JUNE 25,2024
SECOND READING AND ADOPTION OF AN ORDINANCE UPDATING DISTRICT BOUNDAR!ES TO INCLUDE PROPERTY ANNEXED INTO THE C|TY (ANNEXATTON NO. 85 - RED AppLE TRACT) FROM:

DATE:

SUBJECT:

BACKGROUND
On December 4,2OL7, the City Council of Tehachapi ("City") adopted Ordinance No. 17-07-745, changing the City from at large to by-district voting system, adopting boundaries for the City's five voting districts and establishing an implementation schedule for conversion to by-district voting during the 2018 and 2020 election cycles. ln 2022 the districts were redrawn based on the 2020 census data, as required by the elections code. Additionally, whenever a territory is annexed into the city limits, the council is required to add that new territory into the nearest existing council district without changing the boundaries of the other council districts.

On August 16, 2023, LAFCO approved the annexation of the Red Apple Tract, which sits at the northwest corner of Tehachapi Blvd. and Red Apple Rd. The tract includes one home and is adjacent to both District 1 and District 4. However, following the current alignment of the districts in that area, it ls recommended that the Red Apple Tract be incorporated into District 1.

A map of the annexed territory is attached, as well as an updated District map.

SUBJECT:

HONORABLE MAYOR DAVIES AND COUNC!L MEMBERS
JOHN (JAY) SCHTOSSER, P.E., DEVELOPMENT SERVTCES DIRECTOR IULY L,2024
PUBIIC HEARING: VACATION OF A PORTION OF AN IRREVOCABIE OFFER OF DEDICATION FOR A PUBLTC ACCESS EASEMENT TOCATED AT 787 WEST TEHACHAPT BOULEVARD (APN 415-130- 84)

BACKGROUND
The City of Tehachapi has received a second request to vacate a portion of a Public Access Easement lying on the private property located at787 West Tehachapi Boulevard. The first portion of this easement was released by the City Council on November 20, 2023 as a summary vacation. This second action seeks to vacate the remainder of the easement on this property as depicted in the attached exhibit. This thirty (30)foot wide Public Access Easement for ingress, egress, and road purposes recorded on June 19, 1985, was created to allow public access to Parcel 2 of Parcel Map No. 7665 now Lot 2 of Lot Line Adjustment (LLA) zOzO-OL recorded January 27,2O2O. Duetothe new lot configuration created by LLA 2020-01, Lot l and Lot 2 both have access from West Tehachapi Boulevard.

Unlike the vacation that occurred on Novemb er 20, 2023, this second vacation cannot occur without a public hearing as City Staff received a verbal complaint about this potential vacation from the adjacent business owner of the Dog House Saloon. The regulations that Bovern the process to vacate an easement of this nature require a public hearing before the City Council if objections to the vacation are known.

ANALYSIS
As noted above, this public access easement was dedicated in 1985 to permit access to two lots separated from Tehachapi Boulevard. These lots no longer exist and were replaced by the current lot arrangement in 2020 when LLA 2020-01 was approved. The easement therefore has no further value to the property owner but instead prevents the landowner from using the subject land. The verbal complaint received from the neighboring business owner relates to his desire to use this land to support his business. These "uses' by the neighbor are unclear to City Staff and we have not been able to identify any bona fide need this neighboring business owner may have for this easement. As such, City Staff believes this easement is excess in nature and may be vacated.

RECOMMENDATION
The vacated portion has been superseded by lot configuration and is excess right-of-way, which is no longer required. The City hereby finds it to be excess to the City.

CITY OF TEHACHAPI
TO City Council, City Manager D,q.rr: Juur 18,2024
Thomas F. Schroeter, City Attorney
League of California Cities Annual Conference
FROM :

SUBJECT
The League of California Cities Annual Conference will be held on October 16-18 in Long Beach. The registration fee is $650.00 and a two-night stay in the hotel is $199.00 per night.

During the conference, there will be three days of presentations devoted to legal issues facing cities and updates on cases recently decided. This is a critical learning session for city attorneys and reduces the time and effort needed by the City Attorney to research these matters on his or her own.

My other city, the city of Wasco, is being asked to contribute equally to the cost for the registration fee and one night's lodging. The City's share of the expenses would be $524.00. I would request permission to represent the City of Tehachapi at the Annual League Conference and for the City to pay up to $524.00 for my expenses.
