Maps from the Web Soil Survey are based on the Web Mercator Background
projection, which preserves direction and shape but distorts distance and area. A projection that preserves area, such as the ® Aerial Photography
Albers equal-area conic projection, should be used if more accurate calculations of distance or area are required.

This product is generated from the USDA-NRCS certified data as of the version date(s) listed below.

Soil Survey Area: Western Riverside Area, California
Survey Area Data: Version 11, Sep 12, 2018
Soil map units are labeled (as space allows) for map scales 1:50,000 or larger.

Date(s) aerial images were photographed: Feb 24, 2015—Feb 26, 2015
The orthophoto or other base map on which the soil lines were compiled and digitized probably differs from the background imagery displayed on these maps. As a result, some minor shifting of map unit boundaries may be evident.

Hydrologic Soil Group —Western Riverside Area, California Murrieta Creek Bridge
Description
Hydrologic soil groups are based on estimates of runoff potential. Soils are assigned to one of four groups according to the rate of water infiltration when the soils are not protected by vegetation, are thoroughly wet, and receive precipitation from long -duration storms.

The soils in the United States are assigned to four groups (A, B, C, and D) and three dual classes (A/D, B/D, and C/D). The groups are defined as follows:

Group A. Soils having a high infiltration rate (low runoff potential) when thoroughly wet. These consist mainly of deep, well drained to excessively drained sands or gravelly sands. These soils have a high rate of water transmission.

Group B. Soils having a moderate infiltration rate when thoroughly wet. These consist chiefly of moderately deep or deep, moderately well drained or well drained soils that have moderately fine texture to moderately coarse texture.

These soils have a moderate rate of water transmission.

Group C. Soils having a slow infiltration rate when thoroughly wet. These consist chiefly of soils having a layer that impedes the downward movement of water or soils of moderately fine texture or fine texture. These soils have a slow rate of water transmission.

Group D. Soils having a very slow infiltration rate (high runoff potential) when thoroughly wet. These consist chiefly of clays that have a high shrink -swell potential, soils that have a high water table, soils that have a claypan or clay layer at or near the surface, and soils that are shallow over nearly impervious material. These soils have a very slow rate of water transmission.

If a soil is assigned to a dual hydrologic group (A/D, B/D, or C/D), the first letter is for drained areas and the second is for undrained areas. Only the soils that in their natural condition are in group D are assigned to dual classes.

LEVEE CRITERIA
The following criteria is for the design of !evee linings placed in or adjacent to natural watercourses that are to be approved or maintained by the District. The designer is given the choice of a number of materials to provide flexible or rigid linings. It is up to the designer to determine the most appropriate and economical material for his particular locaticn.

Flow Velocities
The anticipated maximum flow velocity restricts the type of material that can be used and determines the str:ctural requirements of the lining. The designer is required to submit engineering calculations which show the maximum expected flow velocity attacking or flow;ng adjacent to the levee. This velocity is used to determine the cutoff depth, levee thickness, and rock size.

The following criteria permits the design of a levee lining cf certain materials up to a flow velocity of 20 fps. If conditions exist where the velocity would exceed 20 fps, measures will have to be taken, such as the construction of drop structures in the natural watercourse, to reduce the velocity.

Levee Cutoff Depths
All levee linings must

Lining Returns

in the table for cutoff depths of this criteria.
this will be in the case of rock rip -rap and
apron can be provided that can adjust to scour
It is required that the upstream and downstream terminus of the levee connect to the natural bank or adjoining levee improvements with transitions designed to ease differentials in alignment, grade, sloe, and roughness of banks. The criteria for the depth of cut-off for the levee also apply to the transition section. If the proposed lining does not join an existing Lining that meets this criteria, the proposed lining must be returned into the natural bank at an anole of 30 degrees, a perpendicular distance of not less than four feet, or in lieu thereof a four -foot cutoff wall.

Page F-30

LEVEE CRITERIA
Filter Blankets and Weep Holes
Filter blankets will be required under all rock rip -rap and gabion levee linings. Weep holes connected by continuous drainage material are required for all concrete and gunite levee linings. Weep holes are also required if grouted rip -rap is used.

Scour Gages
Scour gages are required in conjunction with all levee construction.

The gages will be used to determine actual scour patterns for future refinement of the levee criteria. Unless otherwise directed, scour gages shall be 12-inch diameter holes, 20-feet deep, filled with 1/2-inch to 1-1/2-inch diameter stone, that has a color distinctly different from the surrounding material. The gages shall be placed in sets of (3) beginning at the toe of the levee and spaced at 50-feet perpendicular from the levee out into the watercourse.

