In regard to ADU codes and SB-9 Lot Splitting codes:
I want to buy a house in TO and tear it down and then split the lot...and build a Duplex on one lot and a house and an ADU on the other lot.
I did a title search at the Recorder's Office and found CCRs and HOA rules that I can't violate, even if you tell me the new code supersedes the CCRs.
It's misleading to your constituents when you tell them the ADU code supersedes the CCRs and HOA rules.
I would think you would want to clarify to your constituents that these changes to the codes are not meant to exempt them from existing agreements...like CCRs and HOA rules...so that your constituents can be fully informed prior to spending a lot of time and money trying to build or modify their property.
Your constituents could inadvertently violate their existing agreements, exposing them to a great liability risk... because their neighbors could easily sue them for violating CCRs and other existing contracts that run with the land.
The courts have held that the US Constitution prohibits governments from violating your right to contract.
(unless they are discriminatory against personal attributes, but those ones are void and unenforceable because of the Civil Rights Act, so let's not waste time and money on those.
US Constitution
Article 1, Legislative Branch,
Section 10 says:
"No State shall...pass any...Law impairing the Obligation of Contracts,..." Solution:
Put a notification at the top of the applicable Municipal Codes, the Applications and checklists, stating the following:
"This does not exempt you from other existing Deeds, CCRs, HOA rules or other agreements or contracts."
Can you show where it says in our city code that the ADU code or Lot Split code supersedes CCRs? Sort of..
