9 BACKGROUND:
The City has an ongoing program to improve pedestrian access throughout the community. On December 10, 2019, City Council adopted an Active Transportation Plan (ATP) that ranked missing bicycle and pedestrian improvements Citywide based on several factors, including pedestrian traffic volumes, proximity to schools, and road classifications. Prior to adopting the ATP, the City was awarded CMAQ grants in 2015, 2017, and 2018 for a total of $1,761,284 to improve pedestrian and bicycle facilities on Rancho Road, installation of a new traffic signal at Rancho Road and the 101 southbound ramps, and to modify the existing traffic signal at Rancho Road and the 101 northbound ramps (Attachment #1).
On February 5, 2021, the Ventura County Transportation Commission (VCTC) approved the award of an additional $348,846 in CMAQ funding for the construction of the Rancho Sidewalk and Bike Lanes Project (CI 5308), for a total of $2,085,474 in CMAQ funding with no City matching funds required for the project construction.
On January 12, 2021, City Council approved the award of a construction contract to Sully-Miller Contracting Company in the amount of $1,614,000, plus an original construction contingency of $161,400. Since the start of construction in February 2021, seven Change Orders totaling $235,585.09 have been executed. The contract time has been extended to March 10, 2023, to account for supply chain delays from Caltrans in procuring the new signal cabinets for the project.
The project is substantially complete, and the traffic signals are fully operational except for one additional traffic signal head required by Caltrans as a result of the final walk through. This additional signal head is on backorder and will be arriving by early March 2023.
DISCUSSION/ANALYSIS:
Construction Change Order
Change Order No. 8 to Contract No. 12656-2021 with Sully Miller Contracting Company (Attachment #2) in the amount of $139,757.94 provides for contract bid item quantity adjustments based on field measurements, additional cost due to performing the out of sequence work that became necessary as a result of delayed material delivery, and for performing additional items of work that were required by Caltrans that were not included in the original contract. This change order will also extend the contract period by 21 Calendar Days, resulting in a revised Completion Date of March 31, 2023.

Staff presented the initial concept plan to the City’s Bicycle Advisory Team in May 2017 to present the project and gather input. Conceptual plans were also shared with the City’s Traffic and Transportation Advisory Commission on July 19, 2017, with a follow-up meeting to present the final design in October 2019.
This project meets City Council’s Top Ten Priorities #9, Public Works Infrastructure Investments.

Jorge,
Yes, I will request for an extension past the February timeframe, possibly another 2 months into April.
With the additional changes came down during our last “partial” activation, it warrants this extension.
Thanks,

