DATE April 1,2025
SUBJECT: National Public Safety Telecommunicators Week
We are requesting the Tehachapi City Council proclaim the week of April 13 through April 19, 2024, as National Public Safety Telecommunicators Week.

The second week of April annually public safety agencies across the United States recognize the hard work, dedication and sacrifice made by these essential employees. 24 hours a day, 365 days a year Public Safety Telecommunicators are working and managing 9-1-1 call centers across the country.

At the Tehachapi Police Department, we have seven individuals who are specially trained and assigned to respond to the emergency needs of the public. They help manage some of the most terrifying and stressful moments of our community members lives. The Public Safety Telecommunicators referred to as dispatchers by some are the lifeline for not only the public but our police officers in the field as well. They are the ones that listen for emergency radio traffic from an officer in distress and relay the information on to other officers so they can respond to render aid.

Public Safety Telecommunicators are the unsung heroes who provide calm during the storm Chief Richard Standridge would like to share a little more regarding his team.

INTRODUCTION OF AN ORDINANCE TO ADOPT THE CALIFORNIA DEPARTMENT OF FORESTRY AND FIRE PROTECTION FIRE HAZARD SEVERITY ZONE MAP FOR THE CITY OF TEHACHAP!

BACKGROUND
The California Department of Forestry and Fire Protection (CAL FIRE) recently updated its Fire Hazard Severity Zone Maps as part of its mandate to identify areas within the state with heightened fire risks. These maps categorize zones based on fire hazard severity, considering factors such as fuel load, climate, winds and terrain. The updated maps aim to inform state, regional, and local planning efforts to mitigate wildfire risks and enhance public safety.

The City of Tehachapi is in a region that has experienced significant wildfire activity in recent decades, emphasizing the need for proactive measures to safeguard residents, infrastructure, and natural resources. Adoption of these maps by the City Council will ensure alignment with state guidelines and strengthen the City's ability to implement effective land-use planning, building codes, and emergency preparedness strategies.

CITY OF TEHACHAPI MAPS
The attached maps show the areas within the Ci$ of Tehachapi that have been designated moderate, high or very high from Cal Fire. The areas listed as "Very High" will be subject to additional California Building Code standards for any new construction, while additional landscaping and vegetation clearance requirements for these properties will begin in 2028.

The Kern County Fire Department will be the agency in charge of these efforts. Areas categorized as "High" and "Very High" will be required to disclose upon the sale of their home, that it is in one of those severity zones.

Per California Government Code Section 51179, the Tehachapi City Council is required to adopt these maps via ordinance within 120 days of the release of the maps. The Council cannot reduce the fire hazard severtty zone within the city limits but can increase the severity of a zone prior to adoption.

FISCAL IMPACT
There is no immediate fiscal impact associated with the adoption of the Fire Hazard Severity Zone Maps. However, future implementation of mitigation measures and compliance with updated building standards may incur costs.

INTRODUCTION OF AN ORDINANCE OF THE CITY OF TEHACHAPI ESTABTISHING A

DOWNTOWN ENTERTAINMENT ZONE IN COMPLIANCE WITH CATIFORNIA STATE SENATE BIIL 969

BACKGROUND
California State Senate Bill 969 (2024) authorizes cities to establish entertainment zones that permit the consumption of alcoholic beverages on public streets, sidewalks, and public rights-of-way during special events. The bill outlines specific requirements for entertainment zones, including notifying local law enforcement, defining boundaries, and ensuring public safety measures.

The establishment of a Downtown Entertainment Zone in Tehachapi presents an opportunity to enhance the local economy, attract tourism, and create a vibrant community space while adhering to state regulations.

BOUNDARIES AND PURPOSE
The proposed entertainment zone, highlighted in the attached map, will run from Curry Street east to Robinson Street and from Tehachapi Boulevard South to F Street, capturing Green Street where many special events are hosted and incorporating several businesses and licensed alcohol selling establishments. Establishing this entertainment zone promotes economic development within this area, encourages additional establishments to fill storefront vacancies and increase foot traffic to for events and all surrounding businesses.

