TO:Andrew P. Powers, City Manager
FROM:Clifford G. Finley, Public Works Director
DATE:February 27, 2024
SUBJECT: Out of Agency Water and Wastewater Service Agreement - 371 Acacia Road APN 673-0-190-140 (Bonnet/Brinkworth)
RECOMMENDATION:

1. Approve an Out of Agency Service Agreement (OASA) between Leticia Bonnet/Dorothy Brinkworth and the City to provide water and wastewater service for a new single-family residence at 371 Acacia Road (APN 673-0-190-140) in the unincorporated Ventu Park area of Thousand Oaks.

2. Authorize the City Engineer to apply for an OASA with the Ventura Local Agency Formation Commission (LAFCo) and execute all required documents.

3. Authorize the City Manager to execute an Indemnity Agreement with the Ventura LAFCo.

4. Find that this action is not a project as defined under the California Environmental Quality Act.

FINANCIAL IMPACT:

No Additional Funding Requested. Staff time and costs required to process the agreement are included in the Adopted FY 2023-24 Water and Wastewater Fund Budgets. The applicant will pay all Ventura LAFCo application fees and City utility connection fees in accordance with current City user fees and municipal code.

BACKGROUND:

The City provides service to 17,000 water customers and 38,000 wastewater customers. In some instances, the City’s service area boundaries extend beyond City limits into County unincorporated areas. The Ventu Park area is one such location where this situation exists (Attachment #1).

0 The owner of the property at 371 Acacia Road (APN 673-0-190-140) is pursuing approval from the County of Ventura to build a single-family residence in the unincorporated Ventu Park area. The owner wishes to connect to the City water service and to connect a sewer lateral to the City wastewater main. The property lies outside the City’s existing boundary but is within the City’s water and wastewater service area.

LAFCo does not recognize the City’s entire wastewater service area facilities and boundary from June 18, 1987 (Contract No. 87-30); therefore, a property located in the County unincorporated area must go through the LAFCo process. The City owns and maintains water and wastewater mainlines currently serving the surrounding area near the subject property and is currently able to serve the proposed single-family residence.

LAFCo oversees OASAs between public agencies and private parties and requires the City to obtain LAFCo approval prior to providing water and/or wastewater services outside the LAFCo-recognized City service area boundaries including the addition of new connections. A utility service agreement between the City and the property owner is required for LAFCo to consider approval (Attachment #2). The owner of the property also agrees not to protest future annexation proceedings if initiated by the City.

DISCUSSION/ANALYSIS:

The owner of the property at 371 Acacia Road (APN 673-0-190-140) has requested water and wastewater service from the City. Staff prepared the attached OASA in conformance with LAFCo requirements.

LAFCo requires, prior to providing services to a customer outside of its boundary, that the City must enter into an agreement with the customer and file an application with LAFCo (Attachment #3). The OASA stipulates that:
•The proposed residential project shall be served by a four-inch wastewater lateral, to be connected by the applicant to the City’s existing wastewater main;
•The water service line for the proposed single-family residence shall be one- inch in diameter;
•The size of the water meter shall be determined by the water demand of the plumbing fixtures and the fire flow demand of the fire sprinkler systems, whichever is greater, but not less than three-quarters of an inch; •Installation of the water service line, meter, wastewater lateral, and all connections to the main utility lines will be the responsibility of the property owner at their cost; and
•The owner of the property also agrees not to protest future annexation OASA Water and Wastewater Service 371 Acacia Road
