SUBJECT: Proclamations & Recognitions
We have two requests for proclaiming September in Tehachapi as a special month.
The Community Action Partnership of Kern County, also known as Cap-K, has requested September be proclaimed "Hunger Action Month" in support of their ongoing mission to help those in need. CAP-K supports our Senior "Meals on Wheels" and Salvation Army food programs among others.
Our second proclamation request is to declare September as "National Service Dog Month" and recognize Canine Companions as one of the leading providers of service dogs to Americans in need. Canine Companions has several trainers that aid in this mission to help Americans with disabilities.
We have 10 organizations we would like the city council to consider in recognition for events they have contributed to that make the City of Tehachapi a special place.
To begin our recognitions, first we would like to recognize Cheers for Charity for their annual fundraising event that benefits so many local nonprofits. On August 1.0 Cheers to Charity celebrated its 10th annual event.
Over the past ten years they have distributed several hundred thousand dollars across the Tehachapi community.
Next, we would like to recognize the Tehachapi Valley Arts Association for their continued support of adding art to our community. On August Loth TVAA held its annual "Chalk on the Walk" event, inviting local artisans to create and share the beauty of sidewalk art utilizing chalk to bring the concrete to life. Money raised helped supply local Tehachapi students with art supplies. We would also like to add the efforts of TVAA, and their coordination of the Downtown Maker's Market during Mountain Festival weekend assisted in bringing people closer to local businesses.
Next, we would like to recognize the Tehachapi Valley Recreation and Parks District for their continued support of the Tehachapi community by providing support during special events like the 4th of July celebration, the Old Timers Picnic, Veteran's Day and the Mountain Festival events at parks in the city and for their coordination of the Mountain Gallop 5K during Mountain Festivalweekend.
Next, the Tehachapi Mountain Rodeo Association for their continued efforts to showcase the "western way of life" through the rodeo events at the Tehachapi Event Center and Rodeo Grounds. These events add to the overall success of the 4th of July celebration, Mountain Festival weekend and the Apple Festival weekend.
CALIFORNIA
The Greater Tehachapi Chamber of Commerce for their ongoing annual efforts in producing the Tehachapi Mountain Festival weekend, this year marked the 61't annual event. The Chamber works hard to coordinate numerous local and regional organizations to make the weekend as special as possible for our community.
Thousands of people come to this event each year and have a huge variety of things to do and entertainment to enjoy with their families thanks to the effort of the Grater Tehachapi Chamber of Commerce.
Next, the Tehachapi Amateur Radio Association for their support of community events and volunteerism to make them special. TARA at the Mountain Festival assisted the Chamber of Commerce with communication efforts and helped return two lost children to their parents within minutes of being lost.
We would like to recognize Derrick and Jesse Davis, owners of Westlane Brewing for the creation of the "Green Street Get Down" during Mountain Festival weekend. The Davis's pitched the idea about re-creating the Green Street Dance which began in 1915 and was an annual event for many years. The first attempt in 2023 was rained out thanks to a tropical storm. This year was a huge hit, more than 1.,300 people were in attendance and enjoyed a Tehachapi summer evening and some great live music. Local downtown businesses that participated that evening reached out and stated they made between 2OO-250% more than normal on a Saturday night.
Also, #LoveTehachapi for their sense of community and volunteerism for all events we put together in the City of Tehachapi. Without hesitation #LoveTehachapi volunteered to be part of the Get Down on Green Street. #LoveTehachapi provided and gave away free food, drinks, and assisted with check in at the alcohol lD tables. #LoveTehachapi routinely supports the city with litter cleanup projects and partners with our six blood drives we host in the city each year.
Next, the Tehachapi Area Association of Realtors for their continued support of making Tehachapi beautiful.
Several times each year TAAR reaches out to the City of Tehachapi and asks if they can help with litter cleanup events. For each event TAAR asks us where they can have the most impact and the greatest need to help with their cleanup efforts. This ongoing relationship is greatly appreciated by our Public Works Department.
And finally, we would like to recognize the Tehachapi Mural Project with their restoration efforts has revitalized the interest of outdoor art in Tehachapi. They have created Make Art Tehachapi and inspired people to enjoy our existing murals throughout downtown and raise money to maintain these works of Art.