Under the provisions of Senate Bill 969, which extended the ability for cities to establish entertainment zones following similar legislation for the City and County of San Francisco, the Council must adopt the entertainment zone via ordinance, with dates and times of operation. Within the proposed ordinance are a list of special events and days and hours of operations for the next two years. The Council will be required every two years, via resolution, to adopt the dates and times and can also do so within the two-year window if another special event not previously listed, comes to fruition. The entertainment zone will only be open during the days and times listed in the attached ordinance.

Some of the events that this will benefit include the Tehachapi Farmers Market and Green Street Getdown Concert. This entertainment zone will ensure public safety by coordinating with the Tehachapi Police Department, special event coordinators both internally and externally, and educating licensed establishments wishing to participate in the serving requirements for consumption within the entertainment zone which include a restriction on glass and aluminum containers and age verification wrist bands. The entertainment zone also only applies to brick and mortar locations within the entertainment zone, all other off-site sales of alcohol will still be required to apply for permits and must adhere to the regulations of Alcohol Beverage Control.

FISCAL IMPACT
The ordinance may incur initial costs related to signage, enforcement, and public outreach. However, these expenses are expected to be offset by increased revenue from tourism and local business activity.

COUNCIL REPORTS
MEETING DATE: April7,2025 AGENDA SECTION: COMMUNIW ENGAGEMENT

DEPARTMENT

CITY MANAGE

APPROVED

TO HONORABLE MAYOR POGON-CORD AND COUNCIL MEMBERS
FROM: Key Budge, Community Engagement Director
DATE: April 1,2025
SUBJECT: Donation of folding tables and chairs to TVRPD The purpose of this report is to provide information regarding the donation of 17 wooden folding tables and 90 plastic folding chairs to the Tehachapi Valley Recreation and Parks District (TVRPD).

I regularly meet with Corey Torres, the General Manager for TVRPD. During our most recent meeting we discussed the use of tables and chairs at events, and that the city owned 17 folding ta bles and 90 fold ing ch airs that are only used one day a year at All American 4th of July Celebration during the pancake breakfast by the THS Booster Club.

Corey Torres mentioned they had a need for both folding tables and chairs and that they spend approximately S1,500.00 annually for rental of chairs and tables for six different community events each year.

We discussed donating the tables and chairs to TVRPD if they would agree to make them available to the THS Booster Club on the 4th of July. Corey Torres agreed they would be more than happy to make them available every year.

I also discussed the donation and storage location of the tables and chairs at the scout hut at Central Park so they could be easily accessible with both TVRPD and the THS Booster Club. All agreed the best use of the tables and chairs would be to donate to TVRPD and they would work with the THS boosters each year.

The tables and chairs were stored in a box trailer at our Public Works facility year-long. With the donation of these tables and chairs it frees up a trailer for Public Works to use. lt also now saves several staff overtime hours in the transportation and teardown of the tables and chairs on the 4th of July. TVRPD willsave close to S1,500.00 in rental fees annually and they will be used several times a year for the community's benefit.

Recommendation - this is for information only. Approval for disposition of property was made through the consent agenda.

DONATION AGREEMENT
Simultaneously with the execution of this agreement to be effective this _day of 2025, the City of Tehachapi (the "City") donates to Tehachapi Valley Recreation and Park District (the "District") the following: 8 six-foot round tables, 9 five-foot round tables, and 90 plastic folding chairs (collectively, the "Property"). Upon delivery of the Property, full ownership and responsibility for the Property shall transfer to the District and the City shall have no further obligation with respect to the Property. The District hereby agrees and represents and warrants as follows:
l. The District understands and agrees that the City makes no representations or warranties with regard to the condition of the Property and that the District is hereby accepting the Property "AS IS, WHERE IS, AND WITH ALL FAULTS."