The sets of three gages shall be spaced every 1,000 feet longitudinal to the levee. A minimum of 2 sets (gages) are required for each levee constructed. The exact location of the gages shall be shown on the project drawings, with the instruction to the Contractor to determine the elevation of the top of the gage upon completion of construction and make record of such for the as built drawings.

The tables on the following pages (F-32 to F-34) contain the criteria for cutoff depths, material and structural requirements, rock gradation, and filter design.

Typical levee cross -sections are shown on Pages F-35 and F-36. A typical cross-section at a scour gage is shown on Page F-37.

CIP No. PW 16-05, Federal Aid
Project No. BR-NBIL (543)
The Riverside County Flood Control and Water Conservation District (District) does not normally recommend conditions for land divisions or other land use cases in incorporated cities. The District also does not plan Check city land use cases or provide State Division of Real Estate letters or other flood hazard reports for such cases.

District comments/recommendations for such cases are normally limited to items of specific interest to the District including District Master Drainage Plan facilities, other regional flood control and drainage facilities which could be considered a logical component or extension of a master plan system, and District Area Drainage Plan fees (development mitigation fees). In addition, information of a general nature is provided.

The District's review is based on the above -referenced project transmittal, received January 11, 2024. The District has not reviewed the proposed project in detail, and the following comments do not in any way constitute or imply District approval or endorsement of the proposed project with respect to flood hazard, public health and safety, or any other such issue:
❑ This project would not be impacted by District Master Drainage Plan facilities, nor are other facilities of regional interest proposed.
❑ This project involves District proposed Master Drainage Plan facilities, namely, . The District will accept ownership of such facilities on written request by the City. The Project Applicant shall enter into a cooperative agreement establishing the terms and conditions of inspection, operation, and maintenance with the District and any other maintenance partners. Facilities must be constructed to District standards, and District plan check and inspection will be required for District acceptance. Plan check, inspection, and administrative fees will be required. All regulatory permits (and all documents pertaining thereto, e.g., Habitat Mitigation and Monitoring Plans, Conservation Plans/Easements) that are to be secured by the Applicant for both facility construction and maintenance shall be submitted to the District for review. The regulatory permits' terms and conditions shall be approved by the District prior to improvement plan approval, map recordation, or finalization of the regulatory permits. There shall be no unreasonable constraint upon the District's ability to operate and maintain the flood control facility(ies) to protect public health and safety.
❑ This project proposes channels, storm drains larger than 36 inches in diameter, or other facilities that could be considered regional in nature and/or a logical extension a District's facility, the District would consider accepting ownership of such facilities on written request by the City. The regulatory permits' terms and conditions shall be approved by the District prior to improvement plan approval, map recordation, or finalization of the regulatory permits. There shall be no unreasonable constraint upon the District's ability to operate and maintain the flood control facility(ies) to protect public health and safety. 2 City of Temecula -2- February 5, 2024
Re: Murrieta Creek Bridge at Overland Drive
(Avenida Alvarado over Murrieta Creek), 254776
CIP No. PW 16-05, Federal Aid
Project No. BR-NBIL (543)
❑ This project is located within the limits of the District's Murrieta Creek (❑Murrieta Valley ❑Temecula Valley El Santa Gertrudis Valley El Warm Springs Valley) Area Drainage Plan for which drainage fees have been adopted. If the project is proposing to create additional impervious surface area, applicable fees should be paid (in accordance with the Rules and Regulations for Administration of Area Drainage Plans) to the Flood Control District or City prior to issuance of grading or building permits. Fees to be paid should be at the rate in effect at the time of issuance of the actual permit. ❑X An encroachment permit shall be obtained for any construction and/or restoration related activities occurring within District right of way or facilities, namely, Murrieta Creek Channel and Temecula Creek.

If the Permittee proposes to do work within a potentially jurisdictional area (such as open channels and basins), the Permittee shall accept full responsibility for obtaining, implementing, and complying with all applicable provisions of the appropriate regulatory permit(s). These regulatory permits include but are

1.1 not limited to: a California State Department of Fish and Wildlife Streambed Alteration Agreement in compliance with the Fish and Game Code Section 1600 et seq.; a Section 404 Permit issued by the U.S.

Army Corps of Engineers in compliance with Section 404 of the Clean Water Act; and a 401 Water Quality Certification or a Report of Waste Discharge Requirements in compliance with Section 401 of the Clean Water Act or State Porter -Cologne Water Quality Act, respectively, from the appropriate Regional Water Quality Control Board. Encroachment permit processing will include review of these documents. Please note that conservation easements and mitigation areas within the District's right of

1.2 way may conflict with the maintenance of District facilities, therefore conservation easements and mitigation areas within District right of way are not permitted. If a proposed storm drain connection

1.3 exceeds the hydraulic performance of the existing drainage facilities, mitigation will be required. For further information, contact the District's Encroachment Permit Section at 951.955.1266. ❑ The District's previous comments are still valid.

