COUNCIL REPORTS
MEETING DATE: OCTOBER 6TH,2025 AGENDA SECTION: POLICE DEPARTMENT

DEPARTMENT H

APPROVED
CITY
TO: HONORABLE MAYOR JOAN POGON.CORD AND COUNCIL MEMBERS FROM: SHELDON SHERMAN, CODE ENFORCEMENT OFFICER
DATE: September 3',d,2025
SUBJECT: EMERGENCY ABATEMENT AT 313 SOUTH ROBINSON STREET

BACKGROUND
Pursuant to Municipa! Code Section 1.16,055M, emergency abatements may be conducted by the city when appropriate. This code also requires a hearing before the city council following any such abatement to determine whether the Code Enforcement Officer's abatement actions were appropriate.

On April L6th,2025, the property located at 313 South Robinson Street was inspected based on a complaint of deadandovergrownvegetationandtrashconstitutingafirehazard. Duringtheinspectionoftheproperty,we located multiple municipal code and zoning code violations. A Notice of Violation was mailed to the legal owner of record.

Over the next four months, I made multiple attempts to contact the homeowner which included writing five administrative citations. The building lnspector, Joesph Rankin, also attempted multiple times to get in contact with the homeowner. We were unable to contact anyone at the location due to the fact that the house was vacant.

On August Zlst, 2025, a warrant was served to abate the violations on the property. Through the use of a private contractor the dead and overgrown vegetation and trash were removed from the property. The trash was removed, and open door/windows were boarded up.

RECOMMENDATION
Staff recommend that the City Council approves emergency abatement actions conducted by Code Enforcement at 313 South Robinson Street.

TEHACHAPI

COUNCIL REPORTS
MEETTNG DATE: L0-2O-2025 AGENDA SECTION: DEVELOPMENT SERVICES

DEPARTMENT

APPROVED
CITY
/
7 TO HONORABLE MAYOR POGON-CORD AND COUNCIL MEMBERS
FROM: JOSEPH RANKIN, SENIOR BUILDING OFFICIAL
ocToBER L3,2025
SUBJECT: ADOPTION OF AN ORDINANCE REVISING THE TEHACHAPI MUNICIPAL CODE REGARDING

RESI DENTTAL RENTAL PROPE RTY I NSPECTION REQU I REME NTS

BACKGROUND
Development Services and the Police Department often receive complaints of substandard conditions from tenants and neighbors of rental properties within the City. The City addresses complaints by inspecting properties for health and safety-related violations of the Tehachapi Municipal Code, the Tehachapi Zoning Code, the California Health and Safety Code, and the California Building Standards Code. ln 2023, the State of California passed AB 548, which requires cities to adopt policies and procedures for inspecting multi-family housing when a violation appears to affect other units. While the City has policies and procedures in place for inspecting and addressing code violations, the Tehachapi Municipal Code does not specifically address multifamily housing like the new law requires.

This ordinance would establish a policy and procedure for inspecting health and safety violations, including those affecting other units in multi-family housing. lt would also require landlords to register their rental properties with the City and establish a point of contact for City staff. This is intended to reduce workload for City staff in tracking down property owners to address code violations. ln the same spirit of holding landlords accountable for maintaining their property, this ordinance would require property owners or their authorized agent to make a good-faith effort to prevent illegal, nuisance, or criminal activity from taking place on their properties.

The Tehachapi Municipal Code currently requires business owners that operate within City limits to pay a business tax, but no such requirement exists for owners of rental properties except for apartment complexes with four or more units. This discrepancy holds landlords of one-, two-, and three-unit housing to a different standard than other business owners. Current code (TMC 5.08.295) requires owners of apartment complexes with four or more units to pay a business tax of S40 plus 55 for each unit. For the sake of simplicity, the proposed business tax for three or fewer units is S40 annually.

DATE:

BACKGROU ND
The Development Services Department and the Police Department have identified several areas of the Tehachapi Municipal Code ("TMC") that should be updated to protect public health and safety, improve processes, and comply with new state laws.