We are also excited to announce the Make Art Tehachapi team will be starting new mural projects on utility boxes in our downtown. Artist Mark Pestana is volunteering his time to create a mural highlighting our military on the utility box on Tehachapi Blvd in front of the VFW. The City of Tehachapi has sponsored all the costs associated with this special mural.
We ask Mayor Davies and City Councilto We ask Mayor Davies and Council to proclaim September as "Hunger Action Month" and "National Service Dog Month" in the City of Tehachapi, and to recognize these groups for the extraordinary efforts that benefit the Tehachapi community.

SUBJECT: Tehachapi Hometown Christmas 2024
We are excited to announce the 3'd annual Tehachapi Hometown Christmas on Saturday December 7 on Green Street in downtown. This event has been very popular for families to come enjoy the atmosphere and spend time with our local nonprofit vendors, artisans and downtown businesses. We will have lots of kid friendly games and activities and photo opportunities.
The Community Engagement team will be hosting two planning meetings on Tuesday September 17, the first at noon and the second at 6pm here in this room. We will lead the discussion on this year's preliminary plans forthis year's events and will provide an update on how businesses can get involved. We plan to have a theme this year that coincides with the Chamber of Commerce Christmas Parade and the new route the parade will take.
The Tehachapi Hometown Christmas was created originally to fill a gap in Christmas themed activities during the first Saturday in December. With allthe special events, Breakfast with Santa, Photos with Santa at the Depot, the Christmas Parade, Christmas Tree lighting ceremony, and the Christmas musical planned at the BeeKay Theatre the Tehachapi Hometown Christmas fit in nicely to enhance the Christmas spirit in downtown.
Many businesses mentioned they had one of their best days of the year.

SUBJECT: AT&T AIRPORT CELL TOWER LEASE
FROM
BACKGROUND
As the Council is aware, the City has often held lease agreements with wireless carriers for cell towers on the Airport Hill, or the Rock Pile. The attached lease agreement with New Cingular Wireless PCS (AT&T) allows for the construction of a 38 foot celltower with an initialterm of five years, with four additionalfive year options.
The design and conditions of approval for the new cell tower were approved by the Planning Commission on August 12,2024.
FISCAL !MPACT
Revenue to the Airport:
lnitial fee received 55,000.00
Month ly revenue Sg,OOO.OO
Annual revenue S35,000.00
Annual lncrease - 3%
The revenue generated from thesetypes of leases makes up a significantsource of the operatingfundsforthe airport and the impact to the airport associated with the cell tower operations are negligible.

The Communications Facility is as shown on Exhibit "B" attached hereto and by this reference made a part hereof. To the extent inconsistent with Exhibit "B," the final location, dimensions and design of the Communications Facility shall be subject to Landlord's receipt and approval of Tenant's final site plans. The uses expressly conferred by Landlord to Tenant pursuant to this Section 2, including the terms and conditions expressly set forth herein, shall be collectively referred to as Tenant's "Permitted Use". (b) For a period of one hundred eighty (180) days following the start of construction, or such longer period as may be reasonably required by Tenant provided Tenant diligently pursues the construction to completion in compliance with City building inspection timelines, Landlord permits Tenant, the right to use such portions of Landlord's contiguous, adjoining or surrounding property (the "surrounding Property") as may reasonably be required during the construction and installation of the Communications Facility, provided, however, that upon completion of construction and installation, the foregoing permission shall automatically terminate and be of no further force or effect. Tenant and Landlord shall perform a preconstruction site visit with Landlord's Airport Manager at the Property to establish the Surrounding Property which may be utilized for the limited period.

3. TERM.
(a) The initial lease term will be five (5) years (the "Initial Term"), commencing on the first day of the month after Tenant's start of construction or start of installation of the Communications Facility as determined by Landlord in its sole discretion (the "Construction Date"). (b) On the annual anniversary of the Construction Date (the "Rent Adjustment Date") throughout the Initial Term and all Extension Terms, the Rent shall be increased by an amount equal to three (3) percent of the Rent paid during immediately preceding twelve month period. APPROVALS.
(a) Landlord agrees that Tenant's ability to use the Premises is contingent upon the suitability of the Premises and the Property for Tenant's Permitted Use and Tenant's ability to obtain and maintain all governmental licenses, permits, approvals or other relief required of or deemed necessary or appropriate by Tenant for its use of the Premises, including, without limitation applications for zoning variances, zoning ordinances, amendments, special use permits, and construction permits (collectively, the "Government Approvals"). Landlord and Tenant acknowledge and agree that Tenant may prepare, execute and file all required applications to obtain Government Approvals for Tenant's Permitted Use under this Agreement. In addition, Tenant shall have the right (i) to initiate the ordering and/or scheduling of necessary utilities, (ii) to obtain a title report or commitment for a leasehold title policy from a title insurance company of its choice, and (iii) to have the Premises surveyed by a surveyor of its choice, but may not conduct any invasive testing of the Premises without Landlord's prior written consent. All such Tests shall be at Tenant's sole cost and expense. Notwithstanding the foregoing, Tenant may perform and obtain, at Tenant's sole cost and expense, (i) a non-invasive Phase I environmental report, and (ii) other non-invasive Tests on and over the Premises.
6. TERMINATION. This Agreement may be terminated, without penalty or further liability, as follows:
(a) by Landlord in the event that Rent due and payable by Tenant hereunder remains unpaid by Tenant for a period of ten ( I 0) days following Tenant's receipt of Landlord's written notice of non-receipt of such Rent as described in Section 15 of this Agreement; 4 (b) by either party if the other party remains in default under Section 15 of this Agreement after the applicable cure periods;
(c) by Tenant within the first consecutive twelve (12) months of this Agreement upon written notice to Landlord if Tenant is unable to obtain or maintain any required approval(s) or the issuance of a license or permit by any agency, board, court or other governmental authority necessary for the construction or operation of the Communications Facility as now or hereafter intended by Tenant; or if Tenant determines, in its sole discretion that the cost of obtaining or retaining the same is commercially unreasonable;

The required CGL insurance shall include Landlord, its officers, council members and employees as an additional insured and shall be primary insurance such that Landlord's insurance shall be noncontributory.
Within forty-five (45) days of the Effective Date or ten (10) days prior to Tenant's commencement of construction of its Communications Facility, whichever occurs first, Tenant shall provide Landlord with a certificate of insurance and blanket additional insured endorsement showing the foregoing in full force and effect. During the Term ofthis Agreement, certificates shall be provided to Landlord annually reflecting the continued maintenance of the CGL insurance. Such additional insured coverage shall not extend to claims for punitive or exemplary damages arising out of the acts or omissions of Landlord, its employees, agents or independent contractors or where such coverage is prohibited by law or to claims arising out of the gross negligence of Landlord, its employees, agents or independent contractors.
(b) Notwithstanding the foregoing, Tenant shall have the right to self-insure 5 the coverages required in subsection (a). (iii) Landlord shall fully cooperate with Tenant in the defense of the claim, demand or lawsuit.
8. INTERFERENCE.
(a) Tenant warrants that its use of the Premises will not cause interference (as hereinafter defined) with those existing radio frequency uses on the Property as of the Effective Date as long as the existing radio frequency user(s) operate and continue to operate within their respective frequencies and in accordance with all applicable Laws (as defined in Section 22below).
In the event Tenant's frequencies interfere with any existing radio frequencies uses on the property, Landlord will' not notifu Tenant by calling Tenant's Network Operations Center at and Tenants Landlord Hotline at . If the interference
occurs or continues to occur for a period in excess of ten (10) consecutive days following notice to Tenant, Tenant shall immediately reduce power or cease operations of the interfering equipment (except for intermittent testing to determine the cause of such interference) until such time as the interference is cured. Prior to commencing construction of the Premises, Tenant shall obtain an airspace case determination letter that includes the Tenant's proposed frequency. Landlord shall not be responsible for any claims, damages or further liability if Tenant's use of the Premises interferes with existing towers, radio frequency users and/or wireless service providers that predate this Agreement and are currently active at the Property as of the Effective Date. Landlord shall also not be responsible for any claims, damages or liability if existing towers, radio frequency users and/or wireless service providers predating this Agreement interfere with Tenant's use of the Premises; provided that after the Effective Date of this Agreement, such use is in accordance with applicable Laws, and Landlord shall comply with its covenants set forth in Section 8(b) and 8(c) below.