GENERAL INFORMATION
This project may require a National Pollutant Discharge Elimination System (NPDES) permit from the State

1.4 Water Resources Control Board. Clearance for grading, recordation, or other final approval should not be given until the City has determined that the project has been granted a permit or is shown to be exempt.

If this project involves a Federal Emergency Management Agency (FEMA) mapped floodplain, the City should require the applicant to provide all studies, calculations, plans, and other information required to meet FEMA

1.5 requirements, and should further require the applicant obtain a Conditional Letter of Map Revision (CLOMR) prior to grading, recordation, or other final approval of the project and a Letter of Map Revision (LOMR) prior to occupancy.

1.6 The project proponent shall bear the responsibility for complying with all applicable mitigation measures defined in the California Environmental Quality Act (CEQA) document (i.e., Negative Declaration, Mitigated Negative Declaration, Environmental Impact Report) and/or Mitigation Monitoring and Reporting Program, if a CEQA document was prepared for the project. The project proponent shall also bear the responsibility for complying with all other federal, state, and local environmental rules and regulations that may apply. The District needs to demonstrate that all District related activities for the Project comply with CEQA. This is typically achieved through determinations from the CEQA Lead Agency for the project. We require the applicant to provide a copy of the approved, adopted, or certified CEQA document and the notice of determination if one was prepared by the Lead Agency for the proposed project. For this Project, the Lead Agency is the City of Temecula and the District will be a Responsible Agency under CEQA.

City of Temecula
Murrieta Creek Bridge at Overland Drive Project Responses to Comments on the IS-MND Letter 1
COMMENTER: Amy McNeill, Engineering Project Manager, RCFCD&WCD DATE: February 5, 2024
Response 1.1
The commenter states an encroachment permit must be obtained for construction or restoration activities occurring within the Murrieta Creek Channel and Temecula Creek, which are both within RCFCD&WCD right of way or facilities. The commenter also notes that, if work will be completed within a jurisdictional area, the City of Temecula is responsible for obtaining, implementing, and complying with all provisions of the appropriate regulatory permits.

The Draft IS-MND indicated that project approval is required by the United States Army Corps of Engineers, United States Fish and Wildlife Service, California Department of Fish and Wildlife, Regional Water Quality Control Board, and Riverside County Flood Control District. Section 9, Other Public Agencies Whose Approval is Required, on Page 5 of the Draft IS-MND has been amended in response to the comment to provide clarity on the permits and approvals that are required, as follows:

The City of Temecula is the lead agency with responsibility for approving the project. The project would require regulatory permits from the U.S. Army Corps of Engineers USACE California Department of Fish and Wildlife (CDFW), and San Diego Regional Water Quality Control Board (RWQCB) due to impacts to iurisdictional Waters of the State or Waters of the United States. An encroachment permit from the Riverside County Flood Control District and Water Conservation District (RCFCD&WCD) would be required due to the proposed construction activities within the Murrieta Creek Channel. Approval from the Western Riverside County Regional Conservation Authority (RCA), CDFW, and the United States Fish and Wildlife Service (USFWS) would be required for compliance with the Western Riverside Multiple Species Habitat Conservation Plan (MSHCP) and the Determination of Biologically Eauivalent or Superior Preservation (DBESP).

Response 1.2
The commenter states that conservation easements and mitigation areas within District rights of way are not permitted.

The commenter's statements regarding conservation easements and mitigation areas within District rights of way are noted. The project does not propose conservation easements or mitigation areas within District rights of way.

Response 1.3
The commenter states that, if a proposed storm drain connection exceeds the hydraulic performance of the existing drainage facilities, mitigation will be required.

Hydraulic analyses were performed for the project and are contained in the Hydrology and Hydraulics Report prepared by Engineering Resources of Southern California, Inc. in May 2020 (Appendix H). The hydraulic analyses confirmed that the hydraulic performance of the existing drainage facilities and Murrieta Creek would not be exceeded.

Murrieta Creek Bridge at Overland Drive Project Responses to Comments on the IS-MND Response 1.4
The commenter notes that the project may require an NPDES permit from the State Water Resources Control Board.

As discussed in Section 10, Hydrology and Water Quality, of the Draft IS-MND, the City of Temecula would obtain coverage under the State Water Resource Control Board's General Permit for Storm Water Discharges Associated with Construction and Land Disturbance Activities, Order No. 2022- 0057-DWQ, NPDES No. CAS000002 (Construction Stormwater General Permit).

