HONORABLE MAYOR DAVIES AND COUNCIL MEMBERS
JAY SCHLOSSER, DEVELOPMENT SERVICES DIRECTOR
NOVEMBER26,2024
SUBJECT: TENTATIVE PARCEL MAP NO. 12565
BACKGROUND:
On Tuesday, November 72,2024, the City of Tehachapi Planning Commission approved Resolution 24- 08 recommending that the City Council approve Tentative Parcel Map No. 12565. This resolution includes a finding that a Notice of Exemption satisfies the California Environmental Quality Act.
The project site is located at the southern cul-de-sac of Bailey Avenue, affecting parcels 223-650-14 and 223-650-75. Both parcels were formed as a result of Tentative Parcel Map No. 11353, passed bythe City Council in 2005, which created the current Bailey Avenue subdivision. This project seeks to subdivide these two 5.24-acre parcels from the subdivision into 7 new parcels. As in the first Tentative Parcel Map, these proposed parcels would remain in the Light lndustrial (M-1) zone.
Attached, you will find copies of the proposed map (Attachment 1), a proposed resolution of adoption (Attachment 2), the Planning Commission's resolution recommending adoption (Attachment 3), a copy of the November 12,2024 Staff Report to the Commission detailing the project in question (Attachment 4), and a copy of the CEQA Notice of Exemption (Attachment 5).
FINDINGS:
Pursuant to Municipal Code section 77 .76.070, several findings must be made to confirm approval of the proposed tentative map:
(Passive Heating and Cooling) of the California Government Code. materially detrimental to the health, safety, and welfare of the public or to property and residents in the vicinity.
City Council Staff Report: Tentative Parcel Map No. 1,2565 December 2,2024
Guidelines, and the Tehachapi Guidelines have been duly observed in conjunction with said hearing in the consideration of this matter and all of the previous proceedings relating thereto.

Planning Commission Staff Report: Tentative Parcel Map No. 12565 November L2,2024
A Planning Commission meeting notice for this item has been posted on the City's website at www.liveuptehachaoi.com. As of this writing, Staff has not received any oppositional response from the contacted agencies or the public.
V. ENVIRONMENTALREVIEW:
Categorical Exemption: The project is covered by the 15061(bX3) exemption listed in CEQA, known as the Common Sense Exemption. This exemption applies to projects that can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment.
The parcel is currently zoned as Light lndustrial (M-1), and all parcels created shall remain in this zone.
This zone has no stated limit for the number of light industrial facilities that may be placed on the property. The only constraints to the intensity of this use on the parcel are the height and parking requirements, and the property line setbacks. Subdividing this parcel increases the number of setback and parking requirements for the current area. The end results are more restrictive constraints on the use of the land contained in the current parcel.
Due to this subdivision further restrictinB the use on the acreage provided than is current, this project can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment.
Under this exemption, no further environmental analysis is required. A Notice of Exemption shall be filed with the Kern County-Clerk's Office following City Council approval (Attachment C)' VI. PROJECTBACKGROUND:

CUP 2013-01 Construction of a7,252 square foot office/warehouse structure
VII. PROJECT DESCRIPTION:
Tentative Parcel Map No. 12565 seeks to subdivide two 5.24-acre parcels into 7 parcels of varying sizes.
Four of the newly created parcels shall be accessed through an access easement from the end of the cul de sac. All remaining parcels shall be connected to Valley Boulevard upon their development. No new buildings are proposed with this subdivision.
VIII. ANATYSIS:
Circulation
The proposed subdivision is located at the south end of Bailey Avenue. Bailey Avenue is designated as an industrial collector road and was designed to accommodate traffic based upon the original lot layout captured in Parcel Map 11353. The following Objectives and Policies from the Mobility Element apply to Tentative Parcel Map 12555:
a Objective 1: Connect as many streets as possible.
o Policies
1. Require new through-roadways where necessary for additional connections and congestion relief;
Objeaive 4: Fund roadway improvements from a variety of sources o Policies
1. Require new development to pay its fair share of transportation improvements per the Mobility Element;
a
ln accordance with Objective 1: Policy 1 of the Mobility Element, the City has successfully negotiated with the developer to connect parcels 2, 3, and 7 from the subdivision to Valley Boulevard upon their development. The remaining parcels shall use a common access easement to connect to Bailey Avenue. ln accordance with Objective 4: Policy 1 of the Mobility Element, the future developer(s) of parcels 2, 3, and 7 shall pay for the construction of a section of Valley Boulevard connecting to their parcels. Based on this information, the subdivision is consistent with the Mobility Element of the GeneralPlan.
General Plan Consistency
The subdivision is located in the Freeway Corridor (5A) of the Tehachapi General Plan. The development of 5A is guided by the following muki-area initiatives:
A. Restore/generate appropriate interface between nature, unincorporated communities, and Tehachapi
B. Extend nature into town via Valley Boulevard, Tucker, Curry, and Dennison E. Reinforce Tehachapi's regional role as a service center. www.liveuptehachapi.com CityofTehachapiPlanningDepartment Page 3 Planning Commission Staff Report: Tentative Parcel Map No. 12555 November L2,2024
Within 5A, the following sub-area initiatives apply
2. lmprove housing conditions in North Downtown
3. Position the 58 corridor for local employment Seneration
4. Leverage Tehachapi Airport as a business generator.
The parcels are currently zoned as Light lndustrial (M-1) and shall remain as such. This shall incentivize the creation of industrial businesses and services on the subdivided area, satisfying multi-area initiative E and sub-area initiative 2. Due to the intent of parcels 2, 3, and 7 to extend and connect to Valley Boulevard upon their development, the subdivision shall satisfy multi-area initiative B. lnitiatives A, 1, and 3 do not relate to this project. Based on these criteria, this subdivision is consistent with the intent of the General Plan.
Drainase
Generally, the site naturally slopes from south to north. The parcel contains no flood zones or watercourses. The map provided displays the direction of waterflow on the map and proposed future paths for drainage infrastructure. Based on this information, the site drainage is considered sufficient to avoid negative downstream impacts due to runoff.
Airoort Comoatibilitv
The project site is located within Airport Compatibility Zone B-1 of the City of Tehachapi Municipal Airport Compatibitity Zones (see Figure 2). Since this application seeks only to subdivide the land in question, and future development will seek its own entitlement, no further analysis is required' IX. REQUIRED FINDINGS:
The planning Commission may approve an application for a Tentative Parcel Map only after making the following findings, found in the Municipal code section 17.16.070.

a The proposed subdivision contains no threat to the health, safety, and welfare of the public or to the property and residents in the vicinity of the subdivision.
4. The opplicoble provisions of the Colifornio Environmentol Quolity Act, the State CEQA Guidelines, ond the Tehachopi Guidelines hove been duly observed in coniunction with soid heoring in the considerotion of this motter ond oll of the previous proceedings reloting thereto. a Due to the nature of the Light lndustrial zone (M 1), the intensity of uses is constrained only by the setbacks of the parcels. ln dividing the existing two parcels into seven parcels, the amount of usable space for an increased intensity of use is minimized. The result of this project is a reduction in the amount of land open for potential use. For this reason, the project is applicable for a commonsense exemption (15051(bX3)).