(b) Landlord will not knowingly grant, after the date of this Agreement, a lease, license or any other right to any third party, if exercise of such grant would cause Interference (as hereinafter defined) with Tenant's Permitted Use or the other rights expressly granted or conferred to Tenant pursuant to this Agreement. Landlord will notifu Tenant in writing prior to granting any third party the right to install and operate communications equipment on the Property 6 for which a license to transmit or receive a signal from the Federal Communications Commission ("FCC") is required.
(c) Landlord will use commercially reasonable efforts to cause such Interference to cease within ten ( I 0) days after receipt of notice of Interference from Tenant. In the event such Interference does not cease within the before mentioned cure period, Landlord shall, to the extent of Landlord's control over any party causing such Interference to Tenant, cease all operations which are suspected of causing Interference (except for intermittent testing to determine the cause of such Interference) until the Interference has been corrected. Notwithstanding the foregoing, Landlord's use of the Property in the ordinary course of Landlord's public function of operating a municipal airport operation shall be paramount to Tenant's Permitted Use. Where potential conflicts in airport operations may create Interference with Tenant's Communications Facility or the rights conferred to Tenant hereunder, then Landlord will use commercially reasonable efforts to meet and confer with Tenant and use reasonable efforts to develop solutions following such good faith consultation.
(d) For purposes ofthis Section 8, the term "Interference" shall be defined to mean any material and adverse (i) physical obstruction with the communications signals from Tenant's Communications Facility or the rights expressly granted or otherwise conferred by Landlord to Tenant pursuant to this Agreement; or (ii) electronic interference from a use on the Property with the communications signals from Tenant's Community Facility for which use a license to transmit or receive a signal is required from the FCC.
9. INDEMNIFICATION.
(a) Tenant shall indemnifu, defend and hold harmless Landlord, its officers, council members and employees from and against any and all injury, loss, damage or liability (or any claims in respect of the foregoing), costs or expenses (including, without limitation, reasonable attorneys' fees and court costs) occurring on or after the earlier of (i) the Construction Date or (ii) Tenant's occupation of the Premises, and arising out of or relating to, whether directly or indirectly, the construction, installation, use, maintenance, repair or removal of the Communications Facility or Tenant's breach of any provision of this Agreement or any covenant or warranty herein. (b) Landlord shall promptly provide Tenant with written notice of any claim, demand, lawsuit or the like for which it seeks indemnification pursuant to this Section and provide Tenant with copies of any demands, notices, summonses or legal papers received in connection with such claim, demand, lawsuit or the like. Landlord shall not settle any such claim, demand, lawsuit or the like without the prior written consent of Tenant, and Landlord shall fully cooperate with Tenant in the defense of the claim, demand, lawsuit or the like. A delay in notice shall not relieve Tenant of its indemnity obligation, provided such delay shall not materially prejudice Tenant's ability to defend the matter.
10. WARRANTIES.
(a) Tenant and Landlord each acknowledge and represent that it is duly 7 organized, validly existing and in good standing and has the right, power and authority to enter into this Agreement and bind itself hereto through the party set forth as signatory for the party below.
(b) Tenant further represents and warrants that (i) it is duly organized, validly existing, and in good standing and is authorized to do business under the laws of the State of California, (ii) that the execution and delivery of this Agreement by Tenant and the consummation by Tenant of the transaction contemplated herein has been duly authorized by all necessary action on the part of the Tenant and all required consents and approvals have been obtained; (iii) that this Agreement is a binding obligation on Tenant; (iv) and that no attachments or execution proceedings and no assignments for the benefit of creditors or insolvency, bankruptcy, reorganization or other proceedings are pending against Tenant related to the matters contemplated in this Agreement.
(c) Landlord represents, warrants and agrees that: (i) Landlord solely owns the Property; (ii) the Property is not and will not be encumbered by any liens, restrictions, mortgages, covenants, conditions, easements, leases, or any other agreements not of record, which would cause Interference with Tenant's Permitted Use or the other rights expressly granted or conferred to Tenant pursuant to this Agreement; (iii) the Property will not be encumbered by any liens, restrictions, mortgages, covenants, conditions, easements, leases, or any other agreements of record, which would cause Interference with Tenant's Permitted Use or the other rights expressly granted or conferred to Tenant pursuant to this Agreement; (iv) as long as Tenant is not in default beyond any applicable notice and cure period under this Agreement, then Landlord grants to Tenant sole, actual, quiet and peaceful use, enjoyment and possession of the Premises without hindrance or ejection by any persons lawfully claiming under Landlord; and (v) Landlord's execution and performance of this Agreement will not violate any laws, ordinances, covenants or the provisions of any mortgage, lease or other agreement binding on Landlord.
11. ..AS IS'.
(a) Except to the extent otherwise expressly set forth herein, Tenant accepts the Property "AS IS, WHERE IS, AND WITH ALL FAULTS" including those portions of the Property where Landlord has expressly granted or conferred rights to Tenant under this Agreement.
Tenant acknowledges that the Property is an inherently dangerous area and is not constructed nor maintained for the purpose for which Tenant intends to use it. Tenant, for itself, and on behalf of its employees, subcontractors, agents and representatives assumes the risk of same and hereby waives, releases, and discharges Landlord, its officers, council members and employees from any and all liability, claims, actions, losses, costs, and expenses arising out of all injuries and damages (collectively, "Claims") which may be suffered by Tenant or Tenant's employees, subcontractors, agents, or representatives, except to the extent attributable to a negligent or intentional act or omission of Landlord, its employees, agents or independent contractors. Tenant represents and warrants that it has read and fully understands the provisions of Section 1542 of the Civil Code of California (hereinafter the "CC1542 Waiver") and expressly waives and releases any right or benefit which it may have thereunder and which states as follows: "A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time 8 of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor." Notwithstanding the foregoing sentence, the CCl542Waiver is not intended to waive and release any Claims to the extent attributable to the negligent or intentional act or omission of Landlord, its employees, agents or independent contractors. (b) Notwithstanding the provisions of Section I I (a) or any other provision of this Agreement to the contrary, the CCl542 Waiver is not intended to waive and release any claims by Tenant, Tenant's employees, subcontractors, agents or representatives to the extent attributable to Landlord's breach of any term, covenant or condition of this Agreement or to the extent attributable to a negligent or intentional act or omission of Landlord, its employees, agents or independent contractors.
(c) In the event Tenant becomes aware of any hazardous materials on the Premises in violation of applicable Laws, or any environmental, health or safety condition or matter relating to the Premises, that, in the reasonable exercise of Tenant's discretion, renders the condition of the Premises unsuitable for Tenant's use, or exposes Tenant to undue risks of liability to a government agency or third party, Tenant will have the right to terminate this Agreement upon thirty (30) days written notice to Landlord.
(d) Landlord covenants and agrees that Tenant shall have no liability for any action, notice, claim, order, summons, citation, directive, litigation, investigation or proceeding, to the extent arising from subsurface or other contamination of the Property with hazardous substances prior to the Effective Date or from such contamination caused by the acts or omissions of Landlord during the Term.

Landlord shall have all rights of use of the Access and Tenant shall not unreasonably interfere with Landlord's use. Subject to such rules and regulations as maintained by Landlord for the safe and secure operation of the Property, which rules and regulations shall be adopted and applied in a reasonable and uniform manner, Tenant shall have access to the Premises during ordinary business hours (8:00 a.m. to 5:00 p.m. Monday through Friday) for regular maintenance and repairs, and twenty -four (24) hours a day, seven (7) days a week for unscheduled repairs and other emergency purposes, to be determined by Tenant in Tenant's reasonable discretion. In the event Tenant needs access after business hours, Tenant will endeavor to give Landlord prior notice, if feasible. (b) Tenant may install, operate and maintain transmission cables from the equipment shelter or cabinets to the antennas and related appurtenances, and electric and communication lines to and from and between and among the equipment shelter or cabinets and utility points of connection located on the Property (the "Utilities") as depicted on Exhibit "8" attached hereto. Tenant shall be responsible for paying all utility charges for electricity, telephone 9 service or any other utility used or consumed by Tenant on the Premises. Landlord agrees, provided same is at no expense to Landlord, to reasonably assist Tenant with such applications (subject to Landlord's review and reasonable approval of same) and with obtaining and maintaining the Utilities.