Response 1.5
The commenter indicates that projects involving FEMA mapped floodplains require a Conditional Letter of Map Revision (CLOMR).

As discussed in Section 10, Hydrology and Water Quality, of the Draft IS-MND, the bridge would be constructed above the 100-year water surface elevation associated with the mapped floodway.

Response 1.6
The commenter states that the City of Temecula must be responsible for complying with all mitigation measures defined in the CEQA document, as well as all other federal, state, and local environmental rules and regulations that apply. The commenter also states that the City is required to provide a copy of the approved, adopted, or certified CEQA document and the associated notice of determination.

This comment is noted. The City will comply with all mitigation measures outlined in the accompanying Mitigation Monitoring and Reporting Program, as well as with the conditions of all environmental regulatory permits. The adopted CEQA document and its NOP will be provided to the District following project approval.

Mitigation Monitoring and Reporting Program

Mitigation Monitoring and Reporting Program
Mitigation Monitoring and Reporting Program
The Initial Study -Mitigated Negative Declaration (IS-MND) for the Murrieta Creek Bridge at Overland Drive Project (project) identifies the mitigation measures required to reduce the environmental impacts associated with the project. The California Environmental Quality Act (CEQA) requires a public agency to adopt a monitoring and reporting program for assessing and ensuring compliance with any required mitigation measures applied to proposed development. As stated in Section 21081.6(a)(1) of the Public Resources Code:
"the public agency shall adopt a reporting or monitoring program for the changes made to the project or conditions of project approval, adopted in order to mitigate or avoid significant effects on the environment."
Section 21081.6 also provides general guidelines for implementing mitigation monitoring programs and indicates that specific reporting and/or monitoring requirements, to be enforced during project implementation, shall be defined as part of making findings or adopting a mitigated negative declaration.

The mitigation monitoring table lists the identified mitigation measures for the project. To ensure that the mitigation measures are properly implemented, a monitoring program has been devised which identifies the timing and responsibility for monitoring each measure.

The first column identifies mitigation measures that were identified in the Final IS-MND. The second column, entitled "Action Required," refers to the monitoring action that must be taken to ensure the mitigation measure's implementation. The third column, entitled "Monitoring Timing," refers to when the monitoring will occur to ensure that the mitigation action is complete. The fourth column, entitled "Monitoring Frequency," refers to how often the monitoring will occur to ensure that the mitigation action is complete. The fifth column, entitled "Monitoring Responsibility," refers to the agency responsible for oversight or ensuring that the mitigation measure is implemented. The "Compliance Verification" column is where the agency responsible for oversight verifies that the measures have been implemented.

State Clearinghouse No.: 2024010283
Project Title: Murrieta Creek Bridge at Overland Drive (Avenida over Murrieta Creek), CIP No. PW16-05, Federal Aid Project No. BR-NBIL(543)
Project Location: The project is located in the northwest area in the City of Temecula, west of Interstate 15 (1-15), north of Via Montezuma, west of Enterprise Circle West, south of Winchester Road, and east of Diaz Road. The approximate longitude and latitude coordinates of the proposed bridge site are 117.1658° W and 35.5239' N
Project Description: The project proposes to construct an approximately 340-foot-long concrete girder bridge over Murrieta Creek to connect Avenida Alvarado with Overland Drive. The bridge would accommodate four travel lanes, left -turn lane(s) in the median, and two six -foot -wide Class II bike lanes for a curb - to -curb road width of 68 feet. The bridge design would incorporate aesthetically treated concrete barriers, architectural metal hand and bicycle railings. The architectural treatments at the concrete barriers and abutment retaining walls will discourage graffiti. A six -foot -wide sidewalk would be added on the bridge's southern side for pedestrians to cross the creek. Two piers and two abutments would be placed in the creek to support the bridge.

The existing bike trail on the west side of the creek would intersect with the extended Overland Drive by a signal -controlled at -grade crossing. In order to match the roadway two-lane section on Avenida Alvarado on the west side of Diaz Road, the project would transition the existing lane configuration in the eastern portion of Avenida Alvarado to be consistent with the four -lane configuration of the bridge. Traffic signals and associated signing, striping, streetlights, and utilities would be installed at the intersections Overland Drive/Enterprise Circle West and Diaz Road/Avenida Alvarado. Traffic signals and streetlights will be installed at the Overland Drive/Commerce Center Drive intersection by a separate project. Associated improvements along Diaz Road and Avenida Alvarado would include undergrounding electrical utilities, constructing curbs, gutters, and sidewalks, relocating sewer and water facilities, and adding traffic signage and striping. Landscaping modifications would occur along C:\Users\ufc-prod\AppData\Local\Temp\BCL Technologies\easyPDF 8\@BCL@EC1A7800\@[email protected] RAFORMS\CEQA.DEM 2/28/24 klb

CITY OF TEMECULA

AGENDA REPORT
TO: City Manager/City Council
FROM: Patrick Thomas, Director of Public Works/City Engineer DATE: March 12, 2024
SUBJECT: Approve Second Amendment to the Annual Agreement for Paving Maintenance Services with NPG, Inc.

