FINANCIAL IMPACT:
$326,482 Increase to Adopted FY 2024-25 Solid Waste Fund Budget, Fully Offset by Grant Revenue. $326,482 increase to the Adopted FY 2024-25 Solid Waste Fund Budget will be fully offset by the $326,482 in grant revenue received.
BACKGROUND:
In September 2016, California SB 1383 was signed into law, requiring a 50 percent reduction in organic waste disposal by 2020 and 75 percent by 2025. Final rulemaking was completed in November 2020 with regulations going into effect January 1, 2022. Under the new law, jurisdictions are required to provide organics collection services to all residents and businesses, establish an edible food recovery program, procure recyclable and recovered organic products, monitor compliance, and conduct enforcement.
In January 2022, CalRecycle announced the availability of a Local Assistance Grant Program to assist jurisdictions with implementation of SB 1383 organic waste regulations with applications due February 1, 2022. On January 28, 2022, a

grant application for the SB 1383 Local Assistance Grant Program (FY 2021-2022) was submitted by the City to CalRecycle. On April 27, 2022, CalRecycle notified the City of an award of $177,791. In June 2022, the City received these funds.
In September 2023, CalRecycle opened applications for a second grant cycle for the SB 1383 Local Assistance Grant Program. Grant applications were due by November 15, 2023. The City applied for funding to be used to support edible food recovery in the City.
DISCUSSION/ANALYSIS:
SB 1383 requires jurisdictions to develop an edible food recovery program. As a result, City staff has coordinated with a local network of community-based, non- profit organizations that operate food recovery and distribution services to those in need (food recovery organizations). City staff has held regular meetings with these food recovery organizations to strategize how to support each other and expand services. Over the past two years, these organizations helped City staff understand the capacity and needs of our food pantries and the needs of those facing food insecurity locally.
On February 26, 2024, CalRecycle notified the City of an award of $326,482 from its application to the second grant cycle for the SB 1383 Local Assistance Grant Program. On May 29, 2024, the City received these funds. City Council needs to accept the grant funds before the City can expend them. This funding, which must be used by April 1, 2026, is slated for the food recovery program and the purchase of three mobile refrigerated trailers.
The recommended actions meet City Council’s Top Ten Priority #6, “Environmental Sustainability – Implement the Climate and Environmental Action Plan.”
ENVIRONMENTAL REVIEW:
Acceptance of grant funding has been reviewed in conformance with the provisions of the CEQA and is not considered a project.
COUNCIL GOAL COMPLIANCE:
Meets the following City Council goals:
