AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF THOUSAND OAKS AMENDING THE
THOUSAND OAKS MUNICI PAL CODE, TITLE 9,
CHAPTER 4, ARTICLE 2, TO REDEFINE THE TERM
SMALL AND LARGE FAMILY DAY CARE HOMES
(MCA-2023-70007)
The City Council of the City of Thousand Oaks does hereby ordain as follows:
Part 1
The following definitions in Section 9-4.202 (Definitions) of Article 2 of the Thousand Oaks Municipal Code are being amended:
“Family day care home” shall mean a faci lity that regularly provides care, protection, and supervision for 14 or fewer children, in the provider’s own home, for periods of less than 24 hours per day, while the parents or guardians are away, and is either a large family day care hom e or a small family day care home, as defined in Health and Safety Code Section 1596.78 (a).
“Large family day care home” shall mean a facility that provides care, protection, and supervision of 7 to 14 children, inclusive, including children under 10 years of age who reside at the home, as set forth in Section 1596.78 (b) of the Health and Safety Code.
“Small family day care home” shall mean a facility that provides care, protection, and supervision for eight or fewer children including children under 10 years of age who reside at the home, as set forth in Section 1596.78 (c) of the California Health and Safety Code.
“Small family day care home or large family day care home” shall mean a detached single-family dwelling, a townhouse, a dwelling unit within a dwelling, or a dwelling unit within a covered multifamily dwelling in which the underlying zoning allows for residential uses. A small fam ily day care home or large family day care home is where the day care provider resides and includes a dwelling or a dwelling unit that is rented, leased, or owned as set forth in Section 1596.78 (d) of the Health and Safety Code.

Severability
If any section, subsection, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this title; it being hereby expressly declared that th is title, and each section, subsection, sentence, clause and phrase hereof, would have been prepared, proposed, adopted, approved and ratified irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional.