PREPARED BY: Julie Tarrant, Principal Management Analyst Stacey Biddle, Management Assistant
RECOMMENDATION: That the City Council approve the second amendment to the annual agreement with NPG, Inc., for paving maintenance services in the amount of $500,000, for total agreement amount of $2,750,000.

BACKGROUND: On September 24, 2020, the City entered into an Agreement for Paving Maintenance Services with NPG, Inc., in the amount of $2,000,000, to provide paving maintenance services of various streets throughout the City. On February 8, 2022, City Council approved the First Amendment to increase payment in the amount of $250,000. The Second Amendment will extend the term to June 30, 2025, and increase the payment in the amount of $500,000, for a total agreement amount of $2,750,000.

At this time we have nearly exhausted the full value of the current agreement and with the approval of the Second Amendment it will provide for the additional paving repairs needed, and continued roadway maintenance. NPG, Inc., has provided these services over the past fiscal years and has shown they are capable and responsive to the needs of the City. We therefore recommend the approval of the Second Amendment for the continued repairs and maintenance of our streets and roads.

FISCAL IMPACT: Adequate funds are available in the Annual Operating Budget Fiscal Year 2023-2024, and Capital Improvement Program Budget for Fiscal Years 2024-2028.

FISCAL IMPACT: The costs of police services, as well as services provided by the City Public Works Maintenance Division (for providing, placing, and retrieving of necessary warning and advisory devices), are appropriately budgeted within the City's operating budget.

Section 1. On January 23, 2024, this Board of Directors of the Temecula Public Financing Authority (the "Authority") adopted Resolution No. TPFA 2024-01 entitled "A Resolution of the Board of Directors of the Temecula Public Financing Authority Declaring Its Intention to Establish a Community Facilities District and to Authorize the Levy of Special Taxes Therein — Prado" (the "Resolution of Intention"), stating its intention to establish the Temecula Public Financing Authority Community Facilities District No. 23-02 (Prado) pursuant to the Mello -Roos Community Facilities Act of 1982, Section 53311 et seq. of the California Government Code (the "Law"), to finance the costs of certain public improvements (the "Facilities") and of certain municipal services (the "Services"), and the cost to prepay certain special taxes (the "Special Taxes").

Section 2. Notice was published as required by the Law of the public hearing called pursuant to the Resolution of Intention relative to the intention of this Board of Directors to form the District and to provide for the costs of the Facilities, the Services and the prepayment of the Special Taxes.

Section 3. The Resolution of Intention called for a public hearing on the District to be held on February 27, 2024 and on such date this Board of Directors held the public hearing relative to the determination to proceed with the formation of the District.

Section 4. At the public hearing all persons desiring to be heard on all matters pertaining to the formation of the District and the levy of special taxes in the District were heard, substantial evidence was presented and considered by this Board of Directors and a full and fair hearing was held.

Section 5. Subsequent to said hearing, this Board of Directors adopted resolutions entitled "A Resolution of the Board of Directors of the Temecula Public Financing Authority of Formation of Temecula Public Financing Authority Community Facilities District No. 23-02 (Prado), Authorizing the Levy of a Special Tax Within the District, and Preliminarily Establishing an Appropriations Limit for the District" (the "Resolution of Formation"), "A Resolution of the Board of Directors of the Temecula Public Financing Authority Determining the Necessity to Incur Bonded Indebtedness of the Temecula Public Financing Authority Community Facilities District No. 23-02 (Prado)" (the "Resolution of Necessity") and "A Resolution of the Board of Directors of the Temecula Public Financing Authority Calling Special Election Within Community Facilities District No. 23-02 (Prado)", which resolutions established the District, authorized the levy of a

special tax on property within the District, and called an election within the District on the proposition of incurring indebtedness, levying the special tax and establishing an appropriations limit for the District.

Section 6. On February 27, 2024 an election was held within the District in which the sole eligible landowner elector approved said propositions.

Section 7. By the passage of this Ordinance this Board of Directors hereby authorizes and levies special taxes within the District, pursuant to the Law, at the rate and in accordance with the rate and method of apportionment of special taxes for the District approved by the Resolution of Formation (the "Rate and Method") which Resolution is by this reference incorporated herein.