SUBJECT: 2023 Southern California Association of Governments General Assembly - Delegate Representative
RECOMMENDATION:
1. Designate Al Adam, Mayor Pro Tem, as the Delegate Representative and Councilmember Bob Engler as the Alternate Representative for the City at the Southern California Association of Governments (SCAG) Regional Conference and General Assembly, which will take place May 4-5, 2023.
2. Find that designating a delegate is not a “project” under the California Environmental Quality Act pursuant to CEQA Guideline Section 15378(b)(5).
FINANCIAL IMPACT:
No Additional Funding Requested. The City’s annual SCAG membership dues are included in the Adopted FY 2022-23 General Fund Budget and cover the cost for the Councilmember’s participation in the SCAG General Assembly.
BACKGROUND:
Founded in 1965, SCAG is a Joint Powers Authority (JPA) under California state law, established as an association of local governments and agencies that voluntarily convene to address regional issues. Under federal law, SCAG is designated as a Metropolitan Planning Organization (MPO), and under state law, as a Regional Transportation Planning Agency and a Council of Governments.
The SCAG region encompasses six counties (Imperial, Los Angeles, Orange, Riverside, San Bernardino, and Ventura) and 191 cities in an area covering more than 38,000 square miles. The agency develops long-range regional transportation plans, including Sustainable Communities Strategy and growth forecast components, regional transportation improvement programs, regional housing needs allocations, and a portion of the South Coast Air Quality management plans.
In 1992, SCAG expanded its governing body, the Executive Committee, to a 70- member Regional Council to help accommodate new responsibilities mandated by Item No.7D
2023 SCAG General Assembly - Delegate Representative
February 14, 2023
5 1
4 the federal and state governments, as well as to provide more broad-based representation of Southern California’s cities and counties. With its expanded membership structure, SCAG created regional districts to provide for more diverse representation. The districts were formed with the intent to serve equal populations and communities of interest. Currently, the Regional Council consists of 86 members.
DISCUSSION/ANALYSIS:
From May 4-5, 2023, more than 1,000 local leaders from throughout Southern California will convene for SCAG’s 58th Annual Regional Conference and General Assembly. The General Assembly will be held at the JW Marriott Desert Springs Resort & Spa. This conference will feature presentations and panel discussions on the new technologies to enhance mobility, economic opportunity, and quality of life. The conference brings together state and local elected officials, CEOs, business and civic leaders, transportation and environmental stakeholders, local government staff, and others. The program will also feature the 2023 SCAG Sustainability Awards, which recognizes exemplary transportation and land use projects in the region.
SCAG requires that the City formally designate a delegate and alternative representative to attend the General Assembly. Mayor Pro Tem Adam has represented the City for the last few years as the designated voting delegate.
Councilmember Engler has served as the alternate representative. Both have been actively involved in SCAG Committees and Ventura Council of Governments.
A copy of the staff report must be submitted by March so SCAG can officially publish Mayor Pro Tem Adam and Councilmember Engler to the list of delegates.
COUNCIL GOAL COMPLIANCE:
Meets the following City Council goal:
B. Provide municipal government leadership which is open and responsive to residents, and is characterized by ethical behavior, stability, promoting public trust, transparency, confidence in the future, and cooperative interaction among civic leaders, residents, business representatives, and staff, while recognizing and respecting legitimate differences of opinion on critical issues facing the City.

SUBJECT: 2023 City Council Meeting Schedule Revision
RECOMMENDATION:
1. Adopt resolution revising City Council meeting schedule for calendar year 2023.
2. Find that this is not a project under the California Environmental Quality Act Guidelines.
FINANCIAL IMPACT:
No Additional Funding Requested. Minimal staff time required to prepare the report is included in the Adopted FY 2022-23 General Fund Budget.
BACKGROUND:
Pursuant to Thousand Oaks Municipal Code Section 1-8.101, City Council regular meetings should be held at least twice each month on Tuesdays at such times fixed annually by resolution. City Council typically adopts the meeting schedule in the fall for the next calendar year.
DISCUSSION/ANALYSIS:
Due to a scheduling conflict, the 2023 City Council meeting calendar requires revision. The revised meeting dates consider holidays, family vacations, and work schedules. Staff recommends the removal of the March 28, 2023, meeting date (Attachment #1).
In addition, also due to scheduling, staff recommends that closed session occur before the open session of the meeting. Closed session, when requested, will begin at 5:00 p.m. If no notice for a closed session appears on the regular meeting agenda, there will be no closed session at the established time. The open session of each regular meeting will begin at 6:00 p.m., or soon thereafter, if there is a Item No.7E

preceding closed session. This method of scheduling closed sessions is used in other California cities to eliminate the necessity to post a special meeting call and notice for each closed session that may be scheduled before the regular meeting start time.

(ZONE CHANGE 2022-70828-Z)
The City Council of the City of T housand Oaks does hereby ordain as follows:
Part I
Based upon the information contained in the staff report, exhibits, and public testimony at the public hearing, the City Council approved this zone change application with the following findings:
1. The project is consistent with the Thousand Oaks General Plan and any applicable specific plan or redevelopment plan.
The proposed zone amendment will re-d esignate the 5,600 square-foot property from P-L (Publ ic, Quasi-Public, and Institutional Lands and Facilities) to RPD-12U (Residential Planned Development). Upon adoption of the zone change, the proposed amendment will meet this finding because the General Plan land use designation fo r the property is Medium Density Residential, which will align with the RPD-12U zoning. The proposed project is consistent with the General Plan policies to “maintain and preserve existing neighborhoods through the application of appropriate zoning and development controls” and “maintain and enhance the present high quality, semi-rural single-family residential character of the Thousand Oaks Planning Area.” Furthermore, the subject site is not located within any applicable specific plan or r edevelopment plan. Therefore, the proposed zone amendment meets this finding.

