• Initiate Municipal Code Amendment to establish a Senior Mobile Home Park Overlay Zone and regulations
• Find that this action is not a project as defined by the California Environmental Quality Act Thousand Oaks
3 Recommendation
Option 1:
• Adopt Urgency Ordinance creating a Senior Mobile Home Park Overlay Zone and regulations on the five historically senior mobile home parks at Vallecito, Ventu Estates, Ventu Park Villa, Ranch, and Thunderbird Oaks
• Initiate MCA to establish a Senior Mobile Home Park Overlay Zone and regulations • Find that these actions are exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3 Section 15061(b)(3)
City of
Thousand
Recommendation (cont.)
Option 3:
• Receive report and provide direction to staff if appropriate • Find that this action is not a project as defined by the California Environmental Quality Act Thousand Oaks
5 Background
• Mobile homes and manufactured homes are the largest sources of unsubsidized housing that has traditionally been more affordable than market-rate homes • Residents of mobile home parks are uniquely vulnerable to the hardship of displacement
• The City has a Rent Stabilization Ordinance that imposes rent control on all mobile home parks in the City
• The City currently has 8 mobile home parks within its jurisdiction • Five senior mobile home parks and 3 all age mobile home parks (1 is vacant) • The State of California has jurisdiction over mobile home parks that significantly limits decision-making authority of the City
City of
Thousand
Background (cont.)
• Senior population is increasing in the City
• Senior headed households cover about 31% of City households • Seniors represented approximately 19% of the City's population in 2015- 2019, an increase of approximately 4% from 2010
• Land Use Element Goal LU-3, Action 3.3 calls tor promoting diversity of housing types tor Thousand Oaks Residents through all stages of lite and promote development of housing types that support opportunities to age in place • Housing Element Goal HE-3, maintain and improve the existing housing stock of the City by reducing housing deterioration through Mobile Home Rehabilitation • Housing Element identifies concern that the elderly, particularly those with disabilities, may face increased difficulty in finding housing accommodations City of

