WHEREAS, on April 7, 2022, and April 3, 2023, HCD submitted comment letters to the City of Thousand Oaks indicating that the adopted Housing Element met most statutory requirements; however, additional revisions were necessary to comply with State Housing Element Law; and
WHEREAS, on July 12, 2023, the revised 2021-2029 Housing Element was submitted to the HCD for a mandatory 60-day review; and WHEREAS, on September 8, 2023, HCD submitted a comment letter stating that the revised draft Housing Element met most of the statutory requirements of State Housing Element Law (Gov. Code Section 65580 et seq) for local adoption and would be found in full compliance when the City has completed necessary rezones to address the shortfall of sites to accommodate RHNA; and WHEREAS, on December 5, 2023, City Council approved Resolution No. 2023-065, which certifies the Final Program EIR (SCH #2022060087) including a Mitigation Monitoring and Reporting Program, California Environmental Quality Act (CEQA) Findings of Fact, Statement of Overriding Considerations for the adoption of the General Plan 2045 and approved Resolution No. 2023-066 adopting the 2021-2029 Housing Element.

SECTION 2
WHEREAS, the findings of City Council for approval of said Housing Element Update HSG 2018-70723 are as follows:

1. The Housing Element update is consistent with the goals and policies of the Thousand Oaks General Plan 2045, including the General Plan Land Use Goals and Policies:

Goal LU-1: Create a land use pattern of development that preserves existing neighborhoods while providing opportunities for targeted infill projects in strategic locations to enhance the quality of life, preserve the natural environment, and ensure the long-term fiscal viability of Thousand Oaks.
Policy 1.1 Overall City Structure.
oIncentivizing and streamlining infill multi-family development. oIncentivizing and streamlining infill residential at mixed-use designations, including adding residential development on existing parking lots and underutilized portions of the site.

Policy 1.2 Complete Community.

Strive to maintain a diverse and balanced mix of uses in the City, so that Thousand Oaks is a “complete community” with a diversity of housing for all stages of life and income levels; improved alignment of educational attainment opportunities with high-paying employment opportunities, open space, public facilities that meet residents’ needs, and retail and services to support daily life.

Goal LU-3: Promote a diversity of housing types for Thousand Oaks residents through all stages of life.
Policy 3.1 Diversity of Housing.

Promote a diversity of housing in locations throughout the City, specifically in neighborhood areas that contain goods and services, parks and open space, and public schools in a walkable setting. Policy 3.2 Housing for different life stages and incomes.

Encourage new housing types for all residents including young professionals, older adults, as well as middle- and low-income families.

Goal LU-5: Enhance the quality of life, enable active modes of transportation, and provide housing opportunities with vibrant mixed-use areas.
Policy 5.1 Mixed-use development.

Actively encourage vertical or horizontal mixed-use development projects, especially in areas with underperforming retail and service uses, including adding multifamily residential uses to
underperforming buildings or surface parking lots.

2. The Housing Element update as adopted by this resolution is consistent with applicable State Housing Element law (§§65580-65589.11 of the California Government Code).

3. The 2021-2029 Housing Element concludes that based on substantial evidence the nonvacant sites identified in the RHNA sites inventory are suitable for residential development, and that the existing uses on the nonvacant sites do not constitute an impediment to additional residential development and are likely to be discontinued during the planning period, based on factors including continued decline of commercial uses, age and condition of existing buildings, COVID-impacted uses, and general development trends of commercial uses on nonvacant sites converting to new mixed-use and residential uses in the Mixed-Use designated areas.

Per the evidence in the Housing Element, most of the City’s projects include infill development and redevelopment of sites with existing land uses, either because the life cycle of the building has ended, existing uses on the non- vacant sites cease operation, or because of market conditions. Additionally, per implementation of Housing Element Program 5, policy measures were adopted to promote the development of housing in the mixed-use areas, including infill housing on non-vacant sites. Proposed additional incentives in the Housing Element and in the Land Use Chapter of the Thousand Oaks General Plan 2045 will ensure that the City develop standards that promote housing within the non-vacant infill mixed-use and residential areas to further ensure that existing uses do not impede development of housing within the City.

4. Find that this revised language in this resolution approving the 2021-2029 Housing Element Resolution is consistent with Resolution No. 2023-065, which certifies the Final Program EIR (SCH #2022060087) including a Mitigation Monitoring and Reporting Program, California Environmental Quality Act (CEQA) Findings of Fact, Statement of Overriding Considerations for the adoption of the General Plan 2045 and 2021-2029 Housing Element.

A Final Program Environmental Impact Report (2022-70558-EIR) and associated Mitigation Monitoring and Reporting Program, the CEQA Findings of Fact, and Statement of Overriding Considerations were prepared for the General Plan 2045 and 2021-2029 Housing Element Update in accordance with the requirements of CEQA. Based on all written and oral evidence and testimony in the record received on the EIR and the City’s response thereto, the EIR reflects the independent judgement of the City of Thousand Oaks. City Council adopted and made the CEQA Findings and certified the Final EIR as legally adequate under CEQA as the project and further adopted the MMRP and incorporated its provisions as conditions of approval for future development applications to the extent appropriate and was adopted by City Council as part of the General Plan 2045 (2019- 70760-GPA).

SECTION 3
WHEREAS, Resolution No. 2023-066 is hereby rescinded and superseded by this Resolution.

SECTION 4
NOW, THEREFORE, BE IT RESOLVED that based on substantial evidence contained within the record, the analysis in the staff report, and the findings of fact as set forth above, and, having considered the Final Program Environmental Impact Report 2022-70558-EIR and associated Mitigation Monitoring and CDD:440-20\ih\H:COMMON\City Council\CC Agenda Items\2024\05072024\Housing Element\Hsg Element Update 2018- 70723 Attach 1 RESO Housing Element.docx\pz (FILE ID: 2018-70723-HSG)