2. The project has been reviewed in conf ormance with the provisions of the California Environmental Quality Act.
This project is exempt from t he requirements of the California Environmental Quality Act (CEQA) pur suant to Section 15061(b)(3) of the CEQA Guidelines as “…CEQA applie s only to projects, which have the potential for causing a significant impact on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.” The proposed project is to amend the zoning classification of the subject site to align with the general plan land use designation and allow for the property to be occupied as a residential use. Additionally, no changes to the site are proposed as part of this application. As a result, the proposed amendment meets this finding.
Part 2

TO:Andrew P. Powers, City Manager
FROM:Clifford G. Finley, Public Works Director
DATE:February 14, 2023
SUBJECT: School Crossing Guard Program Standards and Policies RECOMMENDATION:
1. Adopt resolution establishing the City of Thousand Oaks School Crossing Guard Program Standards and Policies.
2. Approve budget transfer in an amount not to exceed $18,340 from A/C #001-5580-612-1210 (Crossing Guard, Regular Pay - Hourly) to A/C #001- 5580-612-5699 (Crossing Guard, Consultant Services – Other).
3. Find that this action is not a project as defined under the California Environmental Quality Act.
FINANCIAL IMPACT:
No Additional Funding Requested. Minimal staff time to prepare staff report included in Adopted FY 2022-23 General Fund Budget. Program funding for future fiscal years will be included in the biennial General Fund Operating Budget process. Budget transfer of salary savings is requested to cover the costs for the 2023 Crossing Guard Program vehicle and pedestrian counts.
BACKGROUND:
There are 24 City-managed and funded school crossing guard locations serving 20 Conejo Valley Unified School District (CVUSD) school campuses citywide, consisting of 15 elementary and five middle schools. Each location costs the City an estimated $16,000 annually in direct and indirect costs. The program is funded from the General Fund with no outside support. On April 20, 2022, staff presented the Traffic and Transportation Advisory Commission (TTAC) with a recommendation, based upon application of existing City policy, to close five existing crossing guard locations for the 2022-23 school year. TTAC unanimously approved staff’s recommendation.

3 On June 14, 2022, City Council considered TTAC’s recommendation. City Council declined to act on the recommendation and directed staff to return with additional information on the program before taking any action. A comprehensive report on the program was provided on August 30, 2022. City Council voted 5-0 to have TTAC review current standards and policies and recommend revisions to the City Council.
At the October 19, 2022, TTAC meeting, staff presented a history of the crossing guard program and information from agencies across Ventura County on their crossing guard programs and practices. Staff received feedback from the TTAC members on potential changes to the crossing guard standards and policies.
At the November 16, 2022, TTAC meeting, staff presented a draft Crossing Guard Program Standards and Policies for consideration. TTAC requested additional modifications to include alternative criteria that addressed concerns that residents have expressed in the past. These alternative criteria were included in the final policy. At the December 7, 2022, TTAC meeting, TTAC members approved a revised Standards and Policies resolution (Attachment #1) on a 4-0 vote.
DISCUSSION/ANALYSIS:
Crossing guard standards exist to objectively evaluate the need for crossing guards by comparing data collected against well-researched requirements.
Locations meeting both pedestrian and vehicle minimum thresholds indicates a potential need for supervision to assist students to find gaps in traffic flow to cross the street.
Most municipal agencies use the California Manual on Uniform Traffic Control Devices (MUTCD) to set their minimum standards for crossing guard placement.
Current City standards for required pedestrian and traffic volumes make it easier for a location to qualify for crossing guard placement than the statewide MUTCD standards. As a result, agencies of a similar size to Thousand Oaks typically have fewer crossing guard placements.
The updated City Crossing Guard Program Standards and Policies are more accommodating than the existing policy and will remain more generous than the state MUTCD standards. They also provide a clear and objective set of standards to determine if locations are eligible for crossing guard placement.
The updated standards will apply to all crossing guard locations citywide, and includes the addition of four significant changes, as recommended by TTAC:
1) Annual decisions for approving new crossing guard locations and closure of existing locations will no longer be considered by TTAC and City Council and will Item No.10B
School Crossing Guard Standards and Policies