Administrative Citations
Section 1.20 ("General Penalty") of the TMC establishes procedures for prosecuting violations of the TMC. Currently, this section requires violations to be prosecuted as a misdemeanor unless the violation is made an infraction by ordinance. The proposed revisions would clarify the Police Department's discretion to prosecute these violations as either a misdemeanor or an infraction.

Section 1.20 and other sections of the TMC currently specify fine amounts for violations of the code - necessitating a municipal code revision to change fine amounts. The proposed revisions would allow the Councilto set the amounts of fines for violations via resolution. The accompanying resolution contains a list of administrative fines and penalties for commonly used fines that Council and staff may want to revise in the future. These include fines for general code violations, building and safety code violations, fireworks violations, and short-term rental violations. The fine amounts reflect current amounts set in the code.

Section 1.16 ("Citation Procedure") establishes procedures for issuing citations for violations of the TMC. The proposed revisions would modify Section 1.15.065 ("Alternative Method of Enforcement") - which covers issuance of administrative citations and appeals procedures - to comply with Government Code 53069.4. The changes would clarify how administrative citations are to be served, list specific information that must be included in the citation (such as which code was violated, the amount of the fine, a time period in which the violation must be corrected, and how to appeal the citation). As with Section 1.20, Section 1.16.065 reaffirms that the Council may set fine amounts via a resolution.

Appeals would be handled via an informal, administrative hearing by the city manager or his/her designee - who would serve as the hearing officer. The hearing officer will decide on the validity of the citation and provide a written decision to the appellant. lf the appellant disagrees with this decision, he/she has 20 days to appeal the decision to the superior court.

Short-Term Rentals
Section 8.68 ("Short-Term Rental Permits")of the TMC requires a permit to operate a short-term rental property within City Limits and establishes policies and procedures for issuing these permits. These regulations were established to enforce transient occupancy tax, to safeguard the peace and quiet of residential neighborhoods, and to protect the health and safety of short-term rental guests. The Police Department has received calls for service to short-term rentals due to excessive noise caused by parties. Development Services recognizes that residential zones have a high expectation of peace and quiet. Downtown Tehachapi often sees events including festivals, parades, concerts, and farmer's markets, at which noise can often be heard from outside the event - making it a more appropriate area for short-term rentals. Therefore, this ordinance would limit the issuance of new short-term rental permits to the downtown area. Existing permits outside of Downtown can be renewed if they remain in good standing with the City.

Tehachapi Zoning Code 7.20.010.B defines the "downtown area" as "the area bounded on the west by Mill Street, on the east by Snyder Avenue, on the north by H Street, and on the south by C Street." For the sake of consistency, these bounds will be used for short-term rentals. A map of the area is shown below.

Page 2 of 4 ends

lo
,
I-
The current code prohibits advertising a short-term rental without a permit. Development Services has encountered violators who attempt to circumvent this code by advertising on websites that support both short-term and long-term rentals. This ordinance will clarify the code by specifically prohibiting advertising on websites that support short-term rentals unless the owner has a short-term rental permit.

Other changes include: (1) defining the use of short-term rentals to avoid ambiguity; (2) requiring a portrait of the permit applicant, to provide a clearer record of the property owner; (3) requiring the life-safety inspection to be scheduled at the time of application, to alleviate city staff time spent following up with applicants to schedule the inspection; (4) establishing June 30 of each year as the permit expiration date, to reduce staff workload in keeping track of various expiration dates; (5) clarifying that short-term rentals with two or more bedrooms are deemed to offer lodging for five or more persons and are subject to transient occupancy tax.

Garbage and Rubbish Regulations
A common problem encountered by the Police Department is littered streets, parking lots, and neighboring properties due to trash receptacles left open to the weather and animals. The proposed changes to Section 8.04 ("Garbage and Refuse") would require property owners to keep trash receptacles closed and kept within a trash enclosure (where applicable), as well as to clean up any litter from their trash cans - including litter that spreads to neighboring properties. Property owners would also be prohibited from leaving trash receptacles in the public right of way or their front yard outside of collection days. Finally, a definition for "curbline" is proposed to avoid ambiguity.