The special taxes are hereby levied commencing in Fiscal Year 2024-2025 and in each fiscal year thereafter until payment in full of any bonds issued by the Authority for the District (the "Bonds") as contemplated by the Resolution of Formation and the Resolution of Necessity, payment in full of all costs of administering the District, and so long as necessary to pay for the Services.

Section 8. The Authority Treasurer is hereby authorized and directed to work with the Finance Director for the City of Temecula (who is identified as the "CFD Administrator" in the Rate and Method) each fiscal year to determine the specific special tax rate and amount to be levied for each parcel of real property within the District, in the manner and as provided in the Rate and Method.

Section 9. Properties or entities of the State, federal or local governments shall be exempt from any levy of the special taxes, to the extent set forth in the Rate and Method attached as Exhibit B to the Resolution of Intention. In no event shall the special taxes be levied on any parcel within the District in excess of the maximum tax specified in the Rate and Method.

Section 10. All of the collections of the special tax shall be used as provided for in the Law and in the Resolution of Formation including the payment of principal and interest on the Bonds, the replenishment of the reserves for the Bonds, the payment of the costs to provide the Facilities and the Services, and to prepay the Special Taxes, the costs of the Authority and the City of Temecula in administering the District, and the costs of collecting and administering the special tax.

Section 11. The special taxes shall be collected from time to time as necessary to meet the financial obligations of the District on the secured real property tax roll in the same manner as ordinary ad valorem taxes are collected. The special taxes shall have the same lien priority, and be subject to the same penalties and the same procedure and sale in cases of delinquency as provided for ad valorem taxes. In addition, the provisions of Section 53356.1 of the California Government Code shall apply to delinquent special tax payments. The Treasurer is hereby authorized and directed to provide all necessary information to the auditor/tax collector of the County of Riverside and to otherwise take all actions necessary in order to effect proper billing and collection of the special tax, so that the special tax shall be levied and collected in sufficient amounts and at the times necessary to satisfy the financial obligations of the District in each fiscal year.

N

Notwithstanding the foregoing, the Treasurer may collect one or more installments of the special taxes on any one or more parcels in the District by means of direct billing by the Authority of the property owners within the District, if any of the Bonds bear interest at a variable interest rate, or otherwise if, in the judgment of the Treasurer, such means of collection will reduce the administrative burden on the Authority in administering the District or is otherwise appropriate in the circumstances. In such event, the special taxes shall become delinquent if not paid when due as set forth in any such respective billing to the applicable property owners.

Section 12. If for any reason any portion of this Ordinance is found to be invalid, or if the special tax is found inapplicable to any particular parcel within the District, by a Court of competent jurisdiction, the balance of this Ordinance, and the application of the special tax to the remaining parcels within the District shall not be affected.

CITY OF TEMECULA

AGENDA REPORT
TO: City Manager/City Council
FROM: Peter Thorson, City Attorney
DATE: March 12, 2024
SUBJECT: Introduce Ordinance Adding Chapter 9.90 Unlawful Possession of a Catalytic Converter to the Temecula Municipal Code (At the Request of Subcommittee Members Mayor Pro Tern Kalfus and Council Member Alexander) PREPARED BY: Betsy Lowrey, Assistant to the City Manager RECOMMENDATION: That the City Council introduce an ordinance entitled:

ORDINANCE NO.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TEMECULA ADDING CHAPTER 9.90, UNLAWFUL

POSSESSION OF A CATALYTIC CONVERTER, TO THE

TEMECULA MUNICIPAL CODE
SUMMARY OF ORDINANCE: The City of Temecula's proposed ordinance establishes that it is unlawful for any person to possess any catalytic converter which is not attached to a vehicle unless the person has verifiable, valid proof of ownership of the catalytic converter.

BACKGROUND: At the request of Public Safety Ad Hoc Subcommittee Members Mayor Pro Tern Kalfus and Council Member Jessica Alexander, the City Attorney drafted an ordinance to provide the City and its Sheriff's Department with reasonable means to address the impact on the community and the victims of catalytic converter thefts. The theft of catalytic converters has been an increasing problem throughout Southern California in recent years. The external location of catalytic converters on vehicles, and the use of valuable precious metals, including rhodium, palladium and platinum, in catalytic converters makes these devices a target for thieves. Individuals in possession of stolen catalytic converters often recycle them for substantial profit, while victims of these thefts suffer the consequences of paying thousands of dollars in repairs, the inconvenience of repairing their vehicles, and feeling unsafe in the community.

While there have been legislative attempts in Sacramento to crack down on catalytic converter thefts, local agencies in California have begun to pass similar ordinances to assist law enforcement in holding individuals accountable for their crimes. Similar to the County of Riverside's recently adopted ordinance related to catalytic converter thefts, the City's proposed ordinance establishes

that it is unlawful for any person to possess any catalytic converter which is not attached to a vehicle unless the person has verifiable, valid proof of ownership of the catalytic converter.