3 instead be reviewed by the Public Works Director or designee in strict compliance with the proposed objective standards. Decisions of the Public Works Director to deny a new crossing guard location or close an existing location are appealable to the City Council, after the Director’s annual program report is presented to TTAC. 2) The State MUTCD minimum standards should be adopted for signalized intersections since it is uncommon to have crossing guards at signalized intersections because crosswalks at signalized intersections effectively control traffic and provide appropriate gaps and timing information for pedestrians to cross. Based on the most currently available counts, adopting this element of the standards is unlikely to impact any existing signalized crossing locations that are already in place.
3) Four alternative criteria are added for consideration. These alternative criteria address unique circumstances where crossing guard locations may fail to meet one of the criterion or address locations where roadway speeds and widths are higher than typical. Only one criterion may be applied per location. The four criteria are as follows:
a) 75 Percent MUTCD Alternative: If a location, regardless of intersection type, fails to meet the City minimum standard for AM and PM pedestrian and vehicle conflict counts, the location will still be eligible for a crossing guard if all three of the remaining criteria meet the higher MUTCD minimum standards. b) Traffic Volume Alternative: If both AM and PM vehicle counts at an uncontrolled intersection exceed 1,000 vehicles but the location does not achieve the minimum pedestrian standard, the location is eligible for a crossing guard so long as each of the pedestrian counts is not less than ten.
c) Speed Limit Alternative: If the highest speed limit for an uncontrolled intersection exceeds 35 mph, the City’s minimum standard for vehicle conflicts may be lowered by ten percent.
d) Roadway Width Alternative: If the width of the longest crossing leg of an uncontrolled intersection exceeds 40 feet, the City’s minimum standard for vehicle conflicts may be lowered by ten percent.
4) Any school recommended for closure for failing to meet minimum standards shall have a one-year grace period. If a school fails to meet the minimum criteria, closures will be recommended but not implemented until the school has failed to achieve the minimum standards for a second consecutive year.
Each spring, staff will conduct an annual pedestrian and vehicle count of all existing and any proposed locations formally requested. All counts will be Item No.10B
School Crossing Guard Standards and Policies

3 conducted per MUTCD guidelines to ensure accurate pedestrian and vehicle counts representative of a typical school day.
Annually, the Public Works Director shall provide the TTAC with a comprehensive report on all crossing guard locations. The report will include a list of approved or denied requests for new locations and any location proposed for closure. A public forum for residents to provide testimony and comments on the report will be provided. This report will be presented to TTAC no later than 60 days after the Public Works Director has made their determination. After the TTAC meeting, City Council and CVUSD shall be notified of any new locations to be added or closed for the upcoming school year.
Staff recommends adoption of the resolution establishing the revised City School Crossing Guard Program Standards and Policies. The recommended changes to standards and policies do not impact existing locations this current school year.
Based on counts conducted in 2022, staff estimates that five crossing guard locations will qualify for closure for the 2023-24 school year, with additional closures possible in 2024-25. Three of these locations have been without a crossing guard during the current school year due to lack of adequate staffing to station guards at these locations. However, the exact number of locations impacted will not be known until the next annual counts are completed by April 2023. A professional engineering firm from the City’s on-call consulting list will be retained to conduct the traffic and pedestrian counts via a task order at a cost not to exceed $18,340 to ensure timeliness, accuracy of the counts, and consistency with MUTCD standards.
This action is not a project as defined under the California Environmental Quality Act because this action will not result in a direct or foreseeable indirect physical change in the environment.
COUNCIL GOAL COMPLIANCE:
Meets the following City Council goal:
C. Operate City government in a fiscally and managerially responsible and prudent manner to ensure that the City of Thousand Oaks remains one of California's most desirable places to live, work, visit, recreate, and raise a family.

