4 and City Council through the complexities of transitioning the local election process to districts.
DISCUSSION/ANALYSIS:
Pursuant to state law, City retirees who are members of the California Public Employees Retirement System (CalPERS) are precluded from returning to work for a covered agency, except in limited circumstances. Government Code 7522.56(c) provides that a retired annuitant may return to part-time employment, if the retired person has skills needed to perform work, of limited duration. The employment is limited to a maximum of 960 hours per fiscal year [Gov. Code 7522.56(d)].
Paragraph (e) of section 7522.56 also prevents a retiree from returning to employment within 180 days of retirement unless the City certifies the nature of the employment and that the appointment is necessary to fill a critically needed position before the 180 days has passed and the governing body approves the appointment in a public meeting.
The City Manager has determined the need to consult with Ms. Rodriguez in responding to the California Voting Rights allegations as necessary before the 180 days elapse. The City proposes to appoint Ms. Rodriguez as a retired annuitant to an hourly position not to exceed 960 hours per fiscal year. The appointment will be for a limited duration and shall cease no later than the adoption by City Council of a final action implementing a transition to district elections. The hourly rate will be within the range authorized by CalPERS regulations.
The City Attorney reviewed the Ethics Code of Title 1, Chapter 10 of the Thousand Oaks Municipal Code and the Administrative Ethics Policy and determined that the proposed appointment is not prohibited by applicable ethics rules.