Parkins Space Compliance
Some City streets in the Downtown area and most public parking lots are marked with painted parking spaces. Currently, the TMC contains no language requiring vehicles to park within the marked spaces. The proposed revision would add this language to the Code, allowing the Police Department to cite vehicles taking up more than one space.

CEQA Exemption
Because these changes are administrative and regulatory in nature and do not have any physical impact on the environment, this Ordinance is exempt from the California Environmental Quality Act (CEQA) pursuant to the General Rule (14 C.C.R. Section 15061(bX3))'

A. Administrative Citation. Any person violating any provision of the code may be issued an administrative citation by any officer described in Section 1.16.010.A and as provided therein. As used in this section, the term "enforcement officer" shall refer to those officers described in Section 1.16.010.A. A separate civil fine for each violation of the code may be assessed by means of one administrative citation.

B. Contents. Upon discovering or observing any violation of the municipal code, an enforcement officer may issue an administrative citation, in a form approved by the city manager and city attorney, to a violator or property owner, with the following contents:
1,. Date and location of the violation(s), including the street address, if any, and the approximate time the violation(s) were observed;

2. Section(s) of the code violated and brief description of how the section(s) are violated; if the citation is for a violation of the Code of Building Regulations set forth in Chapter \5.O4, the citation shall include a statement specifying the behaviors or conditions which constitute the violation;
Description of the action required to correct the violation(s), if applicable; and if applicable, the date by which the violation must be corrected, such date shall be no less than ten (10) days after service of the citation;
Statement explaining the consequences of failure to correct the violation(s);
Amount of fine imposed for the violation(s) as set forth in Section

1.16.065.G;
Explanation of how the fine shall be paid and the time period by which it shall be paid, and the consequences of failure to pay the fine; Right to contest the contents of the administrative citation and right of appeal, including the name and address of the city manager or his or her designee for purposes of filing any notice of appeal;
An order prohibiting another occurrence of the code violation; and The name and signature of the enforcement officer.
lssuance. The enforcement officer shall attempt to issue the citation to the responsible party for any violation of this code. For purposes of issuance of a 3 4.

citation to a business, the citation may be issued to the person in immediate control of the business on site at the time of the issuance of the administrative citation and fine. The enforcement officer may, but is not required, to obtain the signature of the person upon whom the citation was issued. The lack of signature shall not affect the validity of the citation and subsequent proceedings.

D. lssuance When Unable to Locate Violator. lf the enforcement officer is unable to locate the violator(s) then the administrative citation shall be mailed to the responsible party and property owner, if different than the responsible party. The administrative citation shall be mailed to the violator(s) or property owner(s) by certified and first class mail. The failure of any person with an interest in the property to receive such notice shall not affect the validity of any proceedings taken under this chapter. Notice by certified and first class mail in the manner described above shall become effective on the date of mailing.

E. Violations and distinct offense. A violation of this code includes, but is not limited to, allviolations of the municipal code, zoning code, the Uniform codes adopted by the city council, failing to comply with any condition imposed by any entitlement, permit, agreement or environmental document issued or approved under the provisions of this code. Each and every day a violation exists, from the date for compliance specified in the administrative citation until the date the violation is fully corrected as determined by the enforcement officer, may constitute a separate and distinct offense.

F. Appeal. Any person issued an administrative citation may contest the contents of the administrative citation by filing an appeal for an administrative hearing.

1. The action of the official writing the citation shall be final unless appealed to the city manager or his or her designee by the applicant within ten days after service of notice of such citation on the business owner or agent.

2. Any appeal to the city manager or his or her designee shall set forth fully the grounds upon which the appeal is based and shall be in writing. lf no appeal is filed within the time prescribed, the fine shall be final and immediately payable.

3. The city manager or his or her designee shall serve as or select the administrative hearing officer to make a determination as to the validity of the citation after examining the writings submitted by the enforcement official who issued the citation and the individual or entity being cited. The written administrative hearing officer will be given to the individual or entity being cited within twenty-one days of his or her receipt of the writings from both sides.

4. Administrative hearing officers shall be selected in a manner that avoids the potential for pecuniary or other bias. ln no event shall the administrative hearing officer be the citing official.