2. As part of this donation, the District agrees to allow the Tehachapi High School THS Warrior Booster Club access to the Property for the Annual 4th of July Pancake Breakfast at Philip Marx Central Park. Additionally, the City agrees to allow the District to store the tables and chairs in the City's designated "Scout Hut" Storage Room located at Philip Marx Central Park for storage purposes and accessibility.

3. The District hereby releases, waives, discharges and covenants not to sue the City, its officers, councilmembers, commissioners, employees, and agents (collectively, the "Releasees") from all claims arising out of, the use of, or in any other way related to the Property including, without limitation, for any loss, damage, or claim on account of injury, death, or damage to anyone or the District or the District's property, including, without limitation, any such claims caused in whole or in part by any act or omission of the Releasees.

5. The District hereby assumes full responsibility for and risk of bodily injury, death or property damage to the District or others from the Property, including, without limitation, any such injury, death, or damage caused in whole or in part by any act or omission of the Releasees.

6. The District hereby agrees that this release, waiver, indemnification, and assumption of risk is intended to be as broad and inclusive as permitted by California law.

FINANCIAL AUDIT SERVICES CONTRACT WITH VAN TANT & FANKHANEL, LLP FROM:

DATE:

SUBJECT:

BACKGROUND
The City engages an independent auditing firm to perform an annual financial audit as well as the Single Audit for Federal Awards. The objective of an audit is to express opinions as to whether financial statements are fairly presented in all material respects in conformity with U.S. Generally Accepted Accounting Principles and to report on the fairness of the supplementary information when considered in relation to the financial statements as a whole. The independent auditor also performs agreed upon procedures to test and report on the City's GANN appropriation limit calculation as well as preparation of the city-wide state controller's report.

Van Lant & Fankhanel (VLF) has provided audit services for the City since fiscal year 2013 and the audit service contract expired once the fiscalyear end 2024 audit was complete. ln addition to the regular audit services, VLF has assisted the City in improving its accounting practices as well as receiving the Excellence in Financial Reporting award from the Government Finance Officers Association for the last six years. Unlike most other audit firms, VLF's partner is involved in the audit from beginning to end. Moreover, their staff accountant turnover rate is very low. Because of these reasons, their audit practice is very efficient and results in a good quality audit. ln order for VLF to provide unbiased audit services for the City, the other partner of the firm has been reviewing the auditworkdonebythepartnerinchargeoftheCityforthepastsixyears. Thispracticewillcontinuethroughtheendof the recommended four-year audit service extension.

We are pleased to confirm our understandang of the services we are to provide the City of Tehachapi (City) for the year ending June 30, 2025,
Audat Scope and Objectives
We will audit the financial statements of the governmental activities, business-type activities, each major fund and the aggregate remaining fund information, including the related notes to the financial statements, which collectively comprise the basic ftnancial statements, of the City as of and for the year ended June 30, 2025. Accounting standards generally accepted in the United States of America provide for certain required supplementary information (RSl). such as management's dascussion and analysis (MD&A), to supplement the City's basic financial statements. Such information. although not a part of the basic financial statements, is required by the Govemmental Accounting Standards Board who considers il to be an essential part of financial reporting for placing the basic financaal statements an an appropriate operational, economic, or historical context. As part of our engagement. we will apply certain limiled procedures to the Caty's RSI in accordance with auditing standards generally accepted h the United States of America. These limited procedures will consist of inquiries of management regarding the methods of preparing the information and comparing the information for consistency with management's responses to our inquiries. the basic financial statements, and other knowledge we obtained during our audit of the basic financial statements. We will not express an opinbn or provide any assurance on the information because the limited procedures do not provide us with sufiicient evidence to express an opinion or provide any assurance. The following RSI is required by generally accepted accounting principles and will be subjected to certain limited procedures, butwill not be audited:
1) Management's Discussion and Analysis
2) Budgetary comparison schedules
3) Pension Schedules
We have also been engaged to report on supplementary information other than RSI that accompanies the City's financial statements. We will subject the following supplementary information to the auditing procedures applied in our audit of the financial statements and certaan additional procedures, including comparing and reconcifing such information directly to the underlying accounting and other records used to prepare the financial statements or to the financial statements themselves, and other additional procedures in accordance with auditing standards generally accepted in the United States of America, and we will provide an opinion on at in relation to the financial statements as a whole. in a report combined with our auditor's report on the financial statements:

5 The objectives of our audit are to obtain reasonable assurance about whether the financtal statements as a whole are free from material misstatement, whether due to fraud or error, and issue an auditor's report that includes our opinions about whether your financial statements are fairly presented, in all material respects, in conformity with GAAP, and report on the fairness of the supplementary information referred to in the second paragraph when considered in relation to the financial statements as a whole. Reasonable assurance is a high level of assurance but is not absolute assurance and therefore is not a guarantee that an audit conducted in accordance with GAAS and Government Auditing Standards will always detect a material misstatement when it exists. Misstatements, including omissaons, can arise from fraud or error and are considered material if there is a substantial likelihood that, individually or in the aggregate, they would influence the judgment of a reasonable user made based on the financial statements. The objectives also include reporting on:
o lnternal control over financial reporting and compliance with provisions of laws, regulations, contracts. and award agreements. noncompliance with which could have a material effect on the financial statements in accordance wilh Government Auditing Standards.
. lnternal control over compliance related to major programs and an opinion (or disclaimer of opinion) on compliance with federal statutes, regulations, and the terms and conditions of federal awards that could have a direct and material effect on each major program in accordance with the Single Audit Act Amendmentsof 1996andTitle2U.S. Codeof Federal Regulations (CFR) Part200,UniformAdministrative Requirements. Cost Principles, and Audit Requirements for Federal Awards (Uniform Guadance).

Auditor's Responsibilities for the Audit of the Financial Statements and Single Audit We will conduct our audit in accordance with GAAS; the standards for financial audits contained in Govemment Auditing Standards. issued by the Comptroller General of the United States; the Single Audit Act Amendments of 1996; and the provisions of the Unilorm Guidance, and will include tests of accounting records, a determination of major program(s) in accordance wrth Uniform Guidance, and other procedures we consider necessary to enable us to express such opinions. As part of an audit in accordance with GAAS and Govemment Auditing Sfandards. we exercise professional judgment and maintain professional skepticism throughout the audit.

We will evaluate the appropriateness of accounting policies used and the reasonableness of significant accounting estimates made by management- We will also evaluate the overall presentation of the financial statements, including the disclosures, and determine whether the financial statements represent the underlying transactions and events in a manner that achieves fair presentation. We will plan and perform the audit to obtain reasonable assurance about whether the financial statements are free of material misstatement. whether from (1) errors, (2) fraudulent financial reporting. (3) misappropriation of assets. or (4) violations of laws or governmental regulations that are attributable to the government or to acts by management or employees acting on behalf of the government.

Because the determination of waste and abuse is subjective, Government Auditing Standards do not expect auditors to perform specific procedures to detect waste or abuse in financial audits nor do they expect auditors to provide reasonable assurance of detecting waste or abuse, Because of the inherent limitations of an audit, combined with the inherent limitations of internal control, and because we lvill not perform a detailed examination of all transactions. there is an unavoidable risk that some material misstatements or noncompliance may not be detected by us, even though the audit is properly planned and performed in accordance with GAAS and Government Auditing Standards. ln addition, an audit is not designed to detect immaterial misstatements or violations of laws or governmental regulations that do not have a direct and material effect on the financial statements or on major programs. However, we will inform the appropriate level of management of any material errors, any fraudulent financial reporting, or misappropriation of assets that come to our attention. We will also inform the appropriate level of management of any violations of laws or governmental regulations that come to our attention, unless clearly inconsequential. We will include such matters in the reports required for a Single Audit. Our responsibility as auditors is limited to the period covered by our audit and does not extend to any later periods for r.vhich we are not engaged as auditors.

We will also conclude, based on the audit evidence obtained, whether there are conditions or events, considered in the aggregate, that raise substantial doubt about the government's ability to continue as a going concern for a reasonable period of time.

