SUBJECT: Out of Agency Water and Wastewater Service Agreement - 1983 Rudolph Drive APN 673-0-160-210 (Vizcaino)
RECOMMENDATION:
1. Approve an Out of Agency Service Agreement (OASA) between Diana Vizcaino and the City to provide water and wastewater services for a new single-family residence at 1983 Rudolph Drive, APN 673-0-160-210, in the unincorporated Ventu Park area of Thousand Oaks.
2. Authorize the City Engineer to apply for an OASA with the Ventura Local Agency Formation Commission (LAFCo) and execute all required documents.
3. Authorize the City Manager to execute an Indemnity Agreement with the Ventura LAFCo.
4. Find that this action is not a project as defined under the California Environmental Quality Act.
FINANCIAL IMPACT:
No Additional Funding Requested. Staff time and costs required to process the agreements at the time of application are included in the Adopted FY 2023-24 Water and Wastewater Fund Budgets. The applicant will pay all Ventura LAFCo application fees and City utility connection fees, in accordance with current City user fees and municipal code.
BACKGROUND:
The City provides water service to over 17,000 customers and wastewater service to 38,000 customers. In some instances, the City’s service area boundaries extend beyond City limits into County unincorporated areas. The Ventu Park area is a location where this situation exists (Attachment #1).

4 The owner of the property at 1983 Rudolph Drive, (APN 673-0-160-210), is pursuing approval from the County of Ventura to build a single-family residence in the unincorporated Ventu Park area (Attachment #1). The property lies outside the City boundary but within the City’s service areas for water and wastewater. The City presently owns and maintains water and wastewater mainlines in the vicinity of the parcel and can serve the proposed single-family residence.
LAFCo oversees OASAs between public agencies and private parties and requires the City to obtain LAFCo approval prior to providing water and/or wastewater services outside the LAFCo-recognized City service area boundaries including the addition of new connections. A utility service agreement between the City and the property owner is required for LAFCo to consider approval (Attachment #2). The owner of the property also agrees not to protest future annexation proceedings if initiated by the City.
The LAFCo process was completed by the previous owner of the property, Mr. R.
Lee, and all necessary documents were submitted to the City for approval in 2020.
This included the OASA, which was recorded on September 9, 2020. LAFCo was not presented with documents approved by the City to be reviewed and recorded.
LAFCo confirmed they do not have any records of receiving the documents.
LAFCo is therefore requiring the submission of new documents under the name of the new owner as a result of the change in ownership from Mr. R. Lee to Diana Vizcaino. The previous owner paid the water and wastewater connection fees under permit #13149 on August 26, 2020. The water and wastewater will-serve letters were subsequently issued to the applicant after payment of the permit fees.
DISCUSSION/ANALYSIS:
The owner of the property at 1983 Rudolph Drive (APN 673-0-160-210) has requested water and wastewater service from the City. Staff prepared the attached OASA in conformance with LAFCo requirements.
LAFCo requires, prior to providing services to a customer outside of its boundary, that the City enter into an agreement with the customer and file an application with LAFCo (Attachment #3). The OASA stipulates that:
•The proposed improvement shall be served by a four-inch wastewater lateral, to be connected by the applicant to the City’s existing wastewater main;
•The water service line for the proposed single-family residence shall be one inch in diameter;
•The size of the water meter shall be determined by the water demand of the plumbing fixtures and the fire flow demand of the fire sprinkler systems, whichever is greater, but not less than ¾-inch;

4 •Installation of the water service line, meter, wastewater lateral, and all connections to the main utility lines will be the responsibility of the property owner at their cost; and
•The owner of the property also agrees not to protest future annexation proceedings if initiated by the City.
The attached documents fulfill LAFCo’s request and include applications for water and wastewater services. Staff recommends approval by City Council.
COUNCIL GOAL COMPLIANCE:
Meets the following City Council goals:
C. Operate City government in a fiscally and managerially responsible and prudent manner to ensure that the City of Thousand Oaks remains one of California's most desirable places to live, work, visit, recreate, and raise a family.
F. Provide and enhance essential infrastructure to ensure that the goals and policies of the Thousand Oaks General Plan are carried out and the City retains its role and reputation as a leader in protecting the environment and preserving limited natural resources.