13. REMOVAL/RESTORATION. All portions of the Communications Facility brought onto the Premises or the Property by Tenant will be and remain Tenant's personal property and, at Tenant's option, may be removed by Tenant at any time during or after the Term. Landlord covenants and agrees that no part of the Communications Facility constructed, erected or placed on the Premises by Tenant will become or be considered as being affixed to or apart of, the Property, it being the specific intention of Landlord that all improvements of every kind and nature constructed, erected or placed by Tenant on the Premises will be and remain the property of Tenant and may be removed by Tenant at any time during or after the Term.
Notwithstanding the foregoing, all of the Communications Facility shall be removed within twelve (12) months from the date of termination of the Agreement and the Premises shall be returned at Tenant's sole cost and expense to its condition existing as of the date of this Agreement, reasonable wear and tear excepted, as reasonably determined by Landlord. Any failure of Tenant to do so shall constitute a material breach of this Agreement and, in addition to all other remedies available to Landlord hereunder or at law or in equity, Landlord may cause the removal of the Communications Facilities at Tenant's sole cost and expense. In the event that Tenant fails to remove its Communications Facility and restore Premises within the time periods stated in this Section 13, Tenant shall pay to Landlord an amount equal to Rent applicable during the month immediately preceding such expiration or earlier termination of the Agreement until Tenant's Communication Facilities are removed from the Premises and the Premises is restored in accordance with this Section 13.

Except for a default by Tenant in the payment of Rent, delay in curing a default will be excused if due to causes beyond the reasonable control of Tenant. If Tenant remains in default beyond any applicable cure period, l0
Landlord will have the right to exercise any and all rights and remedies available to it under law and equity.

No such failure, however, will be deemed to exist if Landlord has commenced to cure the default within such period and provided such efforts are prosecuted to completion with reasonable diligence. Any such Transfer shall require the transferee to assume all of the obligations of Tenant from and after the effective date of the Transfer. In the event of such assignment, Tenant will be relieved of all future performance, liabilities and obligations under this Agreement.
(b) Sublease. Tenant may sublease any portion of space on its communications tower located on the Premises and space for wires, cables, conduits, and pipes to service space on the communications tower, within its sole discretion and without Landlord's consent. AMENDED MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF TEHACHAPI AND THE COUNW OF KERN FOR RULE 2OA UTILITY POLE UNDERGROUNDTNG PROJECT
BACKGROUND
On December 20,202L, the City Council approved a proposalto create an Underground Utility District (UUD)to relocate all overhead utilities underground and remove applicable utility poles along Valley Boulevard between Las Colinas Street and Curry Street as depicted in Exhibit "A".
This section of Valley Boulevard was selected due to its regional significance for commerce and commuters alike. The removal of overhead powerlines allows for expanded future transportation.
The California Public Utilities Commission (CPUC) authorized electric and telecommunication utilities to convert overhead utility lines and facilities to underground utilities pursuant to Electric Rule 20 and Telecommunication Rule 32 The County originally transferred sufficient Rule 20A Program credits to the City to fund this project estimated at S5,300,000. Due to the rising cost of construction, this estimate has increased to S7,3OO,OO0. The amended MOU provides additional Program credits in the amount of 52,000,000 to cover this cost increase.
Chapter 13.16 of the City's Municipal Code establishes a procedure for the creation of Underground Utility Districts. This was approved at the January L8,2022 City Council meeting.
FISCAL !MPACT
Staff anticipates costs for the undergrounding work will be covered with existing and added City of Tehachapi and County of Kern's Rule 20A credit balances.
There is a possibility of minor expenses to occur with this project due to items not covered by the Rule 20A program.
These minor expenses are unknown at this time but may be a qualified expense under the City's Traffic lmpact Fee Program.
SCE has prepared an updated Rough Order of Magnitude (ROM) Cost Estimates for the undergrounding work within the proposed UUD as follows:
a
The City of Tehachapi's current Rule 20A credit balance, including the original MOU, is 55,300,319. The amended MOU will transfer another portion of the County's Rule 20A credit balance to the city to cover the difference in costs estimated at an additional $2,000,000.

BACKGROUND
As the City of Tehachapi continues to thrive, grow and expand, we have seen an increase in freight and commuter traffic travelling along State Highway 58. The need for extensive upgrades to the interchanges has become a priority to support the needs of both the local residents and commercial traffic. This project seeks to improve the interchange at East Tehachapi Boulevard and State Highway 58 by realigning the eastbound ramps to a new intersection at Steuber Road and Valley Boulevard and the westbound ramps to Noria Drive.
