SUBJECT: EMERGENCY ABATEMENT AT 120 NORTH CURRY STREET
BACKGROUND
On July 25th,2024, the property located at 120 North Curry Street was inspected based on a complaint of dead and overgrown vegetation and trash constituting a fire hazard. During the inspection of the property, we located multiple municipal code and zoning code violations. A Notice of Violation was mailed to the legal owner of record.
Over the next 11 months, I made multiple attempts to contact the homeowner which included writing six administrative citations. I also attempted several door knocks in attempt to contact the homeowner in person which was met with negative results.
On May 22nd,2025, a warrant was served to abate the violations on the property. Through the use of a private contractor the dead and overgrown vegetation and trash were removed from the property.
RECOMMENDATION
Staff recommends that the City Council approves emergency abatement actions conducted by Code Enforcement at 120 North Curry Street.
Pursuant to Municipal Code Section 1.16.065M, emergency abatements may be conducted by the city when appropriate. This code also requires a hearing before the city council following any such abatement to determine whether the Code Enforcement Officer's abatement actions were appropriate. ,:

CONGESTION MITIGATION AND AIR QUALITY PROGRAM FUNDING GRANT APPTICATION &
RESOLUTION
FROM:
DATE:
SUBJECT:
BACKGROUND:
Every two years (on average) the City of Tehachapi, as a member agency of the Kern Council of Governments (Kern COG), is given an opportunity to pursue Congestion Mitigation and Air Quality Program (CMAQ) funds.
This money descends from the federal highway transportation funds allocated by Congress on a periodic basis.
The City of Tehachapi has used these available funds to make improvements to various roadways within the CityassuggestedbyCityStaff. ArecentexampleoftheuseofthesefundsistheconstructionofthePinon Road Extension.
While Tehachapi has consistently executed our projects without fail over the last 10+ years, other member agencies of the Kern COG have, at times, failed to follow through on commitments to execute similar work. As such, the Kern COG has asked all its member agencies to execute resolutions in support of funding applications to help ensure the timely use of the available funds.
PROJECT DESCR!PTION:
City Staff, with Council approval, is proposing to widen and include shoulder improvements to East Tehachapi Boulevard between Bailey Court and the Pilot Travel Center. Traffic on this road is usually that of vehicles traveling through the City limits to other outlying areas of Tehachapi. Shoulders and widening of this road provide greater safety for pedestrians and drivers alike. Our initial estimate of this work is 5478,950.00. The proposed resolution commits the City to support this project including the associated matching funds of 554,935.57. This is one of two projects where we are pursuing CMAQ funding. All federal projects require an 1L.47% shared cost commitment.

FROM: DON MARSH, PUBLIC WORKS DIRECTOR
DATE: JUNE 10,2025
SUBJECT: TERMINATION OF JOINT AGENCIES AGREEMENT BETWEEN TEHACHAPI'CUMMINGS COUNTY WATER DISTRICT AND ClW OF TEHACHAPI FOR SNYDER WELL PROJECT BACKGROUND:
ln January of 2oL6,the City and Tehachapi Cummings-County water District (TccwD) entered into a Joint Agencies Agreement for the snyder well project. At that time, the city owned snyder well was producing high nitrate water and not useable for potable water production. The project involved disconnecting the snyder well from the City water system and connecting it to the TccwD non-potable water distribution system.
The intent of the grant funded project was to provide additional groundwater pumping capabilities to TCCWD while purging nitrates from the well and in the long-term removing nitrates from the groundwater. over the past 9 years, the nitrate levels produced by the snyder well have steadily dropped to the point that the water is capable of being returned to the city potable system. As a result, the joint-agencies agreement with TCCWD needs to be terminated'
FISCAL IMPACT:
rr,. citv has included a capital project in fiscal year 2025/2026to re-connect the snyder wellto the city potable water system.

League of California Cities Annual Conference
The League of California Cities Annual Conference will be held on October 8-10, 2025 in Long Beach. The registration fee is $675.00 and a two-night stay in the hotel is $259.00 per night. During the conference, there will be three days of presentations devoted solely to legal issues facing cities and updates on cases recently decided. This is a critical learning session for city attorneys and reduces the time and effort needed by the City Attorney to research these matters on his or her own.
My other city is being asked to contribute equally to the cost for the registration fee and one night's lodging. The City's share of the expenses would be $596.50. I would request permission to represent the City of Tehachapi at the Annual League Conference and for the City to pay up to $596.50 for my expenses.