Our procedures will include tests of documentary evidence supporting the transactions recorded in the accounts, tests of the physical existence of inventories, and direct confirmation of receivables and certain assets and liabilities by correspondence with selected individuals, funding sources, creditors, and financial institutions- We will also request written representations from your attorneys as part of the engagement. 2 6
We may, from time to time and depending on the circumstances. use third-party service providers in serving your account. We may share confidential information about you with these service providers but remain committed to maintaining the confidentiality and security of your information. Accordingly, we maintain internal policies, procedures, and safeguards to protect the confidentiality of your personal information. ln addition, we will secure confidentiality agreements with all service providers to maintain the confidentiality of your information and we will take reasonable precautions to determine that they have appropriate procedures in place to prevent the unauthorized release of your confidential information to others- ln the event that we are unable to secure an appropriate confidentiality agreement, you will be asked to provide your consent prior to the sharing of your confidential information with the third-party service provider. Furthermore, we will remain responsible for the work provided by any such third-party service providers.

Our audit of financial statements does not relieve you of your responsibilities.

We will also provide a report on agreed upon procedures performed on the City's calculation of its annual appropriations limit as required by Article Xlll B of the California State Constitution. We will perform the procedures in the Article Xlll B Appropriations Limit Uniform Guidelines as published by the League of California Cities. This report will include a statement that the report is intended solely for the information and use of management, City Council and specific legislative or regulatory bodies and is not intended to be and should not be used by anyone other than these specified parties.

Audit Procedures-l nternal Control
We will obtain an understanding of the government and its environment, including internal control relevant to the audit, sufiicient to identify and assess the risks of material mrsstatement of lhe financial statements, whether due to error or fraud, and to design and perform audit procedures responsive to those risks and obtain evidence that is sufficient and appropriate to provide a basis for our opinions. The risk of not detecting a material misstatement resulting from fraud is higher than for one resulting from error, as fraud may involve collusion, forgery, intentional omissions. misrepresentation, or the override of internal control. Tests of controls may be performed to test the effectiveness of cerlain controls that we consider relevant to preventing and detecting enors and fraud that are material to the financial statements and to preventing and detecting misstatements resulting from illegal acts and other noncompliance matters thal have a direct and material effect on the financial statements. Our tests. if performed, will be less in scope than would be necessary to render an opinion on internal control and, accordingly, no opinion will be expressed in our report on intemal control issued pursuant lo Government Auditing Standards.

As required by the Uniform Guidance, we will perform tests of controls over compliance to evaluate the effectiveness of the design and operation of controls that we consider relevant to preventing or detecting material noncompliance with compliance requirements applicable to each major federal award program. However, our tests will be less in scope lhan would be necessary to render an opinion on those controls and, accordingly, no opinion will be expressed in our report on internal control issued pursuant to the Uniform Guidance.

An audit is not designed to provide assurance on internal control or to identify significant deficiencies or material weaknesses. Accordingly. we will express no such opinion. However. during the audit. we will communicate to management and those charged with governance intemal control related matters that are required to be communicated under AICPA professional standards, Govemment Auditing Standards. and the Uniform Guidance.

Audit Procedures-Com pllance
As part of obtaining reasonable assurance about whether the financial statements are free of material misstatement, we will perform lests of the City's compliance with provisions of applicable laws, regulations. contracts, and agreements, including grant agreements. However. the objective of those procedures will not be to provide an opinion on overall compliance and we will not express such an opinion in our report on compliance issued pursuant lo Government Auditing Standards.