5. Administrative hearings are informal, and formal rules of evidence and discovery do not apply. Each party shall have the opportunity to present evidence in support of that party's case and to cross examine witnesses. 3 I
'(;AI
D}XARfrENT
The city bears the burden of proof at an administrative hearing to establish a violation of this code. The administrative citation and any additional reports submitted by the enforcement official shall constitute prima facie evidence of the facts contained in those documents. The administrative hearing officer must use preponderance of evidence as the standard of review in deciding the issues.

6. lf the responsible party fails to attend the scheduled hearing, the hearing will proceed without the responsible person, and the responsible person will be deemed to have waived the right to an administrative hearing and any further appeals.

7. Within twenty (20) days after service of the Administrative Hearing Officer's decision upon the responsible party, the responsible party may seek review of the Administrative Hearing Officer's decision by filing a notice of appeal with the superior court pursuant to Government Code Section 53069.4(b). lf the responsible party fails to timely file a notice of appeal, the administrative citation shall be deemed confirmed.

G. Fine. Except as otherwise set forth in this code, the amounts of the fines imposed pursuant to this chapter shall be set forth in a schedule of fines established by resolution of the city council pursuant to this section.

1. The city council may, by resolution, impose escalating fines in amounts it deems appropriate for repeat offenses in a l_2-month period. The amounts of fines may be modified from time to time by a resolution of the city council.

2. lf a violation would otherwise be an infraction, the civil fine shall not exceed the maximum fine or penalty amounts for infractions set forth in Government Code Section 36900 as may be amended. The amounts of such fines may be modified from time to time by a resolution of the city council provided they do not exceed the limits allowed by state law.

H. Failure to Correct. lf the violator or property owner fails to correct the violation within the time specified on the citation, a second citation may be issued for the same violation due to the failure of the responsible party to correct the violation.

The fine for the second violation would be governed by subsection G. The city may choose other applicable action permissible under this code to gain compliance.
l. Payment of Fine Without Correction of Violation. Payment of any fine shall not excuse the failure to correct the violation nor shall it bar further enforcement action by the city. The failure of any person to pay any fine assessed by administrative citation within the time specified on the administrative citation shall result in the assessment of an additional late fee to be charged. The amount of the late fee shall be ten percent of the total amount of the civil fine due and owing.

J. Collection of Fine. The city may pursue any legal remedy to collect fines and late fees, as applicable. The city may collect delinquent and late fees and fines though the following lien procedure:
4 ct00t
I,ICAI I)TPARruTNT
The total amount of delinquent and late fees and fine still owed shall constitute a special assessment against the respective lot or parcel of land to which it relates and, upon recordation in the office of the county recorder of a notice of lien, as so made and confirmed, shall constitute a lien against the property for the amount of such assessment.

1. After such confirmation and recordation, a certified copy of such decision shall be sent to the appropriate county official to add the amounts of the respective assessment to the next regular tax bills levied against the respective lots and parcels of land for municipal purposes, and thereafter the amount shall be collected at the same time and in the same procedure under foreclosure and sale in case of delinquency as provided for ordinary municipal taxes and assessments.

Such notice of lien for recordation shall be in the form substantially as follows:

BACKGROUND
The City of Tehachapi, using funding from SB1/SGR (State of Good Repair) and SB125/TIRCP (Transit and lntercity Rail Capital Program), seeks to improve sidewalks and drainage for safe pedestrian passage between the existing Transit Center Park and Ride at Mill Street to J & H Automotive on the north side of Tehachapi Blvd.

The Base Bid Schedule includes the construction of a large storm drain junction box to combine 5 inflows into 1-6'diameter discharge, sidewalks, curb, gutter, street repair, hand rails along junction box and a retaining wall adjacent to the junction box. The Additive Bid Schedule removes the retaining wall and extends the 6' diameter discharge 200'.

On September 3, 2025, advertising began for the project. Staff opened bids for this project on October 6, 2025. The results of bidding are listed in the table below:

The budget is insufficient to complete the project. Additional TIRCP allocations are expected to become available in the Spring of 2026 for the 24/25 FY and will be able to supplement this project. ln the event that additional TIRCP funds are not available, additional funding will come from the General Fund.