CROSSING GUARD PROGRAM STANDARDS
These standards and policies and four alternative criteria shall apply to all crossing guard locations.
Review Authority:
The City Public Works Director or designee shall be the responsible party that annually reviews existing crossing guard locations, requests for crossing guard additions, and staff recommended closures to determine consistency with City standards. The following standards shall apply:
1) Requests to add crossing guard locations will be in writing, evaluated by staff for consistency with City standards, and reviewed by the Public Works Director to approve or deny based on City’s minimum standards and four alternatives.
2) Staff will report annually to the Public Works Director, all currently approved locations and will identify all locations that do not meet the City’s minimum standards and four alternatives based on pedestrian and vehicle conflict counts conducted in the current school year. The Public Works Director shall evaluate staff’s report for consistency with Crossing Guard Standards and Policies and prepare a list of approved locations for the upcoming school year. The Conejo Valley Unified School District will be provided the list as soon as practical.
3) Annually, the TTAC will receive a comprehensive report from the Public Works Director on the entire crossing guard program for the upcoming school year, including any changes such as locations approved or denied for crossing guard placement and all locations recommended for closure.
This presentation will be made within 60 days from the date of the Public Works Director’s decision.
4) Decisions by the Public Works Director to close an existing location or deny a new location may be appealed to the City Council via written appeal within 14 calendar days of the date of the TTAC meeting, along with the appeal fee as listed in the City’s user fee manual. If the City Council overturns a determination of the Public Works Director, the appeal fee will be refunded.
5) If an existing location fails to meet the City’s minimum standards including any applied alternative, closure will be deferred for one additional school year, unless it was already posted/notified and recommended for closure the prior year. Removal of crossing guards at locations that fail to meet the City’s minimum standards including any applied alternative for a second consecutive year is mandatory.

BACKGROUND:
The City’s water system serves approximately 17,000 customer accounts, and a population of over 50,000. The City receives treated water from the Calleguas Item No.10C

6 Municipal Water District and distributes to approximately 36 percent of the City.
The water system includes 16 storage reservoirs, constructed between 1961 and 2002, with a total capacity of over 35 million gallons. Thirteen of the reservoirs are above-ground steel reservoirs, and three are partially buried concrete reservoirs.
Meadows Reservoir (Meadows) is one of the City’s three partially buried concrete reservoirs. It was built in 1972 and has a capacity to hold 4.5 million gallons of water. The reservoir is located at 1683 Shadow Oaks Place (Attachment #1) and has a history of performing well during routine inspections.
On November 15, 2021, staff discovered leakage from Meadows that led to a preliminary site investigation by City staff and an on-call engineering consultant, HDR, Inc. (HDR). After the reservoir was fully drained, fresh cracks were observed in the concrete floor, on the base of one column, and in the main girder supporting the concrete roof. On December 9, 2021, HDR was directed to conduct a structural analysis of the reservoir and deploy elevation monitoring points to detect any structural movement. Based on the review of structural analysis, the original design plans, and the structural damages observed in the reservoir, HDR recommended removing a portion of the roof before conducting any further physical investigation inside the reservoir.
On February 8, 2022, City Council determined that the condition of the reservoir required emergency repair due to the need to restore reservoir service in advance of the wildfire season. Pursuant to Thousand Oaks Municipal Code Section 3-
10.308, City Council directed staff to proceed with procuring a contract with Spiess Construction Company, Inc. in the amount of $400,000, plus a contingency of $100,000, to remove a portion of the reservoir’s roof to fully assess Meadow’s structural integrity and determine the available repair options. Spiess was selected because of their experience with constructing and repairing buried concrete reservoirs. The contract was approved on a time and material basis.
On April 26, 2022, City Council approved Change Order No. 1 to Contract No. 12990-2022 with Spiess on a time and material basis, in the amount of $1,700,000, plus an additional contingency of $200,000. Approval of Change Order No. 1 resulted in a new total not-to-exceed amount of $2,100,000, and a total approved project contingency of $300,000 to perform the repairs needed to return the reservoir to service. The scope of the repairs included construction of a grade beam to stabilize the subgrade, construction of a bearing wall below overstressed portions of the girder, leak repairs and lining of the reservoir floor, testing for leakage, and reinstallation of the roof panels.
Change Order Nos. 2 and 3 in the total amount of $300,000, equal to contract’s contingency amount, were executed by the City Manager in December 2022 and January 2023 to cover the cost for additional work including installation of two new Item No.10C

