HONORABLE MAYOR POGON-CORD AND COUNCIL MEMBERS

COREY COSTELLOE, ASSISTANT CITY MANAGER/PLANNING DIRECTOR SEPTEMBER 14, 2026

ADOPTION OF AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEHACHAPI AMENDING

VARIOUS SECTIONS OF THE TEHACHAPI ZONING CODE TO REGULATE ACCESSORY DWELLING

UNITS IN ACCORDANCE WITH STATE LAW AND FINDING THE ORDINANCE TO BE EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT.

BACKGROUND
State law has been amended nearly every year since 2017 with respect to accessory dwelling units (ADUs) and junior accessory dwelling units (JADUs). Most recent state legislation includes SB 477, SB 1211 and AB 2533 in 2024 and SB 9, AB 1154 and SB 543 in 2025. Part of these bills require local jurisdictions to not only adopt these provisions within their zoning codes but also adopt separate ordinances and a ministerial approval process for ADUs and JADUs.

The Department of Housing and Community Development has been requesting that the City of Tehachapi adopt such an ordinance following the revisions to the Tehachapi Zoning Code in which an entire chapter relating to ADUs and JADUs along with ministerial housing approval sections were added.

PUBLIC NOTICE
The notice for this meeting and the required ordinance summary was published on August 19, 2026, in the Tehachapi News, a copy was also posted at Tehachapi City Hall. The Council was presented with the introduction of the ordinance on September 8, 2026.

ORDINANCE DETAILS
California Constitution Article XI Section 7, enables the City of Tehachapi to enact local planning and land use regulations, the requirements for this ordinance are the result of the adoption of the 6 th Cycle Housing Element, a state-mandated
document that identifies certain actions that the City will undertake, including redefining ADUs and JADUs while also ensuring all zoning processes are consistent with State law.

Specifically, this ordinance adds the definition of a Junior Accessory Dwelling Unit (JADU) in Section 11.10.020 of the Tehachapi Zoning Code to read:
• Junior Accessory Dwelling Unit or JADU. A residential dwelling unit that is no more than 500 square feet of interior livable space in size and contained entirely within a single-family residence. A JADU may include separate sanitation facilities, or may share sanitation facilities with the existing structure.

In addition, Paragraph 5 of Subdivision A of Section 4.20.040 (Minor Residential Setback Reductions) of the Tehachapi Zoning Code is modified to read:
• In compliance with state law, no setback shall be required for an existing garage that is converted to an Accessory Dwelling Unit, and a setback of no more than four feet from the side and rear lot lines shall be required for an Accessory Dwelling Unit that is constructed above a garage. If state law is amended to state otherwise, the current version of state law shall prevail.

Other provisions of this ordinance include requiring only a building permit for ADU and JADU submissions and pursuant to California Government Code §66323 the City shall ministerially approve an application for a building permit on a lot that is zoned to allow single-family or multi-family residential uses.

ADUs shall not have more than 800 square feet of livable space, shall not exceed the height limit of the primary residence and shall be back a minimum of four feet from side and rear lot lines.

This ordinance also codifies State laws which now allow ADUs on multi-family developments. On lots with existing multifamily developments, no more than eight (8) ADUs will be allowed. On a lot with proposed multi-family developments, not more than two detached ADUs will be allowed.

Other covenants as applicable to State law are also included.

ENVIRONMENTAL REVIEW
The City Council finds and determines that this Ordinance is not subject to the requirements of the California Environmental Quality Act (CEQA) because this Ordinance implements the provisions of Article 2 (commencing with Section 66314) and Article 3 (commencing with Section 66333) of Chapter 13 of Division 1 of Title 7 of, the Government Code. The Ordinances is exempt from CEQA pursuant to Public Resources Code Section 21080.17 and California Code of Regulations Title 14, Section 15282(h). To the extent that any provisions of this Ordinance are not exempt pursuant to Public Resources Code Section 21080.17 and CEQA Guidelines Section 15282(h), the amendments are not subject to CEQA pursuant to CEQA Guidelines Section 15061 (b)(3), because it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment.
