City Council Item 11 Redistricting the City of Temecula I find it important to provide a background for my comment as follows: Although the council approved on September 28, 2021, to meet for a redistricting workshop with the REDI Commission, the council and community members the city retracted from its promise stating that minimal community participation was not worth the consultant's fees adding also the present in - person health concerns. We certainly don't dispute the in -person meeting; however, we could have had a zoom meeting, but the city clerk following administrative advice did not provided such option.
Let me further elaborate by mentioning, that since 2017 we had acted and participated in good faith and reason requesting the previous and present council to include community involvement beyond public comments. When the city overlooks our past five years of engaging as "minimal participation," it oversimplifies our efforts and the communities of interest we represent.
Unfortunately, faith and reasons were betrayed by your abuse of legislative power; therefore, even with all the obstacles the city placed on us we submitted to the Demographer and council members a modified map from the city's Draft A.
We created this map with the technical collaboration from MALDEF (Mexican American Legal Defense and Educational Fund). This map meets the CVAP (California Voting Age Population) of 50% plus for District 5, and potentially before next redistricting for District 1 and 3, that a majority minority would elect a member of their choice within their community.
This map meets population, contiguous, and preserves communities of interest such as Latino population who share socioeconomic and cultural commonalities. For example, District 5 has the largest Latino population and the largest multi -dwelling residence; in addition, the residents are the working force who elevate our tourism industry providing customer, food, and entertainment services. It only makes sense to adopt Draft A Modified Map we are presenting to you tonight.
Thank you.

CITY OLZRM mvr.
Comments on January 25,2022 Agenda item 11 (Redistricting) "- CITY CLIRKS DEPT.
Mr. Mayor, Members of Council and Staff:
Once again, this is a plea for meaningful and substantial public involvement in Temecula's current redistricting process.
As I understand it, the law requiring certain local governing bodies to change from at -large to by -district elections was enacted primarily to make it easier for citizens who are members of a "protected class" to elect candidates of their choice. Under the federal Voting Rights Act of 1965, a protected class includes citizens of any race or color, and members of any "language minority group". A "language minority group" includes persons who are American Indian, Asian American, Alaskan Natives or of Spanish heritage.
Given the primary intent of the law, a number of Temecula residents and I have been continuously pushing the City to permit the full involvement of protected class members and the general public with the City's hired demographer and City staff in the redistricting process.
How does it make sense to exclude the primary intended beneficiaries of the law from the process?
In 2017, the City in response to what it claimed to be an imminent threat of costly litigation decided to make the required change from at -large elections to elections by district. Despite our request that the city encourage and permit full public involvement in the line drawing process, the public was limited to choosing between three maps prepared by a City hired demographer who essentially worked free of public involvement or oversight.
On September 28, 2021, the Council held its second of four scheduled public hearings concerned with redistricting. The third hearing was scheduled for today, January 25, 2022. A fourth public hearing is scheduled for March 8, with adoption of the final map by April 17 being the hope.
Following comments from then Mayor Edwards, members of Council, the City Manager, the City Attorney, the then Chair of the REDI Commission and the demographer, the City Clerk summed up the discussion as follows:
"We'll go ahead and move forward with the general direction from the Council to do a public workshop of sorts with the REDI Commission as well as the demographer over the next few months. And we'll try to schedule that prior to the January hearing." Following the September 28 meeting, not a word was said by the City to the public or to us about the agreed upon public workshop or a proposed date, time and place for such a session.
Then, on January 18, 2022, the City Clerk forwarded an email message to Ms. Howard and me which said among other things:
III
"Unfortunately due to ongoing COVID concerns, the lack of availability of the consultants for additional in -person gatherings, and the limited expressed interest by the community, we will not be able to hold an additional workshop between now and the conclusion of our redistricting process. "
In other words, during the 112 days that followed the September 28 hearing, absolutely nothing was said or done to make the agreed upon workshop happen.
The good news in all of this is that over the 82 days remaining between now and April 17, there should be time for the City to do what was decided upon over four months ago.
It is respectfully recommended and requested that the Council use the time remaining between now and then to right the ship and give the people a chance.
COVID will soon be a memory, but the new districts will be with us for the next 10 years. Let's get it right this time.
Thank you for allowing me to present these comments.
Ira Robinson (01/25/2022)
PS: If there is time for additional comments:
1. The City did a much better job with its 2016 promotion of Measure S, a voter approved sales tax measure that delivers to the City an additional revenue windfall of well in excess of $20 million a year.
2. In connection with the City Clerk's mention of "little expressed interest by the community ", the question is: Without any announcement, date, time or place for a public workshop, what could we have done to promote it?
3. In connection with the meetings reportedly held at each of the five board or commission meetings, it should be noted that those meetings were reported at the September 28 meeting.