The Uniform Guidance requires that we also plan and perform the audit to obtain reasonable assurance about whetherthe auditee has complied with federal statutes, regulations, and the terms and conditions of federal awards applicable to major programs. Our procedures will consist of tests of transactions and other applicable procedures described in the OMB Compliance Supplement for the types of compliance requirements that could have a direct and material effect on each of the City's major programs. The purpose of these procedures will be to express an opinion on the City's compliance with requirements applicable to each of its major programs rn our report on compliance issued pursuant to the Uniform Guidance.
3 7
Other Services
We will also assist in preparing the financial statements, schedule of expenditures of federal awards, and related notes of the City in conformity with U.S. generally accepted accounting principles and the Uniform Guidance based on information provided by you. These nonaudit services do not constitute an audit under Government Auditing Standards and such services will not be conducted in accordance wilh Government Auditing Standards. We will perform the services in accordance with applicable professional standards. The other services are limited to the financial statements, schedule of expenditures of federal awards, and related notes seryices previously defined.

We, in our sole professional judgment, reserye the right to refuse to perform any procedure or take any action that could be construed as assuming management responsibilities.

You agree to assume all management responsibilities for the financial statements. schedule of expenditures of federal awards. and related notes, and any other nonaudit services we provide. You will be required to acknowledge in the management representation letter our assistance with preparation of the financial statements, the schedule of expenditures of federal awards, and related notes and that you have reviewed and approved the financial statements, the schedule of expenditures of federal awards, and related notes prior to their issuance and have accepted responsibility for them. Further, you agree to oversee the nonaudit services by designating an individual, preferably from senior management, with suitable skill, knowledge, or experience; evaluate the adequacy and results of those services, and accept responsibility for them.

Responsibilities of Management for the Financial Statements and Single Audit Our audit will be conducted on the basis that you acknowledge and understand your responsibility for (1) designing, implementing, establishing. and maintaining effective internal controls relevant to the preparation and fair presentation of financial statements that are free from material misstatement, whether due to fraud or error, including internal controls over federal awards, and for evaluating and monitoring ongoing activities to help ensure that appropriate goals and objectives are met; (2) following laws and regulations; (3) ensuring that there is reasonable assurance that government programs are administered in compliance with compliance requrrements; and (4) ensuring that management and financial information is reliable and properly reported. DENNTSON ROAD B|CYCLE/PEDESTRTAN TMPROVEMENTS PROJECT - CHANGE ORDER

UTILIZATION AND APPROVAL

BACKGROUND
As the Council is aware, the City of Tehachapi has awarded the above-named project to Griffith Company.

Once construction was underway, the contractor began the installation of new curb, sidewalks, curb ramps, bicycle lanes, and pedestrian crossings on Dennison Road from Tehachapi Boulevard to Tehachapi High School in accordance with the project plans. During the construction phase, unforeseen conflicts emerged, necessitating revisions to the proposed design. Adjustments were made to the storm drainpipe crossing, inlet sizing, excavation for manhole installation, and preparation for the concrete pour. This included setting the manhole riser to subgrade, backfilling, compacting, applying cold mix, and changing striping from standard to ladder crosswalks. Additionally, further demolition of the existing sidewalk was required, along with grinding and overlaying to accommodate mobilization, traffic control, grinding, utility adjustments to grade, fog sealing, and striping.

City staff promptly initiated a review and modification of the design to address these conflicts. Collaborating with the design consultant, a revised design was completed on January 28,2025. This modification will necessitate a change order beyond the current approval.

FISCAL IMPACT:

When originally awarded, the City Council authorized an initial change order budget of LO% of the construction value of 5L,15O,743.00 or S115,074.00.

This project is funded through the Active Transportation Program with a total grant value of 52,611,053.00.

The current construction phase budget for this project is a blend of Federal and State funds in the amount of 52,014,853.00. This budget is sufficient to complete the project including recent modifications. No City funds are needed to complete this effort.

Given these values, City Staff believes the additional change order expenses are still within the overall project grant budget and goals.

Surplus funds will be returned to the State/Federal grant agencies.

RECOMMENDATION:

City staff has reviewed the changes and believe the additional work is both necessary and appropriate.

AUTHORTZE STAFF TO SPEND Up TO s2,014,853 WHTCH REPRESENTS THE TOTAL ALLOWABLE GRANT FUNDING !N ACCORDANCE WITH THE GRANT TERMS.