FISCAL IMPACT: None

ORDINANCE NO.2024-

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF TEMECULA ADDING CHAPTER 9.90, UNLAWFUL

POSSESSION OF A CATALYTIC CONVERTER, TO THE

TEMECULA MUNICIPAL CODE

THE CITY COUNCIL OF THE CITY OF TEMECULA DOES HEREBY ORDAIN AS FOLLOWS:

Section 1. Chapter 9.90, Unlawful Possession of a Catalytic Converter, is hereby added to the Temecula Municipal Code to read as follows:

9.90.010 Findings. The City Council hereby finds, determines and declares that:

A. The theft of catalytic converters has been an increasing problem in Riverside County and the City in recent years. The external location of catalytic converters and the use of valuable precious metals, including rhodium, palladium and platinum, in catalytic converters makes these devices a target for thieves. Individuals in possession of stolen catalytic converters often recycle them for substantial profit, while victims of these thefts suffer the consequences of paying thousands of dollars in repairs, the inconvenience of repairing their vehicles, and feeling unsafe in the community. Finding the victim of these crimes is extremely difficult due to the manner in which the catalytic converter thefts occur and lack of identifying markers on catalytic converters to link a stolen catalytic converter to the victim. The inability to identify the victims of catalytic converter thefts can inhibit the ability to successfully prosecute individuals for the thefts.

B. This Chapter is necessary to provide the City a means to protect the public, deter this criminal activity and promote a more productive use of City resources.

C. The purpose and intent of this Chapter is to curb the theft of catalytic converters throughout the City and to provide the City with reasonable means to address the impact on the community and the victims posed by increasing catalytic converter thefts.

D. This Chapter promotes the health, safety and general welfare of people in the City.

9.90.020 Definitions. As used in this Chapter, the following terms shall have the following meanings:

A. "Council" means the City Council of the City of Temecula.

B. "City" means the City of Temecula.

C. "Catalytic converter" means any exhaust emission control device, or portion thereof, that converts toxic gases and pollutants in exhaust gas from an internal combustion engine into less -toxic pollutants.

D. "Enforcement Officer" means: (1) members of the Riverside County sheriff's department or such other police agency under contract to provide police services to the city; (2) persons employed by the city whose job descriptions require the person to enforce the provisions of this code, including, but not limited to, code enforcement officers, or park rangers; and (3) such other employees of the city as may be designated by resolution of the city council.

E. "Lawful Possession" includes: (1) being the lawful owner of the catalytic converter or (2) being in possession of the catalytic converter with the lawful owner's verifiable written consent. It is not required to prove the catalytic converter was stolen to establish the possession is an Unlawful Possession.

F. "Proof of Ownership" means written document(s) clearly identifying the vehicle from which the catalytic converter originated based on the totality of the circumstances, which includes, but is not limited to, the following types of documents:

1. Bill of sale from the original owner with photographs.

2. Verifiable documentation from an auto -body shop proving the owner relinquished the catalytic converter to the auto -body shop.

3. Verifiable electronic communication from the previous owner to the possessor relinquishing ownership of the catalytic converter.

4. Photographs of the vehicle from which the catalytic converter originated.

5. Vehicle registration associated with the catalytic converter containing an etched associated license plate number or vehicle identification number or driver's license number of registered vehicle owner.

9.90.030. Unlawful Possession of a Catalytic Converter. Barring any provision of state law permitting the same, it is unlawful for any person to possess any catalytic converter which is not attached to a vehicle unless the person has a verifiable, valid proof of ownership of the catalytic converter.

A. This section does not apply to a detached catalytic converter that has been verifiably tested, certified, and labeled or otherwise approved for reuse, and is being bought or sold for purposes of reuse in accordance with the federal Clean Air Act (42 U.S.C. § 7401 et seq.) and regulations under the Clean Air Act, as they may be amended from time to time.

B. It is unlawful for any person to knowingly falsify or cause to be falsified any information in a record intended to show valid proof of ownership.

C. Evidence of unlawful possession may be presumed by the number of detached catalytic converters within one's possession and/or by the condition of the 2 dismantled catalytic converter(s), including but not limited to, the manner a catalytic converter has been detached or cut from a vehicle.

9.90.040 Violations And Enforcement.

A. Misdemeanor Penalty. Any person who violates any provision of this Chapter is guilty of a misdemeanor, and upon conviction shall be punished by a fine not exceeding one thousand dollars ($1,000), or by imprisonment in the county jail for a term not exceeding one year, or by both. Upon any second or subsequent conviction of the offense, the person shall be punished by the penalties of a fine of one thousand dollars ($1,000) and by imprisonment in the County jail for one year.