WORK PLAN
LAYING THE
FOUNDATION
It is evident that the current members and
officers of the EDC have worked hard to build a
foundation to launch an effective and
successful economic development
organization. To maintain that excitement and
momentum, it will be essential that we
continue to foster collaboration and
participation in the process. It is my belief that
the most successful economic development
efforts are where everyone has a role to play.
Building awareness around our mission will
help us bring more members to the table and
help us be more successful in our business
recruitment efforts.

THE
WORK
PLAN
This work plan will serve as a guide for'
staff, officers, and members as we
work to strengthen the economy of the
Southwest Riverside region by focusing
our efforts on our mission of promoting
the region to stimulate business
growth.
Business recruitment takes time. The
average project from the first point of
contact to the groundbreaking takes 2
years, and not all projects make it that
far. It is important that while we work
on those projects, we are creating
meaningful deliverables along the way.
It is intended that this plan will be
referenced throughout the year and
also used as a building block for the
coming year. We'll reflect on our
success and areas for growth and keep
our eyes on the vision of a thriving
Valley of Innovation.

Successful economic development takes the
collaborative efforts of a whole region. The
partnership between public and private
organizations and higher education is key to
successfully grow a region and sustaining
economic development activities.
Assisting local businesses in their expansion
efforts, developing relationships with site
selectors and State recruitment officers,
and fundraising are the three most critical
efforts that the staff and officers will need
to focus on in the coming years.
The Southwest Riverside County region has
many assets and opportunities. With the
right targeted approach, those will yield an
even stronger economy.