This project naturally requires extensive coordination with Caltrans District 9 and Kern County with specialized procedures that must be undertaken to prepare these projects for construction that are over and above the normal efforts associated with capital construction.

M ITIGATION
2.L - Understanding of the Work to be Done
The SR SSfiehachapa Boulevard interchange, near the eastern city limits of the City of Tehachapi, is a critical connector between the San Joaquin (SJ) Valley and Southern California. This interchange primarily serves interregional trucks and recreational SR-58 traffic accessing truck stop6 and freeway commercial uses. SR 58 plays a crucial role in transponing freight from SJ Valley's agriculture industry and distribution centers to Southern California and Southern united States.
Since 2011. truck traffic has increased significantly, resulting in delays and queuing during peak traffic periods. Thas rncrease in truck traffic is creating delays and queuing during, peak traffic periods. The construction of the Pilot Flying J Travel Center west of Steuber Road has added to the congestion, which is expected to increase with future development and increased truck trafftc along SR 58.
After engaging with stakeholders, thoroughly reviewing the Operatlonal lmprovement Analysis, and consulting additional resources. the Parsons team comprehends that this project entails delivering the PSR-PDS to realign the eastbound and westbound ramps at the interchange. The propo6ed design will realign the eastbound ramps to the new Steuber Road^alley Boulevard intersection and relocate the westbound ramps to Noria Drive. This realignment is necessary to address operational deficiencies, enhance safety, and improve the efficiency of this key transportation corridor. The team has reviewed additional as-builts from Caltrans and understands the design elements and project components as outlined in the Operational lmprovement Analysis. The project will include complete street elements. relocation and undergrounding of utilities, and right-of-way acquisition.
The reatignment of the SR 58 and Tehachapi Blvd interchange ramp is a critical infrastructure improvement proJect aimed at addre|ssing operational deficiencies and enhancing the efficiency, safety. and mobility of this key transportation corridor. Parsons has extensive expenence working with various municipalities, tralfic authorities, COGs, and various Caltrans districts to prepare and deliver PlD, PSR, PR, and PS&E packages for construction contract award, construction support, and pro.lect closeout. The Parsons management team understands Caltrans' updates to safety requirements and operational evaluation.
The Parsons team will execute this project, aiming to have an approved PSR-PDS by December 2O24, utilizing our approach and understanding of the pro.iect's tasks at key milestones:
With extensive experience designing complete streets proiects, our team also realizes how crucral it is to consider the safety of pedestrians and bicyclists using the facility. particularly since this site experiences heavy truck traffrc. Smooth traffrc flow lvtth clearly delineated, srgned, and protective features for bicycle and pedestrian facilities go a long way in preventing accidents. We will consistenUy work with the City, Kern County, Caltrans and Kern COG to id,enti! oppoftunrues for improvements, all with a focus on maintaining the project budget and delivery schedule. fchachapi Blvd. and SR 58 Ramp Raall3nmsnt P6R'PDS - City of Tehachapa senstNe // Proprretary 7 Kickoff Meeting/ Fi6t 5 da)6

2.2.3 Purpose and Need Approval
A key step in the PID phase is preparing and obtaining approval for the Purpose & Need statement. This invotves conducting a kickoff meeting with the PDT, project sponsors, and key stakeholders to achieve consensus. lt is crucial for the PDT to build PlDs on the proJect purpo6e and need statement early in the project development process. The PDT wilt identify transportation deficiencies and describe the underlying transpo(ation needs early in the project development process.
The project sponsor must concur on the purpose and need and the PDT must have consensus from Stakeholde6 on the project purpose and need. The key interchange deficiencies include:
o Existing ramps do not meet current Caltrans ramp geometric or superelevation standards. . Future roadway and intersection levels of service deficiencies associated with traffic increases on SR 58 and local development.
. Vehicle storage capacity deficiencies at SR 58 Ramp intersections due to proximity to SR 58 overhead and local intersections.
2.2.3 Prepare Draft Project Study Report - Project Development Study (PSR-PDS) Perhaps the most crucial element in the development of alternatives is the initial engineering analysis. The primary focus of the initial engineering analysis is to establish a reasonable study area for alternative development utilizing existing data. The alternattve development effort should focus on rdentirying the project factors that must be studied or resolved.
