COUNCIL REPORTS CITY MANAGER: __ _
MEETING DATE: February 17, 2026 AGENDA SECTION: Finance FROM:
HONORABLE MAYOR POGON-CORD AND COUNCIL MEMBERS
HAMED JONES, FINANCE DIRECTOR
DATE: FEBRUARY 10, 2026
SUBJECT: PUBLIC HEARING AND PROPOSED RESOLUTION DEALING WITH TRANSIT NEEDS
WITHIN THE CITY
BACKGROUND
As part of the annual Public Transit Claim for Transportation Development Act (TOA) funds, it is necessary to conduct a public hearing to receive public testimony concerning the transit needs within the City.
The City of Tehachapi provides a Dial-A-Ride transit service through Kern Regional Transit. Utilizing two buses, the current transit service operating hours are as follows:
Monday through Friday: 6:00 am to 7:00 pm
Saturday: 7:30 am to 5:30 am
The Dial-A-Ride services are available within the city limits of Tehachapi as well as between the City and certain areas of the County. The current one-way fares are as listed below:
General Public
Disabled
Children 4 and under
$2.00
$1.00
Free
Seniors (62 and over)
Youth (5 ~ 15)
$1.00
$1.00
When comparing the fiscal year (FY) 2024/25 operations to FY 2023/24, ridership increased 58.2% whereas the total costs increased 5.5%. Although ridership increased to 4,992 in FY 2024/25, it continued to be significantly impacted by the Covid-19 pandemic down from a pre-pandemic high of 5,729 in FY 2018/19.
TOA requires the City to meet a 10% farebox ratio (ratio of farebox revenue to total expense) in order for the City to receive transit funds. Attaining the 10% ratio has been a continuing issue for the City's Dial-A-Ride transit operation and FY 2024/25 was no exception. However, because of Covid-19, the State of California suspended the usual farebox ratio requirements. The farebox ratio generated directly from riders in 2024/25 was 1.25% and the City was able to utilize $17,000 in American Rescue Plan Act (ARPA) funding along with a General Fund subsidy of $8,819 to meet the 10% requirement. By meeting the required ratio, the City is eligible to receive up to $791,697 in FY 2025/26 from the Local Transportation Fund (LTF) and State Transit Assistance Fund (STAF).
In continuing attempts to improve the farebox ratio, the City has promoted the transit service by communicating through the water bill, reusable informational banners, brochures, digital ads in on lobby TVs, and social media advertising in both English and Spanish. More recent expanded efforts include a locally produced Public Service Announcement (PSA) and an advertising panel at Valley Park. Transit service information, including the PSA, is also posted on the City's official website.
The City is required to adopt a resolution annually proving that "there are no areas within the City with unmet public transit needs which could be reasonably met by expansion of the existing system or establishment of a new system" in order to received TOA Article 4 and Article 8 funds.
This resolution also authorizes the City Manager to execute and file claims for TOA apportionment and allocations for FY 2026/27. The public hearing notice was published in the Tehachapi News on January 14, 2026.
FISCAL IMPACT
This resolution allows the City to file for TOA funds that are used both for transit needs and our public roads. The funding information for FY 2026/27 is not available at this point.
RECOMMENDATION
Adopt the Resolution finding that there are no unmet transit needs that are reasonable to meet within the City.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TEHACHAPI FINDING THAT THERE ARE NO UNMET TRANSIT

WHEREAS, the City of Tehachapi City Council conducted a public hearing on Tuesday, February 17, 2026, to consider possible unmet transit needs within the City, and; WHEREAS, the City of Tehachapi currently provides public transportation service within the City of Tehachapi, and;
WHEREAS, the objectives of providing the public transportation system are to meet the public need for limited cost transportation, to serve the mobility limited population, and to provide an alternative to private vehicle transportation.
NOW, THEREFORE, BE IT RESOLVED by the City of Tehachapi City Council that, after holding a duly advertised public hearing and receiving public testimony, it finds there are no areas within the City with unmet public transit needs which could be reasonably met by expansion of the existing system or establishment of a new system.
BE IT FURTHER RESOLVED, that a copy of this resolution be transmitted to the Kern County Council of Governments in conjunction with the filing of claims for Transportation Development Act Funds for Fiscal Year 2026-27 and that the City Manager is authorized to execute said claims.

BACKGROUND
Thomas F. Schroeter has been the City of Tehachapi's City Attorney since January 19, 1993. BACKGROUND
HONORABLE MAYOR POGON-CORD AND COUNCIL MEMBERS
COREY COSTELLOE, ASSISTANT CITY MANAGER/PLANNING DIRECTOR FEBRUARY 17, 2026
ADOPTION OF AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEHACHAPI AMENDING THE CITY'S OFFICIAL REGULATING PLAN REGARDING ASSESSOR'S PARCEL NUMBERS 415-130- 42 AND 415-130-43 OF THE TEHACHAPI ZONING CODE.
On January 12, 2026, the Planning Commission of the City of Tehachapi approved Architecture Design and Site Plan Review (AD&SPR) No. 2024-04 from the applicant the Kern Community College District to construct a community college campus at 737 West Tehachapi Boulevard on a 6.8-acre parcel of land currently zoned M-1. (Figure 1) As allowed by City Codes, the applicant had simultaneously applied for a zoning amendment of the parcels (APN No. 415- 130-42 and 415-130-43 from M-1 (Light Industrial) to C-3 (General Commercial).
The Cerro Cose Community College Tehachapi Campus totals 19,320 square feet of instructional space, a 4,000 squarefoot maintenance and operations building along with associated parking facilities, landscaping, screening, and infrastructure. Design of student-centric facilities are under the authority of the California Division of State Architecture (DSA), construction of all public improvements as well as infrastructure and utilities are under the authority of the City of Tehachapi. (See Site Plan Figure 2)
Additionally, the applicant has successfully completed the parcel merger with the County of Kern to combine formerly two parcels into one 6.8-acre parcel. A new APN for these parcels has yet to be assigned by the County of Kern, therefore both APN Numbers are listed for reference.
Tehachapi Zoning Code Sections 9.10.020 and 10.10.020 define the process of application for a zoning map amendment as well. as the required findings and decision authority. The Planning Commission held a Public Hearing on January 12th and adopted a resolution recommending the City Council adopt an ordinance to rezone the parcels. As you are aware, the City Council held a public hearing on February 2
nd where the ordinance was introduced.
GENERAL PLAN CONSISTENCY
The proposed project aligns with the General Plan's expectations for Downtown West (1A) accommodating, specifically to the western edge, a strongly sub-urban character of Tucker Road with commercial development along Tehachapi Boulevard buffering the housing in this area from the activity along the rail corridor. Businesses here serve the region and city as well as national tourism. Additionally, this Downtown West (1A) section of the General Plan includes nearby C-3 zoned parcels.
Chapter 1 of the General Plan Section C entitled "Community Goals" specifically lists Tehachapi as "provides post- secondary educational opportunities, enriching town and region." As a permanent campus owned by the Kern Community College District and operated by Cerro Caso Community College, this site would meet that goal of the General Plan.
Modifying the zone from M-1 (Light Industrial) to C-3 (General Commercial) also achieves the initiatives of the General Plan.
The AD&SPR for this project was also evaluated using the C-3 Development Standards from the TZC.
ENVIRONMENTAL REVIEW
Initial Study Mitigated Negative Declaration: As a government agency, the Kern Community College District (KCCD) was the lead agency in preparing environmental documents in compliance with the California Environmental Quality Act (CEQA) for this project and the zone amendment for these parcels. An Initial Study and Mitigated Negative Declaration (IS/MND) was prepared and circulated for public review by the Kern Community College District. A public hearing for the IS/MND was held by KCCD on November 18th, 2025, during the regular meeting of the KCCD Board of Trustees. KCCD did not receive any comments regarding the document, and a Notice of Determination was filed with the State Office of Planning and Research and the Kern County Clerk's office. As a responsible agency, City staff have reviewed the project under the circulated IS/MND and agrees with the filing of the Notice of Determination by KCCD.
RECOMMENDATION
ADOPT, BY TITLE ONLY, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEHACHAPI AMENDING THE CITY'S OFFICIAL REGULATING PLAN REGARDING ASSESSOR'S PARCEL NUMBERS 415-130-42 AND 415- 130-43 OF THE TEHACHAPI ZONING CODE.

League of California Cities City Attorney's Spring Conference The League of California Cities City Attorney's Spring Conference will be held on May 13-15, 2026 in Universal City. The registration fee is $675.00 and a two-night stay in the hotel is $239.00 per night. During the conference, there will be three days of presentations devoted solely to legal issues facing cities and updates on cases recently decided. This is a critical learning session for city attorneys and reduces the time and effort needed by the City Attorney to research these matters on his or her own.
My other city is being asked to contribute equally to the cost for the registration fee and one night's lodging. The City's share of the expenses would be $576.00 I would request permission to represent the City of Tehachapi at the City Attorney's Spring League Conference and for the City to pay up to $576 for my expenses.
