This is primarily due to our ageing fleet and the inability to secure vehicles over the past few years due to a variety of issues with the supply chain. We were recently advised by Jim Burke Ford of Bakersfield that the three Ford Explorer Patrol Units which were ordered in 2021 were built and anticipated to be delivered in March 2024. ln addition, we were able to secure two additional vehicles, being Ford F 150 pickup trucks from Phil Long Ford of Denver Colorado. Our local vendors continue to struggle to keep up with the demand of vehicles for the public as well as governmental and private agencies. Thus, we have an opportunity to secure vehicles which will alleviate issues with our aging fleet and reduce time due to costly repairs. This wi!! increase our readiness and ability to continue to provide the high level of service our city requires and deserves.

FISCAL IMPACT
The fiscal impact for purchasing the three Ford Explorers from Jim Burke with equipment is $249,886.52. The fiscal impact for the two Ford F 150's from Phil Long with an estimated equipment upfit is $162,000.00. These funds will be factored in midyear budget adjustment and a portion of the funds will come from the police department budget and Measure "S" funds. A copy of the quotes for the vehicles is attached. The total estimated cost would be $411,886.52.

RECOMMENDATION
Staff requests the City Council to approve the attached quotes from Jim Burke Ford and Phil Long of Denver Colorado.

TO: City Council, City Manager DArE: February 2112024
Thomas F. Schroeter, City Attorney
SUBJECT: League of California Cities City Attorney's Spring Conference The League of Califomia Cities City Attorney's Spring Conference will be held on May 8-10, 2024 in Rancho Mirage. The registration fee is $625.00 and a two-night stay in the hotel is $239.00. During the conference, there will be three days of presentations devoted solely to legal issues facing cities and updates on cases recently decided. This is a critical learning session for city attorneys and reduces the time and effort needed by the City Attorney to research these matters on his or her own.

My other city is being asked to contribute equally to the cost for the registration fee and one night's lodging. The City's share of the expenses would be $551.50. I would request permission to represent the City of Tehachapi at the City Attorney's Spring League Conference and for the City to pay up to $551.50 for my expenses.