8 Background (cont.)
• Residents of Ranch Mobile Home Park advised the City that the Park owner intends to start leasing spaces to all-age/families
• The park owner has filed a Notice of Intention with HCD to no longer restrict residents to persons over 55 years old
• City's Rent Stabilization Ordinance (RSO) is not affected • Existing residents cannot be evicted based on potential conversion to an all-age / family park • New residents, regardless of conversion/age, will be protected under the RSO Residents object to allowing non-seniors lease spaces in the Park • Requested the City to consider adopting a Senior Mobile Home Park Overlay Zone • Other jurisdictions (Ventura County, City of Huntington Beach, and City of Yucaipa) have adopted a Senior Mobile Home Park Overlay Zone
City Council asked City staff to provide information on mobile home parks and residents' concerns, *including overlay zoning
Thousand ones City of
9 Non-Profit Cooperatives / Subdivision
• Staff conducted preliminary research on residents forming cooperatives or creating subdivisions
• Factors that would impact the possibility of such development Willing seller of both underlying land and improvements • Financing needed
Willingness/ability of residents to purchase
• Possible relocation for uninterested/unable residents • Qualifying for State funding programs, such as the Manufactured Housing Opportunity and Revitalization Program ("MORE")
• Purchasing opportunity laws - First Right
• Long term consideration - not part of options provided tonight • Staff could continue to evaluate such concepts, if directed City of
Thousand
10 Outreach with Stakeholders
• City Staff contacted owners or their representatives of the senior MHPs to inform them of residents' concerns about conversion, and potential City Council action on establishing a Senior MHP Overlay Zone • Four of the five owners/representatives of historically senior MHPs advised they have no plans to change the parks' senior-only status • Western Manufactured Housing Communities Association (representing Ranch MHP owner) stated there were benefits to having units available to all-age/families, not just seniors, but would convey the City's information to the Ranch owner as well as the owners of other historically senior MHPs within the City
Thousand Yoaks
11 Urgency Ordinance
• Establish Senior Mobile Home Park Overlay Zone and Regulations • Authorized pursuant to Government Code section 36937
• Would only apply to the five mobile home parks historically rented to seniors (Vallecito MH Estates, Ventu Estates MHP, Ventu Park Villa MHP Ranch MHP, and Thunderbird Oaks MH Club)
• Elms Plaza MHP, 53 Conejo Living, and Twin Palms MHP Trailer Park will remain "all-age/famid" mobile home parks
• Requires four-fifths vote by City Council
• Must be based on preservation of public peace, health or safety › Effective immediately
City of
Thousand
12 Urgency Ordinance Findings
• Must be based on the Preservation of Public Peace, Health or Safety • City's General Plan/Housing Element Goal to protect mobile home parks as a source of unsubsidized senior housing and increasing senior population • Recent action of intent to convert a MHP from senior to family will result in loss of existing unsubsidized senior housing in the City
• Ordinance will mitigate the unregulated effects of conversion of senior housing and provide protections for senior housing within the City • Purpose is to prevent the immediate and unregulated conversion of senior mobile home parks to all-ages/family mobile home parks and is necessary to protect the supply of unsubsidized housing for seniors within the City limits Thousand Yoaks
13 City Council Authority
• State and City share jurisdiction over mobile home parks • City has land use authority under State Planning and Zoning Law • State of California has authority to regulate/enforce statewide standards under Mobile Home Park Residency Law
• Senior Overlay Zones are permitted under:
• Federal Fair Housing Act
/ California Fair Employment and Housing Act
/ California Mobile Home Park Residency Law
• California Unruh Civil Rights Act
• Housing for Older Persons Act Amendments to the Federal Fair Housing Act City of
Thousand
14 Urgency Ordinance Regulations
• Would establish a Senior Mobile Home Park Overlay Zone (SMHP) • "Senior Mobile Home Park" would mean any mobile home park where at least 80% of the spaces are rented to one resident who is aged 55 years or older
• Requires:
• Occupancy verification and documentation that is available for City staff to inspect
• Once every two years the owners/operators of SMHP must submit documentation
• Reliable information/documentation that at least one person 55 years of age or older occupies the unit
City of
Thousand Oaks
15 Initiate MCA for Senior Overlay Zone
• Standard process to amend zoning code to add Senior Mobile Home Park Overlay Zone and regulations
• Proposed Municipal Code Amendment reviewed by Planning Commission • Planning Commission recommendation presented to the City Council for consideration Thousand Oaks
16 Recommendation
Option 1:
• Adopt Urgency Ordinance by at least a four-fifths affirmative vote to create a Senior Mobile Home Park Overlay Zone and regulations on the five historically senior mobile home parks at Vallecito, Ventu Estates, Ventu Park Villa, Ranch, and Thunderbirds Oaks, and amending the Thousand Oaks Municipal Code (MCA-2023-70011)

Reply-To: Don Weese <[email protected]>
My Name is Don Weese I am a Real Estate Broker Cal. Lic 00581577 818-312 7770 Nick i was on hold for 20 min. trying to talk to you. I have 2 homes in your park that I have listed.
I have no problem with your requiring the homes to be inspected and having all safety requirements met.
This is a senior park and most of your tenants are low income. In the past the buyer would have a home inspection and repairs to met safety standards would be paid from the sellers proceeds out of escrow. I can use an inspector who meet the standard that you require. For the sellers to pay for the inspection and repairs prior to the buyer obtaining park approval and telling the buyers agent that the rent would be computed after the unit was approved for sale seems like you are trying to stop the sale. We all know this park is under rent control and you are limited to a 10% increase on sale. I do not believe this fair to the seniors that reside in your park. The city has set up this park as a low income park.
I would like to work this out with you, but if necessary i will go to the city council speaker:

This guy is a real piece of work. It sounds like he is attempting a really weak form of blackmail. In the process he is asking you to violate state law and title 25 and putting you at risk. I'm also stunned that he so openly admitted to violating state law so blatantly in the past. The threats he is making are also a likely violation of DRE guidelines and state licensing laws. I would recommend having no further contact with this person and only deal directly with the tenant. Follow the protocols as laid out in cc798. Further you should consider filing a formal complaint through the below link. I've forwarded this email to our counsel and they are on standby. I am happy to reach out Councilmember Engler should you hear anything from the city.
I doubt it's of any consequence to address a false narrative but it's an option.