B. Administrative Citations. Violations of this Chapter are subject to administrative citations and penalties pursuant to Chapter 1.21 of the Temecula Municipal Code. The fine for such violations shall be one thousand dollars ($1,000) or such other amount as provided by resolution of the City Council or applicable law.

C. State Penalties Apply. Nothing in this Chapter shall be intended to limit any of the penalties provided for under California law, including but not limited to the Penal Code, with regard to the sale, use, possession, delivery, and/or receipt of catalytic converters.

D. Separate Offenses. Acts, omissions, or conditions in violation of this Chapter that continue, exist, or occur on more than one day constitute separate violations on each day. Likewise, a person shall be deemed guilty of a separate offense for each and every catalytic converter in the person's possession that is not attached to a vehicle unless the person has a valid proof of ownership of the catalytic converter as required by this Chapter.

Section 2. If any section or provision of this Ordinance is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction, or contravened by reason of any preemptive legislation, the remaining sections and/or provisions of this Ordinance shall remain valid. The City Council hereby declares that it would have adopted this Ordinance, and each section or provision thereof, regardless of the fact that any one or more section(s) or provision(s) may be declared invalid or unconstitutional or contravened via legislation.

Section 3. The Mayor shall sign and the City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same or a summary thereof to be published and posted in the manner required by law.

Section 4. This Ordinance shall take effect thirty (30) days after passage. 3 PASSED, APPROVED, AND ADOPTED by the City Council of the City of Temecula this day of ,

Hi there thanks for reading this:

THEY WANT TO ruin TEMECULA and murrieta ,few last common sense cities left in CA.
***Voting record: 3 out of 4 voted NO TO PARENTAL RIGHTS. the pornographic material in schools or the one kids can come here and get gender neutering surgeries without parental approval! Resolution for Parental rights for city council was put by Jessica Alexander, but GUESS WHAT,3 of 4 VOTED NO!
***3 of 4 Voted to increase salary for council. CORRUPT$$$ ***3 out of 4 said yes to install more camera (1984) China model. 500 are installed 25 got added more.
hint: 3 of 4 are all males be there are only 2 genders. "Mayor Pro Tern "Brenden Kalfus on city website it says Key Objectives On City website
• Ensure Public Safety remains a top priority; keeping Temecula a safe city... he didnt vote for those
• Promote understanding and transparency of city
government through open discussions and education WILL HE DO THIS? Town hall? IF NOT! RESIGN
Why did you bring Canada's tyranny with you and not put out the fire you started in TEMECULA?
I can tell at least he feels super guilty and knows he is messing up bad. Lets give him credit for that.

Council Member Zak Schwank former mayor elected by the 5 members.

Key Objectives
• improve traffic flow (smart highways is beginning of smart cities): actually give you credit for being honest about this... • Keep Temecula a safe and beautiful city.

THese 2 are fighing hard for agenda 2030 of tyranny!
2 Will their kids 8 kids have PR? these 2 are most likely controlled opposition payed by Soros, Newhim, China, or Some Globalist Establishment Technocratic Elite $. Everyone, lets find out legal ways to make them both resign legally.

They were sent 100% to damage Temecula Murrieta bc we are common sense city.

Big shout out to Jessica Alexander

SHOULD BE NEXT MAYOR IF YOU WANT TO SAVE TEMECULA
• keeping her promises made
So I ask you to please lets fund a donation plan for the only true patriot, populist, nationalist councilwoman Jessica Alexander who can be most trusted and will be next mayor to give town hall meetings by her self as the other 3 are doing everything they can to stop her*
still have not heard the plans of the smart city in 2030. TEMECULA ALREADY

AGREED TO DO THIS BC SACRAMENTO MADE EVERY CITY DO IT AND TOOK POWER AGAINST CITY GOV,. Some cities are doing right thing and suing Gov of CA back, that's right thing to fight back, not role over and accept it, bc fighting back starts a domino affect.

I ran out of time thank you!
Smart cities , 15 min cities:
- Permanent lockdown global cashless societies
- Central bank digital currency cbdc
-Carbon & Nitrogen taxes ( Green New Scam)
- Social credit score via smart city monitoring
-endless migration replacement:
- Universal basic income. Its Communifornia.

Right now Austria, EU, evil China, and Canada, have announced cbdc to replace cash/credit cards with face thumb scans or subdermal chops, From WEF and the globalist establishment technocratic elites. For social credit scores, vax pass,. They want to create the problems to bring own solutions for power. btw: TRUMP RAMASWAMY 2024 IS OUR ONLY HOPE.

Payam Daneshvar , Temecula LEGAL resident