Item No.10C
TO:City Council
FROM:Community Funding Review Committee
DATE:February 14, 2023
SUBJECT: FY 2022-23 Community Environmental Enhancement Grant Recommendations
RECOMMENDATION:
1. Approve FY 2022-23 Community Environmental Enhancement Grants totaling $45,000.
2. Authorize the City Manager or designee to execute Community Environmental Enhancement Grant agreements with grantees.
3. Authorize expenditure in the amount of $45,000 from A/C #632-8420-682-5920 (NC0104, Community Enhancement Fund/Grants) for Community Environmental Enhancement Grants.
4. Find that this action is not a project as defined under the California Environmental Quality Act.
FINANCIAL IMPACT:
No Additional Funding Requested. Minimal administrative staff costs associated with executing contracts and compliance monitoring are included in the Adopted FY 2022-23 General Fund Budget. The $45,000 for Grants funding is included in the Adopted FY 2022-23 Solid Waste Fund.
BACKGROUND:
The Community Environmental Enhancement Grant (CEEG) provides financial support for community beautification and environmental projects. During the City’s FY 2022-23 budget process, City Council renewed its support to the program by appropriating $45,000 of Solid Waste Funds to be used for CEEG. The CEEG provides grantees a maximum grant award of $4,500 and a minimum grant award of $2,000.
Item No.11A
FY 2022-23 CEEG Recommendations
February 14, 2023
5 1
2 Since 1998, the City has funded projects such as tree planting, litter collection, recycling projects, composting, waste reduction program, water/energy conservation, food diversion (composting, donation, or recovery), and public outreach and education.
CEEG grant applications for FY 2022-23 were accepted from November 14, 2022, through December 15, 2022. Public outreach for the grant program took place in November and December and included news postings on the City’s website, social media channels, the November and December issues of the CityScene newsletter, as well as the Sustainability Blog. The Acorn published an article about the grant opportunity on November 25, 2022. A Community Grant Program workshop was held on September 8, 2022, which was recorded and made available for viewing on the City’s website. In addition, emails were sent to previous environmental enhancement grant recipients and a press release was sent to local media outlets.
Complete program information can be found on the dedicated City Manager’s Office Grant Opportunities webpage (www.toaks.org/grants) on the City’s website.
A history of the CEEG awards for the past five years is attached for City Council reference (Attachment #1).
DISCUSSION/ANALYSIS:
There were 14 CEEG applications received this year. Staff conducted an initial review to confirm the applications met the minimum qualifications. Two applications were rejected for non-compliance with program requirements. The 12 CEEG applications that met minimum qualifications requested a total grant amount of $47,500.
The Community Funding Review Committee (CFRC) members separately reviewed each application and scored them based on several grant-specific criteria, including the organization’s mission and background, program goals and objectives, and benefit to City residents.
On January 18, 2023, the CFRC met to discuss the collated scores of the applications. The CFRC unanimously recommended funding in the amount of $45,000 to 11 programs (Attachment #2).
Allocation Scoring Method
In May 2019, the CFRC approved an allocation method based on collated points scored on the application as shown in Table 1.
Item No.11A
FY 2022-23 CEEG Recommendations
February 14, 2023
5 1
2 Collating the nine committee members’ scorecards and using the original allocation method revealed that 11 applicants were eligible for full funding and one applicant for 75 percent funding, for a total of $47,000. With a budget of $45,000, the CFRC recommends awarding full grant funding to the top applicants until available funds are exhausted, resulting in 10 applicants receiving full funding, one applicant receiving partial funding, and the lowest-scoring applicant unfunded.
The CFRC unanimously recommends awarding grants in the amount of $45,000 to 11 programs (Attachment #2).