INITIATIVE MEASURE TO BE SUBMITTED DIRECTLY TO THE VOTERS The Attorney General of California has prepared the following circulating title and summary of the chief purpose and points of the proposed measure:
(21-0016A1.) PROVIDES THAT LOCAL LAND -USE AND ZONING LAWS OVERRIDE CONFLICTING STATE LAWS.
INITIATIVE CONSTITUTIONAL AMENDMENT. Provides that city and county land -use and zoning laws (including local housing laws) override all conflicting state laws, except in certain circumstances related to three areas of statewide concern: (1) the California Coastal Act of 1976; (2) siting of power plants; or (3) development of water, communication, or transportation infrastructure projects.
Prevents state legislature and local legislative bodies from passing laws invalidating voter -approved local land -use or zoning initiatives.
Prohibits state from changing, granting, or denying funding to local governments based on their implementation of this measure.
Summary of estimate by Legislative Analyst and Director of Finance of fiscal impact on state and local governments: Fiscal effects of the measure depend on future decisions by the cities and counties and therefore are unknown.
To the Honorable Secretary of State of California
We, the undersigned, registered, qualified voters of California, residents of County (or City and County), hereby propose amendments to the Constitution of California and petition the Secretary of State to submit the same to the voters of California for their adoption or rejection at the next succeeding general election or at any special statewide election held prior to that general election or as otherwise provided by law. The proposed constitutional amendments read as follows:
SECTION 1. The people of the State
of California find and declare all of
the following:
(a) The circumstances and envi-
ronmental impacts of local land use
decisions vary greatly across the state
from locality to locality.
(b) The infrastructure required to
maintain appropriate levels of public
services, including police and fire
services, parklands and public open
spaces, transportation, water supply,
schools, and sewers varies greatly
across the state from locality to local-
ity.
(c) Land use decisions made by
local officials must balance devel-
opment with public facilities and
services while addressing the eco-
nomic, environmental, and social
needs of the particular communities
served by those local officials.
(d) Thus, it is in the best interests
of the state and local communities
for these complex decisions to be
made at the local level to ensure that
the specific, unique characteristics,
constraints, and needs of those com-
munities are properly analyzed and
addressed.
(e) Gentrification of housing
adjacent to public transportation
will reduce or eliminate the avail-
ability of low or very low income
housing near public transit,
resulting in the loss of access by
low or very low income persons
to public transit, declines in pub-
lic transit ridership, and increases
in vehicle miles travelled.
(f) The State Legislature cannot
properly assess the impacts upon each
community of sweeping centralized
and rigid state land use rules and zon-
ing regulations that apply across the
state without regard to community im-
pacts and, as a result, statewide land
use and zoning will do great harm
to local communities with differing
circumstances and concerns.
(g) Community development should
not be controlled by state planners,
but by local governments that know
and can address the needs of, and the
impacts upon, local communities.
Local initiatives approved by vot-
ers pertaining to land use and zoning
restrictions should not be nullified or
superseded by the actions of any local
or state legislative body.
(h) Numerous state laws that target
communities for elimination of zon-
ing standards have been enacted,
and continue to be proposed, that
eliminate or erode local control over
local development and circumvent
the California Environmental Quality
Act ("CEQA"), creating the potential
for harmful environmental impacts to
occur.
(i) The purpose of this measure is
to ensure that all decisions regard-
ing local land use controls, includ-
ing zoning law and regulations, are
made by the affected communities
in accordance with applicable law,
including but not limited to CEQA
(Public Resources Code § 21000 et
seq.), the California Fair Employ-
ment and Housing Act (Government
Code §§ 12900 — 12996), prohibitions
against discrimination (Government
Code § 65008), and affirmatively
furthering fair housing (Government
Code § 8899.50). This constitutional
amendment would continue to pro-
vide for state control in the coastal
zone, the siting of a power plant that
can generate more than 50 megawatts
of electricity, or the development or
construction of water, communication
or transportation infrastructure proj-
ects which the Legislature declares
are matters of statewide concern and
are in the best interests of the state.
For purposes of this measure, it is the
intent that a transportation infrastruc-
ture project shall not include a transit -
oriented development project that is
residential, commercial, or mixed -use.
SECTION 2. Section 4.5 is added to
Article XI of the California Constitu-
tion, to read:
SEC. 4.5. (a) Except as provided
in subdivision (b), in the event of a
conflict with a state statute, a county
charter provision, general plan, spe-
cific plan, ordinance or a regulation
adopted pursuant to a county charter,
that regulates the zoning, development
or use of land within the boundaries of
an unincorporated area of the county
shall be deemed a county affair within
the meaning of Section 4 and shall
prevail over a conflicting state statute.
No voter approved local initiative that
regulates the zoning, development
or use of land within the boundaries
of any county shall be overturned or
otherwise nullified by any legislative
body.
(b) A county charter provision, gen-
eral plan, specific plan, ordinance or
a regulation adopted and applicable
to an unincorporated area within a
county, may be determined only by
a court of competent jurisdiction,
in accordance with Section 4, to
address either a matter of statewide
concern or a county affair if that
provision, ordinance, or regulation
conflicts with a state statute with
regard to only the following:
(1) The California Coastal
Act of 1976 (Division 20
(commencing with Section
30000) of the Public Re-
sources Code), or a succes-
sor statute.
(2) The siting of a power
generating facility capable
of generating more than 50
megawatts of electricity and
the California Public Utili-
ties Commission has deter-
mined that a need exists at
that location that is a matter
of statewide concern.
(3) The development or
construction of a water, com-
munication or transportation
infrastructure project for
which the Legislature has
declared in statute the reasons
why the project addresses a
matter of statewide concern
and is in the best interests of
the state. For purposes of this
paragraph, a transportation
infrastructure project does
not include a transit -oriented
development project, whether
residential, commercial, or
mixed -use.
(c) No modification to appro-
priations for state funded programs
shall occur, and no state grant
applications or funding shall be
denied as a result of the applica-
tion of this section. No benefit or
preference in state appropriations
or grants shall be given to an entity
that opts not to utilize the provi-
sions of this section.
(d) The provisions of this section
are severable. If any provision of
this section or its application is held
invalid, that invalidity shall not af-
fect other provisions or applications
that can be given effect without the
invalid provision or application.
SECTION 3. Section 5.5 is added to
Article XI of the California Constitu-
tion, to read:
SEC. 5.5. (a) Except as provided
in subdivision (b), in the event of a
conflict with a state statute, a city
charter provision, general plan, spe-
cific plan, ordinance or a regulation
adopted pursuant to a city charter,
that establishes land use policies or
regulates zoning or development
standards within the boundaries of
the city shall be deemed a municipal
affair within the meaning of Section
5 and shall prevail over a conflicting
state statute. No voter approved local
initiative that regulates the zoning,
development or use of land within
the boundaries of any city shall be
overturned or otherwise nullified by
any legislative body.
(b) A city charter provision, general
plan, specific plan, ordinance or a
regulation adopted pursuant to a city
charter, may be determined only by
a court of competent jurisdiction, in
accordance with Section 5, to ad-
dress either a matter of statewide
concern or a municipal affair if that
provision, ordinance, or regulation
conflicts with a state statute with re-
gard to only the following:
